A Regular Meeting of the Southold TOwn Board Was held on April 28,
1999, at the Southold Town Hall, Main Road, Southold, New York.
Supervisor Cochran Old'ned the meeting at 4:30 P.M. with the Pledge of
Allegiance to the Flag.

SUPERVISOR COCHRAN: May I have a motion to approve the audit of bills
of April 28, 19997
Moved by Justice Evans, seconded by Councilman Murphy, it was
RESOLVED that the followlng bills be and hereby are ordered paid:
General Fund Whole Town bills in the amount of $276,192.19; General Fund
Part Town bills in the amount-of $1,386.57; Highway Fund Whole Town bills
in the amount of $7,805.62; Highway Fund Part Town bills in the amount of
$6,700.14; Capital Projects Account bills in the amount of $128,801.00; Ag

SUPERVISOR COCHRAN: Approval of the minutes of April 13, 1999, Town
Board meeting.
Moved by Justice Evans, seconded by Councilman Murphy, it was
RESOLVED that the minutes of the April 13, 1999, Town Board meeting be
and hereby are approved.

SUPERVISOR COCHRAN: Setting the date for the next Town Board meeting
for May 11, 1999, at 4:30 P.M.
Moved by Councilwoman Hussie, seconded by Justice Evans, it was
RESOLVED that the next meeting of the Southold Town Board will be held
at 0,:30 P.M., Tuesday, May 11, 1999, at the Southold Town Hall, Southold,
New York.

This resolution was duly ADOPTED.
SUPERVISOR COCHRAN: From tifne to time one of the things that the
Town Board does is to, present proclamations. It could be anything from a
hundred year anniversary, or a birthday, o~' community service, and we
have that kind of proclamation today. Nancy, would you join me, please?
Nancy feels that she is not a heroine, but we see it differently. We think
what you ~did was great and courageous. I would like to share this
proclamation from the Town Board.
SOUTHOLD TOWN BOARD
Moved by Supervisor Cochran, seconded the Entire Town Board,
WHEREAS, the Town Board of the Town of Southold wishes to join with
the family of Bertha Orlowski in recognizing NANCY DERMODY of
Alvah's Lane, Cutchogue, New York, for taking decisive and quick action
at a time of a medical'emergency; and
WHEREAS, on Friday, March 26, 1999, at 3: 40 P.M., NANCY
DERMODY, a bus driver working her routine bus route, went to drop
off her last passenger, seven (7) year old Dan Sawicki, at the home of
his grandmother; Bertha Orlowski; and
WHEREAS, finding the door tightly closed and the faithful grandmother
nowhere in sight, NANCY DERMODY, stopped the bus and loudly
beeped the horn. Receiving no response, she proceeded to go up the
road, turn the bus around and returned to Mrs. Orlowski's home, this
time finding the door 'to be slightly ajar; but still no sign of Mrs.
Orlowski; and
WHEREAS, NANCY DERMODY, sensing something amiss, stopped the
bus SafeLy alongside the. road and walked with Dan to the slightly opened
door. Peeking her head into the doorway, NANCY found Mrs. Orlowski
to.i.b.e barely conscious and took immediate charge of the medical situation by
dialing~ 911 to activate the Emergency Medical System. NANCY comforted
Mtg. Orlowski Until the arrival of the Cutchogue Fire Department Rescue
Squad that assessed condition, rendered the necessary care, and
stabilized this g~ for transport to Eastern Long Island Hospital
where it was determi~ that she had suffered a massive heart attack and
tha~ ~e quick NANCY DERMODY more that likely saved her
life; now, therefore, be it
RESOLVED that the vn Board of the Town of Southold takes great
Pmri~e in its citizen commends NANCY DERMODY for her
er~ito~i°Us actions of a life and the care of an apprehensive
child that went a bus driver's duties and responsibilities on this
par;ticular Friday afternoon.

