SUPERVISOR COCHRAN: A motion to approve the minutes of November 1, 1999, Special Town Board meeting. Moved by Councilman Murphy, seconded by Councilman Romanelli, it was RESOLVED that the minutes of the November 1, 1999, Special Town Board meeting be and hereby are approved. SUPERVISOR COCHRAN: Set the next regular Town Board meeting, the next meeting November 23, 1999, at 4:30 P.M. 11/9/99 2 Moved by Councilwoman Hussie, seconded by Councilman Murphy, it was RESOLVED that the next meeting, of the Southold Town Board will be held at 4:30 P.M., Tuesday, November 23, 1999, at Southold Town Hall, Southold, New York. SUPERVISOR COCHRAN: As your Supervisor I get the privilege of doing presentations many, many times, and it is certainly on behalf of the Town Board, and on behalf of the community of Southold, and this is a very special one tonight. We have had several people, one several weeks ago, that donated a piece of land to the Town, and this evening we are also saying thank you to Mr. and Mrs. Kenneth Zahler. Mr. Ryan, why don't you join me, also? Dick Ryan is Chairman of the Land Preservation Councilman, and Brian, why don't you join me, too? You are the Board liaison. These people work hard to put the deals together, but we are especially pleased, because this is a generous gift that you have given to the town. It is a lovely piece of land on the comer of New Suffolk Avenue and Moore's Lane in Cutchogue, and it will be forever preserved. I would like to read this in appreciation, Presented to Mr. and Mrs. Zahler for your generous gift of open space to the Town of Southold helping us to preserve our heritage and quality of life, presented by not only the Town Board, but also the 20,000 residents of Southold Town. We are very, very pleased, and we hope more people: are watching and maybe do the same. Is that anything you would like to say? KENNETH ZAHLER: I would just say that my wife and I have always been very much involved in the community, because we have been residents back about, we go back a great distance. We have been residents for many years, and we havo been very involved there, and I thought by this gift I would like to get started on the right foot. I. REPORTS. SUPERVISOR COCHRAN: As you may or may not know all committees and departments provide the Town Board with monthly reports. They are presented to the ToWn Clerk. They are on file in the Town Clerk's Office. If there is anyone that would like to have access to any of the Reports, we are very happy to share them with you. SUPERVISOR COCHRAN: We had two Public Notices. One is in relation to the Department of Army District Corp of Engineers. It is a hinged walk ramp and a float on Haywaters Cove in Little Peconlc in Cutchogue, and the other Public Notice is in relation to Greenport Village to dredge an existing drainage ditch through a freshwater wetland at Moore's Lane. 1. Department of Army, New York District, Corp of Army Engineers request of Gerald Gelbwaks to attach a hinged walk ramp and a float to an existing timber fixed pier in Haywaters Cove, Little ;Peconic Bay, Cutchogue, Southold. Comments to be received by November 16, 1999. 2. New York State Department of Environmental Conservation Notice of Application of Greenport Village to dredge an existing drainage ditch through a freshwater wetland at Moore's Lane, Town of SOuthold. COMMUNICATIONS SUPERVISOR COCHRAN: Communications, we did receive a very nice letter from William McDermott, who is now a member of the Conservation Advisory Council, thanking us for his appointment. We, also, received a letter from Dr. Micah Kaplan. We presented him with a proclamation on his retirement. Also, a letter to the Supervisor and the Town Board from Mary Tuthill who celebrated her 100th birthday. Is it 1007 Mary, I hope I am not making you older than you were. One down in the nursing home is 100, Mrs. Corazzini. She also celebrated her birthday, 100 years. A letter from Shirley Strum Kenny, President of SUNY Stony Brook in relation to a center for medicine. 1. William McDermott th ,at, king Supervisor Cochran and the Town Board for his appointment to the ConserVation Advisory Council. 