Yakaboski. 9:00 A.M. - Appointment - Justice William H. Price, Personnel (Executive Session; 9:30 A.M. - Appointment - SUperintendent of Highways Raymond L. Jacobs (Executive Session); 10:00 A.M. - Appointment - Conference call with Matthew Leibowitz (Executive SeSsion). On motion by Councilman John M. Romanelli, seconded by Justice Louisa P. Evans, it was RESOLVED that the Town Board of the Town of Southold hereby enters into Executive Session at 9:12 A.M. for the purpose of discussing Personnel specific individuals, Litigation, Contracts, and Acquisition of Property. Vote of the Town Board: Ayes: Councilman Richter, Councilman Romanelli, Councilman Murphy, Justice Evans, Supervisor. Cochran. Also present: Town Clerk Neville and Town Attorney Y. akaboski. The Town Board convened for a break between 10:50 A.M. and 11:05 A.M. Executive Session continued until 12:40 P.M., at which time the Town Board recessed for lunch. 1:20 P.M. The Town Board discussed IV. For Discussion Items as follows: IV. 1. Domestic Partner Medical Coverage. This will be referred to Richard Zuckerman, re: negotiations. IV. 2. Exemption of Transfer Tax - Rosenstone/Lieb. The 2% law makes no provision for apportionment. The Town Board discussed whether or not it should be exempted. The Town Attorney said that the county gives it two separate tax map numbers. Councilman Murphy said that the intent of the law is to preserve farmland and open space. Assessor Chairman Robert Scott was asked to come into the work session on this discussion. He was apprised of the question: You have 96 acres of farmland, separate off2 acres with the house. Can the two acre parcel be included in the Agricultural District? Chairman Scott answered no. Farmer to Farmer is not exempt unless the land is committed to some kind of program. Supervisor Cochran directed that this matter be sent to the Attorney General for an opinion. Councilman Murphy said that when people come in to talk about farmland preservation, you must guide them and advise that there are other solutions out there. The Town Board directed the Town AttorneY to formulate a form to cover this and present it to the Town Board members before it is sent to the Attorney General. for an opinion. IV. 3. Rental Law proposal was presented to the Town Board modeled after the Town of Riverhead's code. Councilman John Romanelli and Justice Louisa Evans were not in favor of the law as .written because they did not think it would solve the problems. This local law will be sent to the Code Committee for review and revision. IV. 4. Ham Operators request for exemption t~om a portion of the Telecommunications Law. The Town Board agreed and directed the Town Attorney to prepare an amendment to this local law. IV. 5. Community Preservation Fund - Agricultural District Exemption. This was already discussed during IV.1. IV. 6 Interview Dates for Public Safety Dispatcher II will be set by Councilman Richter. IV. 7. Set date for Public Hearing Re: Transportation Commission (See ResolUtion No. 34.) IV. 8. Set date for Public Hearing Re: Chapter 100, Section 13, Bed & Breakfast. (See Resolution No. 35.) IV. 9. Set date for Public Hearing Re: Chapter 100, Yard, ~ont (See ResolUtion No. 36.) IV, 10. Town Attorney update on PLT's will be presented at next meeting. IV. 11. Scavenger Waste Facility Update by Councilman Romanelli. The pumps froze up and the plant was closed for a few days last month, not 16 days as it was rumored. IV. 12. Interview Dates for Planning Board member will be set by Councilman Richter and Planning Board Chairman Bennett Orlowski will be consulted. Councilman Romanelli advised that Jim Nelson of ACS computer consulting company will be conducting the telephone interviews with the department heads on February 14, the day before his appointment with the Town Board. Mr. Nelson will determine the wants and needs of the departments through these telephone interviews and then discuss possibilities with the Town Board on February 15. (See Resolution No. 37.) 2:31 P.M. The Town Board reviewed resolution numbers 1 - 37 to be voted, up during the regular 7:30 P.M meeting. Amendment was made to resolution no. 31 on the top of the second page, unlisted action was changed to Type 11 action at the direction of the Town Attorney. On motion by Justice Louisa P. Evans, seconded by Councilman William D. Moore, it was RESOLVED that the Town Board of the Town of Southold enter into Executive Session at 3:03 P.M. to discuss Personnel, a particular person. Executive Session and work session ended at 4:15 P.M. REGULAR MEETING A Regular Meeting of the Southold Town Board was held on February 1, 2000, at the 'Southold Town Hall, Main Road, Southold, New York. This resolution was ADOPTED. 