(footprint) single-family dwelling with a 562sq.ft. roofed-over unenclosed masonry patio, a 463sq.ft. raised (12"-16") uncovered masonry patio, and 141 sq.ft. grade-level masonry patio with outdoor kitchen; construct an 18'x50' saltwater- filtration swimming pool (including 5'x10' spa), and a 872sq.ft. grade level masonry poo patio; install a pool drywell, 4' high pool enclosure fencing, and a 113sq.ft. grade-level pervious gravel pad; remove existing septic systems and install an A/I sanitary system landward of dwelling; install stormwater drainage system; and to establish and perpetually maintain a 20-ft. wide vegetated non- turf buffer along the landward edge of the top of bank, allowing for two 3' wide stepping stone paths to existing steps. SCTM#'s 1000-123-8-9 & 1000- 123-8-10 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the LWRP. 1. The distance from the top of the bank to the pool is not shown. It is too close to the top of the bank. 2. Preserve and integrate existing vegetation in the design to further Policy 6. 3. Require access route for project construction from the landowner. 4. The proposed wood stairs and 99SF platform shown are not permitted (Permit not found in Laserfiche). The LWRP does not support replacing unpermitted structures. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR JSK PARK AVENUE LLC 2150 &2200 PARK AVENUE MATTITUCK,NY SCTM#1000-123-8-9 & 10 Policies 5 & 6 The proposed project seeks to merge two single and separate parcels currently occupied by 4 dwelling structures,and replace the two dwellings located within Chapter 275 jurisdiction with one new dwelling that would be positioned 32 feet farther from the bulkhead,substantially landward of the"pier line,"and only partially within Chapter 275 jurisdiction,with attached patios and a waterside swimming pool. As a result of the proposed design features and incorporated mitigation measures described below, the project will have a net beneficial impact on the adjacent tidal wetland ecosystem. 1) One of two recognized, single and separate building parcels would be extinguished, and the number of legally existing and potential dwelling structures would be reduced in half from four to two. 2) The proposed dwelling would be set back 32 feet farther from the bulkhead and Great Peconic Bay tidal wetlands than the two existing dwellings. 3) The proposed swimming pool and pool patio would be located 5 feet farther from the bulkhead and Great Peconic Bay tidal wetlands than the existing patio. 4) The proposed dwelling would be located substantially landward of the"pier line"of the adjacent dwellings. 5) A 20-foot wide, approximately 1,900 sf vegetated non-turf buffer would be established and perpetually maintained in place of existing turf lawn along the top of the bank, thus reducing lawn area; increasing wetland setbacks to potential lawn areas; and providing a sink and filter for excess nutrients contained in surface water runoff before it reaches Great Peconic Bay. 6) Two existing conventional and nonconforming septic systems, which are located within 50 feet of the bulkhead and Great Peconic Bay tidal wetlands, will be removed and replaced with a low-nitrogen, innovative/alternative sanitary system (I/A OWTS) located outside Chapter 275 jurisdiction, more than 200 feet from the bulkhead. Unlike conventional systems, which are not designed or equipped to treat nutrients such as nitrogen, UA systems are designed to significantly reduce nitrogen loading into the groundwater and ultimately surface waters. 7) The proposed swimming pool would be equipped with a saltwater filtration system, thus avoiding use of a traditional, high-chlorination treatment system; and a drywell dedicated to the capture of pool backwash. 8) A stormwater drainage system consisting of leaders, gutters, and drywells is proposed to collect and recharge runoff from the proposed dwelling, patios, and other developed surfaces proposed both within and outside Chapter 275 jurisdiction. 9) There are no trees to be removed from within Chapter 275 jurisdiction. 10) A project limiting fence would be installed to contain site disturbance and potential surface runoff during construction. Thus resulting in increased separation between wetlands and site development; potentially reduced runoff and improved runoff quality; and potentially improved groundwater and surface water quality, these project design and mitigation measures would further the goals of Chapter 275 and LWRP Policies 5 and 6, including the protection and improvement of water quality; and the protection of the quality and function of the surrounding Great Peconic Bay tidal wetland ecosystem.
