SOUTHOLD TOWN BOARD
September 25, 1979
WORK SESSION
Deputy Supervisor Suter reported on his meeting with Steve Tsontakis
James Monsell from Greenport Village, and other Board members relative
to the Captain Kidd Water Company.
Richard Wilton, Peter Kreh and Wale Krupski representing the Southo~d
Town Promotional Committee spoke to the Board relative to funding for
their brochure. They plan to print 100,000 copies at a cost of
$10,000.00. The committee also feels the Town of Southold should
join the Long Island Tourist Association so the Town will have a
booth at various fairs, exhibits and functions. The fee to join
the Long Island Association is $2500.00 per year. The Committee
and Board members discussed the proposed trailer or building to be
used as an information center on the land the Town has leased from
the State in Laurel. The Laurel School District has objected to the
placement of a trailer on that site.· All concerned will meet
again in the near future to further discuss the proposed brochure.
Ensign Tetreau, U.S. Coast Guard, Port New York, and Lieutenant J.G.
Brice, U.S. Coast Guard, Port New London addressed the Town Board
and a large number of interested residents from the Mattituck area
concerning tbs pollution incident and other safety matters connected
with Mattituck Terminal Inc., et al. Lt. J.G. Brice read ~ report
fo ths events that occurred from July 21, 2979 through the present
time. (A copy of this report is~on file with the TOwn Clerk.) The
present situation is as follows: The consulting firm hited by the
facility owner is conducting a groundwater survey to determine the
extent of pollution underground. Once thfs study is completed, they
%ri. ll. ad~ise the Coast Guard and New York State officials and~ develop
a2plan to remove the POllution. Monitoring the progress of these
actions on site is being accomplished jointly by Suffolk County
Department of Environmental Protection, New York Department of
Environmental Conservation, New York State Department of Trans-
portation and Coast Guard.
Mr. Morton ~hilips-, ~Mr. Frank Husak, Mr. Franklin Bear, Mrs. Marie
Johnson, Dr. Walter Smith, Mr. Michael Mattes, Mrs. Lydia Totora
all addressed the Coast Guard representatives or the Board concerning
the Mattituck incident and their desire for a fire code.
Mr. Peter Coleman, Chief of the Mattituck Fire Department asked
when the Board is going to act on a code?---Supervisor Homan' state~
that he wrote to request copies of the new 1979 F~re Code on August
9th and has not received them to this date. When they are received
copies will be sent to the fire departments, libraries, civic organ-
izations, service clubs, etc.
On motion of Councilman Pell, seconded by. Councilman Nickles, it was ~-~
RESOLVED that the minutes of the September 11, 1979 Town Board meetin~
be and hereby are approved as submitted. ~

On motion of Councilman Drum, seconded by Councilman Pell, it was
RESOLVED that the next regular meeting will be held October 5, 1979
at 10:00 A.M. at the Southold Town Hall, Main Road, Southol~, New
York. This meeting will be for the purpose of allowing the Town
Clerk to present ~the budget to the Town Board members, and be it f~rther
RESOLVED that the Town Board set 7:30 P.M., Tuesday, October 9, 1979
at the Southold Town Hall, Main Road, Southold, New York as time and
place for a regular meeting of the Southold Town Board.

