Romanelli, Councilman Brian G. Murphy, Town Clerk Elizabeth A. Neville, Town Attorney Gregory J. Yakaboski. Absent: Councilman William D. Moore.. 9:10 A.M. The Town Board reviewed IV. For Discussion Items. IV. 1. Land Preservation Administration. Supervisor Cochran advised that wetlands, historic places and parks are all allowed within the 2% laws. All of our land preservation efforts have been handled by the Land Preservation Committee to date. The tasks are going to become a lot larger and there will be a lot of opportunity to obtain funding. We are going to need additional help to coordinate all of these activities with the County. Up until now the Land Preservation Committee has handled it all, but it has gotten to the point where a full-time person is needed to manage these tasks. The day to day management has to be handled by a staff person. It is proposed to promote Melissa Spiro to the position of Senior Planner and assign her to the task of coordinating the efforts of the Land Preservation Committee. It is also proposed that an additional planner be hired that can take over some of Melissa's duties. We have a state grant that will cover $18,000.00, approximately half of the salary. The Town will have to make up the difference and as time goes on it will become a town responsibility. Councilwoman Hussie asked if these duties will be ongoing or are they just initial duties? Councilman Murphy answered on-going. The Board discussed site plan and subdivision considerations on these applications. Someone will be needed to administer all of these in-house. This much needed planner ~ould be used in several places. Data processing and the GIS could also use help. Supervisor Cochran has substantiated this by talking to Valerie and the Land Preservation Committee. This person would also provide in-kind services for grants. Someone is needed to watch over grant applications once they are approved, to oversee and follow-up to make sure that things happen when they are supposed to. As Senior Planner, Melissa will be given half to Valerie and half to the Land Preservation Committee for the Community Preservation Fund. Chairman Ryan informed that we currently h~ve one million dollars in approved grant monies. Up to 10% of this money can be used for administration. We have received the grant award from the New York State Department of Agriculture and Markets. Administration, appraisals and surveys are all a part of that 10% allowance. Valerie explained that Melissa also currently handles all inquiries of which there are many. Hours and sometimes months, even years of work, discussions and meetings proceed an actual application before it finally shows up on the monthly report. So, the monthly report of the Planning Board is not always a good indicator of how busy they are. Bob Kassner handles commercial site plans, winery applicatic~ns and farmstands. Melissa stated that the Town should be assisting people in the beginning stages of development rights to help them develop their initial plans. (See Resolution No. 31). The Town Board reviewed the Rules and Regulations for the Peconic Bay Region Community Preservation Fund Real Estate Transfer Tax which Supervisor Cochran received at the last East End Supervisor's Meeting from Fred Thiele. The Town Attorney will review it to make sure that all of it pertains to us. The additional planner position will be discussed further in Executive Session under personnel. IV. 2. Floater - Clerk-Typist. Comptroller John Cushman was instructed to call for a civil service list for this position and for "Senior Planner". At least six town departments have indicated a need for the floating clerk-typist. Ruthanne Woodhull in the Supervisor~s Office will be in charge of coordinating the work schedule for this person. IV. 3. Acquisition of County owned properties. Supervisor Cochran communicated with Steve Jones on this. We will be getting all of the properties fo'~ $1.00., Most of them are park and playground areas within subdivisions. Councilman Murphy commented that most of these areas have become blighted. Councilwoman Hussie questioned whether or not the Town should assume the responsibility of these properties. Supervisor Cochran remarked that it would be ludicrous not to accept them, in light of all of the Town efforts to preserve open space, etc. Councilwoman Hussie questioned why the Town couldn't resell them ars building lots. This is not allowed, there is this restriction attached-to them. (Scc Resolution No. 3~]. IV. ~. Peconic Land Trust Easement Monitoring Report at Downs Farm Preserve. This item will be held for when Tom Caufield is present. IV. 5. Appellate Division - Decision on San Simeon BY the Sound. Supervisor Cochran commented that she was very disappointed with the decision that the court has made twice. The Town just does not agree with it. Assessor Bob Scott informed that we could appeal it, but he doesn't think it is worth putting any more money into. The Creenport School Board asked us to pursue it and we did. Bob Scott asked .