DOS-0239-a-f(Rev,02-25) page 1 of 5 l I.A new Chapter 164 of the Code of the Town of Southold is hereby adopted as follows: A Local Law entitled, "A Local Law in relation to Irrigation" II. 164-1 Legislative Intent. The Town Board of Southold acknowledges that Southold Town's sole source aquifer system is a finite resource and serves as the only water supply available to meet the needs of the Town's population. Approximately 70% of the water pumped during peak demand hours is used for outdoor purposes, such as landscape irrigation.Unfortunately, up to 50% of this water is wasted due to overwatering caused by inefficient irrigation methods and systems. The Southold Town Board recognizes that water-efficient irrigation systems can help reduce overwatering and mitigate issues like soil runoff,which is vital for maintaining and prolonging our Town's water supply,particularly during peak usage times. Therefore,this law establishes requirements for residential and commercial lawn,turf, and garden irrigation systems to conserve and manage our upper glacial aquifer,which is the sole source of drinking water in Southold Town. 164-2 Definitions. As used in this law,the following terms shall have the meaning indicated: AUTOMATIC IRRIGATION SYSTEM-An automatic underground, aboveground, or grade-level system that allows or provides a means to apply controlled amounts of water to land for irrigation. CONTRACTOR-Any person,business,firm, partnership, corporation, or any other entity of its agents or employees having a Suffolk County Home Improvement Contractors License, depending on the scope of the proposed work, who install, program, and maintain, or repair an irrigation system. RAIN SENSOR-A low voltage electrical or mechanical component placed in the circuitry of an automatic landscape irrigation system that is designed to restrict operation of a sprinkler controller in the event of precipitation. SMART CONTROLLER-An evapotranspiration-based ("ET") controller that calculates soil moisture from known weather and related inputs.A Smart Controller: a. receives and monitors weather data or on-site environmental conditions including, but not limited to, solar radiation,wind speed,temperatures, relative humidity,rainfall, and soil moisture; and b. calculates or determines the amount of moisture input to and moisture lost from the soil and plant; and C. automatically creates or adjusts the irrigation schedule to apply only the amount of water necessary to maintain adequate soil moisture. SOLE SOURCE AQUIFER-An aquifer designated by the United States Environmental Protection Agency("EPA") as the sole or principal source of drinking water for the area above the aquifer and including those lands where the population served by the aquifer live;that is, an aquifer which is needed to supply 50% or more of the drinking water for that area and for which there are no reasonably available alternative sources should the aquifer become polluted. 164-3 General Requirements. A. Sprinkler heads shall preclude water application on paved areas or areas not requiring irrigation. B. During a period of extreme drought where the danger to Southold Town's Sole Source Aquifer is most significant, the Town Board of the Town of Southold may pass a resolution preventing irrigation of all properties, except those properties exempt from this Chapter. Each day such a violation shall continue shall be an additional violation.A violation of this provision shall, upon conviction thereof, be subject to a fine not exceeding$1,000 for each violation. C. Smart Controllers shall be attached to all new Automatic Irrigation Systems and set to prevent irrigation after 1/2 inch of rainfall. After 1/2 inch of rainfall,the Automatic Irrigation Systems shall not apply irrigation for a period of 2 days. 164-4 Requirements for automated systems. A. Premises with Automatic Irrigation Systems or other systems controlled by automatic time-controlled devices may only irrigate on even-numbered days for those with even-numbered street addresses and on odd-numbered days for those with odd-numbered street addresses. Daily irrigation is prohibited. B. All automatic irrigation systems installed after the effective date of this chapter shall be equipped with a Smart Controller and at least one Rain Sensor. The Smart Controller and Rain Sensor(s)shall prevent the automatic irrigation system from applying water during periods of rain and/or periods during which soil moisture content is sufficient to sustain plant life on the property. Any device installed pursuant to this section must be properly installed,maintained, and operated in accordance with manufacturer specifications. C. No more than 3 years after the effective date of this chapter, all Contractors and/or property owners who activate, install, repair, or conduct routine maintenance on automatic irrigation systems shall not activate such system unless that system is equipped with a Smart Controller and a minimum of one Rain Sensor. The Addition to the system shall prevent the automatic irrigation system from applying water during periods of rain and/or periods during which soil moisture content is sufficient to sustain plant life on the property. 164-5 Contractors who install,upgrade,or activate automatic landscape irrigation systems shall provide written documentation to the system's owner stating that the system is in compliance with this chapter. 164-6 Exemptions. The provisions of this chapter shall not apply to residential food production, land used in agricultural production and agricultural operations, nurseries and garden centers. 164-7 Enforcement.The Building Inspector, Code Enforcement Officer, Ordinance Inspector, or other official as designated by the Southold Town Board shall all be responsible for the enforcement of this chapter. 