'1906_ (Please be sure to research before eoniple ft this question or gaff our q, a for assistance) REASONS FOR APPEAL. - -See attached Pages 2 through .10 and Exhibits 1, 2, 3 and 4 A brief background review concerning these Variance requests is relevant- This- application for three variances is a result of the Town of Southold Building Department, filing three Informations in the Justice Court of the Town of Southold against Kevin. Cierach; Town Justice Daniel C. Ross issuing a Criminal Summons returnable in Justice .Court on 09/07/2022 . The Informations. charged Kevin Cierach with three violations of §280-154 of the Code of the Town of Southold: (1) use and occupancy of a storage building as a single-family dwelling without obtaining a Certificate of Occupancy; (2) use and, occupancy of a single story storage building without first obtaining a Certificate of_ Occupancy; and (3) use and occupancy of an- apartment over a three car garage without obtaining a Certificate of Occupancy. Kbvin Cierach ret_ ained .Richard F. Lark, Esq. to represent him concerning these charges. . When Mr. Lark appeared in Justice Court he had conferences with the Town Attorney' s Office, Southold Town Building Inspector,' Michael Verity, and Town Justice Daniel C. Ross. Mr. Lark was advised these violations had been lingering for a long period of time and needed to. be resolved with permits so Kevin Cierach would comply with the Town Code and' be able to obtain Certificates of Occupancy :for the three structures on his property. The matter was adjourned to allow Mr. Lark .to familiarize himself with the history, and he was directed by .Justice Ross to contact the Building Department and the Town Attorney' s' Office to establish a procedure to come in compliance with the Southold Town Code. Mr. Lark along with Kevin Cierach' s agent, Beverly. Cerach, met with Michael Verity several times and were advised to file applications to the Southold Town Building Department and Town _Trustees. Because the buildings' - on this property in their current status are not legal under the Southold Town Zoning . Code., Building Permits cannot be issued until the buildings are legalized. Upon receipt of the -Notice of Disapproval of the Applications for Building Permits, .area variance requests would then 1have to be. made' 'to the Zoning Board of Appeals in order to legalize these buildings . While this process was pending, Mr. Verity further advised in order for the matter to .be. resolved in the Justice Court, . the tenants in the accessory buildings have to be removed, and the two accessory buildings remain vacant and converted back to storage. Further, no new construction work can be done on the buildings until Building Permits are issued. -2- As a .result of several conferences with the Building Department, Town Attorney' s Office and Justice Ross, on March 20, 2024,: Mr. Lark filed three Applications for. Building Permits along with . exhibits with the Southold Town Building Department., (See attached Exhibit, 1) The Building Department on March 27, 2024 issued a Notice ,of Disapproval." On May 15, 2024, a settlement conference concerning the. -violations was held in the Justice Court of the Town of Southold. Kevin Cierach pled guilty to the three outstanding violations, received a $1, 500 . 00 fine and Court Order with Conditions of Conditional Discharge. (See attached Exhibit 2.) Mr. Lark and Kevin Cierach' s agent, Beverly Cierach, had further conferences 'with Mr: Verity concerning the details to legalize the• buildings and .the required variances. As a result' the' Notice of Disapproval was. amended on December- 23, 2024 . (See attached Exhibit 3) Beverly Cierach, acting as agent for Kevin Ciera'ch, is . . . requesting the Zoning Board of .Appeals approval for the following three variance requests: . A. VARIANCE REQUEST#1: . To legalize an existing "as built" 2-story .2, 517 sq. ft.' single-family dwelling with a . 35.2' setback from the rear property line, .which is not in compliance with the .Southold Town Zoning Code 50' rear yard setback. B. VARIANCE- REQUEST #2: To legalize an existing "as built" ' 1-story 565 sq.. 'ft.. Accessory stucco building having a 3. 1' setback from the rear. .property line, which is not in compliance with the Southold. Town Zoning Code 15' rear yard requirement for accessory buildings. C. VARIANCE REQUEST #3.: To legalize an existing "as built" 2-story 7.25 sq: ft. accessory garage which has 104 square 'feet of the westerly- part of this accessory garage located in the side yard area.; which is not in compliance with the Southold Town Zoning Code which allows accessory buildings only in the - rear yard.. If these variances are granted, Building Permits can. be obtained,- which will allow the necessary work to .be accomplished to satisfy the requirements of the Southold Town Zoning Code, New York State. Building Code, and Suffolk County Health Department. When" all these requirements. are completed and -3- " -approved, the Building Department upon application will be in a position to issue Certificates of Occupancy for the single- family dwelling and the two accessory buildings., Kevin Cierach,- as owner, .will then be 'able to satisfy the Justice Court' s Order and Conditions of Conditional Discharge dated May 15, 2024 . . As a result he will be. able to . legally occupy and enjoy the premises knowing everything is in compliance with the Southold Town Zoning Code.- , The property details and location .of the buildings are shown on a survey by Nathan Taft Corwin III Land Surveyor last amended February 20, 2025. (See attached Exhibit.4) Kevin Cierach and hi.s agent, Beverly Cierach understand. the Zoning Board of Appeals must consider• and balance the . followin.g statutory criteria consisting of five factors 'for each. variance request to make .a determination that the "as built" single- family dwelling; and the two accessory buildings have not or will not cause any detriment to the health, safety and welfare of the neighborhood. A. VARIANCE REQUEST #1 (SINGLE.