A Regular meeting of the Southold Town Board was held Tuesday, July 13, 2004 at the Southold Town Hall, Southold, New York. Supervisor Horton opened the meeting at 7:30 P.M. with the Pledge of Allegiance to the Flag. Present: Absent: Supervisor Joshua Y. Horton Justice Louisa P. Evans Councilman John M. Edwards SUPERVISOR HORTON: Good evening and welcome to the July 13, 7:30 public meeting of the Southold Town Board. We have reports, public notices and communications all available for the public's review at the Town Clerk's Office, which is open Monday through Friday, 8:00 A.M. to 4:00 P.M., it is the policy of the Board to invite the public to address the Town Board several portions over the course of the evening. First being prior to the voting on any of the printed resolutions, we offer the floor to the public. We ask that you do state your name and place of address, clearly into one of the two microphones at the front of the room so that we can incorporate that into our record. As well, after the resolution portion of this meeting is complete, we offer the floor again to the public to address the Board on general town business and also over the course of the public hearing we will obviously give the floor to the public. Before we get started into the resolutions, ! would like to ask both Captain Flatley and Chief Cochran to come forward. Come to the bow of the ship, if you will. We had, as many of you are aware and the Town Board is well aware that the Village of Greenport was fortunate July 13, 2004 Southold Town Board Regular Meeting 2 enough and visionary enough to put themselves in the hat to be one of the host ports for the American (inaudible) Association Tall Ship Challenge 2004 and that entails several ocean-going vessels actually coming to the Village of Greenport. And the Village did a wonderful job, a real bang-up job of hosting those ships, providing dockage and really a wonderful time for the tens of thousands of people that came to Greenport. But I wanted to take just a moment to acknowledge what I believed was possibly the backbone of the event by way of administering public safety and ensuring security in a very peaceful, orderly time over the course of the entire weekend and that is the work of the Southold Town Police Department and I will read the proclamation in its entirety, which I seldom do, but I think all the necessary information is included here within. "Whereas on the weekend of July 10, 2004 the Village of Greenport was a host port to the 2004 Tall Ship Challenge and provided dockage for a fleet of sailing ships and ocean-going schooners; and Whereas this spirited maritime event that brought more than 35,000 people to the Village waterfront proved to be an unprecedented undertaking for the Southold Town Police Department in as much as developing a United States Coast Guard approved Homeland Security Port Plan, coordinating and administering a public safety and security plan that involved the New York State, Suffolk County, Shelter Island, Southampton and East Hampton Police Departments and the NYS Department of Environmental Conservation; and Whereas the skillfully executed logistics of this coordinated public safety effort included vehicle, foot, marine, bicycle, K-9 and aviation patrols; and Whereas the Southold Town Police Department exercised the highest standard of professionalism, safety and security for the largest public event in the history of Southold Town; now, therefore be it Resolved that the Town Board of the Town of Southold hereby extends its deepest appreciation and congratulations to the Southold Town Police Department for a job well done; and be it further Resolved that a copy of this proclamation be distributed to every officer, dispatcher and all administrative personnel at the Southold Town Police Department as each member of the organization contributed significant support toward the public's safety during the Greenport 2004 Tall Ship Challenge." I am very proud of the entire department. Thank you for the work you did. The proclamation for the entire department will be displayed at the headquarters in the squad bay. And I also want to thank the Town Board for continuing what is an important partnership for the entire community and that is the partnership and support of the Village of Greenport activities and as far as providing police coverage that was necessary in making a successful event, as well as providing the shuttles from the Human Resource Center, to aid in bringing people to the event, from the designated parking areas. So thank you to the Town Board and the Police Department. Congratulations. CHIEF COCHRAN: On behalf of the Southold Town Police Department, I thank you and the Town Board for your support and we are glad that we made you proud and I would like to thank Captain Flatley for his unprecedented time that he spent on the ground in Greenport. SUPERVISOR HORTON: ! just want to say that the SPAT program, which is not necessarily directly impacted by this program, that the SPAT program that Cornell puts on has been taken to new heights and it is really just absolutely phenomenal and it just keeps growing year after year which has a beneficial effect on our waterways and shellfish. This resolution was duly ADOPTED. #533 Moved by Councilman Wickham, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby grants permission to Detective Beth Dzenkowski to attend the New York Police Juvenile Officers Annual Trainin~ Conference, of which she is the Chairperson, from Saturday, August 28 through Friday, September 3, 2004, in Islandia, New York. Detective Beth Dzenkowski will also be sworn in as the 29th President of the Association as the first female and the first from Suffolk County. Expenses would be approximately $858.00 for conference fee ($160.00) and accommodations ($698.00), which will be a legal charge to the Juvenile Aid Bureau budget line - A.3157.4.600.300. Horton to hire the firm of Cleary Consulting to conduct a review pursuant to the State July 13, 2004 Southold Town Board Regular Meeting Environmental Quality Review Act (SEQRA) of the proposed Local Law entitled "A Local Law in relation to Amendments to Chapter Al08 of the Code of the Town of Southold pertaining to Highway Specifications" at a cost not to exceed $450.00 as per their proposal