2 I. REPORTS. SUPERVISOR COCHRAN: As you know the different committees and different departments supply the Town Board with reports each month. They are on file in the Town Clerk's Office. They are available to the public. If there is any information you would like, please, feel free to come and see us. In reading the North Fork Animal Welfare League, the Shelter, I noticed on top of their synopsis Oyster Pond continues to support the North Fork Animal Welfare League through Newsday Future Corp Project, and the students and facility sold poinsettias with the proceeds being donated to the Shelter. I would just like to say, thank you to the students at Oyster Ponds, and we always encourage, and I think it is nice that students get involved in the community, and have a project, so I was delighted whc~n I read that. In addition to reports each month we are notified for public notices of which there are none this week. II. PUBLIC NOTICES. None. III. COMMUNICATIONS. SUPERVISOR COCHRAN: Communications, we had a letter from Senator Charles Schumer in relation to the support of the land and water conservation fund, a letter from one of the citizens in relation to the problem with the heating up at the Recreation Center. Ray Jacobs, our Highway Superintendent, is in charge of buildings.and grounds, and that is being looked at, because it is cold most of the time, and we are going to solve the problem one way or another. A letter from Mike LoGrande with greetings and his annual report, and also a letter from Frank Trotte, which is the Senior Newsletter, and what it can do for us. Also a letter of thanks to the Highway Department and Superintendent Jacobs for a job that he was responsible for, so we thank those people for appreciating the good job of our Highway Superintendent. 1. Senator Charles Schumer in regard to Land and Water Conservation Fund. 2. Jack Wills, Southold Senior Citizens Club in regard to heating system at Recreation Department. 3. RESOLUTIONS. SUPERVISOR COCHRAN: We had a lot of work today. We really did. We started at 9:00, and we went to late this afternoon, and discussed many, many things. Some of those things we will report to you this evening. A lot we will be acting on as far as resolutions are concerned. As you may or may not know the Town Board has a Town Board policy in relation to the resolutions that we take actions upon. That is that prior to the adoption we would be very happy to hear your input or your comments on any of the resolutions, which appear on your agenda. Is there anyone that would like to address the Town Board at this time in relation to any of the agenda resolutions? There is a period at the end of business where we will accept comments from the public on any given topic that is town business. Anyone like to address the Board in relation to resolutions? (No response.) If not, we will begin the passage of the resolutions. Number one? Moved by Justice Evans, seconded by Councilman Richter, it was RESOLVED that the Town Board of the Town of Southold hereby separates James Rodney Douglass from his employment as auto mechanic III pursuant to Civil Service Law Section 71 effective February 1, 2000. This resolution was ADOPTED. SUPERVISOR COCHRAN: A lot of these modifications to the Budget are for the '99 Budget, our Comptroller John Cushman is trying to close out the books, so we are balancing everything. We'll be having quite a few of these this evening. Hopefully on the '99 budget that will it. Number six is a resolution in relation to reinforcing our commitment against bias, and bigotry, and prejudice. 2/01/20 4 6.- Moved by Supervisor Cochran, seconded by The Entire Town Board, WHEREAS, in light of the recent spate of hate pamphlets distributed in Southold High School, the Town Board wishes to reaffn-rn its position that no form of bias, bigotry, or prejudice is acceptable in Southold; and WHEREAS, the Town of Southold is enriched by the diversity of its population; and WHEREAS, the Town is a mosmc of people from many different racial, religious, and ethnic backgrounds, and intergroup harmony is important to the security of every community; now, therefore be it RESOLVED that the Town Board, together with the Southold Town Anti-Bias Task Force, is committed to reducing tension, eliminating prejudice, and fostering respect and tolerance throughout Southold Town; and be it further RESOLVED that in every instance the Town Board shall stand against bias-related incidents of any kind and shall combat intolerance agmnst any persons because of race, ethnicity, age, disability, gender or sexual orientation. SUPERVISOR COCHRAN: We were very sad to hear about the incident over in the school in relation to the pamphlets that were distributed, and some one said to me, well, they weren't really bias, but anytime a written document attacks another religion that is discrimination. We try to understand one another's religion, although it may be different from our own, and that is part of living and working together. So, I am sure the Town Board supports this resolution. 6. - Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Moore, Justice Evans, Supervisor Cochran. This resolution was ADOPTED. 7. - Moved by Councilman Moore, seconded by Councilman Murphy, it ~vas RESOLVED that pursuant to Article IX of the Constitution, the Town Board of the Town of Southold hereby requests the enactment of Senate Bill No. S. 2760 and Assembly Bill No. A. 4883, entitled "AN ACT to amend Chapter 246 of the laws of 1916 relating to the extermination of mosquitoes and the establishment of districts therefore, in relation to authorization for the amount of the annual appropriation by the Town of Southold for the Orient Mosquito District". It is hereby declared that a necessity exists for the enactment of such legislation, whereas the Town Board does not have the power to enact such legislation by local law. 7.- Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Moore, Justice Evans, Supervisor Cochran. This resolution was ADOPTED. 8. - Moved by Councilman Richter, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby grants permission to the American Diabetes Association to use the following Town Roads for their ninth annual "Tour de Cure" cycling event on Sunday, June 11, 2000, from 7:00 A.M. to 3:00 P.M., provided they file with the Town Clerk a One Million Dollar Certificate of Liability Insurance naming the Town of Southold as an additional insured: Peconic Bay Boulevard, Bay Avenue, Wickham Avenue, Grand Avenue, Mill Road, Oregon Road, Cox Lane, Bridge Lane, Mill Lane, Soundview Avenue, Lighthouse Road, Moores Lane, Village Lane, King Street, Narrow River Road, Orchard Street, and Tabor Road. 8. - Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Moore, Justice Evans, Supervisor Cochran. This resolution was ADOPTED. 2. - Moved by Justice Evans, seconded by Councilman Moore, WHEREAS, the Fishers Island Ferry District has recommended the granting of two easements to the City of New London, Connecticut on real property owned by the Town of Southold for the purpose of the Fishers Island Ferry District in New London, Connecticut; and WHEREAS, the first easement provides the City of New London access over real property owned by the Town of Southold in connection with the City's development of the New London Waterfront Park and the Town of Southold will receive an easement over City real property for the purpose of expanding the entrance to the Fishers Island Ferry District Terminal and a second easement granted over abandoned wharves for the purposes of educational exhibits which will afford the Ferry District use and access to the improved wharves; and WHEREAS, the Fishers Island Ferry District does not require these easements for Ferry District purposes; and WHEREAS, the easement received from the City of New London as consideration for the Town's:granting of the two easements described herein is fair and reasonable; and WHEREAS, the Fishers Island Ferry District has held a public hearing on this matter on January 25,2000 pursuant to Town Law Section 198(12); and WHEREAS, the Fishers Island Ferry District has passed a resolution recommending the granting of said easement (attached hereto); now, therefore be it RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Cochran to execute any documents necessary to grant said easements all in accord with the Town Attorney. 2.-Vote of the Town Board: Ayes: Councilman Richter, Councilman Murphy, Councilman Moore, Justice Evans, Supervisor Cochran. The Town Board finds that each year thousands of seasonal residents and tourists visit the North Fork of Long Island seeking to enjoy coastal waters, beaches, and the pastoral landscape of agricultural lands, gardening centers, wineries and horse farms. Tourism provides a stimulus to local business economy which increases the quality of life for local residents. Over the past five years, however, appreciation as well as concern for local resources and rural ambiance has grown among the majority of citizens. People are anxious to see their rural way of life preserved; but at the same time allow for growth in the local economy. As locally-targeted tourism becomes a more important industry, there is substantially increased need for more efficient, convenient, cost- effective forms of transportation. With a 3-fold increase in the population base during Six months of the year, North Fork roadways are moving toward the saturation point. Therefore, it isthe purpose and policy of this chapter to establish a Transportation Commission to assist Southold Town and its residents in finding solutions to increase transportation efficiency and create attractive alternatives to individual automobile travel