SOUTHOLD TOWN BOARD
August 21, 1979
WORKING SESSION
11:30 A.M. - Dr. Myron Slater appeared before the Board to discuss
his proposal for the creation of an Office of Cultural Affairs by
the Town of Southold. He would like the approval for the creation
of such an office so he can begin to apply for State and Federal
funds. The funding he would be applyingfor would cower administra-
tion and different programs with year round emphasis. Supervisor
Homan said he feels there are certain drawbacks concerning the
creation of another Twon agency.- Councilman Pell would like to see
the Board support the program. Town Attorney Tasker was asked to
research the subject further. He stated there is a provision inthe
Town L'aw for~ the creation of an Office of Cultural Development.--
Supervisor Homan appointed Councilman Pell and Councilman Nickles
to look further into the creation of an Office of Cultural Affairs.
A regular meeting of the Southold Town Board was held on Tuesday,
AuguSt's21, 1979 at the'[Sbuthold Town Hall, Main Road, Southold, New
York. Superviso~ Homan opened the meeting at 3:00 P.M. w£th the

On motion of Councilman Drum, seconded by councilman Nickles, it was
RESOLVED that the minutes of the regular meeting of the Southold Town
Board held on August 15, 1979 be and hereby'are approved as submitted.

Councilman Pell, Councilman Drum, Supervisor Homart. Absent: Justice

On motion of Councilman Drum, seconded by Councilman Nickles, it was
RESOLVED that the next regular meetings of the Southold Town Board
will be held at 10:00 A.M., Friday, September 7, 1979 for audit of
bills and 7:30 P.M., September 11, 1979 at the Southold Town Hall,
Main Road, Southold, New York.

Supervisor Homart.
1. Receipt of a report of the Police Department for the month of
July 1979.
2. Supervisor Homan~reported that he had a meeting Saturday,
August 18th with Congressmen Carney and they discussed the energy
problem as it exists in the east end with particular emphasis on
what they feel must be done to keep it from becoming a bigger problem
in winter as they run into possible fuel oil shortages.
3. Supervisor Homart reported on the last Town Board meeting
on Fishers Island on August 15th. Various problems on the Island
were discussed such as mosquitoes, street lighting, channel markers~
State Police, parking and senior citizen programs. In each and every
case he has answered them as to what he was able to do at this time

