SUPERVISOR COCHRAN: Setting the date of the next Town Board meeting for May 25, 1999, at 7:30 P.M. Moved by Councilwoman Hussie, seconded by Justice Evans, it was RESOLVED that the next meeting of the Southold Town Board will be held at 7:30 P.M., Tuesday, May 25, 1999, at the Southold Town Hall, Southold, New York. SUPERVISOR COCHRAN: Communications, Melanie Doroski, when the American Cancer Society had their Daffodil Day Mel took on the responsibility, and took the orders through Town Hall, and she received a very nice thank you for her volunteer effort. Also, I had a letter from Lyn McDonald, who Is in the public relations department from Cablevislon, and they apologiZed for some of the debris that has been left along the highway from doing this upgrade of the system. Also, a letter from Margot Booth, who works for the Peconic Land Trust, and she is the young woman who has been in .charge of some of the work that is going on up there as far as the trails nd ~o forth are considered, and a letter was sent to all the volunteers ng lin there, that we are trying to straighten away some things, and then :we Work continuing on the trails. Also, a thank you to Jim Bunchuck, Wh° is !the director up at the Landfill, a thank you from a four year class that ha~d visited the Landfill, and learned about recycling, and some of the ot~her important things up there. IV. PUBLIC HEARINGS. 1. On contract for "East-West Greenport Fire Protection District, Town of Southold, New York". V. RESOLUTIONS; SUPERVISOR COCHRAN:As you know the Town Board has a policy in relation to resolutions, and at this time if there is anyone that would like to address the Town Board, or speak to any of the resolutions, please, feel free. If it is Town Board business in general that you would like to share with us we have time set aside at the end of the meeting to accept those comments. Is there anyone that would like to address the Town Board in relation to any of {he resolutions? Yes, Bernie? BERNARD HEINISCH: Bernard Heinisch, County Road 48. On Item #19, are you going to lease the vehicle from the New Jersey concern? SUPERVISOR COCHRAN: I think it is going .to leased from here. I was up island today in relation to getting an award from the State for Fort Corchaug. It was on the agenda earlier. I am not sure what all the decision made by the Town Board were, but we kind of missed the deadline date on this. I knOw John had told me that much, but I think it is going to be leased from a local dealer. He is very interested in doing that. We felt in working it out, that at the end of the lease then we will definitely look at the purchase thereof. So, it is a matter right now of leasing it, Bernie. That is the way we have to go, Any other resolutions anyone is interested in? (No response.) SUPERVISOR COCHRAN: I would like to say the first trip I ever took to Fishers Island, she gave me a recipe for Blueberry Buckle, which I use to this day, and it is absolutely wonderful. She served well, and we are sorry to see her retire. We wish her our best. 18.-Moved by Councilman Murphy, seconded by Justice Evan, WHEREAS. the Board of Commissioners of the Fishers Island Ferry District has solicited resumes for the position of Secretary in the Office of the Fishers Island Ferry District to replace lone D. Norton; and WHEREAS, resumes were received and reviewed by the Board of Commissioners of the Fishers Island Ferry District; and WiIEREAS, Nina J. Schmid, P.O. Box 207, Fishers Island, New York has been chosen to fill the position; now, therefore, be it RESOLVED that the Town Board of the Town of Southold hereby appoints Nina J. This resolution was duly ADOPTED. 2Z.-Moved by Justice Evans, seconded by Councilman Murphy, it was RESOLVED that the Town Board of the Town of Southold hereby accepts the proposal of Pirate's Cove Marine, Fishers Island, New York, in the amount of $1,900.00, for repair and replacement of channel markers and instructional floats to be placed in both .West Ha',rbqr and Hay Harbor, Fishers I;sland, New York, as Well as repairing and '~replacing, or returning missing markers that are lost during the season, ~'at ~ rate of $40.00 per mariner, under the supervision of part-.time Bay Constables Michael Con.roy, and LuJs F. This resolution was duly ADOPTED. 24.-Moved by Justice Evans, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby appoints Jessica Boger as a Full-Time Floater Clerk-TYpist for the Town of Southold, at a salary of $22,658.42, effective June 7, 1999. 24.