SUPERVISOR COCHRAN: I would like to present this to you, Nancy, on
behalf of the entire Town Board. We congratulate you on your good
thinking, and being a good citizen in the Town of Southold.
NANCY DERMODY: I am no orator, but I think everyone needs to know
that when those children get on our bus they are part of our family. I
mean they are our family, and you care about each and every one of them,
and all the drivers, it is the same thing, so I really don't feel that I did
anything anymore than any other driver would have.
SUPERVISOR COCHRAN: Perhaps now, Nancy, but you did, and through
this we are able to say, thank you, and we thank all the other bus drivers
at the same time, because they are a very important part of the community.
They do consider the kids their family.

SUPERVISOR COCHRAN: As you know each month the Town Board during
the day has their Work Session, and as part of that Work Session we
receive certain information that works it's way through Town Hall, and we
receive monthly reports from our committees, and from our different
departments. We review these reports, and they are public information, and
if anyone would like to have this information, please, feel free to go into
the Town Clerk's Office, and avail yourself of any of the reports that are
presented to the Town Board.

III. COMMUNICATIONS.
SUPERVISOR COCHRAN: Communications, we have a thank you from Robert
Hughes congratulating and thanking the ZBA for their cooperation, and
their service. We have a letter from Governor Pataki, Suffolk County Fire
Chief's Council in opposition, they are looking at more than one State
Building Code, I believe, because I know I had just a little bit of
information about it through the Small Towns and Villages. I am sure we
will hear more, but this is a letter in opposition. We also have a thank
you for voicing opposition to the loss of the Main Road parking in
Cutchogue, and then Betty received a letter from the DOT in relation to
the traffic signal on Route 25~ and Factory Avenue in Mattituck, so we do
get correspondence from agencies. Again, they are for your interest and
perusal.

opposition to loss of Main Road parking in Cutchogue.

V. RESOLUTIONS.
SUPERVISOR COCHRAN': As you know the Town Board has a policy. If
you would like to address the Town Board in relation to any of the
resolutions that are to be acted on today we would be very happy to take
your input at this time. There will be a time at the end of the meeting, at
the conclusion of the passage of the resolutions for any other comments you
might want to make to the Town Board, or information that you feel would
be of interest to us, or anything we can answer, we would be very happy
to take your comments at that time on any other ToWn business. At this
time I will ask if there is anyone that would like to address the Town Board
in relation to any of the resolutions on the agenda.
BERNARD HEINISCH: My name is Bernard Heinisch. I live on County Road
48. I wonder if~ you can explain Resolution #10, the renting of a Crown
Victoria?
SUPERVISOR COCHRAN: That is the car that I drive. The car that I
driVe now is presently, also, a leased car, and that is what this will be.
The lease of the first one was three years. This will now be replaced with
another car.
BERNARD HEINISCH: How much is the lease for, a year, and do you have
to pay mileage besides?
SUPERVISOR COCHRAN: No. The car is like it is ours. We just pay a
monthly lease fee. I don't have the figures right here. Do you know what
they are?
JUSTICE EVANS: $419.00
SUPERVISOR COCHRAN: It is on a State contract, State bid.
BERNARD HEINISCH: I was wondering why you don't purchase a car. You
can purchase that same car on State contract for $19,000, and you own it.
SUPERVISOR COCHRAN: It was recommending by our Finance Department
that it be handled this way. So, we did it three years ago, and this is a
replacement.
BERNARD HEINISCH: It wouldn't be cheaper purchasing it?
SUPERVISOR COCHRAN: If you want to come in, I will go over the figures
with you. On the State bid it does not appear to be...
BERNARD HEINISCH:
besides of $.06 a mile.
On the State bid it calls for a mileage charge
SUPERVISOR COCHRAN: Finance takes care of this, Bernie. If you want
to come in tomorrow I will be happy to sit down with you, and have Finance.
BERNARD HEINISCH: It will be too late. The resolution would be passed.
SUPERVISOR COCHRAN: I will hold it. I will hold the resolution for two
weeks, if you want to come in, in the next two weeks. Call my office and
make an appointment, please. Anyone else like to address the Town Board
on any resolution? (No response) If not, we will begin the action on #1.