on those matters and these will be follow-up as necessary.
4. Receipt of a report from Deputy Supervisor Surer on the
current status of the waste disposal study which is being made for
the five east end towns in_~cooperation with Holzmacher, McLendon and
Murrell~ There will be a meeting with H2M on Wednesday at 2:00 P.M.
5. Receipt of a Notice of Intention to Prepare an EIS Determinar
tion of Significance from the DEC upon application of Costello Marine
Contracting Corp for Ruth F. Preston who proposes to construct 85 1.f.
of timber bulkhead plus 30 ft. return, d~edge 250 cu. yds. in front
of proposed bulkhead and use spoil as backfill at Fordham Canal,
Greenport.
6. Receipt of a Notice of Intention to Prepare an EIS Determina-
tion of Significance from the DEC upon application of Jamew H. Ramb0,
Inc. for G. Monacelli who proposes to construct 125 1.f. of timber
bulkhead plus returns 12 ft. from the toe of bluff at Long Island
Sound, north side Petty's Drive, Orient.
7. Receip{ of Notice of Complete Application for Non-Minor
Project from the DEC upon application of David Eastman by Goldsmi.th~
Building & Construction who proposes to construct a one family
dwelling and septic system on parcel west side private road 130 ft.
north of Sound View Avenue, Peconic. Comments until September 5., 1979.
8. Receipt of a Notice ~f Complete Application for Non-Minor
Project from the DEC upon application of Mr.&Mrs. Bernard Cosimano
who propos to construct a low profile rock groin extension increas-
ing the size of the existing groin from 25 ft. to 60 ft. at the south
side WatersedgeWWay, Bay~iew~ Southold. Comments until September 5,
1979.
9. ReCeipt of Notice of Complete Application fro Non-Minor
Project from the DEC upon application of Klaas P. Honig who proposes
to construct a low profile rock groin extension, increasing the size
of the existing groin from 25 ft. to 40 ft., sides of timber groin
to be covered with rock on the south of Bayhaven Lane &_.Watersedge
Way, Bayview, Southold. Comments until September 5, 1979.
10. Receipt of notice from the Corps ~f Army Engineers upon
application of Ms. Sarah Rauch for permission to construct a catwalk,
ramp and attached flating pier with three mooring piles for the
purpose of mooring a private recreational craft on Fordham Canal,
Greenport, New York. Comments by September 5, 1979.
11. Notice from the Corps of Army Engineers that contracts
are being let for the dredging of the Mattituck Harbor.
12. Thursday, August 23 from 2P.M. until 4 P.M. Assemblyman
John L. Behan will conduct a hearing on the subject of Peconic
County at the Southold Town Hall.
13. Letter from Anitz Quinn, Leeton Drive, southold thanking
Highway Superintendent Dean for the installation of metal barriers
at the edge of the Kenney's Beach parkina lot and questioning why
the barrier was not placed along the whoie length of the parking lot.
14. Notification from the Suffolk County Department of Consumer
Affairs that they are going to hold hearings on the licensing of Ihome
appliance repairmen. Comments should be sent to) 'nthony' F. Appoiaro,
Commissioner before Legislature's August 28th meeting.
15. Letter from the Automobile Club of New' York announcing that
the Town of ~outhold has been awarded a Pedestrian Safety Citation for
achieving a record of having no pedestrian fatalities in the last 5
years.
16, Receipt of a press release from the Long Island Gasoline
Retailers Association, Inc. stating the five east end townships have
instituted legal action .in Washington against the inequities of the
gasoline allocation system.
17. Letter from Edna A. Robb reporting a fall on the sidewalk
on the east side of the Southold Savings Bank, Southold. Copies
have been sent to the Highway Superintendent, Town Attorney and
insurance carrier.
18. Letter from the New York State Depar~tment of Environmental
Conservation with suggestions of how the State may~become involved
under various laws with an erosion project in the ~oldsmith Inlet[area.
~ 19. Receipt of a letter from Cablevision the progress report
of the work they are doing in their various phases of the recent
contract entered into with. the To~n last year when they applied for
rate increases. At that time they agreed to extend Cablevision
service to a number of areas in the Township. Basically the report
is that they have made a survey of the areas, noted all the necessary
work that has to be done on the poles and appl~.ed for the necessary
permits to both New York Telephone and Long Island Lighting Company.
20. Notice of a grantsmansh~p seminar to be held on August 23,
1979 from 10 AM to 12 noon at the Wilson Technology Center (BOCES III).
The purpose of the workshop is to share information about the
complicated process of.acqui~n~a~a~a~ing.g~ants. Councilman
Drum has attended the Seminars i~"'{~ p&S~'~d he will be attending
this one.
21. The.Town Board has been in contact with Raymond, Parish,
Pine & Weiner, Inc. and with Pan Tech Management Corp. relative to
securing services for filing a Small Cities grant, This would be
a reapplication of the same grant the Town filed last year and very
narrowly missed. There are many items in the grant that the Board
feels would benefit the Town greatly.
22. Supervisor Homan announced that the Town is in need of
two school crossing guards for the upcoming school season. A school
crossing guard is needed for the Greenport School and one for the
Southold School. If anyone is interested they Should.apply to
Chief Catatdo or Lieutenant Winters for an interview.
~. Letter from Samuel A. Manarel, Chairman, Board of Assessment
Review commenting on the fine cooperation he rece.i~ed from everyone,
custOdians, clerks, assessors and especially the secreatry assigned
to them, Mrs. Babette Conroy.
24. Notice of Claim of Joan Mary Anzalone and Anthony E.
Alzalone relative to a fall by Joan Anzalone on the pa~ement"~abutting
the Doofpot located on the northeast corner of~Main Street and
Stirling Square, Greenport. Copies have been given tO the Town
Attorney and insurance carrier. The incident occured in the Village
of Greenport and it is believed the Town of ~SDuthold is not involved.
25. Letter from former Justice Martin Suter thanking the
Supervisor and Board members for their support over the past few
years, He reports that as of August 7th all neeessary court papers
and dockets have been stored wi~h~he Town Clerk as required by law.
His petty cash has been returned and accounted for in the amount of
$200.00 to the ~hpervisor. All books and papers that are'ToWn
property have been turned over to Justice Tedeschi and his final
monthly report is ready and has been filed with.the Department of
Audit and Control. H.e will advise the Judicial Conference of his
resignation and his bank account has been balanced out and the
account will be closed upon acceptance by Audit and ~ontrol of h'si
final payment to them.
26. Notice from Fishers Island Ferry District that as a
result of their annual election Raymond E. Edwards, Jr. was elected
Commissioner for a term of five~ years succeeding Stephen A. MOrrell.
27. Letter from Holzmacher, McLendon and Murrell, P.C. relative
to the Greenport-Southold Scavenger Waste Study, Amendment No. 1.
Supervisor Homan appointed Councilman John Nickles and Councilman
William Pell as a committee to study the possibility of creating
an Office of Cultural Affairs for the Town of Southold.
On motion of Councilman Nickles, seconded by Councilman Pell, it was
RESOLVED that $1,500.00 be and hereby is transferred from A7530.4
Shellfish to General Fund Whole Town Contingent A1990.4

This resolution was declared duly adopted.
(Supervisor Homan explained that the Town conducted a clam transplant
program in the amount of $3,000.00, As such the Town was reimbursed
50% by the State. The money is now in the Clam Transplant portion
of the budget and it should be returned to the Contingent account.)
On mokion of Councilman D~um, seconded by councilman Nickles, it was
RESOLVED that the Senior Club of Southold-Peconic, Inc. be and
hereby are granted permission to engage two buses at a cos~ of
$390.00 for a trip to Montauk on September 20, 1979.

