HASLBAUER AND KATHELEEN E HASLBAUER, 50 OSPREY NEST ROAD, GREENPORT, NEW YORK SCTM # 1000-35.-6-14 JUL 2 3 2025 Zoning Board of Appeals REASONS FOR APPEAL: The Applicants, John and Kathleen Haslbauer, are appealing the Building Inspector's Notice of Disapproval, dated May 22, 2025, for a building permit to construct additions and alterations to an existing single-family dwelling, substantially on the footprint of the existing residence. The subject parcel is a non-conforming 15,000 SF lot in the R-40 zoning district located on the corner of Osprey Neck Lane and Maple Lane in the Cleaves Point Subdivision in Greenport. The project contemplates a 1581 SF second story addition with a small 91 SF addition at the back end of the house and a 57.6 SF front porch enlargement. Although the proposed construction is otherwise conforming to all bulk schedule requirements, the proposed second floor addition will bring the GFA to 3,370.8 SF which is 646 SF above the allowable GFA of 2,725 SF. The surrounding neighborhood consists of one- and two-story homes varying in size on differently sized lots. Many of the homes in the community have GFAs that exceed the proposed GFA here. For the following reasons, the Applicant submits that variances from Section 280-124 are warranted. 1. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: As stated above, the surrounding neighborhood is characterized by one- story and two-story dwellings on varying sized lots, including larger waterfront parcels as well as substandard 15,000 SF lots like the subject premises. The existing dwelling on this property was constructed in 1974 and is not suitable for the needs of modern family living. The Applicant submits that the granting of the requested GFA variance relief to permit an aesthetically pleasing second floor addition to this home within its existing conforming footprint will not result in any undesirable change in the neighborhood and the renovated home will be entirely in character with many of the surrounding homes in the Cleaves Point community. While the proposed construction is otherwise conforming to the bulk schedule, the size of the parcel and the advent of GFA regulations triggers the need for variance relief for the second story addition. 3. The amount of relief requested is not substantial because: The Applicant submits that while the magnitude of relief sought for side yard relief may be mathematically substantial at 23.7%, it is not practically substantial since there are many homes in the Cleaves Point community with gross floor areas that are substantially larger than what the applicant is proposing here. For example, the house just 2 doors down at 250 Osprey Nest Road was recently constructed with a GFA of 4,205 SF; just around the corner, 600 Snug Harbor Road has a GFA of 5,556 SF and 520 Snug Harbor obtained a variance to maintain a GFA of 4,237 SF (See, ZBA # 7889). In addition, the home at 965 Snug Harbor has a GFA of 4,799 SF and 160 Snug Harbor has a GFA of 4,205 SF. The configuration of the streets in the neighborhood precludes a strict application of the guidelines for averaging but it is apparent that the proposed construction is in character with numerous homes in the surrounding neighborhood where lot widths, areas and the mass of neighboring homes vary substantially. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The granting of variance relief to allow the applicants to create necessary living space in their home will not have an adverse impact on the physical conditions in the neighborhood and will permit the construction of a two story home that is entirely consistent with the size and character of neighboring homes. In addition, as a Type II action, there is no perceivable environmental impact stemming from the proposed renovation. 5. Has the alleged difficulty been self-created? {} Yes, or {X} No Why: To any extent that the difficulty be deemed self-created, pursuant to New York Town Law §267-13 (3), a self-created hardship "shall not necessarily preclude the granting of an area variance." The findings of the Board are that this is a corner property with two front yards and to locate the house facing Maple Lane would be a hardship to the applicant as it would face barns and stables across Maple Lane, and also heavier through traffic. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance.
