Martocchia, 16 South Street, Greenport, New York. Supervisor Martocchia opened the meeting at 3:00 P.M. with the following present: Supervisor Albert M. Martocchia Councilman James H. Rich, Jr. Councilman James Homan Justice Louis M. DemarSst Town Attorney Robert W. Tasker Highway Superintendent Raymond C. Dean Town Clerk Judith T. Doyen On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that tka minutes of the February 15, 1977 meeting of the Southold Town Board be and hereby are approved as submitted. Vote.of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan; Justice Demarest. This resolution was declared duly adopted. On mo~ion of Justice Demarest, seconded by Councilman Rich, it was RESOLVED that the next regular meeting of the Southold Town Board will"be held at 3:00 P.M., Tuesday, March 22, 1977 at the office of the Supervisor, 16 South Street-, Greenport,-New York. The audit has not been completed, a recess of this meeting will be taken to complete the audit. 2. Receipt of the February 1977 reports of the police depart- menz, building department, Supervisor, Toi~Tl-mClerk.'- Building Depart- ment report shows5 new dwellings, 8 additions to dwellings, one business addition, 9 miscellaneous accessory buildings - total of $255,000.00. 3. Receipt of material relative to a permit that has been held up by the Corps of Army Engineers for dreding the New London Harbor and placing the fill at various disposal sites. It is believed a site has been agreed upon and the permit has been issued. There will be a hearing at the Greenport High School at 7:30 P.M. on March 24th. 4. Notice of hearing on March 31, 1977 from the Department of Environmental Conservation upon application of Wunnewetta Pond Assoc- iation for permission to dredge a triangular area approximately 90 ft. by llS~'Tt, on the northern Shore of the inlet to Wunnewetta Pond from Cutch0gue Harbor. Objections by March 25th. Notice from the DEC, hearing April 4th, upon application of Jack J. Levin ~0-construct a one story frame addition on the east side of the~existing Soundview Restaurant with half of this addition to be constructed on 15 piles ajdacent to MHW-Long Island Sound. Objections by March 29th. Notice from the DEC, hearing March 17th, upon application of Robert Pankratz for permission to construct a bulkhead 72 ft. long an~d dredge 200 cu. yds. on Dawn Lagoon 103 ft. east of Maple Lane, Greenport. Objections by March llth. N~tice from the DEC, hearing March 17th, upon applicatiOn of Leeton Drive Beach Association for permission to construct seven timber groins 48 ft. long and three wave deflectors l0 ft. long one mile fouthwest of Horton's Point, Southold. Objections by March llth.---It is believed this is to be a controversial hearing, objections have been filed by associations in S~uthold.---Mr. Hickey, Southold, asked what the town's feelings are on the LeetOn Drive 9pplication?---Supervisor Martocchia stated they did not get involved mn it until just a few days ago. The town officials are not happy with any long groins, but they are not quite smre about short ones, and thes~ are short ones, 48 ft.---Mr. Hic~ey asked if Supervisor Martocchia has seen what the erosion has done so far to the boat ramp at Kenney's beach?---The Supervisor has not.---Mr. Hickey said where you park your car,.you walk out about 8 ft. and there is a 7 ft. drop.---Councilman Homart stated that with the DEC notices they do not get a map or details of the work to be done, all that is received is a notice of the hearing with minimal information. Supervisor Martocchia has applied for maps, but they do not make them available, you must go to Stony Brook to see them. Notice from the Department of the Army, Corps of Engineera, application of Salvatore J. Ariosto for permission to bulkhead, dredgeandbackgill at Fordham-Canal, Gull Pond, Gr~enport, off Wiggins' Lane. Objections by March 2?th.' 5. Letter from'Mrs. Fred A~ S~. Amand, Elmont, New York relative to her inability to enter'Willow 'Hill Cemetery, Southold due to the roads being~ blocked by snow. This cemetery fronts on Route 25 which is a state highway and not controlled by the town. 6. Letter from William Bueschel, North Bay~iew Road, Southold concerning a triangular lot opposite theGoo~e Creek beach which contains trash and~ debris. The board will try to' improve the situation. 7. Letter from Leopold T. Boeker, Pa~k-AYenue, Mattituck, relative to a "beach" which is merely a 50 ft. road emd'on Peconic Bay, Mattituck, where he feels sand should be pumped in [~o prevent further erosion. The board will look into the situation. 