December 4, 1979
WORK SESSION
The Board met with~Raymond Doyen, Chairman of the Board of Commissioners
of the Fishers Island Ferry District, Commzssioner Ray Edwards, and
Secretary-Manager Phil Knauff. They discussed repazr w~rk that is
needed at the ferry ramps at New London, Connecticut and Fishers Island.
They also discussed the coast Guard property on Fishers Island which
is being disposed of by the GSA. The Ferry District had expressed
an interest in the property but it has now come to light that a private
school is interested in the buildings and is looking into their acquzsition
through HEW. The Ferry District feels the best interests of the Island
would be served by a private school occupying the property.
Mr. Peter Quinn, Fishers Island, who has made' an offer to the Ferry
District to lease Elizabeth Airport spoke to the Board and offered a
chronology of events and correspondence relative to his proposal.
Mr. Richard Grebe, the present lessee was present. Mr. Grebe has
a five year contract for the lease of Elizabeth Airport, which
contract can be broken during the first year, however, Mr. Doyen
stated it is the unanimous decision of the Board of Commissioners
to continue the lease with Mr. Grebe. He is a full-time resident
of Fishers Island with a car repair business on the airport premises
and available on the premises for a at least eight hours a day. They
feel he is the most suitable lessee for the airport. Mr~ Doyen did
state that when t~he lease expires in approximately four years, if the
law so states, they may go to bid for the contract.
The Board met with Chief Cataldo and discussed the police officer
training course for special summer police officers. Chief Cataldo
also explained various police activities which occurred during the
past weekend. The Board and Chief Cataldo discussed the night
differential pay clause in the 1979-80 PBA contract.
Mrs. Gladys Csajko inquired of the Board as to the status of the
Gier case which~has been in the hands of Justice Rich since April
1979. The Board suggested that Mrs. Csajko speak to the District
Attorney who is involved in ~e case.
EXECUTIVE SESSION
The Board discussed with Town Attorney Tasker the certiorari
proceeding of Lockman vs. Board of Assessors, Town of Southold.
A discussion was held concerning the 1979 salary for Chief Cataldo.
A regular meeting of the Southold Town Board was held on Tuesday,
December 4, 1979 at the Southold Town Hall, Main 'Road, Southold,
New York. Supervisor Homan opened the meeting at 7:30 P.M. with
the following present:

On motion of Councilman Drum, seconded by Councilman Nickles, it was
RESOLVED that the next regular meeting of the Southold Town Board
will be held at 3:00 P.M., Tuesday, December 18~ 1979 at the Southold
Town Hall, Main Road, Southold, New York.

REPORTS
~f~Supervisor Homan stated he has the report of Mrs.. Jean Tiedke
which is'the wri'~'ten copy of her oral argument ~on behalf of the Town
of Southold in the matter of Case 80~03 - The.LILCO application for
a nuclear plant at Jamesport, New York. The report reflects Mrs.
Tiedke's excellen~ work.

Supervisor Homan reported that he attended, last Wednesday,
a meeting in-Riverhead concerning Peconic County, with Mr. Samuel
Markel, one of Southold's representatives on the Peconic County
C0mmittee. Mr. Homan believes'Peconic County to be a viable objective
for the east end towns, however, it will not be without problems and
work on the Town's behalf.
On motion of Councilman Pell, seconded by Councilman Nickles, it was
RESOLVED that thee following reports for the month of November 1979 be
and hereby are accePted and ordered placed on file: Supervisor, Highway
Department, Town Clerk, Fishers Island Ferry District, Bay Constable,
Justice Tedeschi-and Building Department.

