Moved by Justice Evans, seconded by Councilman Murphy, it ~vas RESOLVED that the next meeting of the Southold Town Board will be held at 4:30 P.M., Tuesday, August 29, 2000 at Southold Town Hall, Southold, New York. SUPERVISOR COCHRAN: This evening I have authorized a special privilege. I had a phone call from Merlon Wiggin, and what he had to say was very interesting, and I thought I really should share this with not only the people here attending this evening, but also the television community out there, and this a 225th Anniversary, but I will let Merlon tell you about it. MERLON WIGG1N: Thank you, Jean, Supervisor Cochran, and the Town Board. This is the 225th Anniversary of one of the most unique things that have happened in this country's history. It didn't happen someplace else. It happened in Massachusetts. It happened down in Washington. It happened right here in Southold Town, and 225 years ago last Friday was the first engagement between American troops and the British, and occurred on Plum Island. How it all came about was, I will give you excerpts, that this took place. George Washington, being a pretty knowledgeable guy, is up in Boston. He had the British sttrrounded, and they were starving to death. The Americans were catching all the boats that were bringing supplies, so the British, 7,000 troops and sailors had no place to go for food, so they looked at the North Fork of Long Island, and George Washington alerted the people here, Suffolk County, Southold Town, in late July that three Men of War, 600 men had already sailed from Boston. Then this was said, Gentlemen, Enclosed a copy of a letter l~om General Washington to General Worster we think it is not unlikely that the designs of these ships may take advantage of different parts as Montauk and other parts of the east end are much exposed. Th/s tells us that you may such methods for securing the shore as you judge necessary. In the Southold Town Committee nether responded, and writes to the Congress as follows. Southold, New York, August 7, Sir, our situation such that we are obliged to call upon the honorable Congress for their immediate assistance. Yesterday thirteen sail, eight of which are supposed to be ships-of war was seen to be crossing the whole day between Montauk and Fishers Island, are this morning riding at anchor between said island and Oyster Ponds. We are in hourly expectation of their landing at Oyster Ponds. We are unable to defend ourselves, and are destitute of power. I think this is amazing. Things didn't move very rapidly back then. George Washington didn't have a cell phone. He didn't have a telephone, but within a months time after he took command on July 3rd he had cut off troops here in Southold Town, and then he sent John Wooster, who was a newly Continental General here to Southold to defend this part of the Island against the British. He came here was he was destitute of power, so he landed his troops at Oyster Pond, which is now Orient, which is where the Yacht Club is, and landed on the 7th, and on the 9th, two days later he sent a fast sailing ship to New London to pick up powder. The British was anchored full force in Gardiner's Bay. That sloop was back here the next day with 300 pounds of powder. Then on the 11th of August, which is 225 years ago last Friday General Wooster found out the British were landing on Plum Island, and were loading sheep. He sent troops across Plum Gut, landed near where the lighthouse is now. They had a brief engagement. They fired one volley, and no one was killed on either side, and then they retreated, because British ships came through Plum Gut and cut them off. I would like to read you General Wooster report of that engagement. He writes to Washington, and to Governor Trumbull, who was then the Governor of Connecticut. Sir, on the l0th, which he was thanking the Governor for his powder. The 300 pounds of powder, which I received, (unintelligible) the last Friday, August 11th, it lasted the war. Twelve transports, twelve ships of the British sailed all the way around Plum Island. After they got through the Gut I sent 120 men in three boats, which were all the boats we had then had, to said island, if possible to gel off the stock, with orders to remm immediately upon the first appearance of the enemy's attempting to bring away any of their shipping between the island and Oyster-Pond Point, lest their retreat might be cut off. This is not hand down stories. These are actual copies of dispatches written back in the 14th of August, 1775. These are all in the American archives. These are verbatim reports. Once we got to said island to possible get off the stock. All of us returned immediately upon the first appearance of the ship between the Island and Oyster Ponds Point. The day before by the way the British had captured a boat out of Orient Point to take the sheep off the boat. It being impossible to support them in out boat the full last boat got over to Plum Island. They were observed to be returning, and when the tide (unintelligible) Behind that after which a cannon fired at her at so great a distance they did no damage. A cutter came with fifteen or twenty, but discovered that there were armed men in the boat, these were American men in the boat, stopped their pursuit. The soldiers in the boat and soldiers on the beach fired at them. It had little affect because our boat was obliged to make all sail possible to keep out of the reach of the cannon on the Ship of War, which was behind us. That was a pretty exciting scene if you picture this. They then came to anchor between the point in the island, and that night took from the island cattle and joined the fleet, which came early Saturday morning. I suppose had gone to Boston. The next day they must have tried to save the rest of the cattle and sheep. They were unsuccessful. This is not the only account of that incident. Another one was written on August 16th, and this was written by someone in Southold Town, and said, to the best account, and this is the title of it, expedition (unintelligible) in the British Colonies plundered Fishers Island and Block Island. Seven transport ships, two brigs, two man of war, ten guns, seventeen men, and two hundred regulars assisted by ten villainous Tories from Southold took off the stock. They took the stock from Gardiners Island and Plum Island. As far as Plum Island, the last prize they took off there was one prize (unintelligible) one of the people from Orient, and then there five hundred of General Worchester's provincials who had landed on the other side. (unintelligible) They retired to the mainland, and the cattle were then taken off the island. Two hundred and twenty-five years ago today, which is this is