REGULAR MEETING
A Regular Meeting of the Southold Town Board was held on November 23, 1999, at the
Southold Town Hall, Main Road, Southold, New York. Supervisor Cochran opened the meeting
at 4:30 P.M. with the Pledge of Allegiance to the Flag.

SUPERVISOR COCHRAN: May I have a motion to approve the audit of bills for November
23, 19997
Moved by Councilman Moore, seconded by Justice Evans, it was
RESOLVED that the following bills be and hereby are ordered paid: General Fund Whole Town
bills in the amount of $130,702.17; General Fund Part Town bills in the amount of $8,560.31;
Highway Fund Whole Town bills in the amount of $5,822.26; Highway Fund Part Town bills in
the amount of $3,439.00; Capital Projects Account bills in the amount of $2,274.97; Ag Land

approved.

SUPERVISOR COCHRAN: To set the next regular Town Board meeting for December 7, 1999

Tuesday, December 7, 1999, at the Southold Town Hall, Southold New York.

SUPERVISOR COCHRAN: As you know each month the Town Board receives Reports from
both it's committees, assorted~ committees, and the different departments. They are public
in'formation. They are on file with the Town Clerk's Office, and are available to you if you so
desire.

II. PUBLIC NOTICE
SUPERVISOR COCHRAN: We have a Public Notice for dredging within Fair Haven Inlet,
Little Peconic Bay, and written comments to be in by December 9, 1999 to the Army Corp of
Engineers.

ten years maintenance and upland disposal at Fair Haven Inlet, Little Peconic Bay, Town of
Southold. Written comments by December 9, 1999.
III. COMMUNICATIONS.
SUPERVISOR COCHRAN: Communications, we had a letter sent to the Southold Police
Department, Chief of Police, from Mayor Kapell commending them for the work that was done
in Greenport recently in a drug bust, or raid, or whatever you would like to call it. Also, a letter
from Ray Corwin from the Central Pine Barrens, thanking for a proclamation in relation to the
air lift, the moving ofjunk cars offFishers Island.

V. RESOLUTIONS.
SUPERVISOR COCHRAN: As you know the Town Board has a policy that prior to the
adoption of the resolutions you have the opportunity to address the Town Board. Later in the
meeting you will have the opportunity to address us on any given Town Board business. At this
time if there is any comment in relation to any of the resolutions I would be very happy to take
your comments. Mr. Williams?
JACK WILLIAMS: Jack Williams from East Marion I want to speak about Resolution #8, the
DARE Program. It is my understanding that after many years of operation around the country
the DARE Program has yet to demonstrate 'that it has been effective in it's primary mission,
which is the deterring of substance abuse on the part of young people. There have been studies,
and studies, and studies, and what they show is that there is no difference between young people
who have been exposed to the DARE Pro,ram, and young people who have not when it comes to
the rate of subsequent substance abuse, or alcoholism, or whatever. So, the program has not been
proven to be successful, and I say that' knowing that Officer Dzenkoski has done a fine job, and
the DARE Program is popular in town, and that the kids are not terribly unhappy about it either.
But, I think that you should be aware of a real danger here, which is that with the DARE
Program in Place parents of the community can delude themselves into thinking that something
is being dOne, and therefore can diminish their own sense of responsibility. Now, in that sense
the DARE Program is counterproductive, because it may work against the kinds of influences in
the home that might be productive.

RESOLVED that the Town Board of the Town of Southold hereby designates the following
house in Southold Town as a Southold Town Landmark, all in accordance with the
recommendation for designation by the Southold Town Landmark Preservation Committee, and
acceptance of designation by the property owner.

Randall J. Feinberg for winter storage of equipment for the periods from December 1, 1999
through April 1, 2000 and December 1, 2000 through April 1, 2001, at a rental of $500.00 per
month, not to exceed $2,000.00 per year, skid agreement all in accordance with the approval of
the Town Attorney.

modeling~ as part of the Goldsmith/Kenney's Beach Erosion Study Project and authorizes
Supervisor Cochran to sign a contract between the Town of Southold and Offshore & Coastal
Technologies, Inc., subject to the approval of the Town Attorney.

needed) for Bulk Salt for Snow and Ice Control for the Southold Town Highway Department, for
the period of November 1, 1999 through November 1, 2000, all in accordance with the bid
specifications.