~the Supervisor to mention the March 1st deadline .for the STAR Exemption Program at teday's public meeting. IV. 6. Southold'Public Utility Agency - q~own Attorney Yakaboski said that there Ts power available to buy, but you just can't distribute it once you get it here. He recommends having a special counsel come in who deals with it on a day to day basis, an expert in the field. The usage for the entire town is ti5 megawatts of power. If the resolution passes, it is still subject to a mandatory referendum. It must be done at least 80 days before an election, he recommends 90 days~, at least by August 1st to have everything ready to go for-the referel~dum. C. omptroller Cushmar~ :recommended bringing in an expert to make a recommendation to the Board. Town~Attorney Yakaboski said that it is a legitimate access problem at the moment~ involving transmission distribution, and stranded asset costs. :Supervisor Cochran stated that she would like Greg to get prices to bring in a special counsel. Justice Evans said that she doesn't rWant another study on it, she wants a legal opinion. Councilman Murphy said that he' would like Creg to come back with prices and specific recommendations on how we should proceed on it. Councilman Romanelli said that he would also like to see prices. Councilwoman Hussie asserted that she would just like the resolution adopted as presented. IV. 7. Engineering Services for Peconic Landing. Held for Executive Session. ~ustice Evans presented another matter for discussion that was not on the agenda concerning the Fishers Island Sewer District contract with Diversified Technologies Inc. for lion i · ~ - call serv ces to evaluate short term problems. (See Resolution No. 35). 11:35 A.M. The Town Board reviewed resolution numbers I through 35 to be voted upon at the regular ~:30 P.M. meeting On motion by Justice Evans, seconded by Councilman Murphy, it was RESOLVED that the Town Board of the Town of Southold enter into Executive Session for the purpose of discussing contracts, litigation, personnel, acquisition of property. Vote of the Town Board: Ayes; Councilman Romanelli, .C.'ouncilman Murphy, Justice Evans, Councilweman Hussie, Supervisor Cochran. Also present: Town Clerk Elizabeth NevTIle, Town Attorney Gregory Yakaboski. Executive Session ended at 12:q0 P.M. at which time the Town Board recessed for lunch. l:q~ P.M. - Appointment with Jared Kramer of Real Time Services, Inc. Supervisor Cochran advised that we have received a complaint with regard to the acoustics and hearing in the meeting hall, as far as providing service and equipment to hearing impaired, persons. A f~d. eral agency called her and said that they would like to mediate the problem with the Town. The Supervisor informed them that she: would just like to fix the problem. Mr. Kramer advised that there are three to four different systems. He demonstrated the infrared and the FM frequency options. Mr. Kramer requested permlsslon to come in perhaps over the week-end and look at the electrical box in the present public address system to determine what is there before he can give us an estimate. This will be coordinated between the Supervisor~s Office and the Town Clerkls Office. SOUTHOLD TOWN BOARD FEBRUARY 18, 1999 2:15 P.M. Appointment, Tim Caufield, Peconic Land Trust Re: Downs Farm The Board questioned the $121,000.00 being eequested by [he Peconic Land Trust for services. Mr. Caufield explained that this would cover funding for everything during 1999, including the $30,000.00 for their contract. Mr. Caufield advised the B'dard of the National Park Service Grant for which the deadline for filing is Monday and they would like to file on behalf of the Town of Southold. The Board gave them the g~o ahead to submit this application. (See Resolution No. 36) The Board had many questions on the plans for the $121,000.00. Tim Caufield will work on a draft plan and submit it next week. On motion by Councilwoman Hussie, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold enter into Executive Session at 3:05' P.M. for the purpose of discussing personnel and contracts. We are waiting for a gentleman that will be joining us, but that gives me a mi.n. ute to share some information with you. Once again, we would like to stress as a Town Board to the entire community in relation to the STAR Program. Everyone that has their primary residence in the Town of Southold no matter what age you are, you are entitled to the basic exemption, be it someone 35, be it some one 21, you have property, you own your house, you are entitled to this basic. There are many, many people out there that have not ~et come in, and filled Put a form here in To~n Hall. Please make every effOrt. The deadline is March 1st. Just believe me, .you are entitled. WILLIAM VAN SCHAICK: What we are doing is basically is we are soliciting; the purchase of bouquets of daffodils. Customers will come in, pay $6.00 to us, wh,ch ult,matey we will donate to the American Cancer Society. At the time that they come back for a pickup, which we are going to set up in March. Not only would we give them daffodils, but we are also going to give them an additional certificate for $6.00 off of $20.00 purchase. So, essentially it doesn% cost the customer anything. We are raising the money. The customers are happy. SUPERVISOR COCHRAN: I usually get them through the staff here in Town Hall. Maybe I should go to A~lway and get my daffodils. MARLA SCHWENK: Anyway that you want to do it, but we are really, really pleased, because all of the Agway stores are participating, and I would like to say that, we are very grateful .