Board of Town Trustees October 8, 2025 Town of Southold 54375 Route 25 Southold, NY 11971 Trustees, ( C I am writing you regarding the wetlands application before you for: 106 Mulberry Corp, 750 West Lake Drive, Southold, NY 11971 - (aka 1000-90.-2-1) I represent West Lake Association, Inc. and would like to share our thoughts on the project. As a community,we have little objection to the applicant constructing the proposed house, on the property they own, as shown on the plans attached to the application.We do have a few comments and questions regarding portions of the project. First and foremost: It is imperative that the community retain access to channel and lake via roadway easement without any restrictions,fences or barriers—temporary or permanent-that might prevent access by any of the local residents.This is a unified concern voiced by the community. Second, during the bulkhead construction the Marine Contractor took liberties in spreading out sand, as much as 8"deep outside of the applicant's property.This already restricts access and was never part of the original permit. Restore roadway easement and adjacent town designated land in front of dock to original condition This excessive sand must be removed immediately. The Rodway Easement and Town property returned to its original elevation of 5.5'(as noted on the original survey drawing) and re-graveled to the original condition. In addition, we would like to request: o No homeowner vehicle Parking or any storage on roadway easement or town land. o Modify the Site plan to reference any portion of the easement as"Roadway"and remove any references to a"Driveway"within the easement. o Hold retaining wall height to 24" along easement, as measured from the original elevation of 5.5'and provide vegetation inside the property line and in front of the concrete wall. o That the proposed house plans represent the maximum size permitted for this site, including the top of ridge elevation. And I would appreciate asking these questions? o Asper the Architectural Plans, the reference to Natural Grade is shown at Elevation 7.0' yet the current property elevation essentially matches the surveyed height of the Bulkhead which is 5.5'.Where is the Natural Grade as per the Town Code? o Should a Non-Turf Buffer be included along the Channel Bulkhead to Protect the Environment? o Can ALL Non-turf buffers be vegetated with Natural Grasses? o Can the plan define locations for all mech equipment to the East Elevation? Including electrical/cable service connects at same location? The WLA previous and current concerns exist because of the sand runoff of the applicants property into the channel.We recognize this is a very unique site.We appreciate that the applicant prepared the site with a new bulkhead. Had the Applicant exercised an opportunity to apply to raise the bulkhead height slightly,which is consistent within the DEC and USACE, It may have helped the grading issues and kept the significant earth/sand and water from running off the property into the Channel during significant storms. The Trustees can and should mandate that any sand or earth directly adjacent to the bulkhead be 4-6"below the top of`C-Loc'so the Bulkhead can act as a curb to prevent water runoff and sand runoff into adjacent waters. In conclusion, as a community that does not have the support of the applicant,West Lake Association. Inc., having accepted the responsibility to keep the channel at a proper depth, it would be helpful to include a C+R that any future runoff of solid earthen materials from this property into the channel be cleaned up (aka dredging) by the current and future property owners- at their expense. No Structures on Pilings No structures,other than structures specifically authorized by this permit, shall be constructed on pilings without further authorization from the department(permit, modification or amendment). 27. Establish Vegetated Buffer To protect the values of the tidal wetlands, a permanent vegetated buffer zone shall be established. There shall be no disturbance to the natural vegetation or topography noted as non-disturbance buffer as per NYSDEC stamped approved plan dated 2/7/2025. 28. Straw Bales or Other at Tidal Wetland A row of staked straw bales or approvable erosion control devices shall be placed at the landward edge of the buffer area or 75 linear feet from the tidal wetland boundary, or as per the NYSDEC-approved plan,prior to commencement of any regulated activities and remain in place and in good, functional condition until the project is completed and all disturbed areas are stabilized with vegetation. 29. Driveway/Parking Area of Pervious Material Driveway and parking areas shall be constructed of NYSDEC-approved pervious materials. Direct Runoff Away from Tidal Wetland and Buffer Roads, driveways, and parking areas shall be graded to direct runoff away from tidal wetlands and protected buffer areas. 31. Authorized Innovative/Alternative Onsite Wastewater Treatment Systems (I/A OWTS) Septic Systems This permit authorizes the installation of any models of I/A OWTS septic system which have received the approval of the Suffolk County Department of Health Services (SCDHS). If SCDHS rescinds its approval of one or more of these models during the term of this permit, DEC will no longer approve new installations of that model. The list of I/A OWTS systems which have received approval by SCDHS are found on website- https://reclaimourwater.info/ 32. Maintenance of Installed Innovative/Alternative Onsite Wastewater Treatment Systems(I/A OWTS) The permittee must maintain, service and repair the installed I/A OWTS in accordance with the maintenance schedule set forth in the Suffolk County Department of Health Services (SCDHS) permit issued for the system. 