Located: Reservoir Road, Fishers Island. SCTM# 1000-9-8-1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. INSTRUCTIONS 1, All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its si nificant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR FERRY VIEW LLC NO #RESERVOIR ROAD FISHERS ISLAND,NY SCTM#1000-9-8-1 LWRP Policies 5 & 6 The proposed development of the subject property has been designed to provide a reasonably sized residence on a 2.4-acre parcel,with a proposed GFA almost 1,000 sf below that allowable by code and total lot coverage of 8.9%, less than half of the 20 percent allowed by code. Due to the limited lot depth between the road and bluff,however, it is necessary for the dwelling to encroach to some degree on both the 100-foot bluff setback and 60-foot front yard setback.But to favor protection of the bluff, an unequal balancing of these encroachments is proposed, with only a 10-foot or 10% encroachment on the required bluff setback and a 20-foot or 33% encroachment on the front yard setback. Through its approval of Appeal #7854, the Zoning Board of Appeals supported these proposed setbacks, as did the LWRP Coordinator. To further mitigate the proposed development, 1) all clearing, grading, and ground disturbance is limited to a distance of 25 feet from the top of bluff, as recommended by the LWRP Coordinator in connection with the application for zoning variance,thereby permanently establishing a 25-foot wide non-disturbance buffer landward of the bluff; 2)on-site septic would be treated by a low-nitrogen,Fuji Clean CEN 10 IUA OWTS sanitary system with leaching galleys located at least 144 feet from the bluff; 3) a stormwater drainage system is proposed to collect and recharge runoff from the dwelling roof, masonry patio, and driveway; 4) the proposed accessory garage is located more than 100 feet from the bluff; and 5) project limiting fencing will be installed to control and contain site disturbance during construction. Therefore, as designed with the incorporated mitigation, the project will not adversely impact groundwater or the quality and function of the surrounding ecosystem, including the adjacent bluff and surface waters of Fishers Island Sound, consistent both with the permit standards of Chapter 275 and the goals of LWRP Policies 5 and 6. 5 See attached narrative addressing Policies 5 and 6.