~or the proclamation, and you were talking about Brian, who has cancer. The /~merican Cancer Society has an camp, a children's camp called, Camp Adventure and is held at Peconic Dunes the last two weeks of .August, and it is for children with cancer, and their brothers and sisters, and it is a wonderful program. SUPERVISOR COCHRAN: I was just doing catch-up on some of my mail before the Board meeting, and I believe that notice is in my present mail. SUPERVISOR COCHRAN: I won't go through all the communication, but I will refer to one letter., from the United States Department of the Interior, the National Park Service, in relation to the Fort Corchaug site being named as a National Landmark. We are now fortunate in the Town of Southold. We have two National Landmarks. We have the Old House in Cutchogue, and now we ~have the Fort Corchaug. I. believe that the Old House Society is having a celebration this summer. I have been asked, August l~4th, to be honorary chairman of a clambake, so around that time they are going to be celebrating the Old House as a National Landmark, and they would also like to celebrate the Fort at that time, so when they develop more of their .plans I ara sure they will be letting you know about it. I would like to thank everyone that was a part of submitting the form, and us reaching this point. I think the community should: be pleased. 1. Carol D. SUPERVISOR COCHRAN: As you know we act on resolutions each Board meeting, and at this time we give those attending the opportunity to share with us opinions, or just anything in relation to any of the resolutions that are on for Town Board action, pro, con, a question, we would be very happy to answer it at this time. If you had something you would like to address the Board on in relation to Town Board business, but not as a part of any of the resolutions, we would be very happy at the end of the meeting to entertain your comments and remarks. I would like to just comment on a newspaper article that I read in the Suffolk Times this morning on preservation, and also, on an article that I read in the Newsday yesterday on the same subject, a report that the Town Board has a $75,000 grant they gave to Suffolk County Planning Manager by the name of Stephen Jones, and I am concerned about this, because the report that I read yesterday in the Newsday article adding some more information than the article appearing in the Suffolk Times, and I put the two together. It raised a lot of questions, so what I would like to ~now is, I would like to know when a copy would be made available to the public, so that it could be analyzed, and comments could be made on it. I think I just really can't make any comments on it specifically without getting those kind of facts. SUPERVISOR COCHRAN: Joe, we have not yet, as I explained to you on the phone, we have not yet received a written copy. Steve came out, Mr. Jones came out, and he is head of Suffolk County Planning, and he presented his findings to the Planning Board, and the Town Board was invited, and there are others in the audience that came and listened. Then on Monday just so this wouldn't happen and there would be a clear understanding, you know, to the press, a press meeting was held, Steve Jones, and the press, on Monday, just so that everybody was on the same page. A written report will be forthcoming. As soon as it comes to us, it is a public document, when it arrives, and even as we go through this process, as I said that day, it is heavy in some areas. There is a lot of things to think about, and the Town Board is going to have to sift through all of this, and see what suits this community, and what doesn't. As we go through the steps there will be hearings, if there are changes in the Code, and so on, and so forth, so that the public will have the opportunity for input, and we will take it as it comes, but you certainly will be kept informed. JOE RISTUCClA: I would just"-Iike to.core,erst [hat this really could have far reaching impacts on our town. There is no question about it. As a matter of fact this is an extremely heavy amendment to be coming down as far as we are concerned, because we are in~ter~sted .in maintaining our way of llfe here in our town. Southold is a wonderful place to live in. Having