WHEREAS, Stacy A. & MiChael Sheppard have proposed a change in
zone for the property identified as Suffolk County Tax Map #1000-115-9-5.1
consisting of approximately 1.2. acres on the corner of the south side of
New SuffoJk Avenue and the west side of Airway Drive, Mattituck, New
York; and
WHEREAS, the proposed change of zone is from Light Industrial (LI)
to a Residential Low Density District (R-it0); therefore be it
RESOLVED that the Town Board of the Town of Southold hereby finds
this to be an UNLISTED Action pursuant to SEQRA and the Rules and
Regulations set forth in NYCRR 617 et seq.

commences the Lead Agency Coordination process with regard to the State
Environmental Review Act in the matter of the petition of Stacy A. &
Environmental Review Act in the matter of the petition of Stacy
Michael J. Sheppard for a change of zone from Light Industrial District
(LI) to Residential Low Density District (R-tt0) on the corner of the south
side of New Suffolk Avenue and west side of Airway .Drive, Mattituck, New
York. SCTM#1000-115-9-5.1. Consisting of 1.2 acres.

south side of New Suffolk Avenue and west side of Airway Drive,
Mattituck, New York; now, therefore, be it
RESOLVED that the Town Clerk be and she hereby is authorized and
directed to transmit this petition to the Southold Town Planning Board and
the Suffolk County Department of Planning for their recommendations and
reports, all in accordance with the Southold Town Code and the Suffolk
County Charter.

permission to Raymond Cleaves Post No. 861 American Legion, Mattituck,
New York to use the following town roads for a Memorial Day Parade on
Monday, May 31, 1999, provided they file with the Town Clerk a One Million
Dollar Certificate of Liability Insurance naming the Town of Southold as an
additional insured: Pike Street, Westphalia Avenue, Sound Avenue, Pacific
Street, and Maple Lane, Mattituck, New York.

Saturday, June 1999, during the Peconic Land Trust's annual
Peconinic picnic being held on the adjacent property of Russell McCall,
Cutchog,ue, New York,. pr. ovided they fil~ with the Town C erk a One Million

house per week at the Nutrition Program of the Southold Town Human
Services Center, at a salary of $7.0,5 per hour, effective May 3, 1999.

Sabrina Crenshaw as a part-time mini-~an driver to work 17 I/2 hours
per seek at the Nutrition Program of the Southold Town Nutrition Center,
at a salary of $7.t~5 per hour, effective May 1, 1999.

RESOLVED that the Town Board of the Town of Southold hereby
authorizes Supervisor Jean W. Cochran to sign an agreement with the
Family Service League of Suffolk County to provide professional services for
the Town of Southold ,Youth Services Program, subject to the approval of
the Town Attorney.

12A.-Moved by Councilwoman Hussle. seconded by Councliman Murphy.
WHEREAS. as part of the Town's Shellfish Program. the Suffolk County
Marine Environmental Learning Center will spawn hard clams, oysters and
scallops and the hard clams, oysters and scallops will be planted in various
creeks and bays in the Town of Southold as recommended by the Southold
Town Shellfish Advisory Committee; and
WHEREAS, the Town Board of the Town of Southold finds that this is an
UNLISTED Action pursuant to SEQRA and the Rules and Regulations set
forth in NYCRR 617 et seq.; and
WHEREAS, there are no other involved agencies; therefore, be it
RESOLVED that the Town Board of the Town of Southold declares itself
Lead Agency.

12B.-Moved by Justice Evans, seconded by Councilman Murphy,
WHEREAS, as part of the Town's Shellfish Program, the Suffolk County
Marine Environmental Learning Center will spawn hard clams, oysters and
scallops and the hard clams, oysters and scallops Will be planted in various
creeks and bays in the Town of Southold as recommended by the Southold
Town Shellfish Advisory Committee; and
WHEREAS. the Town is the Lead Agency for the above-described
pro,eot; and
WHEREAS. a Short Environmental Assessment Form has been completed;
.and
WHEREAS. based on the information analysis contained in the Short
Environmental Assessment Form the proposed action will not result in any
significant adverse environmental impacts; and
WHEREAS. the proposed action will actually have positive environmental
benefits in assisting in the rehabilitation, replenishment and preservation
of the shellfish resources of the Town; therefore, be it
RESOLVED by the Town Board of the Town of Southold that the
above'reference pro~ect will not have any significant adverse environmental
impacts and the Town Board hereby issues a Negative Declaration for this
action.

