HomeMy WebLinkAboutTB-04/14/1958~ETiNG OF APRIL 14~ 19~8~ The Seuthold Town Board met at the office of Supervisor Norman E, Klipp. at Greenport~ on Monday~ April 14~ 19~8~ at Greenport, The meeting was called to order at 7:30 P.M; with the following present: Supervisor Klipp$ Councilmen Albertson and Demarest~ Justices Tuthill -and Clark; Toum Attorney Tasker and Town Clerk Booth, 'Moved by Councilman Albertson; seconded by Justice Tuthi!i: RESOLVED: That the regular monthly Town Board meeting will be held at the office of Supervisor Norman E, Klipp at Greenport~ on April 29~ 19~8~ at 1:30 P,M, Vote of To~ Board: Ayes-Supervisor Klipp~ C~uncilmen albertson and ~emarest; Justices ~u~hm±! and Clark, Moved by Councilman Aibertson~ seconded by Justice Tuthi!l: WHEREAS~ a petition was filed by~LSWORTH AND WiNIFREDGRATh~OHL for a change of zone on certain real property situate at--~o-~~ Main Road~ Southold~ Now~ Therefore~ Be It Resolved: That ~his petition be held in abeyance until such time that the Williams property which is the West boundary of siad property can be included, Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest$ Justices Tuthill and Clark, Moved by Councilman A!bertson~ seconded by Cou~iiman Demarest: ~HfEREAS~ AR~NOLD S, SACKS ~ of Mattituck~ applied to the Board of Appeals to establish a labor camp on the south side of Sound Ave- ~ Mattituck~ this application was denied~ NOW~ THE~FORE~ BE IT RESOLVED: That Supervisor Norman ~, Klipp be and he hereby is authorized and directed to return to Williem Wickham~ Attorney for ~ Sacks~ ~r. the Ten Dollars ($1Oo00) fee for Building Permit which accompanied the petition° Vote of Town Board: AYes-Supervisor Klipp; Councilmen Albertson and D~marest; Justices Tuthill and Clark, Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That ~he Town Board accept the following action which was taken by the Southold Town Planning Board: In the matter of ~t~r~e of dynam~t~ the Planning Board recommends to the Town Board ~-~~ cases UT--~pplications for storage build~ ings for dynamite or high explosives that such cases be handled by the Board of Appealssas a Special Exception, Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest$ Justices Tuthill and Clerk, Moved by Justice C!ark; seconded by Councilman Demarest: ~YHEREAS~ ~he Southold Town Planning Board has orepared an official report ~na reconn~endation upon the petition or'Constance Kendrick 0verton for a change of zone from "A'~ Residential end agrco Dist, to~-~Business Dist, on certain real property situate at~Cutchogue~ NOW~ THEREFORE~ BE IT RESOLVED: That a public hearing will be held by the Southold Town Boar~ at the Supervisor's Office in Greenport~ on Tuesday~ April 29~ 19~8~ at 2:00 P~M, on the proposal of Constance Kendrick Overton. Y. N0kT~ TH~EFORE~ BE iT RESOL~D: That the Town Clerk be and he hereby is direc%edto ~ransmit this communication to the Southold Town Plarming Board. Vote of Town Board: AyeslSuperviwor Klipp$ Councilmen Albertson and Demarest; Justices Tuthill and Clark. The public hearin~ w~s opened at 7:30 P.M. on the proposal to amend the Tourist Camp~ House.~Camp, House Trailer and Similar Establish-~ ment~ also change 0~rom "A" Residential and Agric. Dist. to "B" Business District on a parcel of real property situate at ArshamomaGue~ Town of Southold, N.Y. The minutes of this hearing were recorded by George T. Lederle] Moved by'Justice Clark$ seconded by Councilman Demares~: ~EREAS~ a petition was heretofore filed with the Town Board of the Town of Southold by. C~W~.RLES S. SA=E and B~ S. G~RDE requesting a change, modification and amendment of t~e'Building Zone Ordinance including the Building Zone maps made a part ~n~ thereof by changing from "A~' Residenti~_l and ~gricultural District to ~'B" Business District the property desoribed in said petitionS and ~REIS~ said petition was duly referred to the Planning Board for its investigation, recommendation and report~ and its report having been filed with the Town Board, and thereafter, a public heating in relation to said petition having been duly ~elad by the Tow~ Board on the 14th day of April~ 19~$~ and due deliberation having, been had thereon N0k~ Th~REFORE~ BE IT RESOLVED: That the relief demanded in said petitiom be~ and it hereby is granted. Moved by Councilman Albertson; seconded by Justic~ Clark: WHEREAS~ THE Sv~n Board adopted a resolution on _~arcn R~ 19~8 provmding for a public hearing on proposals to amend the Southold~Town Ordinance entitled "Southold Town Ordinance providingfor the Regulation of Tourist Camps~ Ho~se Trailer'Camps, H~use Trailers~ or s~m~lsr Establ~shme~t~--~7-~ ~nd ' ' ' - WHEREAS~ said hearing was held on April ~ 1958~ after due not~ce~ now therefore be it RESOLVED: That said Ordinance be and it hereby is amended as follows: 1. By amending Section 2 of said Ordinance to read as follows: SectiOn 2. It shall be unlawful for any p~rson, persons~ firms, assoc~ iations~ corpcrations~ or co-partnership to. establish or operate with- in the limits of the Town of Southold~ any tourist camP on any location or plot of ground for use of transients by the day~ w~ek~ month or w~ season~ whether a charge is or is not made~ who does not possess a permit from the Department of Health and the Town Board of the Town of Southold. Such permit shall not be transferable or assignable. All TownBoard permits may be revoked lmm cause by such Board after~a hearing. 2, By amending Section 19 of said Ordinance to read as follows: Sect~ On every Trmiler Camp~ a suitable planting shall be erected ~'~ maintained to screen the Trailer Camp from public lane and pubTic highways. Such planting shell be not less than five (~) feet high~ the . location of which shell be approved by the Town Board. 3, By amending Section 20 of said Ordinance to read as follows: Section 20. Each application for a permit shall be accompanied by a fee of Twenty-five ($2~.00) Dollars. Upon receipt of an application for a permit~providedin this Ordinance~ the Town Clerk shall cause a notice of Public hearing thereon~ specifying the time and place~thereof~ to be published once in a newspaper published in the Town et least 10 days before the day of the hearing.~ 4. By amending Section 21 of said OrdinanCe to read as follows: Section 21._~, This Ordinance shall not apply to any territory included ~i~hin the limits of the incorporated Village of Greenport, o~e of Town ~oard: ~yes-Supervisor Klipp; Oouncilmen Albe~tson and Demarest$ Justices Tuthill and Clark° ~MEN~NT # 15 N~TICE IS HEREBY GIVEN that after a public hearing held pursuant to the requirements of law~ the Bu!_dlng Zone Ordinance (tnczudlng the Building Zone Maps) of the Town of Southold~ Suffol'kCotuutys New York~'~w~s duly amended at a regular meeting of the Southold Town Board~on ~pril 15, 19~8~ as follows: By changing from "A" Residential and Agricultural District to "B" Business District~ the following described property: ~LL that tract ot parcel of land~ si~u~e~ lying and being at ~rsh- ~momaque~ in the T?wn of Southold'~ County of Suffolk~ State of New York~ bounded end described as follows:-Northerly an8 westerly by Main Road (Route 2~) to a depth of 200 feet; norhterly and easterly by land of Long, Island Railroad~ southerly ~,dother land of Charles S.
