"A"and "B" m ' - - - - - - - - - - - - - - - - - - - - x WHEREAS, pursuant to the provisions of the Suffolk County Improvement Act the above entitled proceeding was duly instituted r) by an Order of the Supreme Court which was duly filed in the C Office of the County Clerk of Suffolk County on the 2Ist day Cc of August , 1964, and that thereupon title in fee simple to the property to be acquired in said proceeding became vested in the County of Suffolk., Now York, and the proceeding continued for the purpose of determining the compensation to be made to the owners of the real property to be acquired in this proceeding is to be ascertained by the Court without a Jury, and WHEREAS, immediately prior to the vesting of title as aforesaid in the said County of Suffolk JOHN S. MA.TWIECZYK and of Cutcho ue New York MARY LILLIAN MATWIECZYK g owned the parcel of property acquired as aforesaid and 'designated in said proceeding as Map No. 63 , which said parcel of property is more particularly described as follows: ALL those pieces or parcels of land situate in the Town of Southold, County of Suffolk, State of New York for the reconstruction of Middle Road, C.R. No. 27, as shown on Map No. 63 and described as follows: PARCEL "A" BEGINNING at a point on the Northerly boundary of the existing Middle Road at the intersection of the said boundary with the division line between the lands of John S. Matwieczyk & wife, reputed owners on the East, and the lands of Frank Machinchick, reputed owner on the ;'lest, said point being 47 _feet distant Northerly, measured radially from station 203 + 64 _ of the hereinafter described survey center line of the proposed reconstruction of Middle Road, C.R. No. 27, thence Northerly along said division line 13 e feet to a point 60.00 feet distant Northerly, measured radially from station 203 + 62 f of said center line; thence Easterly on a curve deflecting to the left having a radius of 5669.58 feet, an arc distance of 100 i feet to a point on the division line between the lands of John S. Matwieczyk & wife, reputed owners on the West, and the lands of Pauline Matwieczyk, reputed owner on the East, the last mentioned point being 60.00 feet distant Northerly, measured radially from station 204+ 63 *of the said center line; thence Southerly along said division line 22 3 feet to its intersection with the Northerly boundary of said existing road, the last mentioned point being 38 �feet distant Northerly, measured radially from station 204+ 64 :h of the said center line; thence Westerly along the said boundary 100 *ieet to the point of beginning; being; I750 t s.f. or 0.040 acres more or less. No. .27, thence Northerly along said division line 5 is feet to a point 65.00 feet distant Northerly, measured radially from station 203 + 62 f of said center line; thence Easterly 100 : feet to a point on the division line between the lands of John S. Matwieczyk & wife, reputed owners on the West, and the lands of Pauline Matvrieczyk, reputed owner on the East, the last mentioned point being 65.00 feet distant Northerly, measured radially from station 204+ 63 f of the said center line; thence Southerly along said division line 5 f feet to a point, 60.00 feet distant Northerly, measured radially from station 204+ 63 f of the said center line; thence Jesterly on a curve deflecting to the right having a radius of 5669.58 feet an arc distance of 100 f feet to the point of beginning; being 500 f s.f. or 0.011 acres niorc or less. The above mentioned survey center line is a portion of the survey center line for the proposed reconstruction of Middle Road,,C.A. No. 27 as shown on a map on file in the office of the Commissioner of Public 'Yorks of Suffolk County. - MUM econu Talcing); map Ro. LISER5795 vAA06 and WHEREAS, the said parson or persons who owned said parcel of property prior to its acquisition as aforesaid by the County of Suffolk desire to compromise and'settle the claim for compensa- tion therefor at the sum of $822.50 ,,which the said County agreed to pay, NOW, THEREFORE, in consideration of the premises and of the sum of $822.50 , lawful money of the United States, in hand paid to the undersigned, receipt whe• eof is hereby acknowledged, the undersigned hereby accepts said sum in full compromise and settlement of any and all claims for oompensation or damage by reason of the acquisition of said parcel of property by said County, and the ascertainment of compensation or damages by the said Court is hereby waived and the said County of Suffolk is hereby released from any other or further claim for the acquisition of said parcel of property, and the undersigned hereby ratify and confirm the title to said parcel of property acquired by said County as aforesaid. As an inducement to said compromise and settlement it is represented and guaranteed �)y the undersigned that at the time title to said parcel of property vestcd in said County the undersigned had fee simple title thereto free of any incumbrances or liens or claims of any nature and that no assignment has beep made of the compensation to be paid by said County for said property.