Supervisor Homan announced that the hearing scheduled for 3:30 P.M.
upon the application of George Thogersen for a wetland permit has
been cancelled due to the fact the applicant's attorney notified
the Town Clerk by letter dated September 20, 1979 that the application
is withdrawn.
Supervisor Homan: '~UBLIC NOTICES
1. Notice from the Department of the Army, Corps of Engineers,
upon application of William L. Nicol for permission to install two
p~lings for the purpose of mooring prorate recreational craft in
Eguene's Creek, Cutchogue. ~omments by September 30th.
2. Notice from the District Engineer that they are reviewing all
of their work in the 80 mile area along the Atlantic Ocean, from
Jones Inlet to Montauk Point to determine how their groins are
working and how many more they pay put in. Supervisor Homan stated
he mentions this even though it has nothing to do with this area
but the Town has gone through considerable heartache in this area,
with groins and whenever the Town has asked for any help from the
Army Corps of Engineers the North Fork has not gotten all that the
South Shore has received.
3. Notice from the N.Y.S. Dept of Environmental Conserva-
tion concerning a hearing upon the application of Bernard and Alice
Cosimano who request permission to extend an existing 25 ft. timber
groin to 60 ft. with a low profile rock groin extension into Hog Neck
Bay from the applicant's property on south side of Watersedge Way,
Bayvie~, Southold. Objections by October 26th.
CO~MUNICATIONS:
1. Letter from Michael Cortese, President, North Fork Audubon
Society~concerning the situation in the Mattituck Inlet area. Super-
visor Homan has replied to Mr. Cortese's letter.
2. Deputy Supervisor Suter met last F~day with Legislator
Denis Hu~ley, people from the Suffolk County Water Authority, Greenport
Water District, Steve Tsontakis, owner of the Captain Kidd Water Co.,
/nc., and various other people from the Captain Kidd area in Mattituck
relative to the problem of the Captain Kidd Water ~istrict.
3. Letter from the Laurel Elementary School relative to the
Town using an area in Laurel between the old and new highway as a
possible site for an information booth pro~ect with the chambers of
commerce. The school objects to the use of the site for location
of a trailer. The Town will do nothing in the area that the school
is not aware of or in fact agreeable to.
4. Letter from the Gull Pond-West Association relative to the
request for a bulkhead permit by Ruth F. Preston at Fordham Canal.
Councilman Pell is investigating the proposal.
5. When the Board was on Fishers Island in August the Fishers
Island people had a number of complaints and SuperwiSor Homan responded
within a week to each and every complaint and just what he was doing
about them. One of their requests was to see if there would be an
extension for the State Police, or if possible, a year round State
Police service. A letter has been received from the New York State
Police Superintendent stating that at this particular time they are
providing, service from May 1st to October 31st and a review of the
activity on the Island from November !st to April 30tk does not
warrant in his opinion the stationing of a full time trooper there.
6. Letter from the N.Y.S. Dept..of Environmental Conservation
relative to the application for the Town of Southold Landfill, and
concerning liners, leachates, and pumping between ths liners, etc.---
Highway Superintendent Dean said that the State. DEC is telling us
what we should do but not telling us how' to do it, but it is going
to cost a half million dollars to do something that the DEC hasn't
tried yet and we seem to be an experiment to see how it will work
out. Mr. Dean feels that somehow they should come up with a set
of plans as to exactly what has to be done. Until they come up with a
plan every town is floundering and spending a lot of money on permits,
surveys, etc~
7. Letter from the Long Island State Park & Recreation Cor~iss-
ion relative to Gull Pond. There are still problems in the Gull
Pond area concernmng who should have jurisdiction~
8. Copy of a Memorandum of Understanding between the Town
of Southold and the Suffolk County Soil and Water Conservation
District which will be updated after consultation between the Town
Town, Planning Board and Highway Superintendent Dean.