8. Letter from Stony Brook University requesting tha~~ the town consider three students for an intern program during the summer in the government.of the east end towns. Included were resume~ for. Eric Rawson Bredemeyer, Orient, N.Y., Jacqueline Grennon,:-Stgny~ Brook$~N.Y.,'Neil Xatz, RoslYn Heights~ N~Y. The Board will see~~ if there is anything available in the Town. ~ On motion of Councilman Rich, seconded by Councilman Homart, it was RESOLVED that permission is hereby given to the ChemicalBank to release'without substitution, from Escrow Account C8-17007 Southold Supervisor, the following s~curities: ~25,000 islip U.F.S.D.#4 N.Y. bonds 3.25% due 5/1/77 $80,000 Babylon U.F.S~D.#7 N.Y. bonds 3.30% due 6/1~77 Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Demarest. This resolution was declared duly adopted. SUpervisor Martocchia: 9. Letter from George J. Finnegan, Nassau Point, Cutchogue, .thanking the police department anddog wardenfor their prompt~ courtegus and efficient-response to ~his request, for assistance in caring fer an abandoned dog on Sunday, February 13th. 10. ReqUest for a resolution by the County Legislature relative to the use of aluminum wiring in the construction of buildings and residences. Under the New York State-Code such aluminum wiring is already prohibited. For the town to support such a resolution would be a duplication of an existing state law. Supervisor Martocchia entertained such a resolution, but a motion was not ~forthcoming. On marion of Justice Demarest, seconded by Councilman Rich, it'was RESOLVED that Supervisor Albert M. Martocchia be and he kereby~i.s authorized to sign, on behalf of the Town of Southold, a letter of hardship requesting the County of Suffolk, Department of Public~ Works to remove sunken hulks at Budds Pond, Southold to improve · Budds Pond for the purposes of both safety and efficiency, of. Use of an existing port; a hard. ship exists in this_water~ay because : of the serious hazardous conditions caused by the sunken hulks.-.~ad flotsam thereof. On motion of Justice Demares~,. seconded by Councilmmn Homart, it was RESOLVED that a letter be sent expressing the Town of Southold"s good wishes and happiness to Mrs.. Elizabeth Hackland, Peconic Health,~are Center, Greenport, upon the occasion of her 100th birthday On M~oh 14, 1977. On motion of Justice Demarest, seconded by Councilman Rich,.it was RESOLVED 2hat the Southold Town Board approves the'action of the Fishers I~land Ferry District in awarding a contract to Whaling City Dock and Dredge Corporation in the amount of $3446.00 for the repair ef the loading and Unloading ramp on the pier at Fishers Izland. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Demarest. . This resolution was declared duly adopted. Supervisor Martocchia: 1t. Receipt of a letter from Agnor Benson, 1175 Hill Road, Southold; relative to the condition of Dart of Hill Road where it adjoins Wells Avenue.---Unfortunately this is a private road and out of the jurisdiction of the Town of Southold. 12. Sometime ago the Board met with all of the local school principals relative to a new type of business exemption for new buildings and new additions. This exemption would give people building new business buildings or additions a 5~J reduction in their assessment,reduced'5% each year for 10 years. The Town is calling for a hearing on this matter for hear how the residents feel about such an exemption. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that the Town Board of the Town of Southold will hold a public hearing at the Supervisor's Office, 16 South Street, Greenport, NeWYo'rk on the 22nd day of March, 1977 at 3:30 P.M., at which time and place ail interested persons will be given an opportunity to be heard upon the following matter: "A Local Law repealing the exemption on'real property provided by section 485-b of the Real Property Tax Law." which reads as follows: Be it enacted by the Town Board of the Town of Southo~ as ~oll~ws: Section 1. Pursuant to the authority of subdivision 7 of section 485-b of the Real Property Tax Law, the partial exemption from taxation, special ad-valoreum levies and service charges provided by such section 485-b ishereby repealed insofar as such exemption would have been applicable to eligible real property assessed for town purposes. Section 2. This local law is subOect to a permissive referendum and shall take effect forty-five (45) days after its adoption. In connection with the recreation center that is proposed, a letter must be forwarded to the Suffolk County Board of Health requesting that they make an inspection of the land for sewage purposes and what size facility is required. 