Qualified in Suffolk County Notary Public My Commission Expires 09-28-2028 ,.l RIDER TO VARIANCE APPLICATION OF � PETER AND ALLISON KRONICK STEIN ReceL 'd 63417 CR 48, GREENPORT, NEW YORK AUG 0 6 2025 SCTM # 1000-40.-1-18 Zoning Board of Appeals REASONS FOR APPEAL: The Applicants, Peter and Allison Kronick Stein, are appealing the Building Inspector's Notice of Disapproval, dated June 20, 2025, for a building permit to demolish and reconstruct an existing single-family dwelling substantially within the footprint of the existing residence. The proposed footprint would maintain both the pre-existing non-conforming setback of 14.3 feet from the western side yard where 20 feet is required and the pre-existing non-conforming bluff setback at 61 feet 6 inches where 100 feet is required under Town Code. The subject parcel is a non-conforming 56,812.59 SF lot in the R-80 zoning district located on CR 48 in Greenport. The parcel is substantially vegetated and lies over 350 feet north of the North Road behind two vacant woodland parcels. The parcel to the west is improved with a single-family residence that straddles its western property line and the parcel to the east lies substantially seaward of the subject premises. As such, all of the proposed construction will be well within the Pier Line. The Applicants have applied to the Trustees for the requisite Wetlands Permit for the project. At their field inspection in late 2024, the Trustees did not voice any concerns with the project beyond the required stormwater management by way of gutter and leaders to drywells. In addition to rebuilding the residence, the Applicants intend to upgrade the sanitary system to a modern low-nitrogen system. For the following reasons, the Applicants submit that variances from the side yard and bluff setback requirements are warranted. 1. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The surrounding neighborhood is essentially invisible to the Applicants and to motorists travelling along CR 48 but aerial photos confirm that it is characterized by one-story and two-story waterfront dwellings of varying sizes, many of which lie seaward of the subject premises, closer to the top of the bluff. Due to the long and narrow configuration of many of the lots in this neighborhood, many of the residences are non-conforming to side yard setbacks. In fact, several neighboring homeowners have obtained side yard and bluff setback relief from this Board for various construction projects. As such, the Applicants submit that there will not be any undesirable change in the neighborhood nor a detriment to nearby properties, as the existing Received 0a residence is already non-conforming to the side yard and bluff setba U& &6rb025 which relief is being sought and the majority of the new construction lies landward of the existing residence. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: Due to the pre-existing non-conforming side yard and bluff setbacks, there is no way the Applicants can accomplish the proposed renovation within the existing footprint to minimize ground disturbance without variance relief. 3. The amount of relief requested is not substantial because: While variances for the side yard and bluff setback relief may be mathematically substantial at 28.5% and 38.4% respectively, there is no increase in the non-conformity compared to what already exists and several neighboring homes have greater non-conforming setbacks. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: As stated previously, the currently existing setbacks are pre-existing nonconforming to the current requirements, and the degree of non-conformity is not being increased. Granting of variance relief will not have an adverse impact on the physical conditions in the neighborhood and, as a Type II action, there is no perceivable environmental impact stemming from the proposed renovation. In addition, the Applicants will be upgrading to an I/A low-nitrogen sanitary system, resulting in a net environmental benefit from this project. 5. Has the alleged difficulty been self-created? {) Yes, or {X) No Why: Previous owners built the existing residence in a location which is now non-conforming to modern zoning code, and the Applicants seek to only maintain these setbacks as they rebuild the structure. To any extent that the difficulty be deemed self-created, pursuant to New York Town Law §267-B (3), a self-created hardship "shall not necessarily preclude the granting of an area variance."