said that, though, on the other hand, you have to balance that with the rights of property owners, particularly those who have property in this community for well over ten, twenty, or thirty years, and people down the line they have plans for that, and they have made those plans for a number of years. I think the concern is, in my particular case, speakiRg only as an individual, I have been m~king some plans in that dlre~tion, and consequently this kind of thing could upset those kind of plans. I don't SOUTItOLD ~'BOARD FEBRUARY 18, 1999 think that is proper. I don't mind taking an action. Once everyone knows that action is going to be taken, you can make plans on it. Having put in force plans, and then all of a sudden because of some kind of deal, a study comes down, and the Board has to vote on it, and people have been making plans for such a long .time, I think that has to be taken into consideration. I want to thank you very much. SUPERVISOR COCHRAN: Thank you, Joe. Thank'you for your input. FAUSTO ClMADOR: My name if Fausto Cimador. I purchased a lot in East Marion in an area that was developed in the late 50's, and early 60's called Marion Manor. Most of the homes there are on lots that are 100 by 100. It is a manicured community, and therefOre was attractive to me, so I purchased a lot there to build a modest home. My wife passed away four and I intend to just build a modest home in that area. In hours I realized according to Steve Jones,: Suffolk County' pla~ Director, that the lot I purchased 100 by 100 is substandard; I nt to: knoW if the Town Board agrees with the'Planning DireCtor ste~e s at this point. I would llke to poll the Board based on certain .:information we have. SUPERVISOR COCHRAN: Sir, I don't think you have the authority to poll the Board. I am sorry but you don't. We have not gotten the written report yet. In all fairness let us all digest this, let us all see it, we have not agreed to any of it at this point. FAUSTO ClMADOR: I didn't say, you agreed to.' it, but I would like to know what your current feeling is on it. SUPERVISOR COCH~RAN: I don't have any at th~S' point. I have not seen enough. I ;am kind of like Joe. I want to analyze. I want to look at it. I want to digest it, and see how it effects. FAUSTO CIMADOR: Thank you, but it is m~/ understanding that you attended meeting, where' he had made his presentation, Mr. Jones. So, that you do have an understanding of this concept. COUNCILMAN ROMANELLI: In my personal opinion I can't see a 100 by 100 lot in a area of where you are speaking to be a substandard lot. I can't see that as coming down the pike. My vote counts up here on the Board I can't ~magine that happening. FAUSTO ClMADOR: I appreciate your reaction, and I would like to know, and I guess there is no people on the Board, that are going to react like you. COUNCILWOMAN HUSSIE: Listen, I can react, too, and what I would say is, that substandard-lot idea was put forward in conjunction with a PDR, Purchase of Development Rights situation. I am not going to go into the whole thing. It would mean that it would cost you a little bit more. FAUSTO ClMADOR: A little more than $20,000, as the paper quoted, and living on a retired income it is impossible. COUNCILWOMAN HUSSIE: Things like that have to be looked at very carefully. I can't quite go along with that just carte blanche. Maybe in certain situations it might work, but it certainly wouldn't be a blanket. FAUSTO ClMADOR: It is also my understanding that Mr. Jones does not believe in the Grandfather Clause. Is, th. at correct based on your information, and your contacts with him? COUNCILMAN ROMANELLI: I think basically his initial plan was the way it is, and ~there is no Grandfather Clause :behind it, and that is my understanding of it. You have got to remember, though, this is his presentation to the town. The town has accepted nothing, has shook hands on nothing. Based on the whole presentatiOn made to the Planning Board and the :Town Board members who were there, I think it was last Wednesday night, I was the first one to say it, that it is a completely radical way of changing land use, something that I have never heard before. I~.mean it usually used to be that if they wanted your lot they changed the zone. Well, Jone's plan is to go a different mattering, and almost have to buy it. If I want your piece of property I have to come up with a way of money to buy your rights from you. In my opinion it had some good qualities to his plan, and then it had some qualities that in my opinion wouldn't flush, at all, that I think are worthless. On your initial question in an area that is developed like that, I can't imagine us going along with saying that one lot in that neighborhood can't be built on. FAUSTO ClMADOR: I appreciate your comment. Is there anybody else on the Board like to comment in reference to my..? SUPERVISOR COCHRAN: No, sir. I feel very strongly, and I will not prejudge, and make a decision until we have the