14. Saturday, March 12, 1977 there will be a Town Meeting'~eld at the Southol~ School fro~9 AM to 5 PM, a one-day consultation or conference for the sharing of ideas and suggestions, economic,'politica!, and ultural for the township. The Board is a co-sponaor and hopes everyone will participate at ~sOme time during the day~ 15. The Board will meet on Thursday to discuss with the architect,~ Wiedersum_Associates, on-the new town hall, some changes that' must be made to the construction of the building. 16. Letter from Robert J. Ra¥itz urging the town to formally object to the petition of the Leeton Drive Association to construct groins and wave deflectors on property due west of Xenney's Beach, Southold. 17. The Board met this morning with officials of the Village of Greenport to discuss some of the dog-problems the Village has. Authorization has been given to drawup a contract to determine what type o£-service the Towncau give. the Village in solving'their problem. A draft of the contract should be ready for the next board meeting. 18. PetAtion for a change of zone by Joseph Cornell, hea~ing held on February 15th, needs ~further study. On motion of Justice Demarest,~seconded by Councilman Homan, it was RESOLVED that the Town of Southold purchase two mannequins for train- ingpurp~ses for the Southold Town,ire Chief's Council provided-such mannequins are made available to the Southold Town Police ~epartment for training purposes. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Demarest. This resolution was declared duly adopted. On motion or. Councilman Homan,.seconded by Councilman~ Rich, i~ was RESOLVED that a contract be awarded~to Greenport Ford,. the lowest responsible,bidder, for the purchaSa~of five new marked and one new unmarked police cars, with five trade-ins at a total cost of Vote of ~the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Demarest. This resolution was declared duly adopted. (Supervisor Martocchia explained that last year for'the first 'time they purchased only half of the new cars,' deciding to trade~0nly half of. the cars each year, make the new ones the first line ca~s and the year old cars the second'line cars. This worked out ~ery well at a considerable savings, the two year old cars holding up extremely well.) On motion of Councilman Rich, seconded by Councilman Homan, it was RESOLVED that the town.accounting department be authoriz, ed ~to reimburse Medicare enrollees a monthly reimbursement of $7;70 effective July l, 1977 due to the increased rates. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Demarest. This resolution was deqlaredd~ly adopted. Supervisor Martocchia: 19. It will be necessary for him to send a letter to Parity COrporation, the computer company that processed the tax rolls for the past two years, a letter directing them to release the magnetic tapes tO Belmil the new computer ~company that has been awarded the new contract for processing the tax rolls. At present Parity has refused to release these magnetic tapes contrary to the conditions of their contract. ~2~.~ Receipt of application no. 29 for a wetland permit by C.P.~.. LandCorporation. Copies have been sent to the Southold Town T~ustees and Southold Town Conservation Advisory Council for their reports and recommendations. 21. In, he matter, of a drainage~problem in Peconic where the town has been working on a salfe of property from Kull and Pontino, there has been a hold-up in that area as one property owner must receive clearance from a mortgage holder on the property. On motion of Justice Demarest, seconded by Councilman Rich, it was ~SOLVED that Oscar Goldin be and he hereby is granted permission to maintain a trailer on his property at Lot #60, Greenport Driving Park, south side Linnett Street, Greenport, for a period of six (6) months. This resolution was declared duly adopted. 189 On motion of Councilman Homart, seconded by Councilmsan Rich, it was RESOLVED that Edmund Bokina~ be and~ he hereby is granted permission to maintain a single trailer on the property of ~Aldrich Lane Realty, at the rear of a storage building on a right-of-way off north side Main Road, Laurel, New York for a period of~ix (6) months. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Surer, Justice Demarest. This resolution was declared duly adopted. Moved byJustice Demarest, seconded by Councilman Homan, ~qEREAS, bids were received for the ~placement of dolphins, dredging and dock repairs at ~he Fishers Island terminal of the Fishers Island ferry on February 24,' 1977, and WHEREAS, the specifications provided that the lowest responsible bidder shall be determined upon the basis of the base bid, and WHERE~S, the base bid of James H. Rambo, Inc. in the amount of $79,281.00 was the Iowest base bid, ~OW, THEREFORE, BE IT RESOLVED that subject to the approval of the ep~rtment of Transportation of the State of New York, the Commiss- ioners of the Fishers Island Ferry District be and they hereby are aut~0ri~ed to accept the bid of James H. Rambo, Inc. for said dolphin, dred~in~and dock work. Vote of ~the Town Board: Ayes: Supervisor Martocchia, COuncilman Rich, Councilman Homan, Justice Demarest. On motion of Councilman Homan, seconded by Justice Demarest, i~ was RESOLVED that the Superintendent of Highways of the Town of Southold be authorized to advertise for bids for 10,000 gallons, more or less as may be needed, for the Highway Department and Disposal Area, of Diesel Fuel. On motion of Councilman Homart, seconded by Counoilmau Rich, it was RESOLVED that the Superintendent of Highways of the Town of Southold be authorized to advertise for bids for the following item: Delivery of 2,500 tons, more or less, as may be needed, of 378" Bluestone, to be delivered by truck to the Highway Department yard, Peconic, New York, and each truck must have a weight slip. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homart, Justice Demarest. This resolution was declared duly adopted. Moved by Justice Demarest~ seconded by Councilman Homan~ WHEREA~, the water resources of theNorth Fork of Long Island are unique and fragile in quantity and its qu~ality is becoming increasingly contaminated, and' WHEREAS, the Amendments to the Federal Water Pollution Control Act of 1972 provides for FederalAssistance to conduct studies of the protection of the water resources, and WHEREAS, the Town Board of the Town of Southold is vitally concerned for the protection of the quality and quantity of the ground[water resource, NOW, THEREFORE, BE IT RESOLVED, that the Town Board, in con~unction with the Village of Greenport herewith authorizes the submission of a Plan of Study to the New York State Department of Environmental Conservation, and BE IT FURTHER RESOLVED, that Holzmacher, McLendon & Murrell, P.C. of Melville, New York, is directed to prepare the Plan of Study and attend meetings and conferences with the United States Environmental Protection Agency and New York State Department of Environmental Conservation to receive approval of the Plan of Study, and BE iT FURTHER RESOLVED, that Holzmacher, McLendon & Murretl, P.C.. shall, be paid the sum of $1,400. by both municipalities, .of which the sum of $420. shall be paid by the Village of Greenport, and $980.00 by the Town of Southotd, and BE IT FURTHER RESOLVED, that Supervisor Albert M. Martocchia shall be~authorized to execute such application and forma as may be necessary to submit the Plan of Study and aid application, and otherwise act in behalf of the Town Board to meet Federal and State r'equirements. On motion of Justice Demarest, seconded by Councilman Rich, it was RESOLVED that 7:30 P.M.,~ Tuesday, April 12, 1977, office of the Supervisor, 16 South Street, Greenport, New York be set as time, date a~d place for hearing~in the matter o£ the application of Harmi'et Spilman for a permit under the ~pr~visions of the Wetland 0rdiance ~f~ the Town of Southold for permission to~ constract.a walkway and floating dock on her property on Wickham CreeK, West Creek Avenue, Cutchogue, New York. Hurter for a change of zone from "A" Residential and Agricultural Distri'Ct to "B-I" General Business District on C-~ certain property in Southold, New York, NOW, THEREFORE, BE IT RESOLVED'that a public hearing will be held by the Southold Town Board at 7:45 P.M., Tuesday, April 12, 1977 a~ the office of the Supervisor, 16 South Street, Greenport, New York on the aforementioned petition; at which time any person appearing to be heard on the above proposed petition should appear at the time and place above so specified, and be it further RESOLVED that the Town Clerk be and she hereby is authorized and directed to cause notice of said hearing to be published in the official newspaper pursuant to the requirements of law. Moved by Councilman Homau, seconded by Councilman Rich, WHEREAS the Southold Town Plarnaing Board