while preserving the scenic and historic attributes of the Town's state and county roadways. & 3. DEFINITIONS. As used in this chapter, the following terms shall have the meanings indicated: COMMISSION -- The Transportation Commission established pursuant to this chapter. HISTORIC SIGNIFICANCE -- The quality of a place, site, building, district or structure based upon its identification with historic persons or events in the Town of Southold. SCENIC SIGNIFICANCE - The quality of viewsheds from state and county roads based upon its identification with unique attributes in the Town of Southo!d. RURAL SIGNIFICANCE - The quality of environment based upon its identification with open space, farming, fishing and quaint hamlets. & -4. TRANSPORTATION COMMISSION. There is hereby created a Transportation COmmission for the purpose of presenting transportation solutions which address the use and protection of local resources for recreational and economic benefit through an innovative road-rail-trail network while maintaining the scenic, historic, and rural characteristics of the Town as well as guide their subsequ~ent implementation. The Commission shall consist of nine (9) members to be appointed by the Town Board, to serve without compensation. 2/01/20 15 The term of office of each member appointed to said Commission shall be two (2) years. If a vacancy occurs other than by expiration of a term, it shall be filled by the Town Board by appointment for the unexpired term. In developing and implementing a transportation management strategy, the Commission will work with the Planning Staff, the Highway Superintendent and the Police Department, but shall report to the Town Board. The composition of the Commission shall consist of: representatives of Highway, Police and Planning Departments, civic groups, residents and different sectors of the business community. & -5. DUTIES OF COMMISSION. The Commission shall perform the following duties and functions: Maintain and improve the rural quality of life as expressed herein through reductions in traffic congestion; speeding; impacts on water quality and noise; vehicular trip generation and excessive lighting, sinage and roadside litter while keeping NYS Route 25 as a scenic route and ~County Road 48 as a "through-route". Create a framework to coordinate transportation plans and programs for the Town among all related local and regional transportation agencies, groups, service providers and the private sector. Improve transportation service and efficiency within Town through improvements in traffic safety; speed limits; pedistrian and bicycle safety; parking design and location; traffic flow; roadway lighting, signage and traffic signals; and, access management. Develop implementable innovative transportation strategies through improvements in transit options; linkages between transportation modes; travel demand management techniques; enforcement mechanisms; public and private transit operations; and, vehicle occupancy. Develop a fiscally responsible, feasible, acceptable integrated capacity/mobility/safety plan for the Town as well as a formal monitoring evaluation and update procedure. Recommend alternative transportation solutions with an integrated capacity/mobility/safety plan to the Town Board for incorporatiOn in the Town Master Plan and funding by related agencies. G. Promote use of alternative transportation options through educational activities. Coordinate these alternative transportation options with other East End towns' and villages' initiatives through the East End Transportation Council to effect a unified regional transportation strategy. I. Solicit Public input on an ongoing basis in the discharge of these duties. & -6. WHEN EFFECTIVE. This resolution was ADOPTED. 36. - Moved by Councilman Moore, seconded by Councilman Murphy, WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk County, New York, on the 1st day of February, 2000, a Local Law entitled, "A Local Law in Relation to Amending Chapter 100, Section 13, entitled "Definitions" of the Code of the Town of Southold"; now, therefore, be it RESOLVED that the Town Board of the Town of Southold hereby sets 5:00 P.M., Tuesday, March 14, 2000, Southold, New York as the time and place for a public heating on this Local Law, which reads as follows: A Local Law in Relation to Amending Chapter 100, Section 13, entitled "Definitions" of the Code of the Town of Southold. BE IT ENACTED by the Town Board of the Town of Southold as follows: I. §100-13 entitled "Definitions" of the Town Code of the Town of Southold is hereby amended as follows: YARD, FRONT - An unoccupied ground area open to the sky between the street line, or between the street line established by the Official Map of the town or an approved subdivision plat, and a line drawn parallel