Property Location: '~ 1155 Main Road, Mattituck; CTM 142-2-22.
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without an adverse effect on the environment if the project is implemented
. as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 9,600 sq. ft. lot has 75 ft. frontage along the
Main Road and 128 ft. frontage along the east side of Legion Avenue in Mattituck. The property is
zoned B Business, and was recently improved with a fire-damaged building formerly used as a deli
market business.
BASIS OF APPLICATION: Building Department's April 15, 2004 Notice of Disapproval amended
April 20, 2004 and amended April 23, 2004, citing Code Section 100-103A. The reason stated in its
denial of a building permit application is that the proposed building notes a "right-of-way" setback of
23 feet from Route 25 (Main Road) and 1.33 feet from Legion Avenue. The denial indicates that the
code requires that structures be at least one hundred (100 feet) from the right-of-way_
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on May 20, 2004, at which
time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
AREA VARIANCE RELIEF REQUESTED: Applicant wishes to reconstruct the former deli building
with new construction containing 1,840 sq. ft., set back 23 feet fro the front line along the easement
of NYS Route 25 (Main Road) and set back 1 ft. 5¼ inches from the west line along the easement of
Legion Avenue,
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the relief requested will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The applicant's property is a small corner lot with
frontage along two streets. The building that was used previously as a deli was situated in a location
that did not provide adequate parking or loading areas for vehicles on site. This new building has

been planned with an interior, on-site flow of vehicles around the building, with at Ieast 8 parking
stalls and designed to prevents backing of vehicles onto the street. The buildings which exist on
other parcels to the east of this site, along the Main Road, are visibly closer to the Main Road right-
bf-way than this proposed building. To the west are a cemetery, then the Mattituck Shopping
Center.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance. The lot is only 128 feet deep and 75 feet wide,
and fronts, along two streets. There is no other alternative for applicant to pursue.
3. The relief granted is substantial, with a reduction of 77% reduction of the code required 100 ft.
setback from the Main Road.
4. The difficulty had been self-created, in that the parcel has existed with a nonconforming side and
two front yards, which lends to the difficulties in establishing an "building envelope" under the current
zoning regulations.
5. No evidence has been submitted to suggest that a variance in this business district will have an
adverse ~mpact on the physical or environmental conditions in the neighborhood.
6. Grant of this relief is the minimum action necessary and adequate to enable the applicant to enjoy
the benefit of a new building, while preserving and protecting the character of the neighborhood and
the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by
Member Dinizio, and duly carded, to
GRANT the variance as applied for, as shown on the 5/25/04 site and building elevation plan,
signed by John J. Condon, P.E. 5/26/04, SUBJECT to receiving the Planning Board's review
determination under the site plan provisions of the zoning code.
This action does not authorize or condone any current or future use, setback or other feature of the subject
property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly
addressed in this action.

The applicant wishes to construct a new deli on the site currently occupied by the North Fork Deli
which is located in the southwestern corner at the intersection of the Main Road (Route 25) and
Legion Avenue in Mattituck. The building currently existing on the site was damaged by a fire in
late 2000. In the summer of 2001 a building permit was issued by the Town Building Department
to repair the damage to the building. Shortly thereafter, the owner commenced work which
entailed removal of all appliances and interior finishes ( sheet reck etc.) and the exterior shingle
si.cling. Unfortunately the work did not progress beyond that point and has been tied up in litigation
unfJ'[ the past month. The Town has since ordered the building to be demolished.
The applicant which was the last operator of the North Fork Deli, has made an effort to reinstate
'the ~now expired building permit The Town Building Department denied that request and has
indicated that any work dona on the existing building will require it to conform with the existing
building and zoning codes.
The applicant filed a site plan with the Building Department which proposes construction of a new
buildin~on the same foot print as the existing building. The site plan was subsequently
disapprov, ed based on non conformance with 100 foot setback requirements specified in Article X
Section 100-103A.
The planned b, uilding will be a single story wood framed structure and Will resemble in style and
size the building that is currently on the site with the exception that the new building will have a
gable style roof as opposed to the flat and shed style roof that is on the existing building. The
building will also conform to all requirements of the New York State Building Cede, including
ceiling height and other requirements stipulated for buildings of this use. The current building has
a foot print of approximately 1,372 square feet The proposed use of the building will not change
~rom that of the existing building and will continue to be a community deli with no seating or dining
facilities.

In response to your request for comments, the Planning Board (PB) reviewed the
afore noted appeal at its May 17, 2004 work session and determined the
following:
1. The PB is currently reviewing an incomplete site plan application dated April
26, 2004. The site plan will need to be revised before it can be processed.
2~ This application will require the following before approval from the PB: Suffolk
County Department of Health Services, New York State DOT, Southold (S.)
Building Inspector certification, S. Town Engineers, S. Fire District and
Architectural Review Committee.
2. The use of the existing building will not meet the required Front
Landscape area under Southoid Town Code 100-212, which requires a
25' strip and street trees.
3. The existing building is situated on the undersized property, which
obstructs visibility and directly affects the parking layout.
4. The site plan we reviewed details five parking spaces for a 1,840sq.ft.
building and will not meet the minimum for the Town Code.
5. The PB has concerns about site access and egress as proposed.
6. No compliance with NYS Code on the American Disability Act is proposed
and will be required.
We hope these comments will be useful to the ZBA in its review of this
appeal.

Dear Sir or Madam:
Please find enclosed a copy of the Legal Notice describing your recent application. The Notice
will be published in the next issue of the Long Island Traveler-Watchman newspaper.
1) By MAY 6:
Please send the enclosed Legal Notice, with both a Cover Letter including a contact name
and telephone number, and a copy of your Survey or Site Map filed with this application which
shows the new construction area, CERTIFIED MAIL, RETURN RECEIPT REQUESTED, to all
owners of property (vacant or improved) which abuts and any property which is across from any
public or private street from the property included in the application or petition. Use the current
addresses shown on the assessment rolls maintained by the Town Assessors' Office located at
Southold Town Hall (765-1937) and the County Real Property Office at the County Center,
Riverhead. If you know of another address for a neighbor, you may want to send the notice to
that address as well. If any letter is returned to you undeliverable, you are requested to make
other attempts to obtain a mailing address or to deliver the letter to the current owner, to the
best of your ability and to confirm this in either a written statement, or at the hearing, with the
returned letter.
AND by May 6: please either mail or deliver to our office your Affidavit of Mailing (form
enclosed) with parcel numbers, names and addresses noted, and return it with the white
receipts postmarked by the Post Office. When the green signature cards are returned to you by
the Post Office, please mail or deliver them to us before the scheduled hearing. If any
signature card is not returned, please advise the Board at the hearing and return it when
available. These will be kept in the permanent record as proof of all Notices.
2) By MAY 11:
Please make arrangements to place the enclosed poster on a signboard such as plywood or
similar material, posting it at your property for at least seven (7) days; the sign should remain
up until the day of the hearing. Securely place the sign on your property facing the street, no
more than 10 feet from the front property line bordering the street. (If you border more than one
street or roadway, an extra sign is available for the additional front yard.) NOTE: The hearing
will be delayed 2 months if your property is not posted properly.
Please also deliver your Affidavit of Posting to our office on or before the day of the hearing.
If you are not able to meet the deadlines stated in this letter, please contact us promptly.