RESOLVED that the Town Board of the Town of Southold authorizes Supervisor Cochran to
execute any necessary documents relating to the contract addendum with Trinity Transportation
Corp. for the payment of $70/ton for that portion of the Town's C&D (construction &
demolition) waste which is made up of creosote and/or pressure treated pilings and railroad ties
and large (6 inch by 6 inch by 8 feet and larger) pressure treated lumber only.

Town Clerk to advertise for a part-time clerk for the Receiver of Taxes Office, to fill the vacant
position due to the resignation of Alice Wilder, to work 17 ½ hours per week at a salary of $7.20
per hour, effective December 20, 1999.

Mattituck-Cutchogue Union Free School to use the following town roads to hold a parade for the
"Class C State Soccer Semi-Finalists Boys' Varsity Soccer Team at 3:00 P.M. on Sunday,
November 28, 1999, provided they file with the Town Clerk a One Million Certificate of
Liability Insurance naming the Town of Southold as a additional insured: Pike Street, Wickham
Avenue, and Love Lane, Mattituck, New York.

Member of the Southold Town Conservation Advisory Council to fill this vacancy.

payment in the amount of $150.00 t6 Cheryl Hansen, said sum represents 100% of a fee paid for
a lot waiver application which was subsequently deemed unnecessary by the Zoning Board of
Appeals.

RESCINDS Resolution No. 21 of the November 9, 1999 Southold Town Board Meeting,
which reads as follows:
RESOLVED that the Town Board of the Town of Southold hereby grants permission to the
following elected or appointed officials to attend the Annual Meeting of the Association of
Towns in New York City on February 20, 21, 22, & 23, 2000: Supervisor, Councilmen, Town
Clerk, Town Justices, Receiver of Taxes, Solid Waste Coordinator, Justice Court Clerks,
Building Department Head Edward Forrester and Building Inspector Michael Verity; be it
FURTltER RESOLVED that the Board of Assessors, Town Attorney, and members of the
Board of Appeals and Planning Board are granted permission to attend the annual Meeting of the
Association of Town on a day trip basis.

following elected or appointed officials to attend the Annual Meeting of the Association of
Towns in New York City on February 20, 21, 22 & 23, 2000: Supervisor, Councilman, Town
Clerk, Town Justices, Receiver of Taxes, Assessors, Town Attorney, Zoning Board of Appeals
Member George Homing, Solid Waste Coordinator, Justice Court Clerks, Building Department
Head Edward Forrester, and Building Inspector Michael Verity; and be it
FIJRTItER RESOLVED that the Members of the Board of Appeals and Planning Board
are granted permission to attend the Annual Meeting of the Association of Towns on a day trip
basis.
SUPERVISOR COCHRAN: I would just like to explain that at the time we passed the first
resolution indicating those that would be attending the meeting, since then we have found out
that they will be providing certified courses to the Planning Board and Assessors, and if it means
that we can send them to New York rather than somewhere else a further distance throughout the
state, that this would be the opportunity for them to go in and get their certified courses. That
was the reason for the change.

Cochran to execute the document entitled, "Decision of the Town of Southold Grievance Board"
in reference to grievance number 99-6 all in accordance with the approval of the Town Attorney.

of 1999 to 2002, includes a provision ~ntitled "Health Insurance Declination Bonus"; and be it
RESOLVED by the Town Board of the Town of Southold that it hereby adopts a personnel
policy entitled "Health Insurance Declination Bonus: whereby employees may opt out of the
Town's health insurance pi:ogram ih :WhOl'e Or part for a full year by completing the appropriate
form and complying with the terms Set!forth inthe CSEA employment contract for 1999-2002.