written report. COUNCILMAN MURPHY: The only thing I would like to say on it is that on the surface I felt that there were some good things in what he said~ and there were things that I did not agree with, but I would llke to see his exact propoSals in writing. There was a lot of areas it was vague. Like you mentioned now about. S20,000, I heard some at $5,000 I heard, some at $10,000. I don't know what that is all about, so before I make any judgement I want to read the whole thing. FAUSTO ClMADOR: Since we financed this study I think we are entitled to know. Do you have a time frame for when you expect this report? SUPERVISOR COCHRAN: This report is due to the Planning Board. He is in the employ of the Planning Board. The grant from the Water Authority, the $75,000 was g~ven for this 'study. It is part of planning, and he presented the plan to the Planning Board. We were invited to sit in on it, and listen, but we have a 10ng way to go before we make firm decisions. We want to read the report. We want to analyze everything, and we want to share with the community every step, and every bit of information we have, so that you understand, and you know as well as we understand and know where we are going. As I said, some of this is heavy. Some are new concepts. Some are concepts that are being done throughout different areas of the island according to Mr. Jones. FAUSTO C lMADOR: Anyone living on a fixed income contemplating building in thi.s beautiful community is very heavy. SUPERVISOR COCHRAN: We will keep that in mind. FAUSTO ClMADOR: So, you have no idea of the time frame? SUPERVISOR COCHRAN: No, we don't. Mr. Jones when he left that night said that he would be drafting up the document. We have no time frame. FAUSTO CIMADOR: When this comes to head here, and you have time to digest it there will be a meeting publicized in'the paper to that effect? SUPERVISOR COCHRAN: Like I said, we would like to keep you informed all the way. Thank you, sir. Anyone else like to address the Town Board? HANK KUHN: Good evening. Hank Huhn from Laurel. I attended the last meeting, and I listened with interest the conversation about the electric company, electric plan, and I came away with two things, one everyone on the Board seemed for lower electric rates, which is nice of you. The second thing is that the people who voted against moving forward indicated that we didn't have a complete plan, or a plan. SUPERVISOR COCHRAN: For a dollar~amount .... HANK KUHN: Well, whatever that would take .you to the dollar amount, and I was just wondering whether people, Board members want to share with us wl~at they have done in the last two weeks to move this forward? SOUTHOLD TOWN BO~ FEBRUARY 18, 1999 4' 9 SUPERVISOR CrOCHRAN: I asked the Town Attorney to obtain further information. He went along with our Comptroller, John Cushman, to the County. He has been calling State, Federal, whatever, correct me if I am wrong, Greg, seekJng..information. When he went to the County they are struggling with it, also. They feel they don't have all the answers, nor do we, and after a discussion I put it back on the agenda for this morning, and after the discussion it was left that we would get prices from one of the attorneys, that the County suggested, or recommended for further information. HANK KUHN: Electric rates? SUPERVISOR COCHRAN: Fee, his service to employ him, or at least come up for one meeting to give us further information. HANK KUHN: So we are still moving forward? SUPERVISOR COCHRAN: Board? Yes, we are. Anyone else llke to address the TOM SAMUELS: Tom Samuels from Cutchogue. I wasn't going to say anythi'ng about the electric company today, because I know that you are working on it. However, the last comment concerns me, and that is you are going to chose from attorneys that have been suggested by the County, and I know Greg has spent the entire two weeks practically from what I have heard calling various bureaucrats, State, County, and Federal. I would suggest to the Town Boar~l that you do not take recommendations from the County in this endeavor, that you do not take recommendations from the State in this endeavor, you may. take it from the Federal government I suppose, because they deregulated electricity, but I would stay away from politically correct attorneys, when you need an aggressive stance to get something done in Southold Town. This is progressive action. It is for the benefit of the whole town, and get somebody that is going to do an aggressive job. We want to know how we can do it, not why we can't do it. SUPERVISOR COCHRAN: Town Board? Mr. Gold? Thank you. Anyone else like to address the JOE GOLD: Joe Gold, Southold. I am in a very strange position for me. I am agreeing wholeheartedly with the former Republican Town Chair. I think he has hit the nail right on the head. The County and State have vested interests in the success of LIPA, and I would really be very nervous if I had taken their recommendations, anything to do with