SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief requested in this application is listed under the Minor Actions exempt list and is not st.bject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a semi-trapezoidal-shaped non-conforming 11,585 square foot parcel in the R-40 District. The parcel has 62.70 feet fronting Peconic Bay Boulevard, has a western boundary that runs 228.25 feet north-northwest to the rear boundary, has a 53.97-foot rear boundary adjacent to the neighboring parcel to the northwest, then runs 197.70 feet south-southwest, along a right-of-way, back to_Peconic Bay Boulevard. The parcel is improved with a one-story masonry and frame house with a 9.9-foot by 9.1-foot covered porch at the northeast corner of the house and a small open concrete stoop at the southwest corner of the house. On the southeast side the house is 3.1 feet from the lot line which is adjacent to a right-of-way servicing homes to the east. Stockade and wood fences bound the parcel on the west side and a wood fence and chain link fence bound it on the east side. An arborvitae hedge bounds the north side, all.as shown on the survey prepared by Nathan Taft Corwin 111, Licensed Land Surveyor, last revised April 8,2025. BASIS OF'A.PPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's April 11, 2025 Notice of Disapproval based on an application for a permit to legalize additions and alterations to an existing single-family,dwelling; at; 1) less than the code required minimum side yard setback of 10 feet; located at: 7185 Peconic Bay Blvd, Laurel,NY. SCTM No. 1.000-126-10-12.1. RELIEF REQUESTED: The applicant requests a side yard variance to enclose the covered porch on the northeast corner of the dwelling,'as shown on the architectural plans prepared by James M. Bofill, Registered Architect, prepared May 11, 2025. The proposed project does not alter the existing side-yard setback of 3.1 feet, where the code requires a minimum of 10 feet. r Page 2,July 24, 2025 98018 Davecollco, LLC, David Bofill, Member SCTM No. 1000-126-10-12.1 ADDITIONAL INFORMATION: The application included Plans, Elevations & Section, and Notes & Details collectively titled"Proposed Alteration to the: Bofill Residence" prepared by James M Bofill, Registered Architect, dated May 11, 2025, numbered A-1, A-2, and A-3, respectively. A Stop Work Order was issued by Sean Devlin, Electrical Inspector, dated June 7, 2024. The subject parcel is covered by Certificate of Occupancy No.42205 dated July 29,2021 pursuant to Building Permit No. 43831 dated June 5, 2019 for "as built" complete new roof rafter system as applied for; by Certificate of Occupancy No.Z-25942 dated September 2, 1998 pursuant to Building Permit No.25154-Z dated September 2, 1998 to enclose existing open porch to habitable space as applied for "as built"; and by Pre-Existing Certificate of Occupancy No. Z-25943 dated September 2, 1998 for a one family dwelling and accessory garage with storage. The parcel was the subject of two prior ZBA decisions. In Appeal#314 dated September 23, 1960,the Board granted permission to reduce frontage and split an existing lot into two single lots. In ZBA File#7057 dated May 18, 2017, the Board granted SCTM #1000-126-10-12.1 a variance to legalize "as built" additions and alternations which replaced a flat roof with a pitched roof. The variance allowed the 3.1-foot easterly side yard setback along the right- of-way where the code required 10 feet. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held'a public hearing on this application on July 10, 2025 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is characterized by modest dwellings of various sizes and styles, many on non-conforming lots. Many of the homes were developed prior to zoning,and on the north side of Peconic Bay Boulevard it is not uncommon for the homes fronting the street to share rights-of-way to enable access to homes behind those fronting the street. The subject easterly side-yard setback has existed since at least 2017 and likely since the home was built. Further, the neighboring homes on that side are set back from the right- of-way, such that the distance from the subject dwelling to the dwelling to the east is equal to at least 3'.1 feet plus the width of the right-of-way (25 feet). Hence the non-conforming side yard setback continues to have little visual impact. 2. Town Law V67-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing dwelling was built close to the property line prior to Zoning and the proposed porch enclosure does not alter that situation. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 69% relief from the code. However, the residence was built prior to Zoning and close to the property line, and a prior Board decision allowing installation of a pitched roof to replace a flat roof similarly granted the identical side yard setback variance. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Page 3,July 24,2025 #8018 Davecollco, LLC, David Bofill, Member SCTM No. 1000-126-10-12.1 5. Town Law U67-b(300). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law V67-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of enclosing the covered porch while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Steinbugler, seconded by Member Planamento, and duly carried, to GRANT the variance as applied for, and shown on the survey prepared by Nathan Taft Corwin III, Land Surveyor, last revised April 8, 2025 and Architectural Plans (Sheets A-1 thru A-3) prepared by James M Bofill, Registered Architect, dated May 11, 2025. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant must apply to the Building Department for a building permit for the "as built" improvement(s)within 90 days of the date of this decision and submit same to the Office of the Zoning Board of Appeals, or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a building permit in the time allotted. 2. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s)and submit same to the Office of the Zoning Board of Appeals within 12 months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s) why the applicant was unable to obtain a Certificate of Occupancy in the time allotted. 