The subject parcel is located in the R-40 Zoning District which requires a minimum of 40,000 square feet. The total area of the parcel is 34,891.56 square feet, which is less than that required iu the R-40 Zoning District. The Planning Board is not in favor of creating lots which are less than the minimum zoning requirements. In addition, the subject parcel is within 300' of L.I_ Sound and more importantly, within 100' of Hashamomuck Creek. This creek is the Town's most productive shellfishery. It has been designated by the Board of Trustees as a local Critical Environmental Area_ Although public water is available at this site, sewage treatment is not; therefore the subdivision of this property sets the stage for increased infiltration of septic waste and nitrogen into the head of Hashamomuck Creek. Although the subject parcel is within close proximity to several lots even smaller than the two proposed 17,449 square foot lots, the precedent this case would set if so granted, would be significant. The R-40 zoning designation would be rendered meaningless, thus opening the door to continuing subdivision of much of the partially developed waterfront or near waterfront property into the smallest common denominator. This could have serious cumulative impacts that are likely to be deleterious 1.0 the water quality of the Peconic Estuary and the tidal creeks that feed into it.