9. Aequest for a street light from ~ruce ~. ~s~acs, Allah's
Lane, Cutchog~e. Th~s request has been referred to the s~reet
119htin9 co~ittee.
10, Receipt of a copy of a letter from Councilman John
Nickles to ~r. C. Eisenschmeid, Division of Waterways, County of
Suffolk Department of Public Works concerning the maintenance
dredging at the mouth of Cedar Beach Harbor. Both Councilman
Nickles and Supervisor Homan feel the County has not done a very
good job in opening up the inlet and in telephone conversations
with Mr. Eisenshcmied Supervisor Homan was assured they would come
back and do the opening again and perhaps this time put the sand
where it belongs and where it won't come back into the inlet.
11. A note was received from Samuel S. Markel stating it will
be an honor and privilege to accept a position on the Southold Town I il
Committee for Peconic County.
12. The Town has received the official Flood Plain Maps for
the Town of Southold and they are on file with the Town Clerk and
other departments in the Town. As a result of this the Town, within
the next five or six months, will have to adopt the necessary
regulations pertaining to building in those areas.
13. Letter from the N.Y.S. DEC acknowledging the Town's letter
asking them to throughly investigate the positioning of any groins
in ~the Bay because as we have learned here in 'the Town of Southold
groins sometimes work in ways other than anticipated and we want the
DEC to make sure they have looked at all aspects of any propoSed
projects before they grant permission for any groins.
14. Receipt of a copy of a letter from Councilman John
Nickles to R.M. Ka~erer, Commissioner of the Suffolk County
Department of Public Works concerning maintenance dredging at the
entrance to Wickham's Creek. The fill was supposed to be placed
along a long section of the beach and instead it was all heaped up
in one general area, possibly even to the point of covering some
wetlands. At this point in time the County has failed to answer or
do anything about the situation.
15. Correspondence was received today from the Southold Town
Promotional Committee concerning the funding of their proposed
borchures.
16. The following letter was received from the N.Y.S. Dept. '
of Transportation on September 24, 1979: "Dear~ Supervisor Homan:
Regional Director A.H. Emery has asked me to acknowledge receipt
of your letter regarding the Mattituck Fuel storage area. As you
know, Mattituck Terminal Inc. has emptied its storage tank in accord-
~C~ with our directions and before this facility can be used to trans-
fer petroleum products they must be licensed by %he New York State
Department of Transportation. Our licensing is a formality once we
have' received a certification by the New York State Department of Environ-i!
mental Conservation. Of you have any questions, please call me at
516-979-5030." Supervisor Homan sent the same type of letter to the
DEC asking that the Tow~ of Southold be advised of any request for
permits, any hearings on such permits or any hearings on anything
relative to the oil tank storage facility in the Mattituck Inlet.
At this point he has not had response from the DEC, if he does not
hear soon he will follow up with a ~econd request for the same
information.
· he wetland hearing on the application of George Thogersen scheduled
for 4:00 P.M. has been cancelled.
The Town Board has the minutes on the hearin~ of the Long Island
Cablevision request for a franchise amendment. The Board is holding
that decision until further research has been done and a proper
resolution has been drawn.
On motion of Councilman Pell, seconded by Councilman Dr%m~ it was
RESOLVED that request for retirement effective October 31, 1979
from Frances S. Gaddis, Clerk-Typist at the Southold Town Police
Department be and hereby is accepted with regrets and a letter be
sent to Mrs. Gaddis wishing her every success and happlness in.~the
future.

On motion of Justice Tedeschi, seconded by Councilman Pell, it was
RESOLVED that the resignation of Deborah.M. Scott as SouthOld Town's
representative on the C.A.S.T. Board effective September 12, ~979
be and hereby is accepted with deep regrets and a letter be sent to Mrs.
Scott thanking her for her ~ff6r%'s Oh the Town's behalf and wishing
her every success and happiness in the future.~

Supervisor Homan stated that if there is anyone who is willing to
serve on the C.A.S.T. Board at the To~'s representative he would
like him to contact him or a member of the ToWn Board.
On motion of Councilman Drum, seconded by Councilman Nickles, it was
RESOLVED that the application of Florence Steiner dated September 5,
1-979 for a trailer permit on the right-of-way off of the southeast
side of Main Road~ Mattituck, New York be and hereby is renewed for
six months.

On motion of Supervisor Homan, seconded by Councilman NickleS, it was
RESOLVED that the application of Isidore P. Krupski dated September 5,
1979 for a trailer permit on the north side Main Road, Peconic, New York
be and hereby is renewed for slx months.

On motion of Councilman Drum, seconded by Justice Tedeschi, it was
RESOLVED that the application of Martin Sidor dated September 5, 1979
for a trailer permit on the south side Oregon, Mattituck, New
York be and hereby is renewed for six months.

This resolution was delcared duly adopted.
On motion of Councilman Nickles, seconded by Councilman Pell, it was
RESOLVED that the Town Board of the Town of SOuthotd approves the
action of the Board of Commissioners of the Fishers Islan~ Ferry
District to advertise for bids for the paving of the parking facilities
at Elizabeth Airport, Fishers Island, New York.

This resolution was declared duly adopted.
Supervisor Homan stated that on September 11, 1979 the Town Board
adopted a resolution in the matter of the Goose Bay CiVic Associa-
tion, Inc. application for a wetland permit, the Town assuming lead
agency. Since that time the DEC has become the lead agency, therefore
the Board must rescind their previous resolution of determination on
non-significance.
On motion of Councilman Drum, seconded by Justice Tedeschi, it was
RESOLVED that the following resolution adopted at a regular meeting
of the So~thold Town Board held on September 11, 1979 be and hereby
is rescinded:
"RESOLVED that pursuant to Article 8 of the Environmental
Conservation Law State Environmental Quality Review and 6 NYCRR
Part 6.17, Section 617.10 and Chapter 44 of the Code of tke Town
of Southold, notice is hereby given that the Southold Town Board,
as lead agency for the action described below, has determined that
the project will nto have a significant effect on the environment.
DESCRIPTION OF ACTION
Application of Goose Bay Civic Association~ inc. for a wetland permit.
Permission is requested to maintenance dredge Channel at Goose Creek,
at the end of Cedar Avenue, Southold, New York and beach nourishment.
The project has been determined not to have a significant effect
on the environment for the following reason:
An environmental assessment has been submitted which indicated
that no significant adverse effects to the environment were likely
to occur should the project be implemented as Planned."

