THOMAS AND MARY ROULETTE #7939 - Request for Variances from Article IV, Section 280-18; Article XXXVI, Section 280-208A and the Building Inspector's March 15, 2024, amended March 27, 2024 Notice of Disapproval based on an application for a permit to demolish (as per Town Code definition) and construct a single family dwelling; 1) located less than the code required minimum front yard setback of 50 feet; 2) located less than the code required minimum side yard setback of 15 feet; 3) the construction exceeds the permitted sky plane as defined in Article I, Section 280-4 of the Town Code; located at: 705 Meday Avenue, (Adj. to Howards Branch) Mattituck, NY. SCTM No. 1000-113- 8-14.2. The proposed action has been reviewed to Chapter 268,Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, the proposal is recommended as INCONSISTENT with the below LWRP policies. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The proposed exceedance of the sky plane on the parcel is contrary to fostering a pattern of development in the Town of Southold that enhances community character, setting a precedent in a neighborhood. .e .f y Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