thereto. Except, if the owner of the lot does not have the fight to use or travel over a bordering street, right of way or street line, the side of the lot bordering, that particular street, right of way or street line shall not be considered to be a front yard and any accessory structure placed in such yard shall comply with the apPlicable sideyard setbacks for the zoning district within which it is located. II.Severability. If any section or subsection, paragraph, clause, phrase or provision of this law shall be judged invalid or held tmconstitutional by any court of competent jurisdiction, any judgment made thereby shall not effect the validity of this law as a 2/01/20 17 whole or any part thereof other than the part or provision so adjudged to be invalid or unconstitutional. Cochran to execute any and all necessary documents to retain ACS to assess and provide recommendations for technology integration and executive summary proposal that includes a short and long-range Strategic technology plan with projected budget figures and possible cost savings at a fee of $1,200, plus travel expenses of $1,550. SUPERVISOR COCHRAN: That is the end of our resolutions. First I would like to share with you that we have received an award, which I think is quite lovely. It is glass, and it says for your support of small business in 1999 Town of Southold. It was presented to the town from the Long Island Development Corporation. Let me see here exactly. I don't want to say the wrong thing about why we received it. We had the greatest percentage increase in small business activity of any town on Long .Island during the fiscal year of 1999. So, Brian was kind of enough to go up to the luncheon and event, and received this on behalf of the Town of Southold. I was at the Ten Town Supervisors meeting, and also we received a letter of congratulations from County Executive Tom Gulotta on receiving the award. As I was up with the Ten Towns Supervisors that same day for a meeting I would like to just share with you. I was elected Vice-Chairman of the group, so I will be serving in the capacity. First, Mr. Carlin, I have to say that you ~vere (tape change) On the right hand side, have you seen those? It is very confusing. Just let me say this. I am not going to give any more information about it, becaus~ our Transportation Committee is presently setting up a meeting with the State DOT, because we see many, many problems happening there. I mean right now you have got Diary Queen where people can't park in and out becaus~ of the line-up. You have no right mm, I think, o~n red. It is just a complete disaster and mess. Yes, we do need a light in the area, but the Transportation Committee will be meeting with the DOT, and see what ways we can make this a little clearer, and I know some suggestions, so if you would kindly put them down on a piece of paper, and submit them to my office I will see that the committee gets them. Okay? Second, Mr. Williams, you got the information you requested, and I think there will be some additional, because John didn't have time to pull all the bills. Okay? We just want to keep you happy, Jack. The other thing is in relation to tow trucks we were questioned upon, and as answered is correct. If there is a V&T motor accident, and the person is incapable of stating who they would like to be called, and one of the things that a police officer does, if there are no injuries, he will say, you know, who would you like us to call, your family garage or whatever~ So, the only time that the police make the decision is when there is V&T and there is junk on the road, and they have got to clear the highway, and the person is not capable of saying, this is who I want to tow my car. Then ihey do it on a list that is rotated. Okay? Those were three things that we were asked at the last Board meeting, So I shared that information with you. Bill, I see we have some young people. It has got to be Boy Scouts. COUNCILMAN MOORE: They are. I am happy to introduce to the Board John and Joe Cato from Mattituck. There are working with me on their Citizenship Merit Badge as part of their responsibility requirements to get that badge is to attend a Town Board meeting. We will talk about it afterwards. There will be a quiz. 2/01/20 18 SUPERVISOR COCHRAN: Are you brothers? COUNCILMAN MOORE: They are twins, and their Mom is here with them as well. SUPERVISOR COCHRAN: They don't really look like twins do they? They look like brothers. COUNCIl,MAN MOORE: I don't know they look like twins to me. SUPERVISOR COCHRAN: Welcome. Thank you for joining us. I hope you learn something, especially about government. Who knows, some day after you earn these awards and you go off to college, and become a lawyer you could end up in politics. At this time if there anyone that would like to address