On motion of Councilman Nickles, seconded by Councilman ~ell, it was
RESOLVED that the firm of Pan Tech Management Corp be and hereby is
ordered to be paid the sum of $950.00 ,~ their fee for consulting
services for the p~pose of preparing Small Cities Community
Development Block Grant Application.

On motion of Councilman Drum, seconded by Councilman Nickles, it was
RESOLVED that the following proclamation read by Supervisor Homan
be and hereby is adopted:
WHEREAS, the 4-H.Program of Cooperative Extension since its
beginning 58 years ago has contributed much to the health and Welfare
of the Nation and has encouraged many young people to choose careers
which help improve family and community'living; ~and
WHEREAS, during this week 4-H me~ers, leaders and families
will observe National 4-H Week with the theme: "4-H - Expanding
Horizons."
WHEREAS, 4-H members put into practice the skills and science
they learn as they develop their talents through 4-H projects and
strive to "learn for living;"
WHEREAS, in these changing times young people, who are the
citizens of tomorros, must discover and acquire the virtueS of
responsibility, thoughtfulness, morality and understanding;
WHEREAS, the more than 600 volunteer adult 4-H leaders are
organizing their 4-H clubs for the 1979-80 year, many others are
organizing their clubs for the first time; and
WHEREAS, the nearly 65,000 boys and girls participating in
programs throughout Suffolk County soon will be taking their places
in society by establishing homes of their own and joining the ranks
of community leaders.
NOW, THEREFORE, I, JAMES HO.U2kN, Supervisor of the Town fo
Southold in recognition of the fine achievements of 4-H members
and their families do hereby proclaim the week of October 7-13, 1979

On motion of Councilman Pell, seconded by Justice Tedeschi, it was
RESOLVED that the Southold Senior Citizens be and hereby are granted
permission to engage two buses at a total cost of $410.00 for a trip
to Lake Waramute, Connecticut on October 5, 1979.

of a fire hydrant on Wiggins Lane, Greenport which is located in
the East-West Fire Protection District.

RESOLVED that Supervisor James Homan be and h~rehy is authorized
to sign an agreement with Briarcliff Sprinkler Systems, Inc. for
winterizing the sprinkler system at the Town Hall in the amount, of
$50.00 and $50.00 for turning the system on again in the sprmng.

On motion of Councilman Nickles, seconded by Counc±lman Drum,
WHEreAS, the. State Transportation Department has determined that a
bridge across the Long Island ~Sound~.is ~a feasible objective and that the
logical point for the location of such a bridge is in the East Marion
area, and
WHEREAS, mass transportation facilities are unavailable in this area
and the construction of such facilities would be very detrimental to
the rural agricultural-resort area of Southold Town and a bridge
terminus in Southold Town would be contrary to the policy of preserva-
tiOn of our open space and qulaities of life that make the Town of
Southold a quiet sea shore country haven for our surburban and urban
neighbors and our residents to enjoy,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of
Southold does most strongly oppose the siting of a bridge across
Long Island Sound in the Town of Southold.

