The Southold Building Department has sent a Notice of Disapproval letter dated 11/6/24 citing Section 280-207 of the Southold Town Code as the reason for disapproval. Sections 280-207 A(1) and A(2)would provide for an allowable GFA for this property of 2,578.1 SF. The reason for the denial in the Notice of Disapproval letter in this case should not be applicable as the application meets Section 280-207 A(3). Three applications had been submitted for approval prior to the enactment of Section 280-207 (added to Code on 10/18/22). These applications include the NYS DEC on 3/15/21,Southold Town Trustees(Wetlands Permit) on 4/12/21 and the Suffolk County Department of Health on 4/16/21. Architect Mark Schwartz had been hired by the Owners on 12/9/20 to complete the initial design and applications. Also,the Owners hired an expediter on 3/15/21, Mike Kimack to complete the above- mentioned permits. The Trustees hearings were held on 8/18/21 and 9/15/21. The Wetlands permit application was denied by the Board of Trustees for not proposing an IA septic system. Due to the denial by the Board of Trustees,the Owners hired a professional engineer,James Deerkoski, on 9/23/21 to complete an IA septic design and file an amendment with the Suffolk County Department of Health. The amended IA design was filed on 11/18/21. The NYS DEC application was satisfactorily resolved. A Letter of No Jurisdiction Tidal Wetlands Act was received on 4/20/21. Knowing that the 'Big House Code" (280-207)was adopted by the Town of Southold, Mark Schwartz spoke to the Southold Building Department and confirmed to the Owners in an email dated 11/14/22 that he had "been told if a project has been submitted and the permit process is in the works,the project will be exempt from new zoning". One of the Owners also had separately spoken to the Southold Building Department detailing the applications that had been filed including that the Wetlands permit had been denied. The Building Department confirmed that the new zoning would not apply as permits had been submitted prior to the enactment of the new section. Over the course of 20 months,James Deerkoski received six Notices of Incomplete Application from the Suffolk County Department of Health. All other IA technical issues had been resolved. The Owners engaged AMP Architecture on 4/24/24 to take the initial design drafted by Mark Schwartz and to complete the detailed construction plans and to expedite the remaining applications and permitting. On 7/3/24,AMP Architecture discussed the project with the Southold Town Building Department and a response was given that the application would be denied for GFA. Mike Verity indicated in an email dated 7/3/24 (from Amanda Nunemaker)that"this project will not be grandfathered under the former Town code. There was a 10-month lapse between the last Health Department correspondence and the time when AMP took over the project." The recent Notice of Disapproval from the Building Department did not mention a "time lapse" in the project. Section 280-207 A(3)does not contain any requirements for a time-period for completion of permitting or any disapproval for a time lapse or pause in activity of a project. Therefore,the timing of activity of this project should not be a consideration for grandfathering under Section 280-207 A(3). We ask the Zoning Board of Appeals to consider that the application meets Section 280-207 A(3)and that it is exempt from meeting the current GFA requirements.