the Town Board we would be very happy to take your comments. JACK WILLIAMS: I am Jack Williams from East Marion, and I wanted to, if I might, comment a little bit on the absence for the third time of Councilman Romanelli from this meeting. SUPERVISOR COCHRAN: May I, Jack? His grandmother passed away. It has been a series of things. He did have the flu, and then he did have cold weather, and all the confusion of the business trying to keep our residents warm, and then his grandma passed away. JACK WILLIAMS: I wouldn't want to have the (unintelligible) thinking that there are only five members of the Town Board JUSTICE EVANS: As you know he was at the Work Session all day, but he went to the wake tonight. JACK WILLIAMS: I do understand that, but I miss him, and I would wish him well, and I hope he returns. SUPERVISOR COCHRAN: I am sure he will. For our Scouts in the audience, we are the only Town in New York State that does have six members of the Town Board. Most have five, and we were allowed to have six as a special... COUNCILMAN MOORE: Don't tell them. You guys are going to have to find out why. SUPERVISOR COCHRAN: Okay. Sorry. Everybody call Bill. COUNCILMAN MOORE: Go ahead and tell them. SUPERVISOR COCHRAN: I would like to introduce our Councilwoman from Fishers Island. Because Fishers Island is a part of Southold Town by a special act of the Legislature, New York, we are allowed to have six so that there is a representative from the Island. She does two roles. She is both the Councilperson and a Judge, so Judge Louisa Evans, Councilwoman Louisa Evans. Our young men earning their Eagle, so you can soar.with the birds, or whatever the saying is. It has something to do with a turkey. We had a very long day, believe me. We needed a little humor. It has been a long day. Mr. Carlin? Town business, Frank. FRANK CARLIN: I can assure you this is Town business, Madam Supervisor. My name is Frank Carlin. I am from Laurel, the original watchdog in Southold established in 1952. I have been before many a Town Board as you know. I am going to stop there, because I am getting to sound like a politician. I, too, miss my friend John. I have two questions, and one comment, and that will be it for tonight. COPS Program sponsored by the government, Community Oriented Police Service. Last year you were granted to hire five police officers on that program. You hired three. Can you tell me what plans you have for ~vith the other two? Are you going to hire the other two, or what are going to do about the other two you were allotted for? You were allotted five. 2/01/20 19 SUPERVISOR COCHRAN: Frank, we don't have to use them if we don't feel we need them. Frank, what we will be doing very shortly, and it hasn't even come to the Board, and. I am sure Bill is aware of this, we are going to have to review exactly what our staff is as far as the Police Department is concerned, because we are having some vacancies. COUNCILMAN MOORE: We didn't hire anyone last year actually. It was two years ago, and one of the local problems with the COPS Program as it was set up, is that you. cannot use it to staff what you consider your minimum staffing level. You have to go above and beyond what you consider minimum staffing, and this Federal money is designed to help you hire police officers to go above the minimum staffing level, so we have 24 patrolmen, and that was where we wanted to be. We didn't want to use them all up, because after three years the COPS money hms out, five years, three years, you are then left with what really is more than what you wanted for minimum staffing. It is a nice starter. You are not supposed to use it, and you can't use it to fill in for retiring officers, se that is one ofprovisos of that program. We were able to take just like three out of the five we were 'allotted. As the Supervisor said, we know there is retirement in the offering this summer, and there will be some movement from the department, but how many more we will hire at this point it is hard to say. FRANK CARLIN: That is right, but I just want to know are there plans perhaps to hire the other two if necessary? COUNCILMAN MOORE: You can't. If you have a certain number of officers you need to make a squad mn, given the way their schedule works, and their days off, their vacation days, you can't use those to get you back up to that, so if we are going to talk about going above and beyond the minimum staffing that is what the Board has to debate. SUPERVISOR COCHRAN: If you wanted a crime unit for the street, a street crime unit, you could hire those two more. They would be above what your scope of work is. It is like to enhance. FRANK CARl,IN: So, out of a total six you hired four. SUPERVISOR COCHRAN: There are no plans at this time. FRANK CARLIN: Since we took over Feather Hill as part of Town