NY 11702 Dear Mr-Fox We received your letter and are happy you have decided to repair the damage caused to out bluff terracing system, and stabilize your bluff and Mrs. Reis bluff to the east. As I have stated to you, a large gully was created at my east boundary line where our properties meet at the bluff crest, running down to the bottom along the end of my terracing system. The alarming degree of erosion was caused during last winter's much rain. Soil has been washing away from your bluff crest, at our boundary line undermining my top ten-ace. While your established bluff crest has eroded by at least 5 feet. On October 1, 2001, 1 wrote a letter to then owner George Reis informing him of the imminent damage that would occur to my property, if the bluff face were not stabilized; as per permit# 1-4738-02453-00003. The current damage to my(5 terraces), occurred on 6/30/03, as a result of your construction crew trying to stabilize the bluff erosion by pushing many hundreds of cubic yards of soil by machine onto the bluff face, trying to fill the gully. In doing so, my wood terracing that ended at our boundary line was tatocked out of place by the oncoming weight of the soil and shifted more than 45 degrees opposite the bluff face. Before it was disturbed, the terracing was 110 degrees against the bluff face. You stated to me, after the bluff work stopped, that your landscaper was going to install a net and plant the vegetation. This method was not approved by the D.E.C. permit issued which covered 4 sound front properties including my property. I€you wish to amend the permit and cancel the terracing system, then I think you should have built return terracing system to protect my terracing. This should have been planned for prior to your sending soil down against my terracing system. Your soil has been washing onto my beach from for a long time now and has stilt not been removed. 650 Lloyd's Lane Nlattituck, NY 11952 January 14, 2004 Southold Town Trustees Southold Town Building Department 51095 Main Street PO Bos 1179 Southold,NY 11971 Sirs. I am the owner of 650 Lloyd's Lane, in Nlattiurck. The lot is on the Sound, and is protected by a bulkhead and terracing, as previously approved by the Town Trustees and D.E.C. The adjacent property to the east, owned by Mr. Robert Fox and being developed by R.E. Fos Construction, recently had terracing installed on its bluff. Due to the fact that the Fox terracing and plantings apparently were not installed per the permits issued by the DEC and Town, severe damage and erosion was caused to my bluff. Several hundred yards of soil was pushed, by machine, over the bluff edge, and as a result the terracing on my bluff shifted at several levels, from 110 degrees against the bluff face; to 45 degrees opposite the bluff face. I am concerned about both further erosion, and a collapse. As noted, Fox's method of bluff stabilization has resulted in erosion in the area. The plantings installed apparently consisted of simply Hydro-Seeding the bluff face, rather than the installation of Rosa rugosa, etc. Furthermore, drywells were installed very close to the bluff edge, and natural vegetation near the bluff face was eliminated. Runoff water from the dry-wells is causing further damage through the bluff face. I write to request that a work session be scheduled with the Town Trustees, the Building Department, or both, to discuss and resolve this matter. Sincerely, { ,dim �I1i(ahos is 22 .i l ri Roy family and I have expresses our concern to you regarding the need to stabilize your bluff- First meeting we had, prior to Thanksgiving 2002,.was on the same spot where our boundary lines meet at the bluff crest- At that time my top terrace was stable. I tried to explain the urgency,that it was to your benefit, to first build your terraces and stabilize your bluff avoiding erosion which would undermine my terracing_ Second meeting was held in my home prior to Easter 2003, where Lily and I stated to you,that we thought your were actually delaying this work_ You stated to me that your { money was held in Escrow by George Ms. We were naturally disappointed. Third meeting was held on Saturday first week of June 2003, prior to when bluff work machine work started.I showed you how far my top terrace had shifted and was ready to go due to continued erosion at the gully on our boundary line. The following Monday, you installed a galvanized wire from the top terrace to a metal stake approximately 8' that you drove into the ground to hold my terrace from falling away. I thought at that time you would have acted to begin the actual stabilization as per D.E.C. permit specifications Then on 6130/03 when we saw the new damage was notorious and almost deliberate if not negligent for someone to attempt to push soil down the bluff without a Professional Engineer to supervise_ I called your cell for the first time, and left you a message, you consider threatening and harassing, how else does one communicate to stop another from causing progressive damage to his property'' Our fourth meeting was prior to the e of July, 2003, after you were ordered to stop work, you stated that you decided to build the terraces and vegetate the bluff based on the D.E.C. permit- I am aware and appreciate your installation of hay bales between our houses, preventing water and soil runoff onto my property- You must be aware as well, that I have not disturbed my 30' deep of natural barrier vegetation starting at the bluff crest boundary line on my side and running south approximately 160', ending at the point where your house construction begins. This natural vegetation barrier serves to maintain privacy and prevent up land erasion_ However you did not hesitate to clear the natural barrier vegetation on your side running 120' south toward the cul de sac, leaving our houses without natural barrier for privacy- To prevent water/soil runoff, you installed hay bales. I believe after all that has occurred and the damage that was caused to our pfporty, and given the many times we expressed our concern to you, that my family and I were actually quite neighborly to you. We thought you were going to live here, even so as a spot builder we gave you every opportunity to understand the consequences of your actions. In closing my family and I believe that ultimately you are responsible to correct the 5 damaged terraces that have shifted. My sound front width is 100'. The damage is most severe at the top terrace were the erosion undermined and the oncoming soil further caused the shifting. This top terrace runs approximately 70' long according to my P.E. who supervised and signed this work off for the Town rBpard advises the following: 1 a_ The terraces to be taken down and rebuilt 110 degrees against the bluff face. b. The 4 remaining tower terraces have shifted approximately 35' in length,they have to i be disassembied.and re-built with an angle of 110 degrees against the bluff. c_ Replant or replace all damaged plantings_ d. All repair work to be re-inspected by P.E. of record. e. Any further damage caused during construction must be immediately corrected and inspected_ work is completed that caused shifting damage must be immediately corrected and inspected by P.E. of record. We believe this work must take place immediately and on an Emergency basis before we loose the remaining terraces and plantings.