-Vote of the Town Board: Ayes: Councilman Murphy, Councilman Moore, Justice Evans, Councilwoman Hussie, Supervisor Cochran. This resolution was duly ADOPTED. SUPERVISOR COCHRAN: That is the end of our planned resolutions. We have a public hearing at 5:00 in relation to the East-West Fire Protection District of which the Town Board is the Commissioners. Where we have ten minutes I will take comments from the audience, but I will have to stop it at five, and we will come back to the hearing. RICHARD LESSER: Richard Lesser, Greenport. I would like to know if it is possible to rescind the law of the town? The law is the Building Code 100-31C.2. It deals with selling a product out of your house. It has not been enforced, and it is non-forceable in my eyes. I don't see any reason why the Town Board can't rescind the law. COUNCILMAN MOORE: Manufactured items out of your home, or something? RICHARD LESSER: There is a list of what you can and can't do, but it still remains that you can't have. This is a subdivision. No display of products shall be visible from the street, which you go down the street of any part Qf this town you will find them outside, and no stock and trade shall be kept on the premise. SUPERVISOR HUSSIE: What were the numbers again? RICHARD LESSER: 100-31C-2. TOWN ATTORNEY YAKABOSKI: It was referring to the AC district, the R districts, and it is the residential, 1~80 and R20, and subsection C is accessory uses in that district. You Nave subparagraph 2, correct? You had C2 if I heard correctly. That deals with home occupation. What he is referring to is some of those particular sections. RICHARD LESSER: The first one is the one I am worried about. If I can't get that off the books I can't do what I want. A, no display of products shall be visible from the street, which doesn't bother me, because I won't be doing it,~ and no stock in trade shall be on the premise. That bothers me. In other words, if you want to sell something you sell it' from the .house, they don't' see it displaying, but it is still being sold as a stock in trade from the house, and I can't do it without this thing being rescinded. SUPERVISOR COCHRAN: May I ask what you are selling? RICHARD LESSER: I am a fire arms dealer. In 1996 I had to give up my license, because of this law. SUPERVISOR COCHRAN: So, like you fix guns and stuff? RICHARD LESSER: I can get a gunsmith license if I want to. Yes. I am not a, quote, unquote, qualified gunsmith with a school behind me, but I still can get a. gunsmith license to do minimal repair work. SUPERVISOR COCHRAN: What kind of guns do you sell? RICHARD LESSER: Mostly hunting, shotgun, water fowling. This is predominately the area which it is. I would say some rifles, but mostly shotguns, archery equipment after you get the license they know you are in business, muzzleloading, reloading. SUPERVISOR COCHRAN: I am familiar with all of that. COUNCILMAN MURPHY: Do you sell any handguns? RICHARD LESSER: If I wanted to sell handguns within the State I would have to get another license from the State that gave me permission. I can do it under the Federal, but only outside the State. In other words, if I wanted a handgun for a customer I couldn't buy it in New York State to sell to him unless I had a New York State permit. I would have to go to Colorado, Wyoming, Texas, somewhere outside the limits of New York to do that. TOWN ATTORNEY YAKABOSKI: You want to display the item from your home, so that it is visible from the street? RICHARD LESSER: No. No, there would be no display at all. They wouldn't even know I was there. There is no sign. TOWN ATTORNEY YAKABOSKI: Had you spoken to Ed Forrester regarding what you intend to do? RICHARD LESSER: Who is he? TOWN ATTORNEY YAKABOSKI: He is Director of Code Enforcement for the town. RICHARD LESSER: All I know is when I went over to see, I don't remember his name, but they called him, Stosh. Do you know who I am talking abc~Ut? SUPERVISOR COCHRAN: Yes. MAY 11~ 1999 SOUTHOLD TOWN BOARD RIC'HARD LESSER: The ex-Police Chief. I got all these things that were supposed to be done according to what I thought I knew, and then I got a call from one of the chief inspectors of the ATF in Buffalo, and she said, I am sending you a p.a.ckage. You will conform with the package. The sixth item on the list was, you have to get a letter from the Chief of Police Stating that you can sell out of your house, and I never ran into this, because in the County that I was before there is no law. I lived up 'n Duchess for twenty-three years, and I Cah't tell you what it did to me, SUPERVISOR COCHRAN: Let us have some time for some