SCTM No. 1000-44-2-17. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me,the proposal is recommended as INCONSISTENT with the below LWRP policies. A Board of Trustees Wetlands Permit was issued in 2023 (Permit 10439& 10439)for a replacement bulkhead. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The structure does not enhance community character and sets a precedent on lots in the neighborhood and within the community. The proposed lot coverage of 100% is not consistent with this policy. It sets a precedent for constructing habitual dwellings prone to repetitive loss in designated structural hazard areas from storms, including hurricanes. Policy 4.L Minimize losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development that is not water-dependent as far away from coastal hazard areas as practical. b. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. The proposed as-built deck is residential and, therefore, is not a "water- dependent use". The structure is located entirely within the Coastal Erosion Hazard Area(CEHA). Further,the structure is also located within the FEMA"VE"velocity hazard flood zone designation. Structures located within these areas are subject to repetitive loss from storm events. The parcel and portion of the structure are located within the FEMA Velocity Hazard flood zone AE 16'. The probability of loss of the structure is high. It is recommended that the Board require that the deck area be redesigned to comply with the original building permit and that the purpose of the CEHA and FEMA Flood Zones be to avoid and minimize repetitive structural damage and loss within these vulnerable,high-wave energy areas. What is a seasonal cottage use? Pursuant to Chapter 268,the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The entire parcel and all improvements he seaward of the Coastal Erosion Line. The proposed construction to the Main house consists of the removal of the flat roof on the northeast side of the house and replacement with a pitched roof as well as the replacement of certain doors and windows, which has been deemed to constitute an increase in the degree of the nonconforming .9 feet front yard setback at less than-the minimum 35 feet, with lot coverage deemed to be at 100% (due to the CEHL) exceeding the allowable 25% in the bulk schedule for the RR zone. The alteration to the seasonal cottage consists of the relocation of the existing south facing front door to the east side of the pre-existing non- conforming cottage. For the following reasons, the Applicant submits that variances from Sections 280-123 and 280-36 of the Town Code are warranted: 1. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The subject parcel is uniquely located on CR 48 in Greenport, directly west of the Soundview Inn. There are 5 improved lots to the west of the parcel that are improved with single family residences that were constructed and/or renovated with the benefit of variance relief for, among other things, setbacks and lot coverage. Those homes are all located in the R-40 zoning district with more stringent setback requirements. All construction will take place within the footprint of the existing structure with no new ground disturbance. While the proposed roof construction will increase the height of the house, it will not extend the nonconforming front yard setback or increase the existing lot coverage. The proposed construction is essentially cosmetic in nature and will improve the aesthetics of the home resulting in a positive change to the neighborhood with no detriment to nearby properties. 2. The benefit sought by the Applicant CANNOT be achieved by some feasible method for the applicant to pursue other than an area variance, because: The Applicant is seeking the benefit of an aesthetically pleasing home with an improved roofline with functional windows and access. The cottage door faces the short driveway on CR 48 making access cumbersome when a vehicle is parked there. Because of the Walz Interpretation, and the pre- existing nonconforming cottage, any alteration to this house and cottage will require variance relief even though there will be no increase in the nonconformity of the existing setbacks or lot coverage and the alterations are largely cosmetic. 3. The amount of requested relief is not substantial because:. While the variance for the front yard would seem substantial for ground level disturbance, it is not in this instance since the construction will only increase the pitch of the house. The lot coverage relief is only necessitated by the CEHL which deems the parcel as unbuildable. The actual lot coverage is a conforming 19.1% which is even compliant with the neighboring R-40 restrictions. And the proposed relocation of the door to the cottage and replacement with a window is arguably deminimus in nature and will not increase the .degree of nonconformity of the cottage. 4. The variance will NOT have an adverse impact on the physical or environmental conditions in the neighborhood or district because: As stated previously, the proposed construction amounts to a facelift of the house and cottage to improve accessibility and aesthetics. All work will be done within the existing footprint that was established years ago when the home and cottage were constructed. Granting of variance relief will not have an adverse impact on the physical conditions in the neighborhood and will permit the renovation of the home and cottage in a manner that is entirely consistent with the character of neighboring homes. In addition, as a Type II action, there is no perceivable environmental impact stemming from the proposed renovation. 5.