2. Dr. Z. Micah Kaplan with thanks for the proclamation presented to him. 3. Mary Tuthill thanking the Town Board and the Supervisor for the proclamation. 4. Shirley Strum Kenny, President, SUNY Stony Brook in regard to the invitation to attend dedication ceremony of the Center for Molecular Medicine on November 12, 1999. IV. PUBLIC HEARINGS. 1. 8:00 P. M. on a proposed Bond Resolution for Solid Waste District office trailer. 2. 8:05 P.M. on the Continuation of the Mullen Motors Change of Zone application. V. RESOLUTIONS. SUPERVISOR COCHRAN: As you know the Town Board has a policy in relation to the resolutions, that we will be acting upon. If there is anyone that would like to speak to the resolutions, I will call for that now. Later in the program toward the end of the evening we also have a period where public can speak to the Town Board in relation to any Town Board business. So, before we start the resolutions, if there is anyone that would like to address the Town Board in relation to the resolutions we will be acting upon, please, feel free now. BERNARD HINSCH: My name is Bernard Hinsch. I live on the North Road. Can you please explain item 8? SUPERVISOR COCHRAN: In relation to the towing, when the Police have the need for a towing, a car being in an accident, or it is broken down along the highway, there are guidelines, and they get to keep the fee. Sometimes they have to bring accident cars into 'the impound area, and so on, and so forth, and there have been guidelines, but they have been reviewed and updated. BERNARD HINSCH: Is there an established fee? SUPERVISOR COCHRAN: What is the fee, Greg? COUNCILMAN ROMANELLI: There is an established fee, and they have a list. It was handed out to all the towers within the town. It went back and forth for weeks at what they felt was a fair rate. BERNARD HINSCH: Is the rate all the same from one to the other? COUNCILMAN ROMANELLI: Yes. SUPERVISOR COCHRAN: They rotate, so that everyone gets a little bit of the action. BERNARD., HINSCH: How are they called? By the police? By the dispatcher? SUPERVISOR COCHRAN: Y~s. COUNCILMAN MURPHY: Berni{, the toWing rate is, daytime 'from 6:00 A.M. to 6:00 P.M. $100.00. From 6:00 P.M. to 6:00 A.M! at night $120.00. Saturdays, Sundays and holidays $120:00. BERNARD HINSCH: Is there any distance involved? Distance involved for the $100.00. 11/9/99 4 · COUNCILMAN ROMANELLI: It is within the town. Wherever their yard is. BERNARD HINSCH: So, their yard? How about to the resident's yard? COUNCILMAN ROMANELLI: I think it is determined by the dispatcher at nighttime. COUNCILMAN MURPHY: Those are maximun guidelines, if they bring it into their yard, their area of storage. SUPERVISOR COCHRAN: Anyone else lika to address the Town Board in relation to any of the resolutions? (No response.) Number one? 1. - Moved by Justice Evans, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby grants permission to the Mattituck American Legion, Raymond Cleaves Post No. 861 to use the following towns in Mattituck, New York, for their Veterans Day Parade beginning at approximately 10:45 a.m., Thursday, November 11, 1999 and ending on the eleventh hour 11:00 A.M.: Pike Street, Wesphalia Road, Sound Avenue, and Love Lane, provided they file with the Town Clerk a Certificate of Insurance in the amount of One Million Dollars. 1.-Vote of the Town Board: Ayes: Councilman Murphy, Councilman Romanelli, Justice Evans, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 11/9/99 5 5. -Moved by Councilman Romanelli, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes Supervisor Jean W. Cochran to sign the Year 2000 Individual Program .Application for the Southold Juvenile Aid Bureau Program for grant tLnds in the amount of $31,635.00 from the Suffolk County Youth Bureau. 5.-Vote of the Town Board: Ayes: ~ouncilman Murphy, Councilman Romanelli, Justice Evans, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. 6.