RESOLVED that the Town Board of the Town of Southold hereby
authorizes Supervisor Jean W. Cochran to sign an agreement with the
Suffolk County Marine Environmental Learning Center to provide
professional services for the Town of Southold, as part of the Town's
Shellfish Programs, subjecLto the approval of the Town Attorney.

Fork Housing Alliance to implement the following 1999 Community
Development Block Grant Programs:

14.-Moved by Councilman Murphy, seconded by Justice Evans, it was
RESOLVED that the Town B6ard of the Town of Southold hereby grants
permission to Supervisor Jean W. Cochran to execute a lease agreement
between Jessie H. Jackson & Frances R. Jackson and the Town of Southold
for the black top park'ii~g area north of Main Road, Southold, for a term of
three (3) years, May 1, 1999 through April 30, 2002, at a total rent of
$1,680.00, to be paid in full upon execution of the lease.

RESCINDS RESOLUTION NO. 12 OF THE APRIL 13, 1999 Southold Town
Board Meeting, which resolution reads as follows:

WHEREAS, the Local Government Records Management Improvement Fund
was created in 1989 to provide technical assistance and grants to establish,
improve or enhance records management programs in New York's more that
4300 local governments; and
WHEREAS, as sunset date for the LGRMIF was established in the
original legislation to permit its operation as a five-year experiment, and
WHEREAS, the LGRMIF operated successfully and supported essential
advisement and grants projects signally to improve the management of
records and information in local governments, and
WHEREAS, the New York State Legislature in 1995 extended the sunset
date to December 31, 2000, and
WHEREAS, the LGRMIF and the programs it supports continue to
operate at a high standard of excellence and provide direct and significant
benefit to local government at no cost to the taxpayers, and
WHEREAS, local governments in Nassau and Suffolk Counties have
benefited from technical assistance, training, publications and 422 grants
totaling over $9 million supported by the LGRMIF, and
WHEREAS, the LGRMIF continues to be critically important in the
fulfillment of the many records and information related responsibilities of
local government name, and therefore
BE IT RESOLVED that the Southold Town Board supports the elimination
of said sunset provision of December 31, 2000 in order to make the
LGRMIF permanent.

SUPERVISOR COCHRAN: Just a word of explanation, for those of you who
have been: calling in relation to the deadline having passed this week in
taking the leaves and brush in free, our Highway Superintendent Ray
Jacobs feels that it is going to be another three weeks collecting along the
highways. We have more than has ever been left for us before, and it is in
a sense bogging down the landfill, because you can only process so much
leaves and brush at one time, so it is kind of put them behind the eight
ball, also, so if we extend it another three weeks as far as taking it in
yourself free it certainly will help Jake in the load that he has, but I
think the town looks pretty darn 9ood. The flowers and everything are
blooming right now, but where they have picked up the brush and litter
the community looks nice right now. Let's hope it stays like that all
summer.

SUPERVISOR COCHRAN: Because of his eyesight. John just loves this
committee, and the guys on the committee would really like to have him stay
involved, so we felt this was a way that he could, and he has given up his