Tuesday, three more transports appeared in sight on Tuesday morning, which would be two hundred and twenty-five years ago today, sailed out to meet them. I think that is kind of interesting history that took place. It was the first landing of American troops under fire, and the reason we call them American troops was that America was not formed until June, 1775, and George Washington came in on July 3rd, and one of the first things he did was worry about this Southold Town as being the supplier of food and sheep to the British. This has been research done not by me. SUPERVISOR COCHRAN: You have an article in the Long Island Boating World on this. MERLON WIGGIN: Also, Bill Meyer researched this, and he talked with the Navy, Annapolis, and the United States Navy Institute published a repeat of this whole story. I will give each on of you a copy. SUPERVISOR COCHRAN: I love it. We don't always look to the sea from some of our history. We brought you your historic minute. Thank you, Merlon. MERLON WlGGIN: The only thing I will add is George Washington felt this was so important to his cause that some of the stories report that one third of all the powder hi all the Colonies would be in Southold Town during the month of August. Wt. COMMUNICATIONS. SUPERVISOR COCHRAN: Communications we have a letter from Councilman in the Town of Huntington, Mark Cuthbertson in relation to tobacco advertisements by our schools, and we have a hearing on that this evening. A letter to myself from Gail Horton and William Mills Wt re a thank you from the MIR, the Russian ship for the contributions that Town Hall and the Police Department collected when we heard that the cadets had very little money, and they would come on shore with perhaps a dollar in their pocket. They get paid a dollar a day. Greenport immediately went into action, and got donations from the community. We also took part in that. They are going to continue that. They are going to continue collecting things that can be used next year. I understand that Greenport will be inviting the same ship back, and just clothing, old computers, outdated computers, different things that can be taken back with them to Russia. Also got a letter from Governor Pataki thanking us and congratulations on our preservation program. As you know he has out here several weeks ago, and we presented him with some of our local wine, so this was a thank you not only for the wine, but in relation to the preservation that is being done in the Town of Southold. Also with him was the Commissioner of New York State Ag and Markets. Also, thanking us for our hospitality and he said we have one of the best conservation programs in New York State. A letter to myself from Hamlet Greenberg in relation to a job well done. Gillian William from the Dog Shelter, the call was in relation to a snake, and not only the shelter but the Police Department were very helpful with this lady and the snake, and it was okay snake. It wasn't poisonous, so it was released, but there was some concern for a while so sometimes we take care of more than dogs and cats. 1. Mark Cuthbertson, Councilman from the Town of Huntington, in regard to a campaign to encourage municipahties to adopt a local law that places restriction on tobacco advertisements. 2. V. RESOLUTIONS. SUPERVISOR COCHRAN: As you the know the Town Board has a policy in relation to the resolutions, which we will be begin to act upon. If there is anyone that would like to address the Town Board in relation to any of the resolutions on the agenda we will do that now. There is time later in the meeting for anyone that would like to address the Town Board on any given Town business, anything over and above what is one the agenda. So, at this time, I will ask if there is anyone that would like to share with the Board any comments in relation to the resolutions that we will be acting upon? (No response.) This resolution was duly ADOPTED. 8.- Moved by Councilman Murphy, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Town Clerk Elizabeth Neville to advertise for college students to work as seasonal clerks in the Office of the Receiver of Taxes collecting taxes in December 2000 through the holidays and again in May 2001 until June 10, 2001. This resolution was duly ADOPTED. 9.- Moved by Councilman Richter, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes submission of a 2000 proposal to the New York State Department of Agriculture and Markets, whereby the Town of Southold proposes a cooperative effort to acquire the development rights to agricultural properties which have been submitted by their owners to the Land Preservation Committee of the Town of Southold for sale of such rights to the Town of Southold, in accordance with the terms of the Agricultural and Farmland Protection Program. 9.- Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanelli, Councilman Moore, Justice Evans, Supervisor Cochran. This resolution was duly ADOPTED. 12.- Moved by Councilman Moore, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby declares the following list of items as surplus property at the Southold Town Police Department: Approximately 200 bicycles to be sold in numbered lots of approximately ten (10) bikes per lot; Five (5) "Sunfish" type boats; tow (2) dinghies; One (1) paddle Boat; One (1) Aluminum box boat; One (1) Hobbie Cat Hull Boat; Six (6) Mushroom Anchors; and be it FURTHER RESOLVED that the Town Clerk Elizabeth Neville be authorized and directed to advertise for bids for the sale of this surplus property. 12.- Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanelli, Councilman Moore, Justice Evans, Supervisor Cochran. This resolution was duly ADOPTED. 3.- Moved by Councilman Romanelli, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Jean W. Cochran to execute an Amendment of Agreement that will permit the Mattituck Chamber of Commerce to modify their Downtown Revitalization Program Grant Proposal. 3.- Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanelli, Councilman Moore, Justice Evans, Supervisor Cochran. This resolution was duly ADOPTED. ti. - Moved by Councilman Romanelli, seconded by Councilman Richter, WHEREAS, the Town Board of the Town of Southold has retained Albrecht, Viggiano, Zureck and Company, P.C. to conduct the audit of the financial statements of the Town of Southold for the year ended December 31, 1999; and WHEREAS, Albrecht, Viggiano, Zureck and Company, P.C. has recommended that procedures be implemented to require Dual s~gnatures on all checks issued by the Tax Receiver's Office to ensure that the same individual does not perform each function, now therefore be it RESOLVED that the Town Board of the Town of Southold concurs with the recommendation of Albrecht, Zureck and Company. P.C. and hereby requires dual signatures on all checks issued by the Tax Receiver's Office in excess of $1,000 effective August 16, 2000. .-Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanelli, Councilman Moore, Justice Evans, Supervisor Cochran. This resolution was duly ADOPTED. 15.-Moved by Justice Evans, seconded by Councilman Richter, WHEREAS, the Town Board of the Town of Southold has retained Albrecht, Viggiano, Zureck and Company, P.C. to conduct the audit of the financial statements of the Town of Southold for the year ended December 31, 1999, and WHEREAS, Albrecht, Viggiano, Zureck and Company, P.C. has recommended that compliance with the Davis Bacon Act be properly documented and construction contracts verified to ensure that prevailing wage rates have been paid, including procedures that follow up site visits, wage rate updates and interviews with laborers and mechanics, now therefore be it RESOLVED that the Town Board of the Town of Southold concurs with the recommendation of Albrecht, Viggiano, Zureck and Company, P.C. and hereby establishes a procedure to test construction contracts and subcontracts to verify that the prevailing wage rate clauses are included within the context of the contracts in excess of $2,000 and funded with federal funds. Furthermore, the procedure include testing payrolls paid against the prevailing wage rates established by the Department of Labor applicable to the Town at the time of the payroll. Documentation verifying the procedures are to be maintained on the file in the department initiating the contracts. 15.-Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Romanelli, Councilman Moore, Justice Evans, Supervisor Cochran. Action taken: We concur with the recommendation, and require dual signatures for all checks issued by the Tax Receivers Office in excess of $1,000 effective August 16, 2000. FINDINGS-FEDERAL AWARD PROGRAM AUDITS 99-2 Community Development Block Grant Program-CFDA No 14.218 Recommendation: Compliance with the Davis Bacon Act should be properly documented and construction contracts should be verified to ensure prevailing wage rates have been paid. Follow up site visits should be instated, wage rates should be updated and interviews with laborers and mechanics should be conducted: Action Taken: The Town set up a procedure effective July 1, 2000 to test construction contracts and subcontracts to verify that the prevailing wage rate clauses are included within the context of the contracts in excess of $2,000 and funded with federal funds. Furthermore, the Town will test payrolls paid against the prevailing wage rates established by the Department of Labor applicable to the locality at the time of the payroll. SUPERVISOR COCHRAN: At this time I ~vould emertain if there is anyone that would like to address the Town Board on any Town business we would be very happy to have it presented to us at this time. Yes, sir? Please, state your name so it can be recorded. BOB O'BRIEN: Bob O'Brien from East Marion, Citizen of Marion Lake. I am happy to see that we can finally get some funding to do something on Marion Lake. The only thing is I wonder, I know testing of a single house cost $350 just to do minimal testing for a house. How much testing are we going to get for $1,0007 SUPERVISOR COCHRAN: This is at the recommendation of Chris Pickerall, who works with Cornell University, and as you all know when we all went down there that day, you know, Highway, your people, different government agencies, and so forth, Comell, after that meeting Chris offered to develop some kind of strategy plan so we can begm to not only look at the lake, but perhaps work to bring it back. It is going to take a long time. It is a big job. It is like a sink without a drain. BOB O'BRIEN: I have been working on it for three years. SUPERVISOR COCHRAN: Right. Some testing has been done. Chris feels that there is additional testing. BOB O'BRIEN: One test was taken by the Peconic Estuary Program. SUPERVISOR COCHRAN: Chris Pickerall has been, I believe, taking tests. Cornell has taken tests, yes, and he has recommended this next series of tests. BOB O'BRIEN: The only thing I can say is he works very cheap at $1,000. SUPERVISOR COCHRAN: It is his proposal. BOB O'BRIF, N: I was just wondering how come we are not doing anything concurrently. We are just like addressing the road runoff on Bay Avenue and up at 25. I mean, those are known sources of pollutants. Why aren't we addressing them at the same time? SUPERVISOR COCHRAN: I believe the Highway Superintendent is also working on this. I believe the Town Engineer is also working on this. They are working, developing, looking at what we can do. BOB O'BRIEN: Do you know the status of that? SUPERVISOR COCHRAN: Not at this point, no. BOB O'BRIEN: Because we were supposed to have a meeting with myself, and all the experts in the field, are going back for a meeting out at the lake, we were supposed to schedule that. In the next month or so, I think it has been about three months since we met out there. SUPERVISOR COCHRAN: We are working with what Cornell is telling us, and our Engineer, and our Highway Superintendent, and if you would like a meeting we certainly can set one up. BOB O'BRIEN: They are working with the State Highway Department also. SUPERVISOR COCHRAN: They are working with everyone that I know. BOB O'BRIF. N: What are we doing with land acquisition as far as the west side of the lake as far as the pristine land there? SUPERVISOR COCHRAN: I don't think we have gotten that far. I don't believe that has been discussed, or we have gotten that far. This is the first I have heard of it. 5O COUNCILMAN MURPHY: No. There was a proposal on a piece that went to Land Preservation Committee. They are waiting for a response from the owners on that. Yes, it is being worked on. BOB O'BRIEN: Was that addressed to basically the west side of the lake? COUNCILMAN MURPHY: Yes, there were one or two big pieces there. BOB O'BRIEN: The ones that have the most perimeter on the lake. COUNCILMAN MURPHY: Right. SUPERVISOR COCHRAN: If you would like a meeting for an update we certainly can arrange that. Would you, please, supply me with a list of how you would like to attend with your people? BOB O'BRIEN: Yes, I guess Marilyn Quintana would be one of them. SUPERVISOR COCHRAN: We also have Suffolk County Vector Control involved. They are going to be doing that corrective barrel come fall, September, October, they have scheduled it. We are going to have to have cooperation from neighbors, going to have to do bi-testing, cesspools, the whole bit to find out exactly where the pollution is coming from. This is all the things that are being put into place. BOB