3. The "as built" improvement may not be used until a Certificate of Occupancy has been obtained. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar desirn that is de minimis in nature for an alteration that does not increase the decree of nonconformity, provided de minimis relief is requested within one year of the date of this decision. Any time after one year, the Board may require a new application. The eastern lot line is 197.7 feet running parallel with a neighboring 25 feet wide right of way servicing homes to the north and east who share the benefit of this right of way. The northern lot line is 53.97 feet shared with a residence with accesses to their property via the right of way and the western lot line is 228.25 feet shared with a third neighbor. The lot is improved with a 1 story masonry and frame, single family house and accessory detached garage. At its closest to the road,the house is set back 39.6 feet and on,the west side is 19.3 feet from the lot line, however, on the east side,the house is 3.1 feet from the lot line. The property is enclosed with a chain link fence. Additionally, a taller, wooden stockade fence exists on the west side behind the residential facade and on the north side,as shown on the survey prepared by Nathan Taft Corwin III,LS,dated February13,2017. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's January 18, 2017 Notice of Disapproval based on an application for a permit to legalize "as built" additions and alterations to an existing single family dwelling,at: 1)less than the code required minimum side yard setback of 10 feet;at: 7185 Great Peconic Bay Boulevard,Laurel,NY.SCTM#1000-126-10-12.1. RELIEF REQUESTED: The applicant requests a variance to legalize as-built additions and alterations to an existing single family dwelling, which includes replacing an existing flat roof with a gable roof increasing the overall elevation to 16 feet, 10 inches. The improvements will result in the east side yard setback, along the right of way,of 3.1 feet where the code requires 10 feet.The new roof will cover a rear open porch,as well. RECEIVED Page 2,May 18,2017 #7057,Pagano APR 2 5 2025 SO) 3 SCTM No. 1000-126-10-12.1 ZONING BOARD OF APPEALS ADDITIONAL INFORMATION: While several neighbors spoke publicly at the hearing or offered comments in writing voicing their concerns, it is important to note that the subject property was,prior to the current ownership, in a terrible state of neglect and disrepair. Moreover,the residence was built with a flat roof prior to Zoning and has a legal Pre-Certificates of Occupancy. The most salient point offered in opposition to the applicant's request for a variance is that immediate neighbors who share the right of way to access their property,have concern over drainage and storm water run-off. It is stated that pooling of water and snow-melt have adversely impacted access to their homes caused by a traditional, pitched roof built without Town permits and that the problem did not exist prior to unauthorized building. When asked about gutters and a drainage plan to alleviate this concern, the applicant indicated that she would install gutters along the roof edge and appropriate drywells to collect storm- water runoff and snow-melt limiting the possibility of any pooling onto the right of way owned by neighbors. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 4,2017 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 267-b(3)(b)(1)._ Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Great Peconic Bay Boulevard is a unique road running parallel to the Peconic Bay. Residences on the south side of the road typically are `bay front' and are located on larger and deeper lots, although still quite narrow in width. However, residences located on the north side of the road, like the applicant's,tend to be on lots that are smaller,substantially narrow and irregularly shaped and often share rights of way or other means of access to residential lots behind houses that front along the street.. Many homes on both sides of the road were developed prior to Zoning,with set-backs similar to the applicant's,and are of varied housing styles and sizes. However,with one major difference: all neighboring homes have pitched roofs. Furthermore,neighboring homes are set further back and away from lot lines and or the right of way to the east of the applicant. The proposed addition will have little or no visual impact on neighbors or those using Great Peconic Bay Boulevard. 2. Town Law 267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue,other than an area variance. The existing residence was built close to the property line prior to Zoning with a flat roof, on a small and narrow lot. The applicant's proposed renovations are the only logical solution to remedy conversion of a flat roof to a low gable roof. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 69%relief from the code. However, the residence was built prior to Zoning and no other variance to date has been issued for this property. The applicant is not increasing the non-conformity;they propose to maintain the existing setback of 3.1 feet from the eastern property line adjacent to the neighbor's right of way which is approximately 25 feet wide. The purpose of the request is to allow the applicant to improve their residence with the installation of a pitched roof in lieu of the existing flat roof. 4. Town Law 4267-b(3)(bN4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and install appropriate commercial grade roof gutters and dry well to ensure storm water run-off and snow-melt from the subject property will not adversely impact the adjacent property owners who benefit from the 25 feet wide right of way. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 6267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations to a single family residence while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
