Krupski, Jr., Town Supervisor and Members of the Town Board Re:1600 Bay Avenue, East Marion, New York SCTM No. 1000-31-8-25 Dear Supervisor Krupskiand Members of the Town Board: Our law firm represents James Spanos, Trustee Under Agreement Trust Dated November 18, 2024, Melanthia Spanos, and Nikolaos Spanos, owners of property located at 1600 Bay Avenue, East Marion. The subject property has been in the Spanos family for over 40 years and is located on Lake Marion. Our clients have reviewed the proposed zoning code and attended meetings regarding the changes to the zoning map. At the meetings, and throughout the zoning code community forums, the Town has asked for written comments from the community, and this letter will serve to state our clients’ concerns. The subject property is 1.6 acres and is currently zoned RR (Resort Residential). The property benefits from a 1967 Certificate of Occupancy for “multiple residence, transient occupancy” and its land use classification is “camps, cottages, bungalows.” The proposed zoning code and respective zoning map for East Marion seeks to change the zone from RR to R-40 (Residential) which will adversely affect the property owners and have serious implications on the future use of the property. While we appreciate the amount of time and effort the Town has expended on the proposed zoning changes, the change of zone from RR to R-40 is proposed without an explanation as to why the property is being rezoned to a non-commercial use. We would request that their RR property be treated like other RR properties within the Town respective to the new zoning designation. For example, an equivalent zoning designation such as the new RL zone. A R-40 designation will devalue the property and prohibit the use of the property for them and any future owners.