research, okay? He could go talk to Ed. Start with Ed Forrester, who is our Department Head in the Building Department in Code EnfoYcement: After you talk with him, if you still havel questions, or .need mor~ explanation you will come see this guy over here, the Town Attorney. Okay? RICHARD LESSER: Thank you very much. SUPERVISOR COCHRAN: Is there anyone else that would like to address the Town Board? Yes, Mr. Williams? JACK WILLIAMS: Jack Williams from East Marion. Madame Supervisor, about a year ago you expressed some dissatisfaction with the Southold Town Seal, which appears directly in front of you. I believe what you said was it was a bit too monetary for your taste. SUPERVISOR .COCHRAN: I believe I did not express dissatisfaction. I thought it would be nice for the year 2000 to perhaps change it. The Town Historian has done some research on it. It was she who said the Pound Sterling was monotary. I don't recall exactly my words, but we just thought it might be a nice project. Now, I have had two submitted, but we really haven't gone in any specific direction as a Board. JACK WILLIAMS: You might want to share those designs with the public since one of them I know is the product of one of the best art directors in America, who is now retired in Peconic. SUPERVISOR COCHRAN: Toni Booth got this gentleman to draw something, yes, and she brought them in one day before she went to the hospital, and said that she was turning them over to me. I do have his design. I don't know some Board members have expressed they would like to see it as a contest. I don't think we have really discussed it far enough to see which way we are going to go, or if we are going to. JACK WILLIAMS: I think you should consider that the first entry in the contest, and share it with the public in that light. SUPERVISOR COCHRAN: I don't think the Board is ready for it yet. Do you? COUNCILMAN MOORE: We haven't even talked about it. SUPERVISOR COCHRAN: We haven't even talked about it. It was a concept and thought that I brought up at a department head meeting. A couple of things, we are doing another project, and talked about this one, too, and my son himself said, Ma, don't change it. I like it the way it is, because it is through his lifetime, but it wasn't developed until the fifties. I believe it was when they were building the courts in Riverhead, and in the Legislative Room they have it all the way around the door, and I don't think Southold really had one at that point, so it was Supervisor Kllpp, and I think Rinky Dean, who was the Hig_hway Superintendent at the time, that kind of sat dOwn, and Toni said it was half heartily, almost like a lark, you know we will use the Pound Sterling, and so forth, so it has really never had an interpretive meaning. It is a Pound Sterling. JACK WILLIAMS: I wonder since you have had this design for a couple of months, when are you planning to show it? SUPERVISOR COCHRAN: About a month, less than a month. You can see it tomorrow. The whole world can see it tomorrow. It wouldn't necessarily be my choi~:e. SOUTHOLDTOWNBOARD JACK WILLIAMS: Do you see what we are getting into now, that contest. SUPERVISOR COCHRAN: That is why we need the contest. I put it before the Board. They can discuss it at their next meeting. I will put it on the Town Board meeting, B.etty. JACK WILLIAMS: Maybe you could put a couple on the bulletin board, so people could see it. SUPERVISOR COCHRAN: I think the way we left it, it is still in Toni's hands more than mine, because I think the way we left it was once the Board decides what direction they want to go, and we get some entries, the Board may decide they don't even want to get into this. It was a thought and an idea I had, but they may not agree. They don't always agree with me, Jack. JACK WILLIAMS: Too bad. The reason for my interest in this is because ten years ago, when I was a reporter for the Suffolk Times, I wrote a story about the Pound sign in the middle of seal, and I had the artist replace it with a dollar sign, and I said, this might be how it would look to the people of Southwold, England. SUPERVISOR COCHRAN: That is how they do react to it. It is true. They don't feel it is their place to say, but they really don't care for the Pound Sterling being there. Now, you talk to Merlon Wiggin, and he has a whole history that he recently sent me in relation to it. It was more in honor of Lord Sterling, so he has got another whole concept in his mind why it was developed as it was. The gentleman that did develop the first one that was handed in, I have since had one from