LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD To: Glenn Goldsmith, President Town of Southold Board of Trustees From: Mark Terry, AICP LWRP Coordinator Date: February 10, 2025 Re: LWRP Coastal Consistency Review for JEFFREY VICTOR& LISA HSIA SCTM#1000-53-3-6 En-Consultants on behalf of JEFFREY VICTOR& LISA HSIA requests a Wetland Permit to construct a two- story, single-family dwelling with attached first and second floor porches, steps, hot tub, swimming pool, pool deck with pool enclosure fencing, and outdoor shower piped to drywell; install an I/A sanitary system; install stormwater drainage system; install paver/masonry paths; maintain existing metal storage rack; remove various existing wood decks/platforms/walks; clear specified areas within Trustee jurisdiction resulting in removal of 14 trees; to allow for construction access, the installation of a pervious gravel driveway, and filling/grading of approx. 134sq.ft. area within Trustee jurisdiction (using portion of 185 cubic yards of clean fill to be trucked in from an approved upland source), temporarily clear specified areas within Trustee jurisdiction to be restored using native vegetation, including 14 native hardwood trees (1:1 replacement of trees to be removed); and to establish and perpetually maintain a 50 to 100 foot wide, 1.8 acre Non-Disturbance Buffer adjacent to the landward edge of the tidal wetlands boundary. SCTM# 1000-53-3-6 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local.Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with LWRP. 1. The clearing of natural vegetation is inconsistent with Policy 6.3 Protect and restore tidal and freshwater wetlands. Wetlands and their benefits are dependent upon the condition of adjacent lands which provide buffers between wetlands and surrounding uses. E. Maintain buffers to ensure that adverse effects of adjacent or nearby development are avoided. 2. The expansion of the structure is inconsistent with policy 4; located within a FEMA Flood Zones with a 0.2%Annual Chance Flood Hazard and a 1%Annual Chance Flood Hazard. Structures constructed within these hazard areas should be minimized. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR JEFFREY VICTOR& LISA HSIA 1185 KERWIN BOULEVARD GREENPORT, NY SCTM#1000-53-3-6 LWRP Policies 5 & 6 The subject property was originally approved for developed pursuant to Town Trustees and Building Department approvals issued in the 1980s.After site clearing, construction of a dwelling foundation, and installation of a septic system by the prior owners,however,the project was abandoned, and the current owners removed the foundation after issuance of a wetlands letter of non jurisdiction by the Trustees in 2003. Although the property is more than 5 acres in size, over 2 acres are tidal wetlands,whose boundary meanders around both the east and south sides of the buildable area of the 3-plus acre upland. Great care and consideration has therefore been invested in the development of the site design to meet or exceed required wetland setbacks and maximize to the greatest reasonable and practicable extent the maintenance of open space and preserved vegetated buffer areas adjacent to wetlands. In addition to the proposed construction being situated in the cleared/disturbed portion of the property where the dwelling foundation was previously located, all elements of the project have been designed to comply with the wetland setbacks required by Town Code Section 275-3(D)(3), including 100 feet to the proposed residence(including the attached deck); 50 feet to the proposed driveway; 100 feet to the proposed sanitary system; and 50 feet to proposed clearing.Newly proposed permanent clearing within wetlands jurisdiction would occur no closer than 50 feet from wetlands and is limited to areas to be disturbed and maintained in close proximity to the proposed construction. Almost 1,800 sf of jurisdictional clearing to allow for construction access, driveway installation, and a small grading area would be temporary in nature and restored with native vegetation, including 14 hardwood trees to provide 1:1 replacement of the 14 trees that would be removed by the proposed permanent clearing.And a 50 to 100-foot wide, approximately 1.8-acre non-disturbance buffer would be permanently maintained adjacent to the wetlands boundary. To further mitigate the proposed site development, 1)an I/A sanitary system is proposed more than 100 feet from wetlands and outside Chapter 275 jurisdiction; 2)a stormwater drainage system is proposed to collect and recharge potential runoff associated with the proposed dwelling structure and driveway, and provide storage for proposed pool backwash and drainage from the outdoor shower; 3)the proposed pool would use saltwater filtration; and 4)a project limiting fence would be installed to contain site disturbance and contain potential runoff during construction. Therefore,the project design, inclusive of the above noted mitigation measures and extensive preservation of vegetated wetland buffers, will ensure compliance with the standards for issuance of a wetlands permit set forth by Section 275-12; and will protect groundwater quality and not adversely impact the quality or function of the surrounding tidal wetlands ecosystem and surface waters associated with Pipes Creek, consistent with the objectives of LWRP Policies 5 and 6. -SEE ATTACHED ADDENDUM- Attach additional sheets if necessary Policy 7.