On motion of Councilman Pell~ seconded by Councilman Drum, it was
RESOLVED that International Salt Company the lowest ~e.sponsible bidder
be and hereby is awarded t~a~bid for supplying the Town of Southold
with 300 tons of Grade No. Cayuga (or equal) Rock Salt at $32.99
per ton.

On motion of Councilman Pell, seconded by Justice Tedeschi, it was
RESOLVED that Brighton Steel Company, the lowest bidder for supplying
the Town of Southold with snow fence, be and hereby is rejected as
the specifications requested bids for 100 foot rolls and Brighton
quoted a price for fifty foot rolls.

On motion of Councilman Pull, seconded by Councilman Nickles, it was
RESOLVED that Mutual Steel Company be and hereby is awarded the ~bid
for supplying the Town of Southotd with 10,000 lin. ft. of snow
fence at $38.50 in 100 ft. rolls.

On motion of Councilman Nickles, seconded by Justice Tedeschi, it was
RESOLVED that Capitol Highway Materials, Inc., the lowest responsible
bidder, b~ and hereby is awarded the bid for supplying the Town of
Southold with 500 6 ft. studded steel T. posts with flanges or anchor
plates on posts at $2.30 each.

(Supervisor Homart stated that the Suffolk County Office for the
Aging has made av&ilable to the Town of Southold the sum~ of $10~000.
for a replacement van for the Nutrition Center. As~a result
specifications have been drawn for bids for a 12 passenger van.)
On motion of Councilman Nickles, seconded by Councilman Pell, it was
RESOLVED that the Town Clerk be and she hereby is authorzied to
advertise for bids for one new 1980 Plymouth Voyager PB300 12 passenger
Van, V-318 Engine or equivalent. Bid opening to be 3:00 P.M.,
September 6, 1979 at the Southold'~Dwn Hall, Main Road, SouthOld, N.Y.

RESOLVED that the application of John C. Tuthill dated July 25, 1979
for the renewal of a single trailer permit on the east side Elijah's~
Lane, Mattituck, New York be and hereby is granted for a six month
period.

RESOLVED that the claim of Thermal Comfort, Inc. in the amount of
$10,986.30 for work at the Senior Citizen/Youth Center be and hereby
is ordered paid from HUD funds.

RESOLVED that the claim of Metro Plumbing East in the amount of
$4,387.50 for work at the Senior Citizen/Youth Center be and hereby
is ordered paid from HUD funds.

On motion of Councilman Drum, seconded by Councilman Nickles, it was
RESOLVED that the services of Pan Tech Management Corp be and hereby
is retained by the Town of Southold at a fixed fee of $1,900.0D for
the purpose of providing consulting and other services to the Town
of Southold on behalf of a Community Development Block Grant Small
Cities P~ogram application.

On motion of Councilman Drum, seconded by Councilman Nickles, it was
RESOLVED that the Town Board of the Town of Southold approves the
action of the Board of Commissioners ~f the Fishers Island Fer~y
District in placing Wilfred C. Sinclair on a leave of absence with
~£ck pay benefits pe~ing approval of retirement application.

On motion of Councilman Nickles, seconded by Councilman Petl, it was
RESOLVED that the Town Board of the Town of Southold approves the
action of the Board.of Commissioners of the Fishers Island Ferry
District in substituting the name of Katherine W. Horning in place
of Edwin Horning as Cash%er at the Ferry District movie theatre.

On motion of Councilman Drum, seconded by Justice Tedeschi, it was
RESOLVED that t~e Town Board of the Town of ~ euthold sets 8:30
o'clock P.M., September 11, 1979 at the Southold Town Hall, Main
Road, Southold, New York as time and place for a hearing on the
application of Long Isalnd Cablevision Corporation (LICC) to consider
the following proposal to amend the cable television franchise granted
to it by the Town of Southold, it wit:
To amend paragraph~ 4, subdiviison (g) of the franchise agree-
ment ~o read as follows:
(g) LICC shall re-engineer its cable system in the
Town so that all subscribers Located west of the
easterly boundary line of the Mattituck Fire District
hall be served from the Riverhead Head End, a~d all
ubscribers located East~of said boundary line Shall
continue to be served from the Head End located in the
~illage of Greenport.
The franchise a~endment, if~~ approved by the Southold Town Board,
may not take effect without the prior approval of the New York State
Commission on Cable Television, and that interested parties may file
comments or objections with the Commission.
The application ~_~LICC for an amendment to its franchise is on file
in the Town CIe~k's Office, Main aoad, Southold, New-Yrok, and is'
avai~ab~e~fo~.pub!ic-inSpeot~on~d~ring re~ulab-~business hours.
A¥~P~eB~ntativ~ of LICC will be present at wuch~ hearing and all
interested persons will be given an opportunity to participate in
said hearing and- to ask questions 'of the representative 'of ~ICC.