-Moved by Councilwoman Hussie, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold, pursuant to the recently approved Town of Southold CSEA contract settlement, hereby agrees to participate in the New York State Disability Insurance Plan, subject to the Plan's Rules and Regulations and directs the Town Clerk to complete and forward Form DB-136 to the CSEA for completion and filing with the New York Workers' Compensation Disability Benefits Bureau. 6.-Vote of the Town Board: Ayes: Councilman Murphy, Councilman Romanelli, Justice Evans, Councilwoman Hussie, Supervisor Cochran. SUPERVISOR COCHRAN: Number seven, to appoint a Public Safety Dispatcher, we are going to put on hold. 8.-Moved by Councilman Romanelli, seconded by Councilman Ivlurphy,. it was RESOLVED that the Town Board of the Town of Southold hereby adopts the following Southold hereby adopts the following Southold Town Police Vehicle Town Guidelines and Rates, effective immediately: ~ SOUTIrlOLD TOWN POLICE VEHICLE TOWING GUIDELINES AND RATE I. PURPOSE To establish a procedure to implement a Departmental Policy concerning Towing and Impounds. The policy will apply to all Departmental Personnel and also to the utilization Of Pdvate Tow Operators. The policy will set guidelines concerning the impounding of vehicles pursuant to accident investigations, cdminal investigations, abandoned vehicles, towing from private property, parking violations and other areas. A Rotational Towing List cempdsed of Pdvate Tow Operators will be maintained. This policy will also set rates that may be charged for towing, and establishes the procedure for Pdvate Tow Operators to be' added to the Police Rotational Towing List. These areas are listed separately as follows: APPENDIX A: RATE SCHEDULE APPENDIX B: APPLICATION PROCESS - PRIVATE TOW OPERATORS II. TYPES OFIMPOUNDS: A. HEADQUARTERS IMPOUND:, Certain types of impounds will be'towed (~) to Police Headquarters as folloWs: (') NOTE: No impounded vehicle to be ddven to Headquarters by any departmental employee. ..... ' 1. FATALITIES/SERIOUS ACCIDENTS: Vehicle from scene of. accident for safety check. Dolly or Flatbed will be utilized. Police OfficedDetective in charge of scene wilt determine if PD Wrecker or Pdvate Wrecker is required to, insure integrity of evidence. 2. CRIMES: Vehicle used in cdme. 3. ARRESTS: Ordered by Police Officer at scene of incident for valid reason: (Arrests under NYS V&T Law which mandate impound, ie, Section 511.2, or improper registration documents, license plates, etc.) 11/9/99 IMPOUNDS TO TOW OPERATOR'S PREMISES: 1. ACCIDENTS: Routine Motor Vehicle Accidents not requiring further investigation at Police Headquarters. 2. ILLEGALLY PARKED VEHICLES: Vehicles blocking driveways, intersections, fire zones, tow-away zones, etc. 3. HIGHWAY SAFETY HAZARDS: Vehicles creating unsafe road conditions. 4. SAFEGUARD VEHICLE: Defendants requesting that their vehicles be safeguarded (Vehicle not required by Policel Department). 5, DISABLED VEHICLE: Request for wrecker for disabled motorist. 6. ABANDONED/JUNK VEHICLES: (Section 1224 NYS V&T Law) These vehicles normally secured Monday through Friday during norma~ business hours, UNLESS deemed'a safety hazard, which must be removed immediately. III. REQUESTS FOR WRECKER: A. POLICE OFFICER/COMMUNICATIONS: On any accident or other type of incident where the disposition of the scene will be delayed for the response of the Medical Examiner, photographs, measurements, etc., delay notification of wrecker or inform them of approximate delay time for removal of vehicle. (NOTE: There are additional charges after a one (1) hour delay at scene.) B. TYPES OF REQUESTS: A request for a wrecker will be made by a Police Officer and directed to the Public Safety Dispatchers under the following circu mstances: 1. POLICE ROTATIONAL TOWING LIST: See Section II - TYPES OF IMPOUNDS, Paragraph B. Normal towing to Pdvate Tow Operator's premises utilizing Rotational Towing List for Sector or area in which incident occurred. 2. SPECIFIC REQUESTS FOR PARTICULAR TOW OPERATOR: If a pdvate citizen requests a specific wrecker service and it is available locally, and can respond within a reasonable period of time, efforts will be made to contact same. 3. CLOSEST WRECKER: At times due to special circumstances an officer at the scene of an incident has authority to utilize the "closest" wrecker. OFFICER'S DECISION IS FINAL. 