Located: 3693 Pine Neck Road, Southold. SCTM# 1000-70-6-25 The action is recommended as INCONSISTENT with policy 6.3 for the following reasons: 1. The as-built single structures were constructed without Board of Trustee review or permits. If the action is approved, a vegetated non-turf buffer is recommended landward of this high- quality marine wetland system. An I/A sanitary system upgrade should be required. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR GERARD RIEGER 3693 PINE NECK AVENUE SOUTHOLD,NY SCTM#1000-70-6-25 LWRP Policies 5 & 6 The application seeks approval for as-built structures that were constructed without the benefit of a wetlands permit, primarily a masonry block pool patio that was constructed in place of a brick patio with a lateral extension at its northwest corner prior to 2017. The existing patio was thus present when the Trustees reviewed an application for a retaining wall in 2017, and aerial images showing the brick patio in 2015 and current patio in 2016 are contained in the records associated with Wetlands Permit No. 8999. Nevertheless, permitting of the patio appears not to have been addressed at that time. Subsequent to issuance of that permit, a smaller section of previously existing stone patio at the southeast corner of the pool patio was replaced; extended laterally around a stone barbeque counter also built prior to 2017; and improved with the existing hot tub and stone bench. A generator and two above-ground LP tanks were installed during the Covid-19 pandemic more than 100 feet from wetlands but within 100 feet of the bank. Building Permit No. 45507 was issued for the generator in 2020 but no wetlands permit was requested or obtained. Except for the patio corner extensions, installation of the current pool patio essentially replicated a site condition that dates back to at least 2001 and likely much longer ago, as the existing swimming pool was issued Certificate of Occupancy No. Z11662 in 1983. But to provide potential runoff mitigation that likely would have been required had the patio replacement been reviewed by the Trustees,the F x 56' seaward edge of the patio is proposed to be removed and replaced with a gravel trench drain. And to capture backwash from the existing swimming pool and hot tub, a currently lacking pool drywell is proposed outside Chapter 275 jurisdiction more than 100 feet from the top of bank. A covenanted non-turf buffer on the landward side of the retaining wall authorized by Wetlands Permit 8999 is being maintained and is depicted on the survey submitted herewith.
