The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the concrete porch The proposed deck replacing the 50' concrete porch seaward of the top of the bluff line is INCONSISTENT with the below listed Policy Standards and, therefore, is INCONSISTENT with the LWRP. Policy 4.1. Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are recommended. specifically A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 5. Manage development in floodplains outside of coastal hazard areas so as to reduce adverse environmental effects, minimize the need for future structural flood protection measures, or expansion of existing protection measures and to meet federal flood insurance program standards. The proposed deck sets a precedent on a natural protected feature (bluff) contrary to restoration of such features. It is recommended that the Board relocate the proposed deck landward from the top of bluff to the furthest point practicable to meet this policy and reduce the risk of property loss from potential erosion in the future. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The subject premises is a 129,375SF lot on Long Island Sound with 35;422 SF of buildable land.. As depicted:on the site survey-and site plan submitted, the premises is improved with an 880 SF one-story residence with a screened in . . . porch. and rear concrete patio. 50 SF of the concrete patio and, its supporting retaining wall lie :seaward of the top of bluff line and the balance.of the patio, . house and an accessory-structure lie within-the 100'bluff setback. The western footprint sits 19.6 feet from the side yard line where 20 feet is required under the bulk schedule.. The Applicant is proposing a modest 560 SF addition landward of the existing house..At the suggestion of the Trustees upon inspection,.the concrete patio.will be replaced with a comparably sized wooden deck designed to increase permeability near the edge of the bluff and decrease erosion. The Trustees did not object to the deck as long as it stays within the boundary of the existing retaining wall nor did they voice .any objection to .the construction since is all falls within _the pier line. For the fohowing reasons, the Applicant submits that a Variance from Section 280-.116(A)(1) is warranted: 1. :An undesirable change will not be produced in the CHARACTER of the neighborhood or a.detriment to nearby properties if granted, because: The subject property is comprised of approximately 2:97 acres in the R-80 zoning district adjacent to the Long Island Sound.: The parcel is :substantially wooded landward of the bluff dine making:. the existing improvements barely visible from Soundview Avenue. The Applicant is.only seeking.a modest addition, that will not require the removal of:trees or disturbance of the.natural terrain of the parcel. The neighboring homes are: larger and situated more seaward of the subject premises so that all proposed construction is well within the pier line. The home is in a state of disrepair and the renovation will significantly improve the aesthetics of the structure.As such, the Applicant submits that the proposed construction is consistent with the character of the neighborhood and will:pose no detriment to nearby properties. 2. The benefit sought by the Applicant .CANNOT be achieved by some feasible method for the applicant to pursue other than an area variance, because: Due to the location of the existing single-family residence and concrete patio and the pre-existing non-conforming side yard setback, there is no way for the Applicant to achieve the benefit of an updated and functional home without variance relief from the bluff setback and the minimum side yard setback in the bulk schedule. The existing improvements lie seaward of the top of-bluff and proposed improvements will be in place. 3. The amount of requested relief is not substantial because: The Applicant .submits that while the . required bluff setback may be mathematically substantial at over 100% relief, it is arguably not practically substantial since the vast majority of the construction will be within the existing footprint of the house and patio and the proposed deck will :eliminate an impervious.concrete albatross on the top of the bluff. The addition proposed is entirely landward of the existing home and.neighboring homes on the bluff. The side yard relief is essentially deminimus. 4. The variance will NOT have an adverse impact on the physical or environmental conditions in the neighborhood or district because: As stated previously, the Trustees supported the removal of the concrete patio and construction of a flow through deck to facilitate drainage and reduce erosion which will -be a net positive for environmental conditions. The improvements will be essentially invisible to,the surrounding neighborhood. As a Type II action under SEQRA, there is:no perceivable:environmental.impact from the proposed.construction. The Town Trustees inspected the property in a pre- submission :conference for the Wetlands Permit and did not _indicate that the proposed construction would pose any threat to the integrity of the bluff.