33. Tidal Wetland Covenant The permittee shall incorporate the attached Covenant(or similar Department-approved language)to the deed for the property where the project will be conducted and file it with the Clerk of SUFFOLK County within 30 days of the effective date of this permit. This deed covenant shall run with the land into perpetuity. A copy of the covenanted deed or other acceptable proof of record, along with the number assigned to this permit, shall be submitted within 90 days of the effective date of this permit to Marine Habitat Protection NYSDEC Region 1 Headquarters SUNY @ Stony BrookJ50 Circle Rd Stony Brook,NYl 1790-3409 Attn: Compliance 34. Incidental Disturbance to Vegetation It is the responsibility of the applicant to remedy any incidental disturbances resulting in damage or removal of wetland vegetation. Upon completion of construction activities,any disturbed areas shall be planted with the appropriate marsh vegetation. Please contact the Bureau of Marine Habitat at(631)444-0295 for more information. 35. Contain Exposed,Stockpiled Soils All disturbed areas where soil will be temporarily exposed or stockpiled for longer than 48 hours shall be contained by a continuous line of staked haybales/silt curtains (or other NYSDEC approved devices)placed on the seaward side between the fill and the wetland or protected buffer area. Tarps are authorized to supplement these approved methods. 36. Maintain Erosion Controls All erosion control devices shall be maintained in good and functional condition until the project has been completed and the area has been stabilized. 37. No Interference With Navigation There shall be no unreasonable interference with navigation by the work herein authorized. 38. State Not Liable for Damage The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation,or for other purposes, and no claim or right to compensation shall accrue from any such damage. State May Order Removal or Alteration of Work If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State,the owner may be ordered by the Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State, and if,upon the expiration or revocation of this permit,the structure, fill,excavation, or other modification of the watercourse hereby authorized shall not be completed,the owners, shall, without expense to the State,and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal or alteration. 40. State May Require Site Restoration If upon the expiration or revocation of this permit,the project hereby authorized has not been completed,the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may lawfully require,remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. 41. Precautions Against Contamination of Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings,paints, concrete, leachate or any other environmentally deleterious materials associated with the project. WATER QUALITY CERTIFICATION SPECIFIC CONDITIONS I. Water Quality Certification The authorized project, as conditioned pursuant to the Certificate, complies with Section 301, 302, 303, 306, and 307 of the Federal Water Pollution Control Act, as amended and as implemented by the limitations, standards, and criteria of state statutory and regulatory requirements set forth in 6 NYCRR Section 608.9(a). The authorized project, as conditioned,will also comply with applicable New York State water quality standards, including but not limited to effluent limitations, best usages and thermal discharge criteria, as applicable, as set forth in 6 NYCRR Parts 701, 702, 703, and 704. Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Department,issuance of this permit does not modify,supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. 3. Applications For Permit Renewals, Modifications or Transfers The permittee must submit a separate written application to the Department for permit renewal, modification or transfer of this permit. Such application must include any forms or supplemental information the Department requires. Any renewal,modification or transfer granted by the Department must be in writing. Submission of Renewal Application The permittee must submit a renewal application at least 30 days before permit expiration for the following permit authorizations: Excavation&Fill in Navigable Waters, Tidal Wetlands, Water Quality Certification. S. Permit Modifications, Suspensions and Revocations by the Department The Department reserves the right to exercise all available authority to modify, suspend or revoke this permit. Permit Transfer Permits are transferrable unless specifically prohibited by statute,regulation or another permit condition. This indemnification does not extend to any claims, suits,actions, or damages to the extent attributable to DEC's own negligent or intentional acts or omissions,or to any claims,suits,or actions naming the DEC and arising under Article 78 of the New York Civil Practice Laws and Rules or any citizen suit or civil rights provision under federal or state laws. Item B: Permittee's Contractors to Comply with Permit The permittee is responsible for informing its independent contractors, employees, agents and assigns of their responsibility to comply with this permit, including all special conditions while acting as the permittee's agent with respect to the permitted activities, and such persons shall be subject to the same sanctions for violations of the Environmental Conservation Law as those prescribed for the permittee.