(SuperviSor Homgn explained that LICC is asking for a change in their
frnachise to serve a portion of the Mattituck area from their Riverhead.
They feel with ~he expansion of the system that they are' making the
peDple in the Mattituck area will get be~ter ~e~eption if they are
served from th~ Riverhead tower.)

RESOLVED that the To~na Board of the Town of southold set 3:30 P.M.,
September 25, 1979, Southold Town Hall,~ Main Road, Southold, New
York as time and place for hearing upon the application of George
Thogersen for a permit under the provisions of the Wetland Ordinance
of the Town of SOuthold for permission to bulkhead approximately 95

long existing shoreline at the northerly ~nd.~.of Fordham Canal,
on the southwest corner of North Road and Wiggins Lane, Greenport,
New York. All persons i~terested in said matter shall appear at
the time and place above specified and wilt be given an opportunity
to be heard.

On motion of Councilman Nickles, seconded by Councilman Drum, it was
RESOLVED that Supervisor Homan be and he hereby is authorized to
sign on behalf of the Town of Southold Amendment No.lto the Greenport-
Southold Scavenger Waste Study GRSO 78-01 being conducted by Holzmacher,~
McLendon and Murrell, P.C. which will reduce the cost'of the study
from $31,172.00 to $~2,792.00; the Town's share being $5,698.00,
half of which will be paid by the New York State Department of
Environmental Conservation at Step 3.

Councilman Pell, Councilman Drum, Supervisor Homan. Absent: Justice

On motion of Councilman Pell, seconded by Councilman Nickles, it was
RESOLVED that this Town Board meeting be recessed at 3:40 P.M., to
reconvene following a public hearing in the matter of the application
of Thomas and Jacqueline Occhiogrosso for permit under the provisions
of the Wetland Ordinance of the Town of Southold.

Meeting reconvened at 4:00 P.M.
Supervisor Homan opened the meeting to the public and stated that
he believed there may be people in the audience who are interested
is what is happening in the Mattituck area in relation to the oil
storage installation and the problems concerned. As of this morning
Supervisor Homan ordered the roads closed in the area because of the
information he had received that the Suffolk County Department of
Health ordered the beach closed because the tanks were presenting
a hazard to the people down there. He knows that Lieutenant Conway
of the U.S. Coast Guard, New London office has made certain
directives in the area such as containment booms and additional
containment booms; absorbent material being placed and he believes
he. has ordered test weels to be made. Supervisor Homan talked to
the DEC office this morning and found out that a Consent Order has
been issued but not signed by the Vantage Petroleum people who he
believes are the owners of the property. Just prior to this meeting
Councilman Pell gave him another note that he had just ~alked to
the DEC and a six point order will be issued today.--Councilman
Pell stated that the s~x point order will he hand delivered this
afternoon. The points are: (1) No more gas or ~fuel shall be
allowed into the tanks; (2) all tanks shall be emptied; (3) the
area shall be claened; (4) they will have to install~ground test
wells; (5) thye do not get to operate until they apply for and
receive SPCC permit from the Federal government through the Coast
Guard; (6) they will have to apply for a permit from the DOT of
New York State which will be issued ~hrough the department out of
Stony Brook.
Several members of the audience directed questions to the Board
and made statements concerning the storage facilities at Breakwater
Road, Mattituck. The concerns of those present are: lack of a
code so far as tanks are concerned; no fire code for the Town of
Southold; no application to the Buidling Department for expansion
of the business or location of nsw tanks; quality of life in the
area of the facilities; increase in traffic by tank trucks and blue
stone trucks; high speed of the trucks; intrusion into the gound
water by the fuel leak; fire or explosion from the ~anks; need for
an environmental impact statement.
Some of the individuals who spoke were: Franklin Bear, Michael
Madison, Gusie Kinone, S~muel Markel, Mr. Ortero, A1 Kirby, Marge
Drape~ Mr. Sitora, Marie Johnson.

RESOLVED that there being no further business to come before this
Town Board meeting adjournment be called at 5:00 P.M.