This resolution was declared~_duly adopted.
Supervisor Homan reported that there was an incident on Sunday
evening involving a shooting by the police personnel. B~sed on the
information he~has received on th~ incident, Supervisor Homan
publicly commended Patrolmen Henry Stepnoski, and Sergeant Theodore
Beebe for 2heir fine police work in the matter. They acted in a
manner which the Town of Southold residents expect them to act and
they should be commended for their discretion and action in this very
serious ma{ter.
PUBLIC NOTICES
1. Notice of intention to prepare an EIS, determination of
significance from the N.Y.S.D.E.C. in the matter of the applica-
tion of Fred Renganeschi who requests permission to construct a
one family dwelling and associated sanitary system on lot 131 Map
of Cedar Beach Park. '
2. Notice of complete application for non-minor project from
the NYS DECiin the matter of the application of Ge6rge W. Bornschein
who requests permission to construct a timber dock consisting of
4ft by 30 ft. fixed catwalk, 3 ft. by 10ft. hinged ramp and

Notice of complete application for non-minor project from
the NYS DEC in the matter of the application of Guy Pancaldi who
requests peirmission to construct 90 lin. ft. of timber bulkhead
plus 12 ft. return on south and backfill with material reqraded from
adjacent upiland. Bulkhead is to be in line with existinq-bulkhead
to north. ~roject is located on east side of MattitUck ~reek,
West View D~ive, Mattituck, New York. Comments may be submitted to
the DEC until December 26, 1979.
Notice of complete application for non-minor prgject from
the NYS DEC in ~he matter of the application of Harold Stetler who
requests permission to construct 200 lin feet of timber bulkhead
at mean low water and use resultant 300 cu. yds for back-
fill. The project site faces Fordham Canal on right-of-way off Main
Road, Greenport, New York. Comments may be submitted to the DEC
until December 26, 1979.
Notice of complete application for non-minor project from
the NYS DEC in the matter of the application of Charles Rettig who
requests permission to construct 70 lin. ft. of timber bulkhead in
line with adjoining bulkhead to west. Dredge to 4 ft. below mean
low water and use resultant 30 cu. yds. of spoil as backfill. Project
site in on Goose Creek, Smith D~ive South, Southold. Comments may be
submitted to the DEC until December 26, 1979.
COMMUNICATIONS
1. Notice of claim of John Pytelewiski and Thaddius Pytelewski,
against Jan Zajkowski and Town of Southold and County of Suffolk, New
York. Mr. John Pytelewiski was a passenger in a vehicle driven by
Jan Zajkowski which went through a guard rail and dropped off a cliff
onto the beach below at the foot of Sound Road, Greenport. The notice
has been transmitted to the Town Attorney and Mc-Mann Price Agency.
2. Letter from Councilman Nickles stating he has been trying to
move along the signing of the dedication papers for Hill Road at
Calves Neck, Southold. There is a drainage problem in the area and
the first step toward correcting it would be the dedication of Hill
Road~
3. Receipt of A-95 summary recommendations from the L.I. Regional
Planning Board and Tri-State Regional Planning Commission. This
pertains to the Small Cities Grant. In all instances there is a very
good report On the application filed by the Town. The one problem
that seems to have arisen is that the Town does not have a Affirmative.
Housing Action Program. Superuisor Homan has discussed this matter
at length with Pan Tech Management Corp. the individuals preparing
the grant for the Town and they are of the opinion the Affirmative
Action Program of Suffolk County will cover the Town of Southold.
4. Receipt from County Legislator Drnis R. Hurley correspondence
confirming Southold Town's Agricultural District. Also received,
for the Town Clerk's files, a map of all the parcels 0f land in the
Town which have been placed in the Agricultural District~
5. Letter from Pan Tech Management Corp. concerning a conversa-
tion Supervisor Homan had with them to the effect that when the