SUPERVISOR COCHRAN: That is the end of our planned resolutions. At
this time we would be very happy to take any point of business-from those
attending. If there is there anyone who would like to address the Town
Board, share something with us, we would be be very happy. Yes, ma'am?
Marilyn Quintana is our Receiver of Taxes.
MARILYN QUINTANA: Marilyn Quintana. I am here on behalf of
several of the people from East Marion, who are concerned about the Dam
Pond site, and I don't ~know what. the status is now. I said I would come,
and try and find out from you exactly where it stands at this point.
SUPERVISOR COCHRAN: We are moving forward. I can tell you that we
are supportive of acquisition, and I can tell you 'we are in negotiations.
Yes, we feel it is also a very important piece of land. It is a pristine
visual view. Since the the beginning Of Southold you have been able to look
at that po|hr of land as you drive across the causeway, and I think it
benefits everyone, not just .Orient and East Marion. We are movln9 on it.
The Board gave permission today to move ahead on some aspects of it, and
that is what I can share witl~' you at this point.
MARILYN QUINTANA: So, at this point, it is at a standstill.
SUPERVISOR COCHRAN: It is not a standstill. It is moving ahead. It is
going to the point of negotiations.
MARILYN QUINTANA.~ How do we keep track of what is happening with
this now, and when do we can give our input?
SUPERVISOR COCHRAN: I think we know the input of every resident that
lives down there. The whole world wants this piece of land saved.
MARILYN QUINTANA: I have a picture of the grist mill that was there
also.
SUPERVISOR COCHRAN: Do you really? I would love to see it.
MARILYN QUINTANA: I have others at home.
SUPERVISOR COCHRAN: We realize the value, and as I said, we are
moving ahead, and it is being negotiated.
MARILYN QUINTANA: Are there funds to purchase it?
SUPERVISOR COCHRAN: We have Peconic Land Trust working with us. I
am not going to answer that. Yes, there are, but we have Peconic Land
Trust developing a strategy, and, yes, it is moving ahead, Marilyn.
MARILYN QUINTANA: Okay. I don't know if anyone else had questions.
SUPERVISOR COCHRAN: Is there anyone else on the same topic?
MERLON WICGIN: Merlon Wiggin, resident of East Marion. As you can
tell there are a lot of strong feelings from the .people that live in that
area. That has been a vista that everybody looks at since I came here, and
long, long before that. To me that additional graphlc dis play, Scott
Redfield has taken absolutely unreal photographs of that area. You may
already have one.
SUPERVISOR COCHRAN: Thank you. Merlon, the comments, positive
comments are not just from the Orient, East Marion area. As I said, we
have people in Mattituck, Cutchogue, many people that feel that this one
vista that really must be preserved, and so we are working toward that
end, and actively at this point.
MERLON WlCCIN: I am glad to hear that.
SUPERVISOR COCHRAN: Mrs. Oliva?
RUTH OLIVA: Ruth Oliva, Orient. I just wanted to say I am delighted
to hear there is progress being made on that spot of land at Dam Pond. I
know the executlve committee of the Orient Association met the other day,
and they were most concerned with that, because that is probably one of
the most, as you know, in the whole town one of the best pieces of
property to be acquired, and Merlon knows that we have been working on
this whole thing with the Dam Pond, and the Kull Beach estate, and that
has been for almost twenty years in one fashion or another. So, it will be
absolutely wonderful if you are going to get that in our possession.