Hall, did you move the people out of the cellar? SUPERVISOR COCHRAN: Yes, they are all over there, Frank. We took a lease for two years. That will allow us time, Councilman Richter, because of his construction skills, and so forth, and I believe in using these people as they are best, he is going to be developing the package for all the options that the Town Board can look at to what will be in place at the end of two years when our lease runs. Will it be a building program? Will it be an acquisition of another building, or on, and on, and on. So all these things are going to be put together and brought to the Board. FRANK CARLIN: Then I can connect this next question, connect it with this same question. Originally you bought the Whittaker House along side of the Town Hall with intentions of using it perhaps for part of the Town Hall. What plans do you have for the future of that building after we spent $170,000 for, what plans do you have now for it in the future? SUPERVISOR COCHRAN: We paid $170,000, yes, and not just for the building but also comer business property. Okay? At that time we had a grant from the State to hire a forensic engineer, who went in, and reviewed the entire building. It is actually three houses put together. This gentlemen, we have been waiting. We call from time to time. Do you have your report, do you have your report? Because I would like to start some kind of movement, but it may enter into these options that Councilman Richter will be working on. Found out about a week and a half ago, maybe a week ago, that this gentleman quit the fm'n he was with, so we have no report, no nothing. So, we have to go back to square one as far as the grant is concemed~ because we didn't pay him as far as the grant is concerned, and find another individual to do the same study. We want to 2/01/20 20 know what is there. Is there a facade that can be incorporated into something, or is just a waste? There is a lot of feeling in the community as far as tearing down our old homes. If it could serve a purpose, and I am sure we could find something, but right now it is in limbo because our forensic engineer, architect, forensic architect. FRANK CARLIN: This is my comment. Like you always said, Madam Supervisor, you come up and say what is on your mind. SUPERVISOR COCHRAN: Right. FRANK CARLIN: I am going to do that tonight like I always do, and this is my opinion only. Back in 1986 we spent $30,000 to study a Town utility .company. You had proposition to vote on it, and six of you voted it down. In 98, we spent $15,000 on a study. In '97 we did an impact study, and also we spent money on an environmental study. We are trying to stop killing this issue. Tom Wickham said in 1994, this is one time I believe, that it would too much with the size of this town. It would be too much of a risk to take on a whole new utility company. Then I go and hear that if we had our own utility company our rates would be reduced by 50%. Then that would increase our business. I have done a lot of research on this. Burned a lot of midnight oil. I have got records home to fill up a case. I do this all night. There is a family out in California, and that area went into buying electricity. They found no difference in their rates. There is a family in Houston, Texas, that they are into buying electricity, and they found no difference in their rates. To me it is a puff of smoke. That is all it is, speculation. I think that there are a lot more important things for this town to focus on, that before you spend any more time or taxpayers' money, in my opinion, if you have in mind to study this issue. You know there is an old saying. The grass is always green on the other side of the fence. It would be like taking new wine, and trying to put it into a old bottle. There is a lot involved here, and again, I agree with Tom Wickham. It is too risky for this size of a town to take it on. I was saying to the Board, we wasted money back in '86, and '98. SUPERVISOR COCHRAN: I agree with you. FRANK CARLIN: Especially with weather disaster like we had two or three years ago, and you suffered there with the tornado. That is only a small example. A lot of things involved here. Going to reduce the rate by 50.