Upon the application of ITIA LLC filed pursuant to 19 NYCRR 1205 on April 15, 2025, and upon
all other papers in this matter,the Department makes the following determination:
NATURE OF GRIEVANCE AND RELIEF SOUGHT
This petition pertains to a shared pool fence of a detached one-or two-family dwelling located at 285
Willow Drive, Town of Southold, County of Suffolk, State of New York.
Relief is requested from:
19 NYCRR Part 1220,The 2020 Residential Code of New York State,Section R326.4.2,
Permanent Barrier. Swimming pools shall be completely enclosed by a permanent barrier complying
with Section R326.4.2.1 through R326.4.2.6.
[The petitioner is seeking a variance from installing a separate fence in connection with Dongaris'
installation of a swimming pool.]
FINDINGS OF FACT
1. There is a fence agreement by and between Spiro and Gena Dongaris(Itia, LLC) of 285 Willow
Drive, Greenport, New York(Dongaris)and Apostolos Malatos of 415 Willow Drive, Greenport,
New York(Neighbor).
2. The parties each own the above-reference properties,which are immediately adjacent to one
another.
3. The neighbor had previously installed a fence on the boundary line shared by the two properties.
4. The parties have agreed to enter into agreement to maintain the fence including cost sharing,
access to property, inspections, compliance with the law and insurance.

5. The local code official supports the granting of a routine variance by the Department of State in
this matter.
CONCLUSION OF LAW
The proposed variance will not substantially adversely affect the Code's provisions for health, safety,
and security. Strict compliance with the provisions of the Uniform Fire Prevention and Building code would
entail practical difficulties or unnecessary hardship and would otherwise be unwarranted because such
would be unnecessary considering alternatives which, without a loss in the level of safety, achieve the
intended purpose of the code.
DETERMINATION
WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1220, The
2020 Residential Code of New York State, Section R326.4.2, Compliance, Exception 1, be and is hereby
GRANTED with the following conditions:
1. That the parties shall be responsible for the maintenance of their respective sides of the pool
fence including keeping the fence secure,free of any breaches and in good repair.
2. That in all other respects the applicable requirements of the Uniform Code shall be satisfied.
This DECISION is issued under 19 NYCRR 1205.5 unless objected to by the petitioner in a writing
received by the department, the decision shall become FINAL after fifteen days of receipt of the decision
by the parties.
This decision is limited to the specific building and application before it, as contained within the
petition, and should not be interpreted to give implied approval of any general plans or specifications
presented in support of this application.