O'BR~N: I am glad to see the Town is progressing. Thank you very much. SUPERVISOR COCHRAN: Thank you. Anyone else like to address the Town Board on any Town business? REVEREND CORNELIUS FULFORD: My name is Reverend Cornelius Fulford. I am the Pastor of the First Baptist Church in Cutchogue. My concern is that the water that is in this end of town. My concern, I have been in this community for eleven years, when I first came here I am in the Town of Southold, but I only here about the last year, and I have a church here, and when I first came there the water around that area was so bad that it was actually devastating, even using it for whatever it was dangerous to be honest, so we came to the town, and they told us about a filter, and we have a filter in our church. We have had it for years, and even with the filter at the church we got a letter from the Health Department, because the well was filled with particles (unintelligible) Looking at the map you are seeing where you are going to have public water. It is time you are getting public water. My concern is that the health of the people in the community should be your first priority. Once you start looking at where this water is going that your first priority would be to look at where the most dangerous, where the most water that need to be purification there before you start running water, and then people began to become concerned because the route that you taken. Why not Route 48? Why not where the water is more dangerous? I have been here eleven years, and since I have been in that church I am not saying there has been change in the water, and t am not saying it did not, but I know that seven or eight people have died from the church in the last, not even a year, and the water is so bad that the Health Department tell us do not drink the water, even boil the water, it is so dangerous. So, my concern is what we going to do when it come to the health of the people in the Town of Southold? And the route that you are running the water why not look at the people that are in a more dangerous situation. Run water there first because that is the first priority. So, my whole congregation is really concerned about this health w~se, and for the public all over. So, that is my concern. I have been working on this for eleven years since I have been here, and I have been hoping and praying to God that you will do this and put the peoples fzrst, and so that is my concern. So, I don't know what you plan on doing the future, but my concem is always look and see where the people need the help first in the Town of Southold. Will you do that? SUPERVISOR COCHRAN: Reverend Fulford, you know the responsibility of the Town Board their first responsibility is the health, safety, and welfare. Just recently we began meeting with the Suffolk County Water Authority, and the Health Department, and the Town. This is something that didn't happen. They weren't communicating. They weren't all on the same plate. We now are. We are scheduling meeting like every six weeks. In meeting with them the Health Department feels very strongly that the area by the landfill is the number one priority in the town. Some of the things they are discussing is allowing shallow wells in that area, because if you go down a short distance the water is good. It is when you go deeper and that is what they required in the past the water is not good. So, they are working and looking at ways that perhaps we can provide or have work so that people in that area will be able to have good water. It is being discussed. Brian went to the last meeting for me, because I wasn't available. Did they discuss any more about what we can do around the landfill? Now, at one point we were looking at the possibility of bringing the water from Mill Lane, but now that well is not producing what they thought it would. The Water Authority is still in the Town of Southold 51 sinking test wells from one end of the town to the other, and they are not really finding many areas with good water. What I can do is check with the committee, and see what progress has been made in relation to water in that area, because it is a priority. COUNCILMAN MURPHY: It is the top priority. It has been designated as the top priority by the Health Department and the Water Authority as to getting water there. It is just a matter of the logistics of finding the water to bring in there. As I say, as the Supervisor said, the Peconic well field which they felt was going to provide a tremendous mount of water they started pumping, and I am going to use an example, don't hold me on the figures, because I am not sure it is right, but let's say they had determined they would get a million gallons a day from that field. Welt, we can only get 600,000 gallons a day from that field because the salt level started coming up. So, there are some of the problems when they had planned that they would run, because of this amount we can mn mains here and there, while allof a sudden, so now they are looking for other areas to get that water, but that area around the landfill is the top priority for water. REVEREND CORNELIUS FULFORD: Would it be possible when you get the water that is the first area that you would supply?. Also the contour of where you are running the water. The whole community is curious about the map and how you are running it, and so I am quite sure that we would be talking more about that also, but this is my fncst priority, and hopefully your first priority also. COUNCILMAN MURPHY: It is. SUPERVISOR COCHtLAN: It is. Thank you, Reverend. (Tape change) ROBERT BOWASY: My name is Robert Bowasy. I live up on Sound Avenue in Mattituck. I want to talk about you about the tower they are building up in Mattituck. I live diagonally across the street from that. I just wanted you to know that I don't know about the legalities of it or any of that, but I do know that my neighbors, Mrs. Funn and Mrs. Simmons, and people in the general area are terrorized by this stuff. They are frightened to death of it. SUPERVISOR COCHRAN: I am going to ask our Town Attorney to give you an update as to where we are on this particular issue at this point. TOWN ATTORNEY YAKABOSKI: I am not sure you are aware there is a Stop Work Order issued on this last week, I believe, sometime. Since then I just received in my mail, I talked to the Building Inspector, Director of Code Enforcement Ed Forrester, who has also been a revocation of that permit. First we are going to see how that tums out, and then as you and I were just briefly talking in the hall, we will evaluated the options at that time. ROBERT BOWASY: The permit to building the tower is being revoked? TOWN ATTORNEY YAKABOSKI: Correct. It has been disapproved. It was revoked, and then when somebody submits an application it is either approved or disapproved. This had been approved, and a permit issued. It has now been revoked and a disapproval has been issued. ROBERT BOWASY: Does them mean he has to take it down? TOWN ATTORNEY YAKABOSKI: Take it down or come in compliance with the Zoning Law. ROBERT BOWASY: I am not aware of the zoning. TOWN ATTORNEY YAKABOSKI: The ham radio tower is an accessory use.