SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II
category,of the S'tate's List,of Actions, without an adverse effect on the environment if the
project isimplemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 25,853 sq. ft. parcel has a frontage
of 99.43 feet along`the east side of Terry Lane and is improved with a two-story frame
house with decks and accessory garage as shown on the survey prepared by Peconic
Surveyors, L.S. dated February 6, 2002.
BASIS OF'=APPLICATION: Building Department's December 16, 2002 Notice of
Disapproval,,piting Sections 100-242A and 100-2448, in its denial of a building permit to
cornstrticta,second-story" addition with a single side yard setback at less than 15 feet.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on March 20, 2003,
at which .time written and oral evidence were presented. Based upon all testimony,
documentation, personal inspection of the property, and other evidence, the Zoning Board
finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a second-story
addition with a single side yard setback at 12.9 feet from the southerly side property line,
as shown on the plan dated 10/1/02 prepared by Meryl Kramer, Architect and map
prepared by Peconic Surveyors, L.S. dated February 6, 2002.
REASONS FOR BOARD; ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1 a Grant of the area variance will not produce an undesirable change in the character of
the neighborhood or a. detriment to nearby properties. Applicant wishes to construct a
secondary, zddition to'the south/west side of the dwelling. At the March 20, 2003 public
hewing, no,oppositiort was offered regarding this application. The south/west side is
contiguous to the Southold Park District property. The closest or most affected area,
although overlooking Peconic Bay, is used as a grass parking lot for functions that
occasionally occur at the Park District building. Bearing this in mind, the Board feels that

the addition will not change the character of the neighborhood or be a detriment to nearby
properties.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for
the applicant to pursue, other than an area variance. The side yard is already established
at 12.9 ft. for the one-story footprint. The applicant has no other alternative but to seek a
variance for the second-story addition on the existing footprint:
3. The variance is not substantial., since the code requirement for this.side yard,is,,15 feet,
and applicants request a 2.3 ft. variance from the 15 ft. setback.requirement on the side of
her home.
4. The.difficulty is.self-created since the applicant has an established side yard for the
footprint of this home.
5. No evidence has been submitted to suggest that the proposed additions will have an
adverse impact on physical or environmental conditions in the neighborhood.
6. Grant of the requested variance is the minimum action necessary and adequate to
enable the applicant to enjoy the benefit of a second-story addition, while preserving and
protecting the character of the neighborhood and the health, safety and welfare of the
community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
balancing test under New York Town Law 267-B, motion was offered by Member
Goehringer, seconded by Chairwoman Tortora, and duly carried, to
GRANT the Variance as applied for and shown on the map prepared by Peconic
Surveyors, L.S. dated February 6, 2002.
This action does not authorize or condone any current or future use, setback or other
feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
Vote of the Board: Ayes: Members Tortora (Chairwoman), Goehringer, Oliva, and Orlando.
(Absent was Member Horning of Fishers Island.) This Resolution uly adopted (4-0).

The additions and alterations to an existing single-family dwelling, located on a non-conforming
25.853 square foot lot in the Residential R-40 District, are not permitted pursuant to Article XXn'
Section 100-242A, which states,
"Nothing in this article shall be deemed to prevent the remodeling, reconstruction or enlargement
of a non-conforming building containing a conforming use, provided that such action does not
create any new non-conformance or increase the degree of non-confonnance with regard to the
regulations pertaining to such buildings."
Article XXI<' Section 100-244B which states that on parcels, measuring between 20.000 and 39,999
square feet in size, require a minirntnm single side yard setback of 15. The existing single-family
dwelling has a single side yard setback of+,,- 12.9 feet, which will be maintained as a result of the
proposed addition.
Total lot coverage of 15 percent will be maintained as a result of this addition.

determined that the renovation of part of the ground floor of the existing structure and a second
floor addition above—existing decks shall remain and a new stair will connect them- to be out
of the Wetland Jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the
Town Code, Coastal Erosion.
However any activity within 100' of the Wetland line and/or seaNvard of the Coastal Erosion

Dear Ms. and Mr. Kurz:
Based on the information you have submitted, the New York State Department of Environmental
Conservation has determined that:
The portion of your propertywhich is located landward of the ten foot(MSL)elevation contour on a gradual,
natural slope as shown on the survey prepared by John T. Metzger last revised March 19,2002, is beyond
the jurisdiction of Article 25 (Tidal Wetlands).
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661) no
permit is required under the Tidal Wetlands Act. Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional
boundary, as indicated above, without a permit. It is your responsibility to ensure that all necessary
precautions aretaken to prevent any sedimentation or other alteration or disturbance to the ground surface
or vegetation within Tidal Wetlands jurisdiction which may result from your project Such precautions may
include maintaining adequate work area between the tidal wetland jurisdictional boundary and your project
(i.e. a 15'to 20'wide construction area) or erecting a temporary fence, barrier, or hay bale berm.
Please be further advised that this letter does not relieve you of the responsibility of obtaining any
necessary permits or approvals from other agencies.
