The Southold Town Board met at the office of Supervisor Norman E.
KliDp at Greenport~ on Tuesday~ March 26, 19~7. The meeting was
called to.order at I:30~P.M. with the following present: Supervisor
Norman E. Klipp; Councilman Albertson; Justices Tuthill~ Clark and
Demarest; Superintendent of Highways Price; Town Attorney and Town
Clerk Booth.
Moved by Justice Clark; Seconded by ~m~±~ Councilman Alber~son:
RESOLVED: That the minutes of March ~th and March 13 be and hereby
are duly approved as read.

RESOLVED: That the regular monthl~)~ing of this board will be held
at the office of Supervisor Norma~ E. Klipp at Greenport~ on Tuesday~
April 9~ 1957, at 1:30 P.M.

A request was made by the ~a~tituck Chamber of Commerce for some
finsncial assistance from the Town Board in placing chao~el marking
buoys in the ~attmtuck Creek.

RESOLVED: That Supervisor Norman E. Klipp be and he hereby is author-
ized to appropriate a sum up to but not in access of $475.00 towards
the cost of placing channel marking buoys in Mattituck CreSk.

RESOLVED: That all cars~ which are left at the Southold Tow~ High-
way Department and the owners are unknown~ the Superintendent of
Highways be and he hereby is authorized to store said cars at the
Cutchogue Storage area.

In accordance with the provisions of Section 103 of the Municipal
Law a notice was published in the newspaper of the town requesting
sealed proposals for the purchase of one new T6 International C~awler
type tractor or equal~ with 6D4 Track mounted Hydraulic Bulldozer or
equal~ said proposals were opened at 2 o'clock P.M. on Mar.26~ 19~7o
Only one bid was ~ubmitted which was by Edward Ehrbar Inc.

RESOLVED: That Supervisor Norman E. Klipp be authorieed to enter into a
contract with the s~d Edward Ehrbar Inc. for the purchase of one new
International crawler t~pe tractor with 6 D-$ track mounted Hydraulic
Bulldozer at a cost'of $7~81~.00 with a trade-in allowance'of $25OO~O0
on the old International Model T6 T~actor.

BUDGET NOTE RESOLUTION DATED MARCH 26th~ 19~7~ AUTHORIZ~NG THE ISSUANCE
OF A BUDGET NOTE OF THE TOWN OF SOUTHOLD~ SUFFOLK COUNTY~ NEW YORK~ IN
THE AMOUNT OF $~1~o00 FORAN EXPENDITB~E FOR ~iCH NO PROVISION WAS
~E IN THE ANNItAL B~DGET. 19~ by the Town of Southold~
BE IT ~SOLVED this 26th day of March~
Suffolk County~ New York~ as follows:
SECTION 1. That~ pursuant to SuJdivision 2(b) of Paragraph a of
Section 29..00 of the Local Finance Law~ for the purpose of paying the
cost of p~rchasing a new International Model T-6 Crawler Type Tractor
with 6D-~ ~ractor Mounted Hydraulic Bulldozer~ for use at the Southold
Town Dump~ for which no provision was make in the annual bedget for the
c~rrent fiscal year~ there is hereby authorized to be issued a budget
note of the.~Town of Southold in the principal amotu~t of $5~15.OO~ which
is the maximum cost of such object or purpose~ which note shall mature
on April lst~ 19~8.
Section 2, That~ except as herein specificaally prescribed~ said note
shall be of the date~ terms~ form~ contents and place of payment~ and
at a rate of interest not exceeding three per cent~m per annum~ as may
be determined by the Town Supervisor~ consistent~ however~ with the pro-
visions of~smid Local Finance Law of the State of New York~ and shall
be executed in the na~me of the Town of Southold by its Supervisor and the
seal of said Town shall be attached thereto.
Section ~. That said note shall be sold at private sale by the Town
Supervisor at a price of not less ~ha~ par value and accrued interest~
if any~. and upon due execution and sale of said note the same shall be
delivered to the purchaser upon payment by him to the Town Supervisor of
the purchase price in cash; and the receipt o~ such Superviso~ shall be
a full acquittanc$ to such purchaser who ~hall not be obliged~t0 see
to the applic~tio~ of ~he purchase money.
Section 4. The ~ull faith and credit of the Town of Southold~ New York~
are pledged to the punctual payment of princiPal~and interest on said
note.
Section ~. This resolution shall take effect ~mmediately.
The question of the adoption of the foregoing resolution was duly put to
a vote which resulted as follows:
Ayes-SuperVisor Norman E. Klipp~ Councilman Letter M. Albertson; Justices
of the Peace Louis M. Demar~st~ Ralph W. Tuthill and Henry A. Clark.
Absent-Justice of the Peace E. Perry Edwards.

The Supervisor t~reupon declared that the resolution was duly adopted.

WHEREAS~ the Vehicle and TrafficmLaW of New York~ Section 71-~as amended~
concerning the subject of Chemical Tests~ provides among other~things, as
follows:
"~ny person who operates a motor vehicle or motor cycle in this .S~e
shall be deemed to have given his consent to a chemical test of his blood~
for the purpose of determin&~n~he alcoholic content of his blood pro-
vided that such test is administered ~t the direction of a police officer
having reasonable grounds to believe such person to h~ve beendriving
in an intoxicated condition and in accordance with the rules and regulat-
ions established by the police force of which he is a member." and
WHEREAS~ it is the recon~nendation of Otto Anrig~ Town of Southold C~ief
of Police that Rules and R=gulations of the Southold Town Polic~ be
amended so as to provide that the provisions contained in said Section
71~a~ relating to the subject of examination of persons of whom is
reasonable grounds to believe that they are operating or have recently
operated a motor vehicle while such person or persons are or were in an
intoxicated condition~ be adopted as par~ of the Southold Town Police
Rules and Regulations~
IT IS R~GULARLY MOVED 'BY JUDGE CLARK AND-SECONDED BY ~CpUNCIL~-N
ALBERTSON~ that the Southold Town Police Rules and Reg~la-~i-ons be
amedded forthwith to provide that the provisions of S~tion 71-a of
the Vehicle and Traffic Law of New York relating to/the subject of
Chemical Tests~ as hereinabove more particularly set forth~ be and
the same are adopted by and as a portion of the Ru~es and Regulations
of the To~m of Southol. d Police.

District Attorney John P. Cohalan, Jr,~ Chief Investigator Theodore
Donnelly an8 Zone Chief Gardner were pres$~t"~~ th~me~ting't~' meet
with the Southol~ and Shelter Island Town Justices and Constables
for the purpose of assuring them of the oooperation of his office~
in the despatch of their work and he discussed the proposed forms
which' he would appreciate being used in order to keep, his office
informed as~to matters in which the services of his assistants will
be required.