-He would have to establish a permitted principal use on that property, which principal use would then have to have a ham radio tower as a normal accessory use to that principal use, if he can meet that criteria. I am not sure he can. I am not sure if he can. ROBERT BOWASY: Do you need a residence for that. TOWN ATTORNEY YAKABOSKI: A single family home is not a permitted use in the LI District. There was a home on that property. It is my understanding the home had been there, had a protection of pre-existing non-conforming status. However, I believe that protection was lost because the home was not occupied for two straight years, That is my understanding. I ask folks, and that is what they said, so that is now gone, so I am not going to predict the outcome. I think it would be difficult. 52 ROBERT BOWASY: I just want to say Mrs. Fuun has lived in that house longer than most of you have been alive. Somewhere in the Constitution it says we get the fight to life, liberty and pursuit of happiness, and they are not happy. [ am not happy. They were happy until he put this thing up. Mrs. Cochran you said before when the Reverend was speaking that your main concern is the health, safety and welfare of the people. SUPERVISOR COCHRAN: It still as even in relation to...sir, you are talking to the choir. We support that fact. I don't believe that tower should be in that neighborhood. Okay? When there was going to be a problem we passed a law. Unfortunately a loophole was found in the law that was taken advantage of 2 We are still trying to correct the situation. COUNCILMAN MURPHY: Somebody misinterpreted. COUNCILMAN MOORE: We will take a look at that. Our position is the Building Inspector made a mistake, and the first thing we did when it came to our attention that it was being built was, we filed our own appeal as a Town Board against our Building Inspector. We have never done that before, but that is what we did. The Town Board said you made a mistake. You have misread the law we wrote three years ago. So, we don't think it was a loophole. He found the only place that language gave him some kind of place to play in, but we don't think it is a loophole. SUPERVISOR COCHRAN: A poor choice of words. ROBERT BOWASY: It is Southold Town Law? COUNCILMAN MOORE: It is Southold Town Law. If it has to be fixed we are going to take a look at it. We don't take a look and see if it needs fixing, but we don't happen to think so. ROBERT BOWASY: I don't know if any of you have seen that. COUNCILMAN MURPHY: Oh yes. SUPERVISOR COCHRAN: I have been there several times. Alice can attest to that. She came out and told me I could go on her property to look a little better ifI had to, but we have been up there. ROBERT BOWASY: Thank you for listening. sUPERVISOR COCHRAN: You are welcome. Anyone else like to address the Town Board? HOWARD CAIN: My name is HOward Cain, and I live in Mattituck. I think you know I am interested in the towers that LIPA wants to erect on the North Fork. We would like to have a little input where the Board is concerned, a few thoughts for you to consider when you are dealing with LIPA. I know that they try and tell you that it is not feasible, not really workable, etc., etc., etc. we know those lines caUse cancer. They are going to deny it the way the tobacco companies have denied it for 35, 40 years, soi that doesn't mean anything. But just to put this table in prospective I want to take you back 100 years. I want to take you back a hundred years in Manhattan the island lost nearly half of it's pQpulation due to the fact that most of them came to New York. We had Polish, German, Italian, Jews, there were wall to wall people in Manhattan. Their transportation system was horse drawn trolley cars. They ran one in back of the other. How many stables could you have? It was a struggle when you got to lan intersection to try to cross the intersection, so there was no choiCe. They had to put in a subway. They did that around 1903. Now, that may not seem like much. You have to understand and appreciate that Manhattan is bedrock. That is why they were able to put up all those skyscrapers. They are not gQing to sink. When they built the subway it was an open pit. Why do I bring this up? Because it is a trench. The only thing is it is a bigger trench. Theirs was 100 feet deep approximately, 200 feet across. They couldn't stop transportation, and they couldn't stop commerce in Manhattan while they were digging that trench. They had to put overpasses. You Couldn't cut off the east Side from the west side. When they dug those trenches it was not like digging a trench out here when you throw the dirt on the side, because you are going to put it back in. When they dug those subways it was bedrock, and they had to haul it away. Before they could haul it away they had to use dynamite Sticks. They had pick and shovel, and they had horse and wagon. They had to haul away those rocks with horse and wagon across Manhattan, and you compare what Richard KeSsler is trying to tell you about digging a trench out here to bury some cable. He's got backhoes, diesel poWered backhoes, diesel powered earth movers, diesel powered cable pullers. My father was an electrician along with his brOther. He used to talk about Pulling cables physically. When it was too hard theY Would get a horse to pull. Richard Kessler doesn't have any problems like that. The way I see Richard Kessler has options. There is no ptlysical problems in his way. It is his choice, and he :is refusing regardless of the fact that they cause 53 cancer, all the other problems about reducing property values. He is refusing to do it. He didn't chose to do it on the South Fork. He won't chose to do it in Nassau County. He is telling you his attitude toward the public. That is what he is telling you. You are not worth it. He would consider on the South Fork. He wouldn't consider it in Nassau County. He wants to save money. Well, if he wants money tell him to ask Gullotta for the $20,000,000. That will go towards burying the cable. I don't want to hear about it is costing money or anything like that. He was choosing. What really disturbs me is that I consider it an insult. It is an insult to the Board when he will tell you a story like that, and you know a hundred years ago the