Re: LWRP Coastal Consistency Review for ZBA File Ref CEDARS 1883,LLC/JONAH AND KATIE
SONNENBORN#7945
SCTM No. 1000-17-1-11.5.
CEDARS 1883, LLC/JONAH AND KATIE SONNENBORN #7945 - Request for Variances from Article IV,
Section 280-18; and the Building Inspector's April 29, 2024 Notice of Disapproval based on an application for a
permit to legalize an "as built" habitable third story and create additional habitable third story space in an existing
single family dwelling; 1) more than code required number of stories of two and a half, 2) less than the code
required minimum front yard setback of 50 feet; located at: 825 Stephensons Road, Orient,NY. SCTM No. 1000-
17-1-11.5.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold
Town Code and the Local.Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the
information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the
records available to me, the proposal is recommended as INCONSISTENT with the below LWRP policies.
Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves
open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and
minimizes adverse effects of development.
The"as built"habitable third story is contrary to fostering a pattern of development in the Town of
Southold that enhances community character and negates Board review, setting a precedent in a
neighborhood.
The front yard setback is EXEMPT for review.
Pursuant to Chapter 268,the Southold Town Zoning Board of Appeals shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.