%, increase business, especially not in New York State. Thank you. What happened to my friend? He always Walks out when I am speaking. He always does. SUPERVISOR COCHRAN: We will let you speak first then. FRANK CARLIN: Well, at least I stayed back tonight. SUPERVSOR COCHRAN: You are a gentleman, Frank. You always have been. Anyone else like to address the Town Board? (No response.) If not, Brian, do you have anything to report? COUNCILMAN MURPHY: At the Work Session today, we were looking at the 2% Law, and some of the transactions that have taken Place recently. There has been some, I guess I don't want to call it dispute. SUPERVISOR COCHRAN: Healthy disagreement. COUNCILMAN MURPHY: And surprises as to how actually the way the law has been whtten. From what I had originally understood as to the way the taxes are being applied is quite different at the moment on certain transactions. So, we are requesting, is it from the Attorney General's Office, for an interpretation on the application of that 2% law, because really right now there are some farm transactions that are taxed completely, and that, at least I understood it, was not the way it was supposed to be. So, we are looking into that right now. The law is specific. I did not realize it. Bill showed it to me, and brought it to my attention today. It is applied the way the law is actually written, but the intent of the law at the time was not for that to happen, so we are looking into that. The Farmland Acquisition Committee has been very busy. We have got a number of new 2/01/20 21 applications coming in that we are looking at, and we should be having some reports in a very short period of time on some new acquisitions. SUPERVISOR COCHRAN: Good. Thank you. COUNCILMAN MOORE: I attended a meeting of our Transportation Committee, and a lot of work is going in over the next several months, public input, recognizing transportation as a big issue. We will see what happens over the summertime. We are going to try to try and address transportation issues level. The State DOT with prodding, pushing, and changing their attitude, our Transportation Committee has been very effective in getting them to address transportation on a regional basis, and really listening to local input, so that is a big change from what we used to get. With the State that is what you have got to do. Looking forward to doing that and working with Valerie and the Transportation Committee on that. Frank, I wanted to respond to something that you said before about the utility company. We got a pretty good analysis because of our Town Attorney. He did a lot of homework on this issue, gave the Town Board his advice. There were skeptics, which is fair among Town Board members, and we went out to the Attorney General's Office, the State Comptroller's Office. We got letters back from them, and with the creation of LIPA the State authority to handle electric for Long Island, and Nassau- Suffolk specifically, it was made real clear that the town has no business, and more importantly no right or power or authority to create it's own power company. Back before LIPA was created, and before LIPA took over the LILCO transmission system, you could do it. You could mm around and hire a professional firm to do it. You could debate whether it was a wise decision or not, but that certainly was an avenue open to the community, but once the LIPA transaction closed, and they took over LILCO assets that door was closed, and that was known to the Board last spring, this summer, and maybe we didn't make it clear enough to the community, but issue is dead as far as I am concerned. SUPERVISOR COCHRAN: And me. FRANK CARLIN: I appreciate what you said, and I believe what you say. A lot of groups in this town are starting this thing up again, making all these statements, and all this stuff. I don't want another McDonalds. You are right, and I believe that you are fight, but people won't let it go in this town, and they are going around on TV, too, and starting up this fire. SUPERVISOR COCHRAN: They are wrong. Anything else, Bill? COUNCILMAN MOORE: I want to thank the Cato young men for being here. I look forward to quizzing you. I have taken a few resolutions so we can talk about what it is the Town Board did tonight. It wasn't as boring as you may think it is. SUPERVISOR COCHRAN: I would just like to recap. In the past month we have gotten some pretty good grants. We received $220,000, study of Mattituck Inlet, to conduct up there. We received a grant of $53,000 for Eel Grass Culture Facility, which is down at Cedar Beach, so we will be working with that grant. We have to apply it, and do the paper work. We also received $90,000 for the Southold Erosion Mitigation Project, which is addressing erosion problems at Goldsmith's Inlet, and also we received $495,000 from Department of Ags and Market for Farmland Development Rights, so when we ask you at election time to vote for a $2,000,000 bond, this Board does it's very best in stretching that dollar and doubling that dollar, so every time we get a grant we are matching our money against it, and we are able to buy a lot more than we would with only our money. So, we are quite pleased when we do received these grants. That is about all I have. All committees are working, and a lot is being done, and we'have a lot on our plate, and if the Board has nothing else, Iwill entertain amotion to adjourn.
