(631) 765-1809 Southold Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF AUGUST 21,2025 ZBA FILE: #8023 NAME OF APPLICANT: Osvaldo Landvik, LLC PROPERTY LOCATION: 16109 NYS Route 25,East Marion,NY SCTM No. 1000-23-1-10.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 25 and the Suffolk County Department of Planning issued its reply dated July 1, 2025 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 30, 2025. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is INCONSISTENT with the LWRP policy standards and therefore is INCONSISTENT with the LWRP. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character,preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. 1. As built structures that do not meet setbacks, do not support or enhance community character. While there is a non-conforming side yard setback issue, after personal inspection of the subject property by the members of the Board of Appeals, this Board does not believe that community character will be affected by this application. Therefore,the Board finds that the Action is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a 124,699 square foot'lot located in the R-80 Zoning District. The northerly property measures 199.97 feet and is adjacent to the Long Island Sound,the easterly property line measures 545.65 feet and the southerly property line measures 250.00 feet and the westerly property line measures 267.34 feet and move northwesterly 357.48 feet totaling 624.82 feet. The property is improved with a two- story frame dwelling with an attached covered wooden porch in the rear of the residence, an in-ground,swimming pool located southwest of the dwelling and circular driveway, and a large 40.2 ft. by 22.3 ft. frame garage located Page 2,August 21,2025 98023, Osvaldo Landvik, LLC SCTM No. 1000-23-1-10.1 southwest of the swimming pool with an attached concrete slab located at the most southern point of the property as shown on the survey map prepared by Howard W. Young, LS and dated February 23, 2021. BASIS OF APPLICATION: Request for Variance from Article III, Sections 280-15 and the Building Inspector's May 5,2025 Notice of Disapproval based on an application for a permit to legalize a sunroom addition,on an existing patio attached to an existing accessory wood frame building (amendment to BP#49185); at 1) located less than the code required minimum side yard setback of 25 feet; located at: 16109 NYS Route 25, (Adj. to the Long Island Sound) East Marion,NY. SCTM No. 1000-23-1-10.1. RELIEF REQUESTED: The applicant requests a variance to legalize a sunroom addition on an existing accessory wood frame building(amendment to BP#49185). The proposed addition is not permitted pursuant to Article XXIII, Section 280-15 which states; lots measuring 80,000 square feet or over in total size require a minimum side yard setback of 25 feet. The proposed construction will have a side yard setback of 2.65 feet. The original application dated October 18, 2023 proposed a side yard setback of 5 feet. ADDITIONAL INFORMATION: On August 29, 2023 a Stop Work Order was issued to the applicant for a code violation for construction of an enclosed sunroom/screened porch on an existing concrete slab with second-story deck and pergola without a building permit. Permit renewal was applied for September 25, 2024 and May 1, 2025 and a Notice of Disapproval was issued that date and renewed on May 1, 2025 to include the as built sunroom with second story deck and pergola with a non-conforming side yard setback.The accessory structure has existed for over 100 years,but no building permits were obtained to build the sunroom addition on the existing concrete slab and the porch with a pergola on the second floor as shown on the Site Plan drawings prepared by Neil Roy Logan, Architect and dated July 9,2024. The second floor of the garage is to be used solely for storage. The applicant submitted an old photograph of the subject garage with the originally constructed screened porch and deck with pergola. One neighbor spoke at the public hearing in opposition to the application with construction so close to the property line and voiced concerns about the.structure being used as habitable space. The subject property has the benefit of a Pre-Existing Certificate of Occupancy No. 39871 dated 8/29/18 for a"wood frame one family dwelling with covered concrete entry, wood frame covered side entry a covered concrete patio and accessory wood frame garage with unfinished storage space above and concrete patio." FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 7,2025 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law V67-b(3)(b)(U. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The accessory building(garage)has existed for over 100 years on the property before there were any other dwellings. The enclosed sunroom and second story deck and pergola were original at one time and pre-dated zoning. The applicant wishes to restore the building to the original condition. The subject property is almost three acres and is accessed via a private road. It is set back from Rt. 25/Main Road almost 500 feet and is not visible from Main Road or the property to the west. Only two other dwellings are in the vicinity. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The proposed work is to restore the building back to its original historic structure over the existing concrete patio/slab which has a non-conforming side yard setback. Page 3,August 21,2025 #8023,Osvaldo Landvik, LLC SCTM No. 1000-23-1-10.1 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 89.4%relief from the code. However,the proposed construction will restore what was there and predated zoning. The footprint and lot coverage will remain the same as that which existed prior to zoning. There is substantial vegetative screening from both neighbors surrounding the property. Conditions of approval prohibit the subject storage structure from being used as conditioned, habitable space, other than the approved seasonal use of a screened porch/sunroom and pergola. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions of approval imposed herein. 5. Town Law 4267-b(301(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a restored covered sunroom on an existing slab with second story deck and pergola above with second story storage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Acampora, seconded by Member Lehnert, and duly carried to, GRANT the variance as applied for and shown on Site Plan (Sheet A-000.00) last revised June 4, 2025 and Architectural Plans dated July 9, 2024 prepared by Neil Roy Logan, Architect. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The first and second floor of the subject accessory garage must remain non-habitable and unconditioned space to be used only for storage. 2. The proposed screened porch/sunroom and pergola may not be enclosed with glazing or solid walls and are approved for seasonal use only. , 3. The applicant must apply to the Building Department for a building permit for the"as built" improvement(s) within 90 days of the date of this decision and submit same to the Office of the Zoning Board of Appeals, or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a building permit in the time allotted. 4. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s)and submit same to the Office of the Zoning Board of Appeals within 12 months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a Certificate of Occupancy in the time allotted. 5. The "as built" improvement(s)may not be used until a Certificate of Occupancy has been obtained. IMPORTANT LIMITS ON THE APPROVALS) GRANTED HEREIN Please Read Carefully Any deviation from the survey, site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings,site plan and/or survey cited above,such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,setbacks and other features as are expressly addressed in this action.