Senior ~Citizen/Youth Center becomes operational the Town hopes' to
have office space there for the RSVP group. By the creation of
office space at the Center it will provide a daily occupancy use
for the building and will county greatly toward the Small Cit~-es
Grant.
6. Letter from the Goose Bay Civic Association, Inc. asking
for t.he Town Board's help, influence and cooperation in obtaining
the necessary permits from yhe New York State Environmental Depart-
ment and the Army Corps of Engineers. The Town if very sympathetic
to their problems but when the Town itself is involved in a similar
project the Town must obtain the same permits as are required of
the Goose Bay Civic Association. Further, the Town may be rsquired
to act on the same request they are making to the State and Federal
agencies, therefore the reply to their request must be ~n~.the negative.
7. Letter from the Suffolk County Department of Land Management
stating John Wickham's property in Mattituck has been accepted in
the Suffolk County Farmland Acquisition Development Rights Program,
Phase I.
8~ Supervisor Homan reported that some time ago at the direction
of the Board he wrote to the Corps of Army Engineers, Suffolk county
Department of Works and Department of Environmental Conservation
asking for a ~oint meeting of all concerned as the d~edging projects
in the Town of Southold. He has received calls from everyone and
has received a letter from R.M. Kammerer, commissioner of the~Suffotk
County Department of Public Works requesting that such a meeting be
held after the first Of January. Thi- may have to do with some re-
structure in the county Departments. Supervisor Homan will forward
the letter to the Board for action after the first of the year.
9. Receipt of two letters from Sacco & Ahlers, architects for
the Seniro Citizen/Youth Center. These letters are to Metro Plu/~bing
East and Cavaliere Electric Co. concerning .items that must be completed
at the building before it can be operational. Supervisor Homan had
wanted to enter into the building and begin certain additiona and
improvements to make it operational but he has been advised by the
architect that until certain problems are taken care of with the
sub-contractors the Town must delay work in the building.
10. Letter of commendation~_to Superintendent of Highways Dean_
relative to correction and repair of a drainage problem.
11. Receipt of a resume from Michael F. Mattes for the vacancy
on the Zoning Board of Appeals.
12. Receipt from Greenman Pedersen a letter which is the result
of a meeting between the Supervisor, Town Attorney Tasker and representa-
tives of Greenman Pedersen, architects for the Town Hall Addition.
There are several items which have not been completed and are hindering
the concutsion of paper work concerning the addition.
RESOLUTIONS
Supervisor Homan explained that the Town must purchase a piece
of equipment for the Disposal Area so the~area may be properly
maintained in conformity to the DEC requlations. To this end--the
Town has been very fortunate in being ~ble to obtain a State grant
which will help to pay for part of the equipment. However, the
balance of the equipment the Town must pay for. To this end the
Town must sell bond anticipation notes. The following resolution
pertains to the bonds.
Councilman Henry W. Drum offered the following resolution and moved
its adoption~
BOND RESOLUTION OF THE TOWN OF SOUTHOLD, NEW YORK,
ADOPTED DECEMBER 4, 1979 , AUTHORIZING THE PURCHASE
OF A FRONT END LOADER, STATING THE ESTIMATED MAXIMUM
COST THEREOF IS $117,000., APPROPRIATIONING SKID AMOUNT
THEREFOR, AUTHORIZING THE EXPENDITURE 0F$29,250.
STATE FUNDS RECEIVED FROM TH ~ STATE OF NEW YORK!
AND AUTHORIZING THE ISSUANCE OF $87,750. SERIAL BONDS
OF SAID TOWN TO FINANCE THE BALANCE OF SAID APPROPRI-
ATION. ~
THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN TH ~ COUNTY OF
SUFFOLK, NEW YORK, HEREBY RESOLVES (by the favorable vote of not less
than two-thirds of all.the members of said Board) AS FOLLOWS:
