RESOLUTION WAS ADOPTED BY
REGULAR MEETING HELD' ON
WHEREAS the Town Board of the Town of Southold wishes to purchase the
development rights in the agricultural lands of William and Theresa
Ackerman; and
WHEREAS the Town Board held a public hearing with respect to said
acquisition on the 19th day of February, 1998, pursuant to the
provisions of the Southold Town Code; and
WHEREAS the Town Board deems it in the public interest that the Town
of Southold acquire the development rights in the agricultural lands set
forth in the proposed acquisition between the Town and William and
Theresa Ackerman; now therefore, be it
RESOLVED that the Town Board elects to purchase the development rights
in the aforesaid agricultural lands owned by William and Theresa Ackerman,
comprising 58.7 acres, $5,500.00 for 53.6 acres and $8,000.00 per acre for
5.1 acres; said property located at Middle Road (County Road 48),
Cutchogue, New York, SCTM No. 1000-101-02-004 and 108-03-007; and be it
FURTHER RESOLVED that the Town Clerk be and she hereby is authorized
and directed to give notice of such acceptance to William and Theresa
Ackerman; and
FURTHER RESOLVED that the Supervisor be and hereby is authorized and
direct~ed to execute any and all required documents for the acquisition of
said development rights.

THE SOUTHOLD TOWN BOARD AT A REGULAR MEETING HELD ON
FEBRUARY 19. 1998:
RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law, State Environmental Quality Review Act, and NYCRR Part 617.10, and
Chapter L~ of the Code of the Town of Southold, notice is hereby given
that the $outhold Town Board, in conducting an uncoordinated review of
this unlisted action, has determined that there will be no significant
effect on the environment.
DESCRIPTION OF ACTION: Acquisition of development rights in the
agricultural lands of William and Theresa Ackerman. Middle Road (County
Road ~8), Cutchogue, New York, SCTM No. 1000-101-02-00~ and 108-03-007,
comprising 58.7 acres, $5,500.00 for 53.6 acres, and $8,000.00 per acre
for 5.1 acres. The proposal has been determined not to have a
significant effect on the environment because an Environmental Assessment
Form has been submitted and reviewed and the Town Board has concluded
that no significant adverse effect tO the environment is likely to occur
should the proposal be implemented as planned.

development rights in the agricultural lands of Ackerman. Councilman

COUNCILMAN MURPHY: "Notice is hereby given that pursuant to the
provisions of the Agricultural Lands Preservation Law of the Town of
Southold, constituting Chapter 25 of the Southold Town Code, the Town
Board of the Town of Southold will hold a public hearing on the 19th
day of February. 1998.' at 5:00 P.M.. at the Southold Town Hall, 53095
Main Road, Southold, New York, on the question of the acquisition by the
Town of Southold of the development rights in the agricultural lands of
William & Theresa Ackerman, Middle Road (County Road 48),
Cutchogue, New York, SCTM No. 1000-101-02-004 and 108-03-007,
comprising 58.7 acres, $5,500.00 for 53.6 acres, and $8,000.00 per acre for

of the Town of Southold Land Preservation committee. I have an aerial
photograph here, which outlines the subject parcel under consideration,
· located in Cutchogue, South of Middle Road, County Route 48. The
:property totals approximately 62.7 acres in size in two parcels bisected by
,the Long Island Railroad. Approximately 59 acres of the property si

Committee.

The purchase price is $5500./acre for the 53.6 acres and $8000_/for the 5. I acres, totally
about $335}600.(subject to final survey). The market value of the proposed purchase was
· determined by a June, 1997 appraisal, commissioned by the Town Boarc[ fi-om David
Wimpelberg.
The zoning for the parcel is Agricultural Conservation (minimum lot size of S0,000SF)_
The property is designated in Suffolk County-Agricultural DL~.ri~ gl. The so~ ~re ~n the
Haven Loam classification, one of the prime agricultural soils ofLon~_ Islan& The
currently contains areas of an established vineyard and vegetable and~field crops.
The property is located adjacent on the west to approxSmately 1T6 acres ofoe~lier
agricultural lands, over which the Town of Soulhold recently acquired the development
rights and; to the south by 24.7 acres of additional development rights owned by the
Town_
Because of the enhancing factors of agricultural use, size, vista-enhancement, prordufi~y to
other preserved agricultural lands, as well as buffer-enha~.cement between the 1J~rnlets cf
Cutchogue and Mattituck, the Land Preservation Committee i~ lJl'lanimous in
recommending the purchase of these development rights_ The purchase will do much to
preserve important agricultural lands and further-assure the country-like environment
enjoyed by the residents of the Town of Southold.
I urge the Town Board to accept the offer of development rights ~o the 59 acres, owned
by William and Theresa Ackermarm, pursuant to the provisions of Chapter 25 ofthe Town
Code, entitled "Agricultural Lands Preservation"_
