The failure to obtain such other approval when required shall subject this permit to immediate revocation by the. Box 728 Southold, New York 11971 January 30, 1987 Mrs. Louise Tashjian 401 Littleworth Lane Sea Cliff, New York 11579 Dear Mrs. Tashjian: The following action was taken by the Board of Trustees at their regular meeting held on January 29, 1987 regarding your wetland application. 1 WHEREAS, Louise Tashjian applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the town of _ Southold, application dated September 17, 1986 and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on January 29, 1987 at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as ,proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE, BE IT RESOLVED that Louise Tashjian BE AND HEREBY IS GRANTED PERMISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: Construct a dock consisting of:a 60' x 4' walkway, a 12' x 4' ramp and a 2' x ' float. Smith, President Board of Town Trustees Town of Southold Town Hall , 53095 Main Road Southold, New York 11971 Re: Wetland Application No . 449 Dear Mr. Smith, This is in response to your letter dated November 3 , 1986 (received Nov. 10, 1986) advising that the Town Trustees rescinded the Lead Agency Declaration on Wetland Application No . 449 by reason of violation of permit No. 290 for deck construction. By voiding application 449 , it appears that the Board has acted prematurely by citing a violation on permit 290 . The Board is reminded that this permit has an expiration date of May 29, 1987. I presume that the applicant has until that date to comply with the provisions thereon. Furthermore, no formal notification or pretense of completion of these provisions, has ever been made to the Board by the applicant. It is therefore incomprehensible that the Board can arbitrarily declare a violation when the project is clearly in progress and well within the time. l.imi.ts_ set. by the permit. The Board is further reminded that the deck construction also falls within the jurisdiction of the New York State Dept. of Environmental Conservation. This authority has asked that no modifications be made in the deck area until the outcome of a compliance hearing tentatively scheduled for Dec. 2 or 3 , 1986 . Since there are two "Masters" to satisfy, it would . seem appropriate to wait until that time to make sure the State and Town provisions are in accord before provisional work is begun. Neither project impacts on the other. Reason dictates that each application should stand on its own merits . Under the circumstances Mr. Smith, I believe the Board is obligated to do nothing less than to lift its 10 day period of compliance and to reinstate its Lead Agency Declaration on the dock application. Ultimately, of course, the issuance of a dock permit should be contingent on the deck matter. I trust the Board of Trustees will be as assiduous in reviewing this matter as they were in rescinding its Declaration. .