164-8 Penalties for offenses. A. A violation of the provisions of this chapter shall be issued only after notice of noncompliance and warning to cease illegal operations has been properly served and an opportunity to cure, not to exceed thirty days,has been provided. B. Any contractor or property owner violating the requirements of this chapter shall,upon conviction thereof, be subject to a fine not exceeding$1,000 for each violation. C. Any contractor or property owner violating the requirements of this chapter shall, upon the second or subsequent conviction within five years of the first conviction, be subject to a fine not exceeding$2,500 for each subsequent violation. III. Severability. If any clause, sentence, paragraph, subdivision, section, or part of this law or the application thereof to any person, individual, corporation, firm, partnership, entity, or circumstance shall be adjudged by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, section, or part of this law, or in its application to the person, individual, corporation,firm,partnership, entity, or circumstance directly involved in the controversy in which such order or judgment shall be rendered. IV. Effective Date. This Local Law shall be effective upon adoption by the Southold Town Board and filing with the Secretary of State. P ! I'm Jeff Szabo, Chief Executive Officer of the Suffolk County Water Authority. SCWA is the largest provider of drinking water in Suffolk County. We serve 1.2 million residents and supply more than half the population of Southold, with about 12,000 customer connections. No one knows the North Fork aquifer system better than we do. Here on the North Fork, we operate 60 public supplywells and delivered over 1.4 billion gallons of drinking water to Southold customers in 2024. 1 want to thank Supervisor Krupski and the Southold Water Advisory Committee for advancing this critical legislation. SCWA has presented to the committee multiple times over the last several years, consistently urging the Town to treat this issue with the seriousness it demands. Today, I am here to support this legislation. Southold is in a water supply crisis.And this bill, along with adding additional supply with the North Fork Pipeline project, is part of the solution. The core of the problem is simple. There simply is not enough water in the aquifer under Southold to meet demand. During the summer months, SCWA's infrastructure on the North Fork, though robust and modern, is overwhelmed by automatic lawn irrigation systems in the overnight hours, when in-home water use is low. Southold residents are using more water than ever before and that is evidenced by the crisis we are facing today. Our wells are pushed to maximum capacity and still cannot keep up.As a result, storage tanks like the one on Moore's Lane in Greenport drop to dangerously low levels, sometimes just a few feet of water. That creates a domino effect: insufficient pressure, reduced flow, potentially limiting firefighting capability, and our inability to meet the water needs of hospitals and emergency responders. That is the reality we're already living with—and the consequences of doing nothing are dire. Let me be as clear as I can: This is not a hypothetical. The aquifer beneath Southold is at serious risk of saltwater intrusion. At times,we are pumping all our wells in the entire township just to keep up with irrigation demand. If this continues, we run the risk of drawing saltwater into the aquifer—a process that cannot be reversed. And once it happens, the wells are done.You cannot flush the salt back out. The supply is lost— permanently. Unlike the other parts of Suffolk,where freshwater wells can be constructed up to 800 hundred feet deep and can supply up to 1,300 gallons per minute by pulling from deeper aquifers like the Magothy, freshwater in Southold is limited to the Upper Glacial Aquifer. These wells range from 50 to 100 feet deep and supply only around 50 gallons per minute. Studies, such as the Hydrogeologic Framework of the North Fork done by the United States Geologic Survey, discuss this sensitive system and indicate that the freshwater in this region is a series of shallow isolated freshwater bubbles surrounded by seawater both at the coastline and below.This region is sensitive to pumpage changes and over pumping will result in the irreversible threat of seawater contamination. We've seen this before. In Jamaica, Queens, the public water supply was shut down in the 1990s after saltwater contamination infiltrated the wells. Now, 30 years later, the U.S. Geological Survey has found that the saltwater plume has not significantly diminished. That's the future we face on the North Fork if we do not act.This is not a choice between doing something or doing nothing. It's a choice between doing something—or damaging the aquifer for generations. The Town's proposed legislation is a serious and thoughtful attempt to confront this problem. One provision stands out as the single most impactful change the Town can make: the adoption and enforcement of an odd/even lawn watering schedule. SCWA implemented this policy in 2023, but we have no authority to enforce it. Most residents already water every other day—typically Monday,Wednesday, Friday—but that's exactly the problem.When everyone waters at once, our system cannot recover. A well- enforced odd/even rule would distribute demand more evenly and help maintain pressure in our tanks and mains during peak periods. We also strongly support the proposed requirements for smart irrigation controllers. SCWA has issued hundreds of thousands of dollars in rebates to encourage the installation of these water-saving devices. These devices have been shown to be effective at reducing water use while keeping lawns healthy and lush. SCWA has made an enormous-effort to make our customers aware of the importance of water conservation and the best practices to achieve it.We