horse and wagon, bedrock, they built a subway. He is trying to tell you going into the 21st century this is a major undertaking. He is insulting your intelligence if he expects you to believe it. Put him in his place. So, that is my input where Richard Kessler is concerned. SUPERVISOR COCHRAN: You sat in this morning on the Work Session. I think you heard most of what we discussed in relation to burying the lines underground, and this Town Board has not changed it's position. The only person that we have spoken to to-date is a Mr. Bill Davidson, and some of his people that ~vork around him. We have not had the oppommity to meet with Mr. Kessler. I think that is very close on our agenda. We have not really began to negotiate. They have made one offer. They would like to find what they could do for us. As far as the Board is concerned what they can do is bury the lines. We are standing firm on that. HOWARD CAIN: I know what your thinking is. I just want to have that input so that you know, what they did in Manhattan a hundred years ago. That was 25 years before the Lindbergh flew the Atlantic, you know. SUPERVISOR COCHRAN: I appreciate the material you brought in to us, too, in relation to cancer. We are going to get additional information from the agencies in the federal government that are studying this. LIPA had promised to send me some information on it's relationship to cancer, and three weeks ago I didn't get it, so when I mentioned it yesterday at a meeting they said that they would send out a copy for each Board member. I received one copy today. HOWARD CAIN: Why would we have to wait and see. SUPERVISOR COCHRAN: We are mowng legally, as we have to. Thank you. Anyone else like to address the Town Board? CHRISTIAN BAIS: Good evening, nice to see you all. My name is Christian Bais. I am a resident of Southold. I am here this evening to speak on behalf of Save Open Spaces Now 2000, which is a not for profit corporation founded with the objective of preserving the farmland, and open spaces here on the North Fork. It is our opinion that the proposed above ground changes to the LIPA power transmission line constitutes a degradation to our open spaces and scenic vistas. The franchise agreement between LIPA and the Town of Southold grants LIPA the right to provide power to the Town of Southold, but such power shall be subject to such reasonable regulation as may be prescribed by the Town of Southold. I won't repeat that quote. I will just say, quote, it is up to you guys.. SUPERVISOR COCHRAN: We are working on it. CHRISTIAN BAIS: I realize that, and we have an opporttmity here to prevent a defacing of the area by getting these things underground rather than aboveground. It is a decision just like the line that runs out here now, and across some of my family farmland, and it has been in place for, what, over sixty-five, or seventy years. Someone who made a decision seventy years ago we are looking at that decision today. Likewise the decision that you all make is the decision that our heirs, and decedents, and future vacationers and tourists won't have to look at in the future. Save Open Spaces Now believes the proposed LIPA aboveground alterations are not reasonable as significant public support has shown, any power transmission facility scheduled for upgrading. In addition, recent analysis of public health and environmental issues in several nearby communities have all lead the decision to bury the transmission lines where they were upgraded. Now I have had a direct personal experience with this in the community I used to live in a number of years ago, where TESINE Power Authority in the State of New York wanted to put up mega power transmission lines running through the community to the shoreline of Westchester and then the irony of it is that it was one of the two major feeder lines upstate New York that was to feed Long Island. They buried those lines, and to support your argument, sir, I watched them dig the trench right down the middle of the road. They dug up the macadam. The trench was no wider than my shoulders, It was no deeper than shoulder high, and they put a thousand k.d.a. through there, and that is all it takes. That is all the space you need. You don't have to move a lot, and there is no drilling, and shooting, and blasting, such as the New York City subway systems had to experience. This is dirt simple. S.O.S. now would like to go on record with our position, and we ask the Town Board to do the same as it relates to your interpretation of the provisions of the franchise agreement with L~A. I think you have indicated where you want to head with this but obviously again our future is in your hands today, and the future of both health and the vistas here rely on your hanging with the interpretation of powers that are in that agreement. SUPERVISOR COCHRAN: Thank you, Chris. I have also been communicating with Alex from your organization, and the Town Board is in addition also working, still continuing to work on the law, which will make all future lines in the Town of Southold go underground. We know we have a hard nut to crack here. Part of their claim is that on the south side part of the reason for burying was that they were putting a KV cable of the magnitude of 139. This cable will only be 69. There prediction for growth on the south shore is that they will need more power. The prediction for growth by L~A is less on the north shore, so it would only be a 69 cable. At this point the main thing that they seem to tell us, and Greg sat in with me yesterday, is the financial aspect. As far as I am concerned that is not a good enough reason, so we will continue. CHRISTIAN BAIS: Have they been able to innumerate the financial aspect of digging a trench three feet wide by five feet deep for twenty miles or whatever? SUPERVISOR COCHRAN: Part of the argument is what we do for Southold we have to do for Riverhead. So, they are looking at it as a project that encompasses Riverhead and Southold together. That is the project, and when they do the figures they feel that it is too expensive. Like I say we are not accepting that. CHRISTIAN BAIS: Well, you know it cost about $.50 to move a bank cubic yard of dirt. A bank cubic yard of dirt is like this, so let's say that three feet by three feet by sixty nine it's going to cost us a dollar, and if you have three thousand feet of that, that is $1,000, so if you have got 30,000 feet, which I need sort of the length of the Town of Southold it would probably be affective with the power lines. It is only about a $30,000 job, and they are probably telling you millions. Okay? But, the cost to do that would be something on that order. I don't ka~ow how tall these poles are going to be. SUPRVISOR