4. TRUCK ACCIDENTS: Normally utilize closest wrecker (*) that can handle size and type of large truck(s) involved. (*) See 5, Specialized Equipment, below. 5. SPECIALIZED EQUIPMENT: Separate lists are maintained for requests foe four (4) wheel drive wreckers (*) and flatbed ca~ carriers (*) 11/9/99 (*)' NOTE: THESE ~PES OF WRECKERS ARE NOT REQUIRED FOR THE POLICE ROTATIONAL TOW LIST AND A TOW OPERATOR WILL NOT LOSE HIS TURN ON LIST IF HE DOES NOT POSSESS SAME. C. TYPES OF WRECKERS: 1. BOOM/SLING TYPE WRECKER: Utilized for vehicles that have a free turning axle at one end and no major airdams, ground effect extensions, or easily damaged body work. Can also be utilized in "tight" towing situations where larger trucks cannot function. 2. FlATBED/ROLL-OFF CAR CARRIER: a. Designed for newer vehicles with extensive use of plastics, airdams or easily damaged body work that cannot be towed with conventional slings. b. Requires sufficient space and straight area in front or behind vehicle to be towed in order to load. c. Can be utilized for vehicle with no wheels or all fiat tires. D. VEHICLE REMOVAL AT SCENE: 1. HIGHWAY HAZARD: First wrecker at scene will take most hazardously located vehicle as directed by Police Officer at scene. If vehicle locations are not deemed hazardous, normally first wrecker on the scene may choose which vehicle to remove if this does not conflict with overall investigation. 2. ROAD DEBRIS: Police Officer will ensure that wrecker operator clears highway of accident debris (glass, metal, etc.) prior to leaving the scene. (See Section 1219(c) NYS V&T Law.) 3. REFUSAL TO TOW: A Private ToTM Operator has the right to refuse to tow a Vehicle if it is an exotic vehicle or he cannot safely handle a particular vehicle without losing his rum on the Rotational Towing List. Such a refusal to tow is subject to review. 4. TOWING GUIDELINES: The AAA Towing Manual will be utilized as a guide for the proper towing procedures to be followed. A copy of same is maintained in the Communications Room. IV. ROTATIONS LISTS: ' i";' A. ADDITIONS/DELETIONS: Additions or Deletions from the Rotational Towing List will be maintained by the Lieutenant. B. POSTING OF CALLS: Communications will maintain ROtational ToWing List with respect to posting rotatiOnal calls,: TOw operator may review same upon request through arrangements with Lieutenant responsible for maintaining Rotational Towing List. " C. ROTATION: 1. EAST END: Entire area east of Peconic Lane. 2. WEST END: Entire area west of Peconic Lane. 11/9/99 8 D. DISPUTES: Disputes conCerning Rotational Towing will be resolved informally between the Chief of Police (or his designee) and the Private ToW Operator. E: NEW ADDITION TO ROTATION LIST: Private Tow Operators wishing to al~Ply for addition to the Police Rotational Towing List must comply with specifications set forth is APPENDIX B, APPLICATION PROCESS. F. REMOVAL FROM ROTATION LIST: Tow Operators may be removed from the Police Rotational Towing List for the following reasons: 1, REFUSAL -UNAVAILABLE - NO ANSWER/TELEPHONE: Any refusal or unavailability to respond will lose turn on rotation list. Three (3) refusals or unavailabilities in a three (3) month period will be subject to review for retention on list. 2. OVERCHARGING: Private Tow Operators who are found to violate the Rate Schedule by overcharging may be removed from list after review. 3. NON-COMPLIANCE WITH POLICY: Pdvate Tow Operators who are found to no longer comply with provisions of this Local Law will be removed from the PoliCe Rotational Towing List and will be advised in' Writing of the reasons for removal. V. RELEASE OF IMPOUNDS: A. HEADQUARTERS: 1. REQUIREMENTS: Vehicles that are held as evidenCe or held pursuant to legal statute (ie, Section 511.2 NYS V&T) will not be released unless authorized by investigating officer, District Attorney's Office or Court Order. 