dated July 8, 2004. This resolution was duly ADOPTED. #539 Moved by Councilman Ross, seconded by Justice Evans, WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk County, New York, on the 29th day of June, 2004 a Local Law entitled "A Local Law in relation to Parking at the Road End Area on Duck Pond Road" now, therefore, be it RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold, New York, on the 27th of July, 2004 at 5:20 p.m. at which time all interested persons will be given an opportunity to be heard. The proposed Local Law entitled, "A Local Law in relation to Parking at the Road End Area on Duck Pond Road" reads as follows: LOCAL LAW NO. 2004 A Local Law entitled, "A Local Law in relation to Parking at the Road End Area on Duck Pond Road". BE IT ENACTED by the Town Board of the Town of Southold as follows: I. Purpose - In order to restrict and regulate the use of the road end area of Duck Pond Road in Cutchogue, the use of which has become overcrowded by the parking of vehicles of nonresidents of Southold Town, consistent with the policy of Chapter 65 of the Town of Southold Town Code regulating Parking at Beaches it is necessary to limit parking in this area to parking by Southold Town Permit Only. Accordingly, to effectuate that change, Chapter 92 of the Town Code shall also be amended. II. Code Amendment. Chapter 65 of the Code of the Town of Southold is hereby amended as follows: § 65-2. Designation of parking areas requiring permits. B. The following road end areas are hereby designated as Town of Southold "Parking by Southold Town Permit Only" areas: Duck Pond Road, Long Island Sound, Cutchogue, along both sides from the guardrail at the northerly terminus southerly for a distance of 500 feet. IlL Code Amendment. July 13, 2004 Southold Town Board Regular Meeting 9 Chapter 92 of the Code of the Town of Southold is hereby amended as follows: § 92-42. Parking prohibited during certain hours. following locations: Name of Street Pond The parking of vehicles is hereby prohibited between the hours indicated in any of the Side Between the Hours of lth.thth ~ ~ Location Pond West ~ n.nn ~ ~ a.m. § 92-43. Parking for limited time only. SEVERABILITY t0 If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. V. EFFECTIVE DATE This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law. This resolution was duly ADOPTED. #54O Moved by Justice Evans, seconded by Councilman Ross, it was RESOLVED that the Town Board of the Town of Southold hereby grants permission to the Knights of Columbus, Marion Council No. 3852, Cutchogue, New York, to march using the Main Road from the Sacred Heart Church east to Depot Lane, then north on Deport Lane to the Sacred Heart Cemetery, on Saturday, October 9, 2004 beginning at approximately 10:00 A.M., provided they file with the Town Clerk a One Million Dollar Certificate of Insurance naming the Town Southold as an additional insured and notify Capt. This resolution was duly ADOPTED. #541 Moved by Councilman Wickham, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the closure of the following town road for the 25th Annual Douglas Moore Memorial Concert on Saturday, August 14, 2004 from 5:00 p. m. to 10:00 p. m., Cases Lane from Cedar Road to Main Road, Cutchogue provided they file with the Town Clerk a One Million Dollar Certificate of Liability Insurance naming the town of Southold as an additional insured and contact Capt. Flatley at least ten (t0) days prior to the event to coordinate traffic control. Allen to the position of part-time Minibus Driver at the Human Resource Center for 17 lA hours per week, at the rate of $10.25 per hour effective July 14, 2004. WHEREAS the Town retained a "moratorium group" consisting of in-house and outside planners and attorneys who have developed a "Comprehensive Implementation Strategy" of the Comprehensive Plan of the Town of Southold, and certain comprehensive planning currently being undertaken includes, but is not limited to, 80% preservation of open space throughout the Town and a 60% reduction in density, clear establishment of the Hamlet Centers, and a possible Transfer of Development Rights component (a full description of the "action" is set forth in the SEQRA Resolution dated January 7, 2003 for the Southold Comprehensive Implementation Strategy which is incorporated by reference into this decision); and WHEREAS, planning work is actively proceeding during the moratorium, which was extended January 6, 2004 for an additional 180 days.. The issues facing the Town of Southold and possible solutions to those issues are complex. Legislative solutions have not yet been agreed upon, and the Town continues to face significant development pressure; and July 13, 2004 Southold Town Board Regular Meeting 18 WHEREAS the Town Board finds that the applicant has demonstrated an extraordinary hardship, in that he has gifted a Conservation Easement on 28.4 acres to the Peconic Land Trust, and the preserved area encompasses more than seventy two percent of the parcel and falls just short of the seventy-five percent land preservation threshold. No structures, including agricultural buildings, are allowed in the open area. Dr. Damianos is now faced with the possibility of having to amend and re-file the Conservation Easement and incurring expenses associated therewith; and WHEREAS the Town Board finds that the application is not in contrast with the extensive planning initiatives being undertaken by the Town, or the Comprehensive Plan of the Town of Southold; and WHEREAS the Town Board finds that this application will not adversely affect the purpose of the Local Law # 3 of 2002 and the extensions thereof; and WHEREAS the Town Board of the Town of Southold finds that the application will not adversely affect the health, safety, or welfare of the Town of Southold; and WHEREAS the Town Board of the Town of Southold finds that the minor subdivision application is consistent with the existing land use in the surrounding area and has a minimal impact on water supply, rural character, natural resources and transportation infrastructure of the Town; and WHEREAS the Town Board of the Town of Southold finds that the application supports the preservation of agricultural lands and open and recreational space, and has demonstrated a significant land