have invested hundreds of thousands of dollars into advertising campaigns to stress the urgency of the situation.We have held community meetings on the North Fork.We have gone door-to-door, taking our message directly with customers on how they can help. Through emails, phone messages, text messages and bill inserts we are imploring residents to follow the odd/even lawn watering schedule and install smart controllers for their irrigation systems. I wish I could report that these efforts have been a unmitigated success and the problem has abated.The truth is that we have seen only a small change in behavior. We understand that conservation alone won't solve this problem. Adding additional supply with the North Fork Pipeline project is the only surefire solution to ensuring the long-term supply for Southold. But the situation has become so severe and every step must be taken to urgently address this problem. Every additional gallon we draw now puts the long-term health of the North Fork aquifer at greater risk.This is an aquifer we are supposed to be protecting—not pushing to collapse. The Suffolk County Water Authority strongly supports this legislation.We believe it will help stabilize water use, preserve pressure and storage capacity and slow the march of saltwater intrusion. RAIN SENSOR-A low voltage electrical or mechanical component placed in the circuitry of an automatic landscape irrigation system that is designed to restrict operation of a sprinkler controller in the event of precipitation. SOLE SOURCE AQUIFER-An aquifer designated by the United States Environmental Protection Agency ("EPA") as the sole or principal source of drinking water for the area above the aquifer and including those lands where the population served by the aquifer live; that is, an aquifer which is needed to supply 50% or more of the drinking water for that area and for which there are no reasonably available alternative sources should the aquifer become polluted. 164-3 General Requirements. A. Sprinkler heads shall preclude water application on paved areas or areas not Requiring irrigation. B. During a period of extreme drought where the danger to Southold Town's Sole Source Aquifer is most significant the Town Board of the Town of Southold may pass a resolution preventing irrigation of all properties, except those properties exempt from this Chapter. Each day such a violation shall continue shall be an additional violation.A violation of this provision shall, upon conviction thereof, be subject to a fine not exceeding$1,000 for each violation. C. Smart Controllers shall be attached to all new Automatic Irrigation Systems and set to prevent irrigation after 1/2 inch of rainfall.After 1/2 inch of rainfall, the Automatic Irrigation Systems shall not apply irrigation for a period of 2 days. 164-4 Requirements for Automated systems. A. Premises with automatic time-controlled underground irrigation systems or other systems controlled by automatic time-controlled devices may irrigate on even- numbered days for those with even-numbered street addresses and on odd- numbered days for those with odd-numbered street addresses. Daily irrigation is prohibited. B. All automatic irrigation systems installed after the effective date of this chapter shall be equipped with a Smart Controller and at least one rain sensor. The Smart Controller and Rain Sensor(s) shall prevent the automatic irrigation system from applying water during periods of rain and/or periods during which soil moisture content is sufficient to sustain plant life on the property.Any device installed pursuant to this section must be properly installed, maintained, and operated in accordance with manufacturer specifications. C. No more than 3 years after the effective date of this chapter, all Contractors and/or property owners who activate, install, repair, or conduct routine maintenance on automatic landscape irrigation systems shall not activate such system unless that system is equipped with either a Smart Controller or a minimum of one Rain Sensor. The Addition to the system shall prevent the automatic irrigation system from applying water during periods of rain and/or periods during which soil moisture content is sufficient to sustain plant life on the property. Y 164-6 Exemptions.The provisions of this chapter shall not apply to residential food production, land used in agricultural production and agricultural operations, nurseries and garden centers. 164-7 Enforcement. The Building Inspector, Code Enforcement Officer, Ordinance Inspector, or other official as designated by the Southold Town Board shall all be responsible for the enforcement of this chapter. r r 164-8 Penalties for offenses. A. A violation of the provisions of this chapter shall be issued only after notice of noncompliance and warning to cease illegal operations has been properly served and an opportunity to cure, not to exceed thirty days, has been provided. B. Any contractor or property owner violating the requirements of this chapter shall, upon conviction thereof, be subiect to a fine not exceeding$1,000 for each violation. C. Any contractor or property owner violating the requirements of this chapter shall, upon the second or subsequent conviction within five years of the first conviction, be subiect to a fine not exceeding$2,500 for each subsequent violation. III. Severability. If any clause, sentence, paragraph, subdivision, section, or part of this law or the application thereof to any person, individual, corporation, firm, partnership, entity, or circumstance shall be adjudged by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence,paragraph, subdivision, section, or part of this law, or in its application to the person, individual, corporation, firm,partnership, entity, or circumstance directly involved in the controversy in which such order or judgment shall be rendered.