2. TIMES: Impounds released ONLY between the hours of 8:30 AM and 3;30 PM, Monday through Friday (Excluding holidays). Unusual circumstances, requiring special arrangements for release at other times may be made through Impound Release Officer. 3. ,PAYMENT: Full payment in CASH, US POSTAL MONEY ORDER or BANK CERTIFIED CHECK to include towing, storage and surcharge. Insurance Company checks may payable to the Southold Town Police Department are also acceptable. (See APPENDIX A, RATE SCHEDULE 4, OWNERSHIP DOCUMENTAIION: Proper ownership documentation must be produced by owner of vehicle or his designee (with written authorization for release of. vehicle). 5. PHYSICAL REMOVAL: Vehicles to be ddven from Headquarters may only be released to a pemon with a current valid driver's license and acceptable proof of insurance for the vehicle, ie Insurance ID. This will not apply if the vehicle is not to be moved under its own power but will be transported by tow truck. (See Section 1204(d) NYS V&T Law). B. PRIVATE TOW OPERATOR: Payment and release arrangements to be made through Private Tow OperatOr. Releases normally accomplished dudng ngrmal business hours unless other arrangements made. LIPA is once again trimming trees, and they practically top the entire trees,~ so those ofY°u who have sent in a note or a phone call we are talking with them. I t usually doem't do too much good. They usually say the problem is, we plant the trees under the lines to begin with and what do you prefer? Having the trees cut, or come winter the ice and snow on the branches taking your electricity? SO it is an ongoing battle every time they decide they have to trim the trees. We are placing our complaints with the company. If we ever get the lines underneath we wouldn't have the problem. Romanelli, Councilperson In the Matter Of the Increase and Improvement of facilities of the Southold Solid Waste Management District, in the Town of Southold, in the County of Suffolk, New York, Pursuant to Section 202-b of the Town Law. RESOLUTION AND ORDER ATER PUBLIC HEARING WHEREAS, the Town Board of the Town of $outhold (herein cailed "Town Board" and "Town", respectively), in the County of Suffolk, New York, on behalf of the Southold Solid Waste Management District, heretofore established and now existing in the Town (herein cailed "District"), has determined to increase and improve the facilities of the District, by the purchase (i), at the estimated maximum cost of $132,000, one used, 25 ton capacity, articulating, off-road dump truck for use in hauling sand, dirt, leaves, brush, landclearing debris and mulch to and from processing and staging areas at the Southold Landfill in Cutchogue, in the District, and (ii), at the estimated maximum cost of $30,000 (including the estimated cost of $9;500 for sewer and electrical hookups), one new office trailer approximately twelve (12) feet by sixty-four (64) feet, to include three (3) offices and a restroom facility, for use as a central office and break room for ail employees at the said Landfill, the estimated total cost thereof, including preliminary costs and costs incidentai thereto and the financing thereof in the $8,000, being the amount of $170,000; and WItEREAS, after a public hearing duly cailed and held on January 19, 1999, the Town Board of the Town determined pursuant to the Resolution and Order After Public Heating duly adopted on January 19, 1999, that it is in the public interest to so increase and improve the facilities of the District, and ordered that SUch facilities be increased and improved at the estimated totai cost of $170,000; and WItEREAS, due to increased costs of materials and labor for the acquisition of the new office trailer and the sewer and electricai'hookup thereto, the estimated maximum cost thereto has increased by the amount of $19,500 to $49,500 and the estimated totai cost of said increase and improvement of facilities is now $189,500, and it is necessary and desirable and in the public interest and the best:interests of the Town to increase the totai appropriation therefore by said amount of $19,500, from $170,000 to $189,500; and 