COCHRAN: Ninety feet, I believe. They are taller than what is presently there. CHRISTIAN BAIS: IfI have my kayak on the bay the North Fork will look like it is sailing away if you hang sails f~om all these towers. SUPERVISOR COCHRAN: I would just like to make a clarification. Some people misunderstand what poles we are talking about. We have distribution poles and we have transmission poles, and the transmission poles are the ones they are looking to replace with taller poles. It is a single pole but it is ninety feet. Those run along north of us through the farm fields. They are the ones that have the arms, and they kind of look like robots. That is a transmission line. Those are the lines that are going to be put underneath. Many people that have called thought that the lines that we were talking about are the poles along 48 on the North Road. Those are not the poles. Those are distribution poles. There is a difference. COUNCILMAN ROMANELLI: That is next. SUPERVISOR COCHRAN: Yes, that is next. We are talking about the poles up in the farm fields although some of them, if you ride the right-of-way for those transmission lines some of them are right in people's yard, so, yes, not only aesthetics of how it looks. We are concerned about the cancer, the health also, so it is two things. So, we will continue the good fight. CHRISTIAN BIAS: No alternatives for a right of way? I mean I guess I picked up in the press somewhere the Long Island Railroad tracks. SUPERVISOR COCHRAN: They claim they have investigated that. They have investigated along the highway. What else would you say they have investigated? TOWN ATTORNEY YAKABOSKI: It was the railroad tracks. I think it was a couple of options involved in the raikoad tracks, one underground, one aboveground. It was Route 48, and there was the existing right of way north of 48 back to the farm fields. Those are the four at the top of my head. CHRISTIAN BIAS: Has there been a map published of this proposed line, or the area? SUPERVISOR COCHRAN: They would go where the old ones are. That is their right-of-way. So it would be in the same spot. It would just have a different look and be much, much taller with lots of lines hanging. 55 CHRISTIAN BIAS: Or no breaking of the vista otherwise. SUPERVISOR COCHRAN: So, at this point, it is just starting to get to the point of hard ball, which we are preparing for. CHRISTIAN BIAS: This is to go to the Greenport substation, or how far east? SUPERVISOR COCHRAN: The Greenport substation, and they are talking about another cable across the Sound to bring the power down from north of us. That is basically it at this point. CHRISTIAN BIAS: Their proposal is to just simply put in an additional 69 kva line? SUPERVISOR COCHRAN: Yes, 69. CHRISTIAN BIAS: On top of the existing one. TOWN ATTORNEY YAKABOSKI: There is the one in the farm fields is a 23 kd. What they want to do ~s upgrade that to 69 kd. SUPERVISOR COCHRAN: On the south shore they went to 130. They expect much more growth and use there than here. CHRISTIAN BIAS: Do we need? SUPERVISOR COCHRAN: I hope we don't grow to need 38. CHRISTIAN BIAS: Did we utilize the 23? COUNCILMAN ROMANELLI: I think they feel that is pretty well maxed out. At least that is what they tell us. CHRISTIAN BIAS: We solved our growth issue. COUNCILMAN MURPHY: No water. No power. SUPERVISOR COCHRAN: During the conversation he said, well, you can have electricity or candles. Said the wrong thing, believe me. Anyone else like to address the Town Board? ALICE FUNN: Alice Funn. The tower is right in my yard. I don't feel good about it. I am sorry he started it, but I just hope that everything works out. How long will it take for this to clear up? How long will it take? TOWN ATTORNEY YAKABOSKI: Actually at the moment it is not an Appeal. It has been revoked, and then we are going to looking at the options of how to get rid of it, take it down. ALICE FUNN: Do you have any idea how long? SUPERVISOR COCHRAN: It is going to take a little while, Alice. TOWN ATTORNEY YAKABOSKI: It is not fair to you. I can't predict it. ALICE FUNN: Months or years, or what? TOWN ATTORNEY YAKABOSKI: Hopefully much sooner than later. I don't know the answer I don't know the answer. I can't give you an answer. We will try to get it down as soon as possible. ALICE FUNN: I am just not comfortable with that there. TOWN ATTORNEY YAKABOSKI: I don't blame you. I have been by it myself several times. ALICE FUNN: It is just too much. TOWN ATTORNEY YAKABOSKI: It is right there, right on top of the houses. ALICE FUNN: It is not safe in my back yard. SUPERVISOR COCHRAN: We know. We know all that, and we completely sympathize with the situation, and We are moving as quickly as can on it, and we are all of the same mind that we want to see it down, and I think you are too, Alice. ALICE FUNN: Yes. Thank you. SUPERVISOR COCHRAN: Anyone else like to address the Town Board? (No response) If not, I will call for Board reports starting on my left. Craig Richter, do you have anything to report at this time. COUNCILMAN RICHTER: I don't have any this evening. SUPERVISOR COCHRAN: John Romanelli? COUNCILMAN ROMANELLI: Just on the computers in the town. We are moving at a speed now that I never thought was going to happen. We are getting closer. I think the only thing that will hold us up at this point is the Bell-Atlantic. If Bell-Atlantic goes on strike we are going to lose our phone lines. That's a slowdown, but otherWise we are moving very fast. SUPERVISOR COCHRAN: I understand it is going well. Louisa? JUSTICE EvANs: Just that last Wednesday instead of me having to commute over here from Fishers Island I had everyOne commute over to Fishers Island. Hopefully everyone enjoyed themselves. It was a great opportunity for people of Fishers Island to have a chance to meet with the local State and County officials. So, I appreciate them all coming, and I hope that they all had good time. SUPERVISOR COCHRAN: Mr. Moore? COUNCILMAN MOORE: No report tonight. COUNCILMAN MURPHY: I happen to spend Monday with the Tree Committee out in Orient along with a representative from LIPA, and a representative from the New York State Department of Transportation; and we were looking at the trees that over a period of time have been cut and hacked and some dieing unfortunately, not because of what was cut, but just over a period of time and the damage that has been done. You will notice some ribbons on the trees if you fide along the right-of- way, There is a red ribbon, which is one that is on the tree that is going to come out very quickly, very soon. A white one is going to be monitored to see it's growth, and maybe some remediation done to see if the tree can be saved, and something without any marking on