DECISION Robert Kujawski For a Variance to the New York State PETITION NO. 2003-0247 Uniform Fire Prevention and Building Code Upon the application of Robert Kujawski, filed pursuant to 19 NYCRR 1205 on April 29, 2003, and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to the construction of a Group Al (one-family dwelling) occupancy, two stories in height, of Type 5b (wood frame) construction, approximately 4,000 square feet in area, located at 1490 Duck Pond Road, Town of Southold, County of Suffolk; State of New York. The petitioner is seeking relief from: 9 NYCRR 711.2(b), which requires that bathrooms, toilet rooms, kitchenettes, corridors and recreation rooms have a minimum ceiling height of seven feet. [The petitioner requests a bathroom built under the sloping roof area of the second story with a ceiling height of 8 feet sloping down to approximately 5 feet 3 inches on the opposite side.] FINDINGS OF FACT 1. As part of proposed new dwelling, a bathroom is to be constructed under the sloping roof area of the second floor of the building that is the subject of this petition. 2. The ceiling height of 8 feet slopes down to approximately 5 feet 3 inches on the opposite side. 3. With the placement of the fixtures the ceiling height is adequate for normal usage. 4. The petitioner has proposed to install smoke-detecting alarm devices throughout the entire building as required by the Uniform Code. 5. The local Code Enforcement Official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 1205.6. 6. While not applicable in this instance, Section R305.1 exception 4 of the Residential Code of New York State, effective January 1, 2003, allows space under sloping ceilings provided not more than 50 percent of the required floor area of a room or space has a sloped ceiling less than the required height with no portion WWW.DOS.STATE.NY.US E-MAIL I NF0900S.STATE.NY.US Petition No. 2003-0247 Page 2 of the required floor area less than 5 feet in height. The bathroom,as proposed, would comply with this section and would not require a variance. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a negligible additional health, safety and security benefit to the occupants of the building. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 711.2(b), to allow a bathroom built under the sloping roof area of the second story with a ceiling height of 8 feet sloping down to 5 feet 3 inches on the opposite side, be and is hereby PROPOSED TO BE GRANTED with the following condition: 1. That the petitioner installs smoke-detecting alarm devices throughout the.entire building in conformance with the Uniform Code. This DECISION is issued under 19 NYCRR 1205.6. Unless objected to by the petitioner in a writing received by the Department, the decision shall become FINAL after fifteen days of receipt of the decision by the parties. I was pleased to observe that the Structural Insulated Panels had been installed as per the instructions of both the contract documents and the manufacturer's recommendations. Additional girders, beams, posts,framing members and fasteners have all been sized and installed correctly according to the requirements of the contract documents. In light of the inspection performed as described above. I certify that to the best of my -knowledge and belief the dwelling as built meets all the structural requirements of the New York State Construction Code in effect at the time the permit for the project was Issued. Additionally,as the SIP Construction includes the properly installed Insulation as wail, which together with the interior OSB protects the Interior walls from weather, it Is appropriate to Install the Interior gypsum wall board prior to the installation of the exterior siding. The spun-bonded polyolefin house wrap provides extra protection from the elements.