SUPERVISOR COCHRAN: That is the end of our planned resolutions. At this time we will take
comments from anyone in the audience in relation to any Town business. Is there anyone who
would like to address the Town Board on any town business? (No response.) If not, I have a
cduple of things I would like to share with you. One is a fax that we receivec~ in relation to a fire
alarm call that the Mattituck Fire Department responded to at Waldbaums, and it was found that
there were in the freezer area there were sprinkler heads that did not go off. So, they got the
information from the company, and it is U.S. Consumer Products Safety Commission, and the
Star sprinklers are being recalled, a dry top type models, D1, RD1, RE1, El, and ME1 made
from 1961 through 1976. The name Star appears on the sprinkler, and these may be found in
hospitals, schools, resorts, stores, office buildings, warehouses, and supermarkets, so it might
behoove you, although you have never had to, thank goodness, use the sprinklers, just kind of
check, and See if they are Star, and if they are then you certainly can call here, find out exactly
what models, because I did read it off quite quickly. Actually Star has a recall hot line and the
number 800.866-7807, and they will replace the sprinkler heads, and reimbursement of the labor
costs if they are found. Evidently it was so badly corroded that it would not work, so that is for
your information in relation to safety. We got a very nice letter fi-om the Robert L. Penny
Development Corporation, the day care center. We do provide funds in the amount of $7,000
through HUD monies to the day care center, and as a thank you we received a picture of the kids
that attend, which is pretty neat. We are delighted, and it certainly is our pleasure to provide the
funds. Does any Town Board member has anything they would like to report7 John7 Mice?
COUNCILMAN ROMANELLI: Have a Happy Thanksgiving. ·
COUNCILWOMAN HUSSIE: I went over to Plum Island Monday last week, which was quite
an experience especially wearing those space suks, and with a white hat on top of us, all good
guys. It was a very interesting session even though I realized it was geared to make everything
look good, and I tell you from what I heard and what I saw I wouldn't be terribly worried about
the whole situation over there. However, I do know that it was designed to do just that. To make
us feel good, and there is always something somewhere which is what I am going to be looking
for now. But, nevertheless I was very happy to go, and I was glad I went.
COUNCILMAN MOORE: [, too, traveled to Plum Island. It was a neat experience, and Alice is
right from the science standpoint they justified the need for that kind of facility somewhere in
our country, and the scientists in ours see nothing but the best in science work, and we asked
them, and they do have the answers how they handle security. Not to be an alarmist, but security
will be an issue as they deal with, if in fact Congress approves that, that have to have security,
and how they handle making sure that what they have got there, what they take there, doesn't get
released· What they are looking to doing is germs and bugs that are transmittable to human
beings, so that is an appropriate area of concern for us. We are looking very carefully at that.
COUNCILWOMAN HUSSIE: And that was another word we learned zoanotic, diseases that
are transmitted from animals to humans, and humans to animals,
COUNCILMAN MOORE: I was going to take a moment to take to task. I saw a headline today
in Newsday that made reference to a young man that died in police custody. Unfortunately the
headline is big, and it makes it sound like this young man died while he was in headquarters, or
in a cell, or something like that, and it was too bad, because he was a troubled young man who
was on a suicide kind of mission, and the police actually did a fine job on Saturday of gathering
this person in. He took ill. They took him to the hospital and transported him down to Stony
Brook, and he died hours later, the next morning. Obviously we will see what his problem was. !
think it was drug overdose, but this young man had stolen a car in Massachusetts with a child in
it. Quite the story, but Newsday had the story right, but the headline made it sound like a young
man died i~ police custody. I thought that was ~t misleading headline. It was too bad, but hats off.
The Police department did a fine job. No one got hurt. No property was damaged, and they
corralled this fellow safely. So, hats offto the police for a good job. Enjoy your Thanksgiving.

SUPERVISOR COCHRAN: I would just like to make a few comments in relation to Plum
Island, because I am getting calls, and people stopping in that do have concerns. I think there are
some concerns as far as safety and health overview, and the security. Now, one of my concerns is
in relation to the security and terrorism. It is a known site, and because of what happens there, so
I ihought about it this afternoon quite extensively, and what I am going to do is call together
interested persons that have contacted me from the community, our politicians, Mike Caracciolo,
Pat Acampora, LaValle, and the five East End town Supervisor, and anyone from the public that
has something to bring to the table. A gentleman that was part of the design of the facility feels
that there is areas of concern, t have not had the opportunity to speak with him yet, but I will be
scheduling a meeting after the East End Supervisors and Mayors, which is held December 15th to
bring this together, because if everybody is just going off in their own direction you accomplish
very little. Il'it can be give and take, and then organized to the sense that perhaps some of what
the concerns are can be addressed, then that is the way we should .function. So, you will be
hearing more as we go along. I am fine. There has been conservations throughout town that I
was going to leave the planet, but I haven't. I have decided to stay, and I feel fine. I would like
to wish everyone a very sincere, thankful Thanksgiving, and safe health, and we look forward to
seeing you after this holiday. Thank you very much for joining us. May I have a motion to
adjourn?
