ZBA and Miller Article 78 (#2) Dear Mr. Miller: Enclosed herewith please find Justice Berler's decision dated August 2, 2004 regarding Petitioners' most recent Article 78 Application. Please be advised that I have been working on this matter with Mr. Arnoff and have discussed the enclosed decision with him. Mr. Arnoff is out of the office through August 13, 2004 so accordingly, I am forwarding this decision to you. As you can see from the enclosed decision, Justice Berler has annulled the Findings, Deliberations and Determination of the ZBA dated November 13, 2003. According to Justice Berler , Respondent ZBA issued a new determination without you having made a new application at the administrative enforcement level (the Building Department) and therefore, the decision must be annulled. Additionally, Justice Berler indicates that the ZBA's methodology of a "sliding scale" in determining that the Heron is a customary use and exempt from the height requirements as a monument is not a proper basis for establishing a customary use so as to be an accessory use. On the other hand, Justice Berler recognized that the case law to which we cited supported that the ZBA could consider factors related to the monument, the property and the particular area as providing a basis to determine whether the monument is a customary' use. However, Justice Berler ruled that the Court will defer to the ZBA for a f proper methodology if it has a rational basis. i Mr. James Miller Page Two August 5, 2004 As a result, Justice Berler annulled the ZBA'S decision and sent the matter back to the ZBA to allow you to submit a new application to the Building Department. Arnoff (Millers) 206 Roanoke Ave . , Box 329 Riverhead, N.Y. 11901 In this proceeding pursuant to article 78 of the CPLR, the petitioners seek to annul the "Findings, Deliberations, and Determination" of respondent, Zoning Board of Appeals of the Town of Southold[Board herein] , dated November 13, 2003 . The facts that established the premise for that determination are articulated in the decision of this Court dated May 9, 2003 _ Based upon this decision a judgment was entered, dated Julv 10, 2003, annulling the respondent' s prior determination and declaring. the Building Permit and Certificate of Occupancy issued for the Miller' s Heron Structure was invalid. Although the respondent' s respectfully disagreed with this decision and appealed`, they also issued new "Findings, Deliberations and Determination" on November 13, 2003 . The respondent, Both parties appealed and the Appellate Division, Second Department, by decision and order dated March. 24, 2004, dismissed the appeals on the ground that the judgment entered July 16, 2003 is, in effect, a non-final order, which is not appealable as of right and leave to appeal was denied. The decision will use the label judgment, however, for claritq purposes . Board, found that the height of the Heron'- b_1onument has not trans forted it into a separate and distinct principal use . Moreover, in considering the size of the monument in relation to the size of the property and residence, the "Heron Monument is relatively small in comparison to the overall property and improvements and is subordinate to the principal use . . . This monument with a height of 40 feet situated on a 3 .25 acres parcel of land in the R-80 district with a substantial house is accessory, and its height does not change its accessory nature . " The Board concluded that the "because the sculpture is both a monument and an accessory use, it is exempt from the height restrictions pursuant to §100-230 of the Southold Zoning Code . " The petitioners commenced this proceeding seeking to annul this determination by the Board. The petitioners claim that the Board's determination is irrational in finding that the sculpture is both a monument and an accessory use exempt from the height restrictions . The petitioners' basis is that both the Board and the Millers conceded that a 40-foot monument is not customarily found as accessory to a single-family residential use, so the determination to the contrary is irrational. Second, the Board' s re-issuance of a new decision based upon the Millers written request without anV notice to the applicants, i . e . the petitioners, was procedurally improper. The prior judgment stated that the Board should review any new application in conformity with the zoning code. Although the decision did not specifically state the word "new" it was the thrust of the decision to have a new full record. See Cilla _v. Mansi, 2002 WL 1275122 (N_Y.Sup. Mar 05, 2002) . In any case, the respondents did not make a motion to resettle the judgment so that the language in the judgment is controlling. CPLR 2221 . Having issued the new determination without a new application and the procedural safeguards required the determination must be annulled. This is in harmony with section 267-a of the Town Law, which requires full open hearings with an opportunity to be heard prior to rending a determination. Moreover, the jurisdiction of the Board is appellate only, so that the new application would be required to be initiated at the administrative enforcement level. Town Law 267-a (4) . This is specifically appropriate in this proceeding since the prior record has numerous conclusions by the respondents that the monument is not customary.; Therefore, the new determination is inconsistent with the prior record and the new methodology that was employed must be based upon some rational process that the petitioners should have an opportunity to review. ' It is noted that the petitioners seem correct that the methodology utilized by the. Board, which it calls a sliding scale, does not seem to be a basis for establishing that an entity is a customary use, so as to he an More specific it is a bittern, which is a subclass of herons with nocturnal habits . The Millers' counsel indicated that "38-foot nigh monuments are not customary in anv municipality in the United States or perhaps the world" and the Board' s decision stated that the "monuma-nt is not customarily found in Southold' s residential districts or elsewhere for that matter. " All respondents seem to miss the decretal paragraph's that declared invalid the building permit and certificate of occupancy, so a new application process was needed since there is nothing for the Board to revieer_ accessory use. However, it would appear that a methodology based upon proportionality may be a basis to establish an entity is a customary use. In fact, the cases cited by the petitioners seem to indicate such a possibility. Compare Matter of Presnell v. Leslie, 3 N.Y. 2d 384, with New `Fork Botanical Garden v. Board of Standards and Appeals of Cit_v of Nora York, 91 N.Y. 2d 413 . As the Court of Appeals noted in Botanical Garden, the analysis used to determine whether an entity 1s a customary 'use takes into "consideration the over-all character of the particular area in question . " New York Botanical Garden v. Board of Standards and Appeals of City of New York, supra. at 420 . Therefore, a methodology that takes into account factors related to the entity, the property and the particular area could provide a basis to determine whether the entity is a customary use. Cf. Collins v. Lonergan, 198 A. D.2d 349; Porianda v. Amelkin, 115 A.D.2d 650 . Of course, the court will defer to the Board for a proper methodology which has a rational basis .
