Greg Y. to discuss this proposed easement, following the 05/15 me~ing oflhe LPC. The LPG doe~ not.favor the offered easement, in this instance beean~e it appears to be merely~ an effort at avoiding the 2% transfer tax, which otherwise apparently will apply to a purcha~e.gf the fa~rm. The involvement o£the LPC, has been "last minute" and admi~t~dIy all ~he~¢h'cumstances are not 1L~own to it. The LPC ha~ had a long-standing interest in ~this'farm being preserved via a perpe~aal Development Righ£s easement. The Lappe.~intere~t.s ha,d reject'ed earlier efforts to purchase such an easement I spuk~ with the attorney for the contract-vendee (A. Tohill, Esq. for Anderson) who is to purchase th~ Lapp~ farm. It is this "buyer" who offers the agricultural e'asement~ which is the subje,~t ~fth¢ iBstant public hearing. The buyer presently owns l~nc~s to the south and adjacent tothe La, pc farm. Apparently, the purchase is exposed to the transfer t~ax becau's~ ~he "entire" property is not "p~-otected" in a qualified manner. My conversation with Tony Tohill (an acquaintance of many years) tins led to the following unc~rs~tandings between us: a mutual re.q~st that'che scheduled hearing record be kept open in this matter (I will be out of Tow~ the week of 05/22)~ Amatual m~ eeting scheduled for 8:30AM on 05/30 at Town Hall, where we (and other inter,ed parties) will discuss the merits of a Development Kights ~asement (ei/ther pureh~efl by the Town or bargained/gibed to the Town or a qualified not-for- prOfit group}, ~s the most-appropriat~ and ~gr¢¢d method of preserv:ing the farm and provid|rfg a Buyer (contract-vendee) exemption to a payment of the 2% transfer tax. r askth~t the hearing record of 05/23 be kept open, until such time as the discussions between the easement-offeror and the LPC have agreed on the most-appropriate means of preserving the farm, that can there~affer presented to the Town Board. : It is conceivable, that the purpose for the scheduled hearing will ultimately be al.t~red to ad&ess the merits ora Town-acquisition ora Development Rights easement on the farm.
