• In completing the form the reviewer should be guided by the question: Have my responses and determinations been
reasonable? The reviewer is not expected to be an expert environmental analyst
• Identifying that an impactwili he potentially large (column 2) does not mean that it is also necessarily significant.
Any large impact must be evaluated in PART 3 `a determine significance. Identifying an impact in column 2 simply

Dear Mr. Cron:
The Planning Board has received the Trustees' report in regard to the
above mentioned site. The Board of Trustees have determined that the
wetlands are accurately shown on the map.
As noted in my correspondence of August 25, 1995, the Planning Board is
using the map dated April 27, 1992, for yield purposes only. Based on
this map, the Planning Board has determined that the density for the
parcel is thirteen ( 13) lots. '
The Planning Board is requiring that the sketch plan be designed as a
cluster subdivision. The proposed cluster must include either a permanent
tap to the adjacent Sage property or a tap for emergency purposes only,
the lot areas reduced to a minimum of 20,000 square feet, and at least a
75' buffer around all wetland areas located both on and off site.
The Board will proceed with review of the subdivision proposal upon
receipt of a proposed clustered subdivision.
On July 2.0, 1995, the Village of Greenport imposed a moratorium on all
new applications of major subdivisions for the hook up of water and sewer
services for a period of twelve months. Please note that the Southold
Planning Board will not schedule any final subdivision hearings when
public water is required without a valid contract for public water.

Attached please find a copy of the proposed sketch pian dated April 27,
1992, for the above mentioned subdivision. The Planning Board is using
this plan as a yield plan for computing the allowable density for the
site. Please verify that the wetlands are accurately shown on the map.
In August of 1991, the Planning Board forwarded a yield plan to your
office for review. Bruce Anderson reviewed the site and flagged two
wetland areas located in the vicinity of the site. The Planning Board
asked the applicant to indicate all wetlands on the proposed subdivision.
A revised map dated April 27, 1992, was submitted and again forwarded to
your office in May of 1992. Our records do not contain a response from
your office.
The file has been inactive since 1992" However, the applicant has recently
submitted additional information pertaining to the subdivision, and has
asked that the Planning Board proceed with the subdivision review.
Please let me know if you require any additional information.

Dear Mr. Ward:
The above-captioned proposed subdivision has been pending before the Board
for sometime. When last. discussed, a question arose as to whether Island
View Lane at least for a distance of 400' was a private or public road.
The memorandum of June 4,1992 of James A. Richter, R.A. concludes that since
there was no formal dedication of the road that it is a private road-an
opinion accepted by the Planning Board as set forth in Bennett Orlowski's
letter to the undersigned dated June 12,1992.
In the interim, I have had discussions with Raymond L. Jacobs, Superintendent
of Highways, who has verbally indicated, and now indicates in writing by
letter dated July 18,1995, a copy of which is enclosed, that the Highway
Department has so maintained a portion of Island View Lane to a point westerly
of the proposed access to the subdivision. Interviews with neighbors along
said road is supportive of such fact.
While the road has not been formally dedicated as a public highway to the
Town of Southold, it is nevertheless deemed a public highway through maintenance
and use for over the past 26 years, and presently so maintained and used,
pursuant to Section 189 of the Highway Law of the State of New York.
In the light of the foregoing, the Planning Board should recognize that the
portion of Island View Lane westerly from Bay Shore Road a distance of at least
400' is a public highway by virtue of the use of said road by the public and
the maintenance thereof by the Southold Town Highway Department for the past
26 years and currently so maintained.

Dear Mr . Cron-
The Planning Board has received a report from James
Richter, Engineering Inspector, in reference to the status of
Island View Lane. A copy of his report is enclosed.
It appears that Island View Lane is a private road.
Therefore, it cannot be used to provide public access to the
proposed subdivision. Therefore, the Planning Board suggests
that you attempt to obtain access from the owners of the August
Acres subdivision to the north.
The Planning Board has before it a subdivision proposal
under the name "Harbor View Landing" for the Sage parcel to the
west of your client' s property. This application received a
Positive Declaration, and the applicant is in the process of
preparing the Draft Environmental Impact Statement. It is
entirely possible that a vehicular connection to this parcel may
be required.
Upon submission of a revised map showing viable road
access, the Board will proceed with their review.

roadway has to our knowledge been open and used without conten-
tion for many years, and possibly by "use" has become public in
nature . Barring this, it would at least be a right-of-way in
favor of Mr. Holder ' s property from the 50-foot strip easterly
to Bayshore Road.

The Planning Board has reviewed both the February 28 , 1992
report from the Town Trustees and the map submitted by Roderick
Van Tuyl on December 17, 1991. A copy of the Trustees report
is enclosed for your information.
Please provide information to substantiate the area
designated as the point at which the ownership of Island View
Lane changes from public to private. The Town Clerk' s records do
not reflect the area so designated by Mr. Van Tuyl.
In addition, the Trustees report discusses two other
wetlands that are in the vicinity of the subject parcel. Please
have Mr. Van Tuyl indicated all wetlands within 200 ' of the
property..
Upon submission of revised maps the Board will proceed with
their review.

A field inspection was conducted on the above
referenced parcel on February 16 , 1992 . The field
AT
inspection revealed the presence of the pond, a second
freshwater wetland west of the pond (primarily on the
iFt property of Sage) and a third wetland northeast of the pond
(primarily on .the property of Posillico) . The pond appears
to be man made (the resulting spoil was deposited to the
north of the pond) and lacks freshwater wetlands vegetation
around its periphery. Therefore , the wetland line is the
pond boundary as shown on the sketch plan prepared by
Roderick Van Tuyl last amended Jun. 12 , 1991 .
The two other wetlands are either located on the
property line or outside the property boundary . The wetland
boundary of the second wetland was flagged in the field.
The third .wetland appears to be located completely outside
of the property boundary.
While the presence of the pond is regarded as having a
regulatory effect on the approval of this subdivision , the
remaining wetland areas are for the most part located off
site and therefore would have no effect upon subdivision
layout. However, all three wetlands will have a regulatory
effect on the eventual development of lots 10 , 11 and 13.
Given the sizes of these respective lots , the eventual
construction of. dwellings and related appurtenances can all
be sited outside the Trustees wetland jurisdiction.

The Planning Board is in receipt of the additional items
submitted on July 31, 1991, for the above mentioned subdivision.
The map has been submitted to the Board of Trustees for
their review. It has also been forwarded to the Engineering
Inspector for his review of the drainage area.
The maps dated June 12, 1991, which were submitted on June
14, 1991, are labeled as "Sketch Plan. " However, the Planning
Board will use this map as the Yield Map, for purposes of
computing density. Upon the determination of the density for the
parcel, the Planning Board will be requiring that the sketch
plan be redesigned as a clustered subdivision.
The following items must be submitted to complete the file:

to process the subdivision.