Jim Grathwohl, who developed the logo for the Bicentenial celebration with the divided king of pie things in there, and so forth, and he:sent his in saying, by golly, that is the best one. If we decide to go in that direction I think it is going to take a contest with some impartial judging, and I asked the public more than once, you know, please give me any input, if you don't want to change it, or you know, if you would be happy, but you usually don't hear from people until you take action, and then they say, what are you doing? So, we will see. JACK WILLIAMS: On behalf of the public I am looking for your in~ut. SUPERVISOR COCHRAN: I just gave it to you. We will discuss it at the next Board meeting. It is five o'clock. Cochran to execute an agreement between the Town of Southold and the Village of Greenport for the "East-West Greenport Fire Protection District, Town of Southold, New York", for a term of five (5) years, ~ommencing on January 1, 1999 and ending on December 31~, 2003, and which contract includes payment to the Village, in addition to'the following sums ann~Jally, cost of maintaining the Fireman's Service Award Benefit Award Program: 1999 - $25/~,935.00; 2000 - $267,226.00; 2001 - $279,517.00; 2002 - $291,808.00; 2003 - $316,611.00; all in accordance with the approval of the Town Attorney. 25.-Vote of the Town Board: Ayes: Councilman Murphy, Councilman Moore, Justice Evans, Councilwoman Hussie, Supervisor Cochran. Everyone is always so happy with the Planning Board even though they are holding hearings at 7:00 A.M. in the morning. SUPERVISOR COCHRAN': I don't think hearings. BERNARD HEINISCH: Their Work Session, 7:00 A.M. Is this the right time to have a public Work Session, at 7:00 A.M.? Or is it because they don't want anyone else to attend their public Work Session? Why have it at 7:00 A.M.? SUPERVISOR COCHRAN: I will check with them, and find out why it is at 7:00 A.M. BERNARD HEINSCH: That is tomorrow morning. SUPERVISOR COCHRAN: Probably because some of your Board works. They have other jobs, but I will check, and see if adjustments can be made. How's that? Anything else? COUNCILWOMAN HUSSIE: I don't have anything to report, but I thought I would just cast a little flashlight on something you had mentioned, Mr. Heinlsch, and that is why we go back and forth between 7:30 and 4:30, and I am sure Jean knows this too. It has always been something that bothers people. People who want it at 4:30 can not understand why it had to be at 7:30. Those people who want it at 7:30 see no reason for it to be at 4:30, and our only way to try to please, and as Lincoln said, I think it was, you can please some of the people some of the time, but you can't please all of the people all the time. SUPERVISOR COCHRAN: Did he say that? COUNCILWOMAN HUSSIE: Who was it? COUNCILMAN MOORE: Wasn't it Mr. Barnum? SUPERVISOR COCHRAN: Yes, the circus person. BERNARD HEINISCH: What I don't understand is when you have a Planning Board member, that is supposed to represent the Town, regardless of his other jobs, he has his duty to this town, and that duty should also be precedent when he is. holding hearings in relationship to the town. I really don't care about his personal job. This is the job I am quite concerned about. This is one that he ~s appointed to. This is why you appointed these people to the Board. This is Why they get paid from the Town. COUNCILWOMAN HUSSIE: My reply to you is strictly to the Town Board's schedule. BERNARD HEINISCH: I understand that, but I am just reinforcing. SUPERVISOR COCHRAN: Yes, you certainly are, and I will check with the Planning Department, and the Planning Board, rather than the department. Mr. Moore? COUNCILMAN MOORE: I am going to pass. SUPERVISOR COCHRAN: Mr. Murphy? Louisa? I would like to share with you, we did go up to ~Jones Beach today to receive a presentation from Commissioner Castro, and Bernadette sent her best to the Board. We received an award, which I will show when the TV is here next time so we can share it with people. New York State gave six awards in relation to Heritage and Pr. eservatibn, and we received this on our Fort Corchaug acquisition. It was a lovely lunch, and everyone was there, be it from the State Parks, or from S.PLIA, so I made some nice contacts in ~elation to future grants for money, and a few other things, which is always good, but we were pleased and delighted, and on behalf of the Town Board I soU~0LD TOWN BOARD MAY 11,1999 I 5 9 expressed our sincere appreciation for being selected as one of the six in the entire State of New York.