Section I. The Town of Southold (herein called "Town"), in the
~ County of SuffOlk, New York, is hereby authorized to purchase a four cubic
yard bucket front end loader for use at the Town landfill site. The estimated
maximum cost of said specific object or purpose, including preliminary
~-~ costs and costs incidental thereto and the financing~there0f id $117,000..
and said amount is hereby appropriated therefor. The plan of financing is the
expenditure of $29,250 State funds received from the State of New York,
the issuance of $87,750. serial bonds of the Town to finance the balance
of said appropriation and the levy of a tax upon all the takable real
property in the Town to pay the principal of and interest on said bonds
as the same shall become due and payable.
Section 2. Serial bonds of the Town in the principal amount of
$87,750. and hereby authorized to be issued pursuant to the provisions of
the Local Finance Law, constituting Chapter 33-a of the Consolidated Laws
of the State of New York (herein called "Law), to finance the balance of
said appropriation.
Section 3. The following additional matters are hereby determined
and declared:
(a) The period of probably usefulness of said specific object
or purpose for which the bonds authorized by this resolution are to be
issued, within the limitations or Section 11.00 a. 28 of
the Law, is fifteen (15) years, but the maturity of the bonds shall not
exceedlfive (.5) years.
(b) Current funds are not required by the Law to be provided
prior to the issuance of the bonds authorized by this resolution
or any bond anticipation notes issued in anticipation there, pur-
~ suant to the provmsions of Section 107.00 d. 5 of the Law.
Section 4. Each of the serial bonds authorized by this resolution
and any bond anticipation notes ~ssued ~n anticipation of the sale of
said bonds, shall contain the reoital of validity prescribed by Section
52.00 of the Law and said bonds and any notes issued in anticipation of
said bonds, shall be general obligations of the Town, payable as to both
principal and interest by a general tax upon all the taxable real property
within the Town without limitation of rate or amount. The faith and credit
of the Town are hereby irrevocably pledged to the punctual payment of the
principal of and interest on said bonds and provision shall be made annually
in the budget of the Town by appropriation for i(a) the amortization and
redemption of the bonds and any notes in anticipation thereof to mature
in suck year and (b) the payment of interest to be due and payable in
such year.
Section 5. Subject to the provisions of this resolution and of
the Law, pursuant to the provisions of Section 30.00 relative to the
authorization of the issuance of bond anticipation notes, or, the
renewals of said Notes and of Section ~50.00 and Sections 56.00 to
60.00 of the Law-, tLhe .po~e~s and duties 'of the Town Board relative
to-aUthorizing bond anticipation no%es and prescribing the terms, form
and contents and as to the sale and issuance of the bonds herein
authorized and of any bond anticipation notes issued in anticipation
of said bonds, and the renewals of said notes, are hereby delegated
to the Supervisor, the chief fiscal officer of the Town.
Section 6. The validity of the bond authorized by this
resolution and of any notes issued in anticipation of said bonds,
may be contested only if:
(a) such obligations are authorized for an object or purpose
for which the Town ~s not authorized to expend money, or
(b) the provisions of law which should be complied with at
the date of the publication of such resolution are not
substantially complied with,
and an action, suit ro proceeding contesting such validity ~s
commenced within twnety days after the date of such publication, or
(c) such obligations are authorized in violation
of the provisions of the cohs~itution.
Section 7. This resolution shall take effect immediately.
The adoption of the foregoing resolution was seconded by
Councilman William R. Pell III and duly put to a vote on roll
call, which resulted as follows:

Councilman Henry W. Drum offered the following resolution and moved
its adoption.
RESOLVED BY THE TOWN BOARD OF THE TOWN OF SOUTHOLD, tN T~J~
COUNTY OF SUFFOLK, NEW YORK, is hereby directed to publish the
foregoing bond resolution, in full, in "The Suffolk Times",
a newspaper published in Southold, New York, and having a general
circulation herein, which newspaper is hereby designated as the
official newspaper of the Town for such publication, together
with the Town Clerk's statutory notice in substantially the
form as prescribed by Section 81.00 of the Local Finance Law
of the State of New York.
2. This resolution shall take effect immediately.

RESOLVED that the Town Board of the Town of Southold set 3:00 o'clock
P.M., Tuesday, January 8, 1980, Southold Town Hall, Main Road, Southold,
New York as time and place for hearing upon application of Kurt A.
Koehler, a/c Mr. & Mrs. David Arthur for a permit under the pro~i~ns
of the Wetland Ordinance of the Town of Southold, for permission to
construct a walkway over grass area at Eugene Creek, Cutchogue, New York.

On motion of Justice Tedeschi, seconded by Councilman Drum, it was
RESOLVED that the Southold Town Board declares itself lead agency
· n regard to the State Environmental Quality Review Act in the matter
of the application of Margaret Braatz for a wetland per.mit at
Cutchogue, New York.

and Surety Company in the name of George Mellas, Receiver of Taxes,
Town of Southold in the amount of $100,000. for the term beginning
December 1, 1979 and ending December 1, 1983 be and hereby is

This resolution was declared duly adopted.
Supervisor Homart stated the Town Board has been a little concerned
about the police department because it is the largest single expend-
iture in the Town and recognizes the fact there are several members of
the department who are eligible for retirement and some may be next
year. If this is the case the Town will have to hire replacements.
There are a lot of things going on right now as far as hiring police
officers that the Board is no= necessarily in agreement with such as
no town list available. HOwever, there are certain things the Town
can do to protect the Town in this instance and one of them is to
adopt a residency requirement for any Town police officers that may
be hired in the future, and to that end the Board would like to
adopt a police residency law.
Moved by Councilman Nickles, seconded by Councilman Drum,
WHEREAS, Section 30, Subdiuision 4 of the Public Officers Law
authorizes this board to require that police officers in the Police
Department of the Town of Southold reside within the Town of
Southold, and
WHEREAS, this Board deems it in the public interest that po.lice
officers in the Southold Town Police Department be required to
reside within the Town of Southold in order that they may respond
promptly and be readily available when their services may be
required in emergencies,
NOW, THEREFORE, IT IS RESOLVED, AS FOLLOWS: ~~

This resolution was declared duly adopted.
Supervisor Homan stated that the Town Clerk has received notice
from Bay COnstable William Januick will be retiring as of December
31, 1979. In offering his resignation Mr. Januick ends what Super-
visor Hor~n deems to be a very very fine career of work for the
Town of Southold. His knowledge of the water and his diligence
to duty has been outstanding. Outstanding to the point where even
though he has vacation time coming to him and he fully expected to
take it, an instance occurred over the weekend and without any
hesitation, although his vacation time began Friday afternoon, he
was back at work Saturday morning and immediately upon the water
giving whatever assistance the Town Police Departmen could give
in that respect. Mr. Januick has been a most valuable employee
to the Town of Southold.
On motion of Justice Tedeschi, seconded by Councilman Nickles, it was
RESOLVED that a letter be forwarded to Bay Constable William Januick
acknowledging his many years of outstanding service to the Town of
Southold, his diligence to duty and dedication to serving the people
of the Town and accept with regret his decision to retir~ effective
December 31, 1979, and a copy of this resolution be senn to Mr. Januick.

Supervisor Homan stated that this year the Town Board hired Eileen
Carey as a summer employee and it worked out very well. She has
approximately a month winter vacation from college and the chief
building inspector has informed Supervzsor Homart that he would like
very much to hire Miss Carey during her winter vacation as he has
a back-log of filing and other necessary work Miss Carey could do
during that period of ~ime.
On motion of Councilman Pell, seconded by Councilman Nickles, it was
RESOLVED that Eileen Carey be and she hereby is appointed temporarily
for not more than 30 days as a clerk~typist in the Building Department
during the months of December and January at a salary of $3.25 per hour.

Councilman Pell, Councilman Drum, Supervisor Homan.

On motion of Councilman Pell, seconded by Justice Tedeschi, it was
RESOLVED that th~ resOlution adopted at the November 20, 1979 Town
Board meeting authorizing. Supervisor Homan to sign a lease between
the Town of Southold and the 1774 House Associates be and hereby is
amended tO show an annual rent of $1,500.00 for the year 1980, rather
than $1,451.50.

Councilman Pell, Councilman Drum, Supervisor Homan.

On motion of Councilman Drum, seconded by Councilman Nickles, it was
RESOLVED that Supervisor James Homan be and he hereby is authorize~~
and directed to execute a one year lease agreement betwesn the Town
of Southold and Agnes Reinhart for a portion.of a building on ~the
north side of Route 25, Peconic, for Highway Department use, at the
rental amount of $2400.00 for the 1980.
Vote of the Town Board: Ayes: Justice Tedeschi, Councilman Nickles,
Councilman Pell, Councilman Drum, Supervisor Homan.