and Suffolk County Depart- ment of Planning have prepared official reports and recommendations on the application of William and Barbara Schriever for a change of zone from "B" Light Business District to "C" Light Industrial District on certain property in Orient, New York, NOW, THEREFORE, BE IT RESOLVED that a public hearing will be held by'the Southold Town Board at 8:00 P.M., Tuesday, April 12, 1977 at the office of the Supervisor, 16 South Street, Greenport, New York on the aforementioned petition, at which time any person desiring to be heard'on the above proposed petition should appear at the time and place above so specified, and be it further RESOLVED that the Town Clerk be and she hereby is authorized and directed to cause notice of saidhearing to be published in the official newspaper pursuant to the requiements of law. Report from the Chief of Police indicating that there have been less dog incidents for 1976 and two months of this year. Mrs. Gladys Csajko asked why the police cars ran so expensively?' She gets a figure of $5,106.00 each with the trade-in.---Supervisor Martocchia explained that the police cars are not standard passenger cars, they have automatic trunk openers, oversize engines, larger generators, larger alternators, different 2ypes of tires, they call it police package.---Councilman Homan stated the cars are made to different specifications, and all the equipment on one car can be taken off and put on another car.---The unmarked car has air conditioning. Mr. James Thompson from the Southold Senior Citizens stated that the office of the County Executive has made mini buses ayailable to th~ 'ten towns in the county. He understands that nine towns have accepted the mini buses but Southold refused it. Is that true?--- Supervisor Martocchia stated it is correct. The offer did come to Southold like the other towns, if you take a bus you must maintain it yourself and insure it. He met with Beatrice Zegzula of CAST who has one of the mini buses, and they will take anyone shopping or to medical appointments, but she isn't using her bus full time; there- fore he felt it wrong to take a second bus when the first one is-not being utilized fully; he could always ask for the bus if there were a need.---Mr. Thompson and some of the other members of the senior citizens present were not aware of the bus.---A representative of FISH stated they are averaging 20 to 30 calls a month, for trans- portation, why couldn't they have use of a mini bus?---Supervisor Martocchia stated that th~ycould use the CAST mini bus ~h~the bus that the nutrition center has for their use. Apparently it is not being publicized enough. (Considerable discussion relative to need for a mini bus for senior citizens and the hours it should run.) Supervisor Martocchia asked those present if they felt he should apply for the bus to the County?---The answer was "yes".---He said he would give it more study. Mrs. Gladys Csajko, President of the Council of Allied Associations of the North Fork Taxpayers Association, Inc., presented a 12 page report from that organization and read the following letter: "The undersigned has been authorized to submit the enclosed report to each member of the Southold Town Board for their study. The report is a detailed analysis of the operation of the Southold Town Dog Pound for the year 1976, based on official Town records and records of the North Fork Animal Welfare League, Inc.---The Council will look forward to your comments and reactions in the near future.--- Sincerely, Gladys Csajko, President." Mr. Martin carry, Senior Citizens, Mattituck, asked how much time, who will use and maintain and support the Senior Citizen-Youth Center at Peconic?---Supervisor Martocchia stated that there has been an advisory committee appointed, consisting of senior citizens from each group, junior high students from each of the schools, citizens involved in youth in the community to help the town board on matters concerning the needs for this center. This committee will meet in a week or ten days. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that a recess be called at 4:05 P.M., meeting to reconvene at 5:00 P.M. On motion of Councilman Homau, seconded by Justice Demarest, it was RESOLVED that the following autied bills be approved for payment: General Fund bills in the amount of $34,777.10; Highway Department bills in the amount of $18,057.78; Fishers Island Ferry District bills in the amount of $35,315.71 and Federal Revenue Sharing bills in the amount of $2,197.40.