11/9/99 20 WHEREAS, said $189,500 total estimated co§t shall consist of the purchase (i), at the estimated maximum cost of $132,000, one used, 25 to capacity, articulating, off-road dump truck for use in hauling sand, dirt, leaves, brush, landclearing debris and mulch to and from processing and staging areas at the Southold Landfill, in Cutchogue, in the District, and (ii), at the estimated maximum cost of $49,500 (including the estimated cost of $20,000 for sewer and electrical hookups and landscaping cost), said additional amount expected to be paid by the expenditure of $19,500 from available funds of the District, one new office trailer approximately twelve (12) feet by sixty-four (64) feet, include three (3)office and a office restroom facility, for use as a central office and break room for all employees at the said Landfill, the estimated total cost thereof, including preliminary costs and costs incidental thereto and the financing thereof in the sum of $8,000, being the aggregate amount of $189,500; WHEREAS, pursuant to the Order Calling Public Hearing, adopted October 19, 1999, a public hearing was duly held by the Town Board on this 9th day of November, 1999, at 8:00 o'clock P.M. (Prevailing Time), at the Town Hall, 53095 Main Road, Southold, New York, in the Town, and considerable discussion on the matter has been had and all persons desiring to be heard have been heard, including those in favor of and those in opposition to said increase in cost to the increase and improvement of facilities of the Southold Town Waste Management District; and WItEREAS~ the Town Board has given due consideration to the impact that the increase and improvement of facilities of the District may have on the environment and on the basis of such consideration, the Town Board has found that no substantial adverse environmental impact will be caused thereby; and WHEREAS, the Town Board and the Town have complied in every respect with all applicable federal, state and local llws and regulations regarding environmental matters, including compliance with the New York State Ehvironmental Quality Review Act, comprising Article 8 of the Environmental Conservation Law and, in connection therewith, a duly executed Short Environmental Assessment Form has been filed in the office of the Town Clerk; NOW, TItEREFORE, on the basis of the information given at such heating, it is hereby DETERMINED, that it is in the public interest to increase and improve the facilities of the District as hereinabove described and referred to at the increased estimated total cost of not to exceed $189,500; and it is hereby ORDERED, that the facilities of the District' shall be so increased and improved as hereinabove described at the estimated maximum cost of $189,500 and, further, that the Engineer heretofore retained by the Town Board shall prepare specifications and make careful estimates of the expense of said increase and improvement of the facilities and with the assistance of the Town Attorney, prepare a proposed contract or contracts therefore, which specifications, estimate and proposed contract shall be presented to the Town Board as soon as possible; and it is hereby FURTHER ORDERED that the expenses of so increasing and improving such facilities shall be finances by the expenditure of $19,500 from available funds of the District, and the issuance of not to exceed $170,000 serial bonds of the Town, and the costs thereofi including payment of principal of and interest on said bonds, shall be assessed, levied and collected from the several lots and parcels of land within said District by the Town Board in the manner provided by law, but if not paid from such source, all the taxable property within said Town shall be subject to the levy of an ad valorem tax, without limitation as to rate or amount, sufficient to pay the principal of and interest on said bonds; and it is hereby FURTHER ORDERED, that the Town Clerk record a certified copy of this Resolution and Order After Public Hearing in the office of the Clerk of Suffolk County within ten (10) days after adoption hereof.