This resolution was declared duly adopted.
Councilman Drum, reported that the new bids for the dredging of the
Mattituck Inlet will be opened on October 16th and the Corps of
Army Engineers hopes that shortly thereafter the work %rill begin.
Supervisor Homan reported that since the last meeting he has been at
work to see what can be done in the Mattituck Terminal area as far
as upgrading the area and getting rid of the tanks, he thinks that
is a very poor place for tanks, besides the condition of the tanks.
But, even if the tanks were put there in their very best of Lcondition
the possibility of a epS11 in that area is still very hreat. Should
the spill ever occur on an ingoing tide. in that area of any fuel oil
it would take a long time for the effects of it to be done away with.
Supervisori.Homan read parts of a letter received from the Long Island
Regional Planning Board: "In response to your request of September
10, 1979 for information on the Mattituck Creek are, be ad~ised_.th~tt
a portion of this region has been ~esignated as a statewide Geographic
Area of Particular Concern (GAPC). The Mattituck Creek-Northville
Area: Management objectives ~ithin this GAPC are to increase the
public access and convert the creek from obsolete industrial uses
to tourist related facilities. Tourist facilities and recreational
boating activities should have a high priority. The protection of
the agricultural resources and wetlands preservation should also be
high priority. A lower priority is additional residential develop,ent
along the shore." .... Supervisor Homart stated that even more Importatn,
as a result of severls calls he made, some of them to Washington, he
has a meeting on October llth with the following people: Mr. Bernie
~ackson, Regional Secretary, Department of Interior, A1 Houn±, Regional
Secretary, Department of Interior, ~ohn Scotti, New York Sea Grant,
Dwight Davis, Long Island Regional Planning Board, Susan Coligan,
Suffolk County Department of Economic Development, J~m Morton, New
York State Coastal Management, Carey Uste~from the Mid-Atlantic
Fishery Foundation and Richard Miller from the Long Island Fisherman's
Association. He feels they are definitely on the right foot with a
group such as that in trying to do something in that area. He does
ask, when the time comes, for the support of everyone in the area.
He is not so much worried about making the tanks safe as he is to
make them non-existent. This is where he is directing his efforts
~nd he believes he has the full support of the Town Board in this
area.
A member of the audience asked if the Town had considered a permanent
injunction against the owners of the terminal.---Supervisor Homan
said he would review the suggestion with the Town Attorney.
Mr. Franklin Bear suggested that the~.Town Building Inspector might
make an inspection and discover violations at the site.---Supervisor
Homan asked Mr. Bear to put his request in writing.
Mr. Michael Mattes said that at the height of the tourist-swimming
season the beach at the end of Breakwater Road was closed. It is
operated by funds collected for the Mattituck Park District. He

feels the Town Board should institute a law suit to recoup those
taxes paid for a beach which was unusable at the height of the season,
and for punitive damages a~nst the owner of the terminal being
found guilty fo having caused the beach to be closed by order,of
the::Coas~3~G~ard.----Supervisor Homan stated he feels the Park
District should being suit on their own behalf and not the Town
Board for them.--Further, he spoke to the County District Attorney's
Office about this and they said it would be possible, buy they would
like a little more information before they would really suggest the
Town to go to the expense of a suit.
Mr. Ange Panagopoulos asked who has jurisdiction of the North Road
in Southold west 6f Van Duzer's. There is a severe drainage problem
there.----Highway Superintendent Dean stated the County is in the
p~ocess of acquiring proPerty and doind survey work for the co~struc- l ~t
tlon of a sump to handle this d~ainage problem.---Supervis~ Hbman sta~d
that the Town has been on record complaining to the County abo~t the
area.
There is a public hearing at 4:00 P.M. on the matter of the intended
use of Federal Revenue Sharing Funds.
On motion of Councilman Nickles, seconded by Councilman Pell, it was
RESOLVED that a recess be called at 4:10 P.M., meeting to reconvene
at 10:00 A.M., Thursday, September 27, 1979 at which time there will
be discussion on 100% Assessmentk .~

The Board discussed at length the Scope of Services for the Town of
Southold on their 100% A~sessment program prepared by Cole-Layrer-
Trumble Company. ~hs~will meet with representatives of C.L.T. on
Tuesday, October 2, 1979 at 10:00 A.M. to discuss certain items that
are not clear.
On motion of Councilman Pell, seconded by Councilman Nickles, it was
RESOLVED that the Town ~oard approves Work Order for LILCO Service
and change order by Ca~aliere Electric Contracting Ltd. amo~n~in~to
$3,346.00
Vote of the Town Board: Ayes: Councilman Nickles, Councilman Pell,
Councilman Drum, Supervisor Homan. Absent: Justice Tedeschi, Justice
Doyen.
This resolution was declared duly adopted.
On motion of Councilman Drum, seconded by Councilman Pell, it was
RESOLVED that Supervisor James Homan be and he hereby is authorized
and directed to execute Amendment No. 2 of the agreement between
the Town of Southold and Village of Greenport and Holzmacher,
McLendon and Murrell, P.C. f0r~ a Section 201 Wastewater Facility
Sutdy under a grant of the ~nited States Environmental Protection
Agency. This Amendment No. 2 includes the Town of Shelter Island
in the aforementioned Study.