-FAMILY DWELLING) CRITERIA #1. Whether .an undesirable change will. be produced. in the character of the neighborhood or a detriment to nearby ' properties will be created by the granting• of the area variance? The existing 2, 517 , sq.. ft. "as built" single-family dwelling was originally moved to its present position in 1953 from,_another location. and placed on a foundation constructed by Frank R. Zaleski. . - The foundation was located 45. 3' from the rear property line. This building was then used by .the - prior owner I s a storage building for heavy -machinery with a workshop in the cellar. After Kevin Cierach purchased the property on March 11, 1994, he made -repairs to the building to protect it from 'the elements and used the building primarily for storage- of equipment; and the workshop in the cellar for making repairs, and fabricating ductwork for his heating and air conditioning business. In 1997., Kevin Cierach began to renovate this building into, a single-family dwelling and in the process submitted: building plans to the•'Southold Town Building Department; and septic and. cesspool plans to the Suffolk County Department of Health Services. Although Mr. Cierach did not receive. approval from the. Southold Town Building Department, he did receive- approval from the Suffolk County Department of Health Services for the location of the cesspools. In the process of renovation, Kevin -4- Cierach constructed a 10 .2' wide elevated attached wraparound deck in the, rear and side yard area with a garage under the .deck in the .rear yard area, all of which then placed the .building 35.2' from the rear property line: Kevin Cierach submits that the renovation of this building into a single-family dwelling with an elevated attached -wraparound deck is .an enhancement .to the property and is in conformance with the residential .character of- the surrounding properties. The overall benefit due to the renovations to a single-family . dwelling, clearly outweighs any detriment to the neighboring properties and established residential character of this - community. CRITERIA #2 . Whether the benefit sought by the applicant can. be achieved by some method, ' feasible for the applicant to pursue, other than an area, variance? An area variance is the only available method for Kevin Cierach to pursue to ' legalize this 2-story building into a single-family dwelling with the addition of a 10.2' wide elevated attached wraparound deck and garage under the deck, which requires a -variance for a 35. 2' rear yard. setback. CRITERIA #3. Whether the requested variance is. substantial? The .2-story 2, 517 sq. ft. storage building renovated into a single-family••dwelling with' the addition of an elevated attached, wraparound deck with garage under the deck is 35.2' from the rear property line results in a mathematical deviation of 14.. 8' (30%) of the 5.0' rear yard requirement. This substantial deviation should be -reviewed only as a mathematical deviation .percentage, .because granting of . the variance will .allow the use of this property as a residence equal to that of neighboring .properties. The single-family dwelling' s location on the subject property and its relationship to the neighboring properties is in conformity with the residential . character of the neighborhood. This is especially true due to the irregular topography of ..the sub}ect property "and the fact that the front yard area and the first floor of the house are at least 10' higher in elevation than .the rear yard area. , The elevated deck in 'the . rear. ya.rd area -provides additional building exits and is a *positive addition to this property. -5- CRITERIA #4. Whether the proposed .variance would have an adverse effect or impact on the physical or environmental conditions" in the neighborhood? It" is submitted there is no evidence that. this "as built" renovated single-family dwelling with an elevated attached wraparound deck has or will have any physical or environmental impact on the neighborhood. CRITERIA #5. Whether the alleged difficulty was self-created? Yes, the renovation of this storage building into a single- . family dwelling with the elevated attached wraparound deck Without the benefit of a .variance and Building Permit is a self-created hardship. It is submitted this self-created hardship should not be a 'reason for denying the requested variance, since the existence of this single-family- dwelling with its improvements in this location over many years, has not caused any negative -impact on the residential character of this . community and the surrounding. properties. B: VARIANCE REQUEST #2 (ACCESSORY STUCCO BUILDING) CRITERIA #l. Whether, an undesirable change will be produced in the"character of the neighborhood or a detriment to -nearby properties will be created by the granting of the area variance? In 1954, " this 565 sq.. ft. accessory building was moved by Frank" R. Zaleski from another location and placed on cement piers a distance of- 3. 1' from the. rear property line. . The building was . utilized as a storage building until Kevin Cierach purchased the property. He made improvements to this accessory storage building by. converting it into an accessory. apartment for himself, while he renovated the 2, 517 sq. ft. building to a single-family dwelling. , This accessory building which has remained, in: this" same location 3. 1' from the rear property line, for over 70 years has not caused any .ghange in the character of the neighborhood or been a detriment to nearby properties. Further; pursuant to the Southold Town Building Inspector' s request, this accessory building' s use has been changed back . into an accessory storage use, with no one living. in this building. -6- CRITERIA #2. 