electricity. Enough said. Concerning the plan proposed by Steve Jones, when I was on the Land Preservation Committee I had the opportunity to work with Steve Jones quite a number of times, and all the people in the County he is the one for whom I have the highest respect, as a planner and as a professional, and don't know the details of his proposals, nobody does, but I think before we start nickel and diming it to death we accept this as a golden one shot last chance for this town. We don't have our own long range plan. He is presenting us with an opportunity to structure around his recommendations, and some of his ar[thmetlc can not be refuted regardless of the details of the plan if you look at the number of acres left in this town, you look at the rate at which that land can be used up, your only argument is whether this place will be suburbia in ten years, or fifteen years, or twenty years. It is not whether or not it is going to happen, it is when it is going to happen, so I would suggest that we regard this plan even though it is maybe radical in some aspects, remember in our lifetimes, some of us, zoning was ~[ntroduced in this town. Zoning was introduced into the country within our lifetime. Before that you could do anything you wanted. Two acres zoning was introduced into this town in the lifetimes of people a lot younger than I am. These were actions taken by people with vision, and courage, and I hope this Board can step up to that mark, and equal that vision and courage.. I know our Governor supposedly is a great fan of Teddy Roosevelt's, but there is a quote from '0 FEBRUARY 18~ 1999 SOUTHOLD TOWN BOARD Teddy Roosevelt, which I can't quote exactly, but I will paraphrase it, and that is that a man's property is held subject to the forbearance of his neighbors. Property rights are not total. We all know how they can be restricted, how they can be changed, and grandfathering is a concept that we followed for y~ars, but when Zoning was first introduced there was no grandfather. So, let's just keep in mind that this is a last Chance for this town, and view as such. Thank you. SUPERVISOR COCHRAN: Thank you, Mr~ Gold. Mr. Lizewski? JOE LIZESKI: I just want to remind everybody that when the 2% Law was passed there is a rider in the 2% Law was a TDR Program, that is basically to go along with it, which basically dovetails into this, that even the planners told me that it would never have to bear fruit. All the TDR is basically, wants you to pay for something that you once had the right to give legally through the Town Board, or through Town government through zoning. TDR basically wants you to pay for some of those rights that you could have gotten, change of zone for example. The TDR's could mean that you have to buy five acres of land on the North Road preservation change of zone. At the presen( time any change of zone the Town Board has the right to give it. Some of those rights become very, very expensive. I want to remind you that, that was part of the 2% Law, that was passed, and is now in place, and it is already there. So, it really dovetails with what we have coming, and I think it is something that should be looked at very carefully, because it was never really discussed by this town. It was never an im. portant part, it seemed to me, of the 2% Tax. SUPERVISOR COCHRAN: Of the legislation. JOE LIZEWSKI: Of the legislation, I thought it belonged in it's own form, and always did belong in it's own form. It was discussed eight or nine years, ten years, but it is now part of this town. SUPERVISOR COCHRAN: I was not happy to see it part of the legislation, because I do not, do not support a TDR Program. JOE LIZEWSKI: The way it was passed it is in place. SUPERVISOR COCHRAN: It was passed because the 2% was important that we continue. Sometimes you have to balance things, Joe, and the balance was there. Now, a town does not have to do:a TDR Program. Although it is in the law, it is a matter of choice. I have asked this more than once. It is a matter of choice. The Town Board does not have to do it, and I will fight to the death with that one. JOE LIZEWSKI: I hope it comes to public view, so that they have something to say about it. Thank you. SUPERVISOR COCHRAN: Anyone else like to address the Town Board? (No response.) If not, may I call on anyone for reports? COUNCILMAN ROMANELLI: I just wanted to make one quick comment. Most of us spent the last week in Manhattan for the Association of Towns and Villages Convention. It was educational, but you know at one moment I started to have a little fun. I got up early, and I got my family up early. We went down to the Today Show,' and I have to tell this story. I wanted to get on TV. I got my prompts, too; I wanted to get on TV, and promote Southold Town. So, I got down early, and tried to fight the crowd to get up front, and across the crowd I see a. man ~holding up a sign that says, I came all the way from Orient te be on TV.:So~ I. Iooki and it was an