The proposed action has been reviewed to Chapter 268,Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available to me,the proposed action is recommended as INCONSISTENT with the below LWRP policies. Policy ]. Foster a pattern of development in the Town of Southold that enhances community character,preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The as-built structures were constructed without obtaining the required permits. As-built development does not reinforce the traditional land use pattern of the Town of Southold and is not supported by this policy. Regardless of when the structure was constructed, a second detached dwelling would require the minimum lot size to be 80,000 square feet or 40,000 square feet for each detached dwelling in the R- 40 zoning district. The total lot size is 24,319 square feet; deficient by 55,681 square feet. Pursuant to Chapter 268,the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. An undesirable change will not be produced in the character of the neighborhood or a detriment to nearby properties if granted, because: Town records are incomplete concerning the origins of this building but I did find a sketch on a building permit application dated July 23, 1965 that shows a building between the house on Richmond Creek and the garage on Wood Lane. It is labeled"sleeping house". This confirms what others in the neighborhood say, which is that this house has "always been there." The permit application was found in the zoning board application #789 which granted the owners the right to erect a detached garage in the front yard and is included in this application package as Attachment#2 The house on Richmond Creek existed prior to 1959 because building permit#611 was issued on March 24, 1959 for alterations to an existing dwelling. This is included in this application as Attachment#3. There were alterations and additions made to the house on Richmond Creek which are covered under building permit Z 3032 a copy of which is included in this application. The final documentation of this building is from a Site Plan dated February 24, 2010 which was included with an application to the Southold Town Trustees for a permit (#7243)for bulkhead replacement. On this Site Plan the building is described as "1 story framed house°. This Site Plan has been included in this application package as Attachment#4. All of this is to say that this building has been included in the character of the neighborhood for at least sixty years and the current owners have now taken it upon themselves to legalize all of the existing structures and bring them into compliance to the best of our abilities. 2. The benefit sought by the applicant cannot be achieved by some other method feasible for the applicant to pursue, other than the area variance because: The house exists in its current location and as far as we can determine it was built on a slab which makes a successful relocation unlikely. 3. The variance will not have an adverse effect of impact on the physical or environmental conditions in the neighborhood or district because: Prior to submitting this application to the Zoning Board the owners made an application to the Suffolk County Dept. of Health Services for a permit to install a new I.A. OWTS sanitary system to serve both existing houses. The application (R-22-1250)is on hold pending Town Trustee and DEC approvals which are also on hold pending the determination of the Zoning Board. A copy of the Sanitary System Site Plan that was submitted to the Department of Health Services is included in this application as Attachment#5 5. Has alleged difficulty been self created? The current owners purchased the property in 2021 and all of the existing buildings were located on the lot in their current condition at the time of purchase. They have not altered them and, as I stated earlier,they have been actively working towards bringing the property into compliance. An undesirable change will not be produced in the character of the neighborhood or a detriment to nearby properties if granted, because: I examined the digital files for 17 properties that could be considered in the neighborhood of the Nerreau Residence and of those 17 properties four of them have been granted variances for property line setbacks that do not meet code requirements. Some of the houses built in this neighborhood were built 60 to 70 years ago and many of the lots are, like the Nerreau property, less than 75'wide making it likely that the older houses were not sited with setback requirements in mind. The existing house was built prior to 1959 and it was placed about 20'-0"from the side yard property line to the west. There is a CO and Building permit attesting to this included in this application as attachment#7. The addition was permitted and received a CO in 1968 and on the hand drawn sketch included with the permit application it shows the side yard property line setback of 12'-0"which must have been acceptable to the Building Dept. officials at that time. The CO and Building Permit for the addition are included in this application as attachment#8. 2. The benefit sought by the applicant cannot be achieved by some other method feasible for the applicant to pursue, other than the area variance because: The addition was permitted and built 65 years ago and is now an incorporated part of the existing residence. I have attached a floor plan and an exterior elevation of the existing house to show how the addition cannot be removed or relocated without substantial alterations to the house. See attachments#9 and#10. 3. The amount of relief requested is not substantial because: The required setback is 15'-0" and the existing setback is 12.4'which means it is only 2.6 too close to the side yard property line. The east property line setback is 26.8'which meets the requirements of 20'-0". 4. The variance will not have an adverse effect of impact on the physical or environmental conditions'in the neighborhood or district because: Prior to submitting this application to the Zoning Board the owners made an application to the Suffolk County Dept. of Health Services for a permit to install a new I.A. OMITS �4 4'b sanitary system to serve both existing houses. The application (R-22-1250)is on hold pending Town Trustee and DEC approvals which are also on hold pending the determination of the Zoning Board. A copy of the Sanitary System Site Plan that was submitted to the Department of Health Services is included in this application as Attachment#5. 5. Has alleged difficulty been self created?