'Whether the benefit sought by the applicant can be achieved by some method, - feasible for the .applicant to pursue, other than an' area variance? To legalize the location of this accessory building to remain 'in its present location in order to obtain a Building Permit, Kevin Cierach 'has no other method to pursue other than an area variance for a 3.-1' rear yard setback. Further, there is, no practical place to move this building on the property without a variance in order to comply with the Zoning Code. CRITERIA #3: Whether the requested- variance- is substantial? The location of this accessory building 3. 1' from the rear property line is a 79% mathematical deviation of .-the 15 foot rear yard setback requirement. However, after weighing this percentage -of deviation ,in the overall- context of surrounding - properties it is not substantial, because this one-story accessory building has no direct relationship. or impact on the neighborhood and surrounding properties. CRITERIA#4. Whether the proposed variance would have -an adverse effector impact on the physical or environmental conditions in the neighborhood or district? There has not been any evidence that the existing location of this accessory building in the- rear -yard-' has any affect or impact on. the .physical or environmental conditions 'in. the neighborhood or the surrounding properties . CRITERIA #5. Whether the alleged difficulty was self-created? Ye.s, Kevin Cierach should have obtained a .variance and Building Permit when making improvements. This self-created difficulty should not in and of itself cause a 'denial of this variance request because this accessory building is now converted back to storage, which was the original use in 1954 before the,adoption of. zoning in the Town of Southold. Since there is no practical place to relocate this accessory building and be incompliance with the Zoning Code; to allow it to remain in its present location by granting the setback variance is .an obvious benefit to the property, which outweighs its removal consideriiig. there- is no detriment to the neighborhood or the surrounding properties. -7- C. VARIANCE REQUEST #3 (ACCESSORY GARAGE) . CRITERIA #1. 'Whether an undesirable change will be produced .in the character of the neighborhood. or a detriment to nearby properties will be created by the granting of the area variance?, In 1954 the prior owner, Frank R. . Zaleski•, constructed a 725 sq. ft. foundation located .18 . 6' from the rear property line along the side of a hill on 'this property. Mr. Zaleski then placed a building moved. from another property on this foundation, which he used- for storage and an office. Upon the adoption of zoning. by .the Town-- of Southold, 104 sq. ft. of the westerly part' of this accessory,building by Town Code definition became located in the side yard area. of this property. After -Keviri Cierach .purchased the property in 1994, he improved the ground level of the building into a three car garage. He , . also converted the -storage/office area on the second floor into a studio apartment.. This accessory building in its present location with 104 sq. ft. in the side yard area has not in the past .and will not in the futur'e- be a detriment to either the neighborhood or nearby properties. Due to the topography and this accessory building' s location; it is. barely visible from any of the surrounding properties. At the request of the Building Department, the second- floor studio apartment has been changed back to a storage area. CRITERIA #2. Whether the benefit.. sought by the applicant can be Achieved by some method; feasible for the .applicant to pursue; other than an area variance? 104 sq. ft.. of this 725 sq. ft. -accessory building is within the side yard area.. A variance is the- only feasible method for your applicant. to pursue to. allow this building to remain .in its present location. CRITERIA #3. Whether the requested variance is substantial? This- accessory building in its present location with 104 sq. ft. In .the side yard area is a 14-Al. deviation . from the Zoning Code. .This -variance is- not substantial when considering its location on the property with a 1 . 3% lot coverage. The building -is inconspicuous from- any of the neighboring properties and has access only from the rear yard area of the subject property,. -8- Further, this garage accessory building partially located in the. side yard area has not caused and will not- have any impact on the surrounding properties in the neighborhood. . CRITERIA #4. Whether the proposed .viriance would. have an adverse . effect or impact on the physical or ,environmental conditions in the neighborhood or: district? _ There is no evidence that the granting of this . side: yard variance, will have an- adverse. effect on the physical or any environmental conditions' in the neighborhood. Further, the only access to the second floor storage portion of the building is . by stairs from the rear .yard. . The garage entrance is also .accessible only from the rear yard. CRITERIA #5. Whether the alleged difficulty was self-created? This accessory building was originally located in -its present position in 1954 -.by the former owner. The footprint of the accessory building has existed in its present location since that time. Kevin .Cierach self-created his difficulty� by converting the building into a studio apartment and improving the garage area without permits. - However, the location 'of. this . accessory building in and of itself has not caused. any adverse problems with the surrounding properties . This self-created- difficulty should not be a reason for denial of this side yard area. variance request. The benefit of- allowing this. accessory garage/storage building to remain in its present ' location by the granting of a side yard variance outweighs .any possible detriment ,to this residential . neighborhood. It is noted this. accessory, building is presently converted' back to storage which was the original use in 1954 before the adoption of. zoning in the Town of Southold.