it of course will remain where it is. There is also a proposal to replace trees and plant new trees along by Key Span, however these will be done in conjunction with the property owners. They will not be planted unless the property owners are in agreement that they want the trees, and they are going to be placed in such a way, and such tight trees they will not interfere with the power lines. It is unfortunate that this was done, but a lot of it unfortunately was very necessary. There were limbs overhanging a lot of those wires. I know from personal experience about fifteen years ago after a hurricane I spent fourteen days without power at my house for the simple reason of a couple of very large trees that have never been trimmed back came down and took the wires down. So, I am not happy that it was done, but it was done and we are trying to do everything we can to remedy the situation and try to bring back the vista along 25 in that area. So, it was a very good meeting I thought trying to remedy the situation. SUPERVISOR COCHRAN: This is the Tree Committee that we have here in Southold Town that is working with the DOT and LIPA in relation to replacing the trees. I believe they have the right to cut twenty feet around the wires, so any distance from the wire to twenty feet theyjust hack. I don't think they have ever been to school on how you trim trees. In addition I met last Wednesday, we went over to Fishers Island as Louisa reported, and I would like to thank the Fishers Island Ferry District for our transportation, and the school for use of the building, and my staff for arranging the hamburgers we enjoyed at noontime. Prior to getting on the boat to go to Fishers Island some of the Planning Board and myself met with the DOT in Orient. We are requesting a No Parking sign as you go down to the Orient Ferry On the left hand side. The cars block the highway time and time again. We requested of DOT that be changed to No Parking. The ferry company does not have a problem with it. The DOT had a problem with'it. They felt it wasn't necessary. We argued that point. Also, I ask for the big green sign to be removed that says, welcome to the State of New York. It is the ugliest thing I have ever seen, and the County owns that property fight there, and they have given us permission to clean up the area. They will move the fence back. We will make it more a park effect, so that when you come off the boat and youi are coming into Southold Town for the first time it certainly will be a lot more attractive with the Welcome to Southold sign, and the park sign. They would be arranged in a way with 57 plantings and so forth that will be a lot more attractive. The gentleman from the DOT, his response when I asked that the sign be taken down, his response was, don't you know that sign cost the people of New York a lot of money. Well, that wasn't the right answer to give. l am writing a letter to his superior. That is an attitude that we do not tolerate. The DOT has changed and this is the first gentleman in the last couple of years that had this attitude, but the group itself is easier to work with. They are working with us on the Eastern End Transportation Committee. This one gentlemen that must be left from the old system, but we would like to get that cleaned up. As I said to him, anywhere in New York State? He said, when you come into Pennsylvania there is a big sign. I said, leave it m Pennsylvania, because this is a country road. This is a country road. This isn't a throughway. This isn't a four-lane highway, so hopefully in the next year we will see some improvement down there as it should be. Also, we met with the DOT, and this is another arm of the agency, and these guys couldn't have been better. This is the group that is going to dig out the area down by the Chamber booth. As they fix the highway what they were looking at was putting two sumps, one on each side, and we know that sumps aren't always the most attractive thing in the world, and as we met with the DEC and the DOT, we talked about the possibility of putting a pond there, because we have a lot of runoff that comes down from Moore's Woods, and there is a stream if you notice that goes across that property down there, so what is going to happen is it is going to be all excavated in the next year, about a years time, and a pond will form, and DEC wants to stock it with fish se we can all go fishing, and it is just gong to be visually more attractive entrance into Greenport. Also I attended the dedication for Andrew L~in, the park down at the synagogue. It was very lovely, and of course when we lost Andrew through an accident it was very sad for not only the family but the community, but a lovely park has been dedicated to his memory, and if you are down in Greenport make a right on 4th Street. Just go dawn. It is a very peaceful and very lovely park. I met with the Southold Sound Homeowners on Saturday, the 5th, up on the Sound bluff. They are very concerned with the erosion in relation to the erOsion being caused by the Mattituck Inlet, which is a Federal owned jetty. So, they are looking for money from the Federal government to solve the problem up there of the erosion along the Sound bluff. Yesterday I went to Huntington for a press conference in relation to support from the ten Supervisors in Suffolk County. As you may or may not know the Suffolk County Legislature passed legislation, which they had their settlement with LIPA due to overpayment. Southold Town was going to get $337,000 as a pan of the settlement, Southampton a million something, Hunting[on about the same. It was designated to be used for affordable housing. In the resolutions also, that they passed they designated the Town of Huntington would do a project, and where it would be located. It was felt very strongly by the Ten Town Supervisors that they were infi'ingmg on Home Rule, that they did not have the right to tell loCal municipalities ~vhere a project shall be situated. So, we had a press conference, and we have stated our position. We have asked Mr. Gaffney to rescind the legislation, the resolution. This is not an issue of affordable housing. This is an issue of Home Rule, and the people that you elect to make these decisions, so we haven't heard the end of that. I understand that we have support, and we will keep you updated as to what is happening with that. We would like to see it vetoed, and then presented again by allotting the same amount of funds but not dictating how they should be used, or where they should be located. It has been busy. We have all been busy. We have lots more on our calendar and we have had a Work Session since nine o'clock this morning, so I will entertain a motion to, adjoum.