SUPERVISOR COCHRAN~ We agree, Ruth.. Anyone else like to address the
Town Board?
BERNARD HEINISCH: I have a question on the property.
SUPERVISOR COCHRAN: Not all of it, no. It is upland.
BERNARD HEINISCH: About what percentage is wetlands?
COUNCILMAN MURPHY: Less than 10% I would think.
Is this wetlands?
RUTH OLIVA: There is.an old farm road that was filled in wetlands that
the Trustees have said that they hav.e jurisdiction over. That piece was
farmed not too many years ago.
BERNARD HEINISCH: Is it still considered wetlands?
SUPERVISOR COCHRAN: Would you say what? Brian, would you say maybe
10%?
COUNCILMAN MURPHY: 10% of the whole piece is probably wetlands.
SUPERVISOR COCHRAN: What Ruth is referring to there is a culvert that
has to have DEC permitting, and Trustee permitting, in order to allow
egress and ingress to one of the spits of land, or part of the land, the
point, that we treasure more than anything. I know the DEC was down
there about a week ago. They have been issuing the official permits, but I
know they saw no problem with this road. We are moving as quickly as we
can. We think we have something good going, and it is a package being
formulated by Peconic Land Trust, and so it looks good.
BERNARD HEINISCH: My only concern was if it was all wetlands I would
ask if it is not buildable, why purchase it, but being it is only 10%.
COUNCILMAN MURPHY: Bernie, it also has been subdivided.
SUPERVISOR COCHRAN: It is subdivided one side, four lots.
BERNARD HEINISCH: Into building lots?
SUPERVISOR COCHRAN: Yes.
BERNARD HEINISCH: Thank you.
SUPERVISOR COCHRAN: Any thing else? (No response.) If not, I will
call for Board reports starting on left with Councilwoman Hussie,
COUNCILWOMAN HUSSIE: Who has nothing to say.
SUPERVISOR COCHRAN: Councilman Moore?
COUNCILMAN MOORE: I will be real brief. There is a lot of sad news out
there that we watch on the television, and press, and that was great to
have a proclamation for Nancy. That was in the works for a couple of
weeks. I am glad we gave it to her. I had the good occasion of attending
the Eagle Scout Code of Honor for lan Lorras on Sunday, and one of the
presenters of many proclamations kind of wished that those kind of good
events got the attention of the public the way the negative events and
horrific events get the attention, so I will give my two sense worth in my
air time to congratulate lan on his Eagle Scout Award, and give him some
play in the paper and the press that way. Thank you.
SUPERVISOR COCHRAN: Councilman Murphy?
COUNCILMAN MURPHY: I also had the privilege of attending lan's
elevation to Eagle Scout, and I was quite impressed, and it is nice to see
positive things happen in our world today other 'than what we do read in
the paper. Second thing, and this I was going to mention, and it was
talked about, that the Land Preservation Committee in conjunction with the
Town Board has working on that parcel, plus numerous other parcels in
town. At the present time we have had .some submissions. I can't tell you
which parcel at this po. iht, because we are in. negotiations. We are moving
along. We have got some nice parcels coming along, and I think in the next
few months you are going to see quite a bit more being done in the land
preservation area. I also, along .with the Supervisor, attended a Economic
Development Conference yesterday at the Vineyard Caterers, talking about
opportunities for economic development in town; how local businesses can be
helped. I thought it was 'a positive meeting, and to allow us to find out
where resources are, and how we can use them to see what we can do with
it, and that was it. Thank you.
SUPERVISOR COCHRAN: Louisa?
JUSTICE EVANS: No.
SUPERVISOR COCHRAN: I would like to share several things with you. We
are going to close this down as quickly as we can, and I will close the
meeting with some information, but first, one of pieces of great news from
Bernadette Castro, od~ Commissioner of State Historic Preservation Officer,
Southold Town is going to be receiving the New York State Historic
Preservation Award. There are only six of these given in the State of New
York, and Southold was selected for preserving Fort Corchaug, of which
the State was one of the partners in the funding. So, we will be traveling
on Tuesday May 11th, at 11:30 up to the Boardwalk Restaurant in Jones
Beach, and we will have lunch and Bernadette, the Commissioner, will
present us with the award, so we are very pleased about that. I would
like to say that I went up to a hearing for the County Legislature last
week, and one of their first orders of business, evidently they have what
they call Volunteers Week, I guess, because each Legislator brings in
someone from their community that they feel is a topnotch volunteer
benefiting the community at large, and unbeknownst to me we had submitted
his name, but then we hadn't really heard anything, but our Neb
Brashich from Southold, he is President of the hospital, and he serves on
our Southold Transportation Committee, so we would like to congratulate him
on his award from our County Legislator Mike Carracciolo. What I started
to share with you is the Southold Transportation Committee has been
working very hard to put a bicycle safety program in place. We received a
grant from the Allstate Insurance Company, and the Town Board was kind
enough to add a nominal amount of funds, so it gave them enough for the
program. They will be doing the safety aspect, and each child will receive
one of these flashing gizmos, that you can either hook to your clothing, or
to the bicycle itself. In addition they are requesting of the schools that
essays be written, and there is going to be the awarding of, I believe,
there is two bikes, two divisions, and two bikes, and they have been
donated by the Greenport Bike Shop. So, we are quite happy once again,
Neb, and Val, and the rest of the people on that committee have come up
with a program that certainly will be important and benefit the community.
What I would like to share .with you, we do have sad news. Patty
Acampora, her brother passed away suddenly. He was 3~, years old, and
he had a massive coronary, and didn't feel good, went to bed, and he
died. He leaves two children, one three, and one ten. The wake is this
evening, so some of us are going up, and he will be buried tomorrow. It is
in Newsday today, if anyone would like to have the details. So, we
would like to close the meeting today in memory of patty's brother, Michael,
and we extend to the family our sincere sympathies, and I ask for a motion
to adjourn.