On motion of Councilman Nickles, seconded by Justice~Tedeschi, it was
RESOLVED that Supervisor James Homan be and he hereby is authorized
and directed to ~xecute a two year lease agreement between the Town
of Southold and Richard F. Lark for a parking field adjacent to the
Justice Court building on the north side of Route 25, Cutchogue, New
York at a annual rent of $500.00 for the first year, January 1, 1980
through December 31, 1980, and $550.00 for the second year, January 1,
1981 through December 31, 1981.
Vote of the Town Board: Ayes: Justice Tedeschi, Councilman Nickles,
Councilman Pell, Councilman Drum, Supervisor Homan.
This resolution was declared duly adopted.
Supervisor Homan stated that approximately six months ago the Town
Board created a Licensing Review Board in the Town of Southold. One
of the requirements was that a town official be appointed to it, and
the Board appointed George Fisher, Building Inspector. HoweVer, they
have gince found Ghat this is perhaps a conflict of interests and Mr.
Fisher therefore submitted his resignation from the Licensing Review
Board.
On motion of Councilman Nickles, seconded by Councilman Pell, it was
RESOLVED that the Town Board of the Town of Southold accepts the
resignation of George H. Fisher from the Southold Town Licensing
Review Board effective immediately.

On motion Of Councilman Nickles, seconded by Councilman Pell, it was
RESOLVED that the following audited bills be a~d hereby are authorized
for payment: General Fund Whole Town bills in the amount of $25,725.58;
General Fund Part Town bills in the amount of $13,388.13; Highway
Department Bills in the amount of $11,284.37; and Fishers Island
Ferry District bills in the amount of $27,260.06.

Supervisor Homart stated that the negotiations with the PBA have
been concluded, and by virtue of award their salaries and compensa-
tion for 1979-1980 have been set. However, the salary of Chief
of Police is not set by the PBA contract, and setting of his salary for
1979 had been put off until the contract was settled. The Board
now wishes to set the 1979 salary for Chief Cataldo after reviewing
the PBA award and request by the chief.
On motion of Councilman Drum, seconded by Councilman Nicktes, it was
RESOLVED that the salary of the Chief of Police of the Southold Town
Police Department be set atJ'~$26,482.00 effective January 1, 1979.

RESOLVED that the Town Board of the Town of Southold declares itself
lead agency in regard to the State Environmental Quality Review Act
in the matter of proposed excavation and removal of material from
a proposed reCharge basin on Boisseau Avenue, Southold, New York by
the Town.of Southold.

Moved by Justice Tedeschi, seconded by Councilman Nickles,
WHEREAS, Raymond and Anna Ciacia, by application dated August 22,
1979 petitioned the Town Board of the Town of Southold for a change
of zone from "C" Light Industrial District to "A" Residential and
Agricultural District on certain property situated at Greenport,
New York, and
WHEREAS, the said petition was referred to the Southold Town Plan-
ning Board and the Suffolk County Department of Planning for
official recommendation and report, and
WHEREAS, the Town Board, pursuant 'to due notice held a public
hearing thereon on the 20th day of November, 1979, at which time
all interested persons were given an opportunity to be heard~
NOW, THEREFORE, BE IT RESOLVED that Raymond and Anna Ciacia be and
hereby are denied the relief demanded in sa'id petition for the
following reason: this Board believes that to grant the requested
application would constitute spot zoning, and for the further reason
that the applicant:may seek relief from the Southold Town Zoning Board
of Appeals.

Mr. Samuel Markel spoke about the meeting he attended with Supervisor
Homan on Peconic County. Mr. Markel said that vital things are going
to happen within the next few months concerning Peconic County. Un-
fortunately he will not be available to attend those meetings until
the spring. However, he suggested to the Town Board that Supervisor
Homan be deginated to take his place until he returns. Mr. Markel
said he knows Supervisor Homan has the same interests he has and took
the time to go tothe meeting.--Supervisor Homan thanked Mr. Markel
for the recommendation and stated that if in Mr. Markel's absence
the Board wishes him to attend the meetings he would be more than
glad to.
On motion of Councilman Drum, seconded by Councilman Pell, it was
RESOLVED that there being no further business to come before this
Town Board meeting adjournment be called at 8:15 P.~.