Orient resident, Bill Gillooley. He beat me to the crowd. I mean I got there at 6:30. He was there before me.. He beat me to the crowd to get up front, and he was successful on getting on TV, and prdmoting Southold Town. I was just shunned away, and you know, got to-be someone who saw the stars, and dicln't get to speak, but I dld brll~g my prop, and my daughter had one tapped to her head, and I had one. I had the whole family holding them up, and I thought this was going to get me on TV, $outh~id Town is better than the Bahamas, but it didn't work. It didn't get us ~here, but Bill Gillooley and family, they got it. That .is my story. SOUTHOLD TOWN BOXRD FEBRUARY 18, 1999 COUNCILWOMAN HUSSIE: Mine is not so cute and not so happy. This morning we had discussion VI, which was about the Southold Public Utility Agency, and I hoped, foolishly it turns out, that we were actually going to have something that was going to move us forward. Instead we were thrown six or seven miles ba.ck. The Town Attorney talked for a long time about the problems, and I put that in quotes, that might, and that is in quotes, that might happen, and he gave opinions, opinions from counsel here and there, and everyplace else. The Town Attorney also said that in his opinion, or from what he had gleaned from elsewhere, that the electricity could not be .transmitted over lines beyond the Town boundary. I refute that with the Energy Act of 1992, which says, there is no one that can stop you from using anybody's lines to transmit electricity. There was a suggestion to hire an attorney. I have no interest in hiring another attorney. We spent thousands and thousands of dollars on this. We have got to stop. The other argument is that we don't have a bottom line dollar amount. How can we have a bottom llne dollar amount? There is no amount of dollars that is .going to be spent. There is an expense, yes, but that is applied, that is attended to in the plan, and when you ask somebody else, wl~at did do? Was it you, Mr. Kuhn? What I did was rewrite my original resolution, which 'was full of legal mumbo jumbo, and put it into succinct words, and it says exactly the same thing, form an agency, go out and find the power, sell the power, and that is it, and I wish that we could just form the agency, and test it, and get all the ifs, maybes, and opinions out of the way. We have nothing to lose, and everything to gain. SUPERVISOR COCHRAN: Brian, do you have anything to report? COUNCILMAN MURPHY: Only that I went to the Association of Towns meetings. I attended quite a number of the seminars, and just talked to people from different parts of the state, found out their views on certain things, and many of the counties now are going through land preservation projects that we started twenty years ago here. They are new at it. They are looking for all the information they can find. So, it was very interesting talking to those people. SUPERVISOR COCHRAN: Louisa? JUSTICE EVANS: I, also, was at the Association of Towns, but I had to spend my two days in Justice courses, which are always interesting, always learn something new, but in a different field that my Town Board will. enjoyed it, but unfortunately I can't attend the Town Board. SUPERVISOR COCHRAN: I, also, attended the Association of Towns in New York City, and attended as many sessions as I could. I have a dual role when I go there. I am also the delegate for the town. The Town Board did review some of the resolutions that were on for support. I will be sharing with the Board for the next meeting. They will get a copy of those that were passed. I think the only one that was held was in relation to firemen and volunteers. Part of the legislation, that is being presented to Albany is in relation to less training by EMT's and volunteers with the fire departments, because it is going so that many, many communities do not have the volunteers saying, I will serve on your First Aid Squad, because it takes a great deal of time away from their job, and evenings from their families to get their training. The group, or the body, felt that this should not be supported, because cutting the training that goes to local firemen and First Aid Squads would increase their liability, so it was a good half hour discussion, and the end result was that the delegates turned down that piece of support, but they did support everything else that was presented. It has been busy, and as you hear it is going to get a lot busier. We are expecting the report from ~our consultant that is doing the L~8 study for the town in relation to zoning. We are going through interviews for an Assistant Town Attorney. We have done one round. We cut it today, and we will be going for more. Just from Steve Jones' report alone there is a great deal on our plate. We will keep you informed as much FEBRUARY 18~ 1999 SOUTHOLD TOWN BOARD as we can, and hopefully some of you .will come in and join us at the meetings in the body. We would like to hear from you.
