(footprint), single- family dwelling and attached garage with 352sq.ft. rear attached deck with pergola and 14sq.ft. outdoor BBQ area; and 53sq.ft. front roofed-over landing; construct a 340sq.ft. raised(18") uncovered masonry patio; 79 linear feet of 18" high stone retaining wall; a 17'x40' swimming pool (equipped with saltwater filtration system), and 841sq.ft. grade-level masonry pool patio with planters landward of pool patio; install window wells and 5.7'xl9.5' basement steps; install a 4' high utility enclosure; install a generator, A/C units and pool equipment area; install a 26sq.ft. trash enclosure; remove and replace in-place existing 213sq.ft.grade-level masonry patio and 3' wide steps adjacent to bulkhead; install 4' high pool enclosure fencing; remove existing septic system and install a new I/A OWTS sanitary system; install stormwater drainage system; remove three(3) mature hardwood trees and replant three (3) native hardwood trees. SCTM# 1000-86-6-11 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department and the records available to me, I recommend that the action is INCONSISTENT with LWRP. 1. The proposed large, structure is inconsistent with Policy 4 as it is located within a FEMA Flood Zone with a 0.2%Annual Chance Flood Hazard. INSTRUCTIONS l, All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR WIN WUNN LLC 1055 WOOD LANE PECONIC,NY SCTM#1000-86-6-11 POLICIES 5& 6 As a result of its design and associated environmental mitigation measures,the proposed project would result in increased separation distances between wetlands and site development; well mitigated and potentially reduced runoff and improved runoff quality;and potentially improved groundwater and surface water quality. The project would thus avoid adverse impacts and in fact have a potential net beneficial impact on the adjacent tidal wetland ecosystem of Richmond Creek; would be compliant with the standards for wetlands permit issuance set forth by Section 275-12 of the Town Code; and would be consistent with the objectives of Polices 5 and 6 of the LWRP, i.e., protecting and improving water quality, and protecting and restoring the quality and function of Town of Southold ecosystems,respectively, as summarized below. 1) The new dwelling would be located 56 feet farther landward of the bulkhead, nearly tripling the existing dwelling's wetlands setback from 32 to 88 feet; and only 228 sf of the proposed habitable dwelling footprint would be situated within the 100-ft wetlands regulated area. 2) As a result of the landward relocation of the dwelling,the project would replace a dwelling structure projecting well seaward of the "pier line" drawn between the adjacent dwellings with one positioned significantly landward of the pier line, compliant with Section 275-11(A)(3). 3) The proposed swimming pool and grade-level masonry pool patio would also be located landward of the pier line, landward of the existing dwelling, and set back at least 54 feet from wetlands, compliant with the minimum 50-ft wetlands setback for swimming pools and related structures set forth by Section 275- 3(D)(1)(a)(5). 4) The proposed swimming pool would be equipped with a saltwater filtration system, thus avoiding use of a traditional, high-chlorination treatment system. 5) The existing nonconforming septic system, which is located less than 100 feet from wetlands, would be removed and replaced with a low-nitrogen, innovative/alternative sanitary system(I/A OWTS)located more than 150 feet from wetlands. Unlike conventional septic systems,the UA OWTS is designed to significantly reduce nitrogen loading into the groundwater table. 6) A stormwater drainage system is designed to collect and recharge roof runoff from the dwelling; surface runoff from the proposed masonry patios; and discharge from the proposed pool. 7) As evidenced by the design of the proposed driveway,the project seeks to minimize the removal of significant hardwood trees throughout the site; and because three (3) hardwoods must be removed from the 100-ft wetlands regulated area in connection with the proposed construction,three(3)native hardwood trees would be replanted less than 100 feet from wetlands. 8) A 15-ft wide vegetated non-turf buffer located adjacent to wetlands, which will provide a sink and filter for excess nutrients contained in potential surface water runoff before reaching Richmond Creek, will be established pursuant to recently issued Town Wetlands Permit No. 10635 and the associated covenant. 9) A project limiting fence would be installed to contain site disturbance and potential surface runoff during construction. -- See attached addendum-- Attach additional sheets if necessary Policy 7.