preservation effort; and WHEREAS based on the application, all relevant documentation, the comments set forth at the public hearing on this matter, the comprehensive planning currently being undertaken by the Town, the above referenced facts, and the criteria set forth in Local Law No. 3 of 2002 and the extensions thereof, Section 6. CRAIG ARM: ! am Craig Arm from Southold. ! have a letter on behalf of Southold Business Alliance, which ! have a copy for you also for the record. A letter entitled 'Kudos for Affordability' "While the debate continues over land sue and the private property rights of affected landowners with the proposed subdivision code, many still see the lack of entry-level or work-force housing as the greater risk to maintaining Southold's rural character and quality of life. The Southold Business Alliance supports the efforts of the Southold Town Board to address the people side of preserving July 13, 2004 Southold Town Board Regular Meeting 19 Southold. While some residents of the Town of Southold cry for a 'needs assessment' to take place before any legislation is passed for the purpose of affordable housing, the business community has been very aware of what the needs already are. Simple math already tells most of us that a median residents income that is about $50,000 could only afford a house costing about $150,000 according to well-established mortgage industry standards. And with the entry-level cost of housing in Southold Town exceeding twice that amount, a needs assessment (while helpful for measuring demand) was unnecessary to decide whether or not Southold Town should adopt the enabling legislation that would make the Affordable Housing District work again. The Town Board's overhaul of the Affordable Housing District (AHD) code was a good place to start to help make living in Southold affordable once again. Mandating permanently affordable housing in the AHD zone along with a fair selection system for housing applicants will ensure that housing is administered to those people that we as a community need the most. Some residents disdain for affordable housing has been expressed with concerns about children, schools, property values and taxes without necessarily recognizing or understanding what the availability of entry-level housing means to our community. Our rural character and rural quality of life, the way we know it, certainly depends upon the second homeowners who help pump up our economy, but even greater is the very existence of our many local families. They provide goods and services. They give back to their community by serving the volunteer fire departments and they give back in countless other ways. Oh, and yes-sometimes they have children and educate them proudly in our schools. That is not something that should be feared. The business community recognizes how important entry-level housing is to our businesses because of our employees. But we also see how necessary it is to keep Southold the town that we all want to live in. We supported the changes made to the AHD code and we support the Town Board's effort to provide for a diverse range of housing opportunities in the hamlet areas. Thank you. I, too, was actually, ! am here, my comments are in support of the legislation that you passed a few weeks ago. It was unfortunate ! was unable to make it to that public hearing, to support it but ! think that it is something that the Board should be proud of. It is something that the community needs and ! look forward to the Town moving forward on creating affordable housing opportunities in the Town of Southold. Thank you. First, ! would like to thank the Supervisor for the kind words but affordable housing was not my idea. When ! got on the Board, there was a deadlock between the builder's committee and the Planning Board. Both wanted 100% control of the projects and in probably about a year and a half, ! was able to wrangle a compromise out of them which eventually neither side was very happy with but we did wind up with a law and we did wind up with many, many people that are in housing. As an employer in the Town of Southold, nobody knows more than ! do the need for housing in this town. ! have heard a lot of skeptical remarks here and ! think last week there was quite a barrage of them and the papers were very quick to pick up on some of the key points raised by the opposition to affordable housing and ! just hope that they will take the time now to listen to the people that really have a need for it and the people that aren't here tonight, a lot of them are working second jobs and a lot of them just don't come to public meetings and they let other people speak for them. So here we are, ! have two employees that moved early on into the affordable housing units and are still there today. And ! suggest that anybody that is skeptical about how that program works, go down and visit and talk to the people that are in that housing. They are not in there for profit, they are in there for the long run. ! have heard people complain that somebody sold one for $350,000. Well, god bless them, in this day and age because they had to leave town because you can't buy a lot for $300,000 in this town right now. Affordable housing, entry level housing is just what it was always meant to back in those days but in those days was a lot cheaper. Back in the 80's a grandfather or a parent could give their grandson or son or nephew $20,000 they could put down on a lot and then the young person or the young couple could then pay off the lot over a period of time and then eventually build on it. It is very tough now for people, if you want to come in with a deposit of about 50%, ! don't think that there are a lot of parents that are going to just reach into their pockets and pull out $150,000 to get them started today. That is the problem in this town and it is getting worse. It has not been addressed in the last 12 years and ! thank you very much for bringing it up to the front again and ! hope that we can proceed and see something finally happen. Thank you. We need affordable housing, badly, for the young people so they can stay here. I appreciate the Board being the first Board in a long, long time to have the intestinal fortitude to do something about it and I appreciate that. I want you to know it.
