SOUTHOLD TO?~ BOARD August 15, 1979 A regular meeting of the Southold Town Board was held at the Fishers Island School, Fishers Island, New York on Wednesday, August 15, 1979. Supervisor Homan opened the meeting at 1:00 P.M. with following present: Supervisor James Homan Justice Francis T. Doyen Councilman ~Henry W. Drum Councilman John J. Nickles Justice Frederick J. Tedeschi Town Clerk Judith T. Terry Town Attorney Robert W. Tasker Supervisor Homan introduced Deputy Supervisor Martin Surer and the Town Board members. On motion of Justice Doyen, seconded by Councilman Nickles, it was RESOLVED that the minutes of the Southold Town Board meeting held August 7, 1979 be and hereby are approved as submitted. Vote of the Town Board: Ayes: Justice Tedeschir Councilman Nickles, Councilman Pell, Councilman Drum, Justice Doyen, Supervisor Homart. this resolution was declared duly adopted. On motion of Councilman Nickles, seconded by Justice Doyen, it was RESOLVED that the next regular meeting of the Southotd Town Board will be held at 3:00 P.M., Tuesday, August 21., 1979 at the Southold Town Hall, Main Road, Southold, New York. Vote of the Town Board: Ayes: Justice Tedeschi, Councilman Nickles, Councilman Pell, Councilman Drum, Justice Doyen, Supervisor Homart. This resolution was declared duly-adopted. Moved by Supervisor Homan, seconded by Justice Doyen, ~EREAS, this Board on November 10, 1077 adopted a conditional order establishing the Fishers Island sewer district, and WHEREAS, this Board~ as the governing body of the Fishers Island Sewer District on April 11, 1978 entered into a contract with Henry Souther Engineering, Inc. of Bloomfield, Connecticut to provide all necessary engineering services in connection with the Fishers Island Sewage Collection Treatment and Disposal System and services in connectio,n with the completion of al~ State and Federal requirements, and State and Federal funding, and WHEREAS, the United States Environmental Protection Agency has issued revised rules and regu!ations.~e~ative to engineering sub-agreements, all as set forth in ~he p'~op~ a~d~ndum No. 1 to said contract dated April 11, 1978 attached to a letter to the Supervisor dated June 11, 1979 from A. Richard Lombardi, President of Henry~ ~uther Ehgineering, Inc., and HWEREAS, such revised rules and regulations necessitate the amendment of the April 11, 1978 engi~ee~ing:'~r.~eme~t ;with~Henry Souther Engineering, Inc., NOW, THEREFORE, IT IS RESOLVED by the Town Board of the Town of Southold, as the governing body of the Fishers Island Sewer District as follows: 1. That this Board does hereby authorize the amendment to the contract dated April 11, 1978 between the Town of Southold and Henry Souther Engineering, Inc., by adding thereto Addendum No. 1 to provide as follows: (A~ That Appendix C-1 (Revised E.P.A. rules and regulations relative to consulting engineering agreements) shall become an integral part of said agreement. (.B) That completed Environmental Protection Agency Form 5700-41 shall become an integral part of said agreement. (C') That the Plan of Study prepared'by'~{h~- '~- Henry _ Sou%her Engineering, Inc., dated June, 1977 shall become an integral part of said agreement. (D) That the amendment to said contract dated April 11, 1978, to be contained in Addendum No. 1, provide assurances from Henry Souther Engineer, Inc. to the Town of Sou%hold, that the Town of southold will not in any respect be liable to Henry Souther Engineering, Inc. for any of the costs contained in said agreement, other than~to the extent of any State and Federal funds received by the Town of Southold for such purposes, and it is FURTHER RESOLVED that the Supervisor be and he hereby is author- izied and directed to execute on behalf of the Town of Southold as the governing body of the Fishers Island SeWer~Dis%ri~t any and all documents required for the amendment of the 'aforesaid engineering contract. If~there is a complaint relative to sidewalks the matter will be corrected. He ~romised a comp:ieee' inspection of the si~eW~lksin the near ~ut.u~e. Mr. Thomas Ryan of the Suffolk County Real Property Tax Service Agency explained ~he 100% assessment procedure. The Town of slip ha~.completed their 100% assessment program, Brookhaven S under~6ontract, Riverhead is in the process, and Southold Town is investigating the procedure.--Supervisor Homan stated that he has appointed a committee from the Town Board consisting of Councilman Pell and Councilman Drum to study the 100% assessment. A meeting has been scheduled with Finnegan Associates to discuss their~proposal on lugust 16th at 1:00 P.M.--Assessor Henry Moisa-also spoke about the proposed 100% assessment program. Mr. A. John Gada said that for the last five years he has been asking for additional lighting from the village to the school. He presented a proposal to Justice Doyen the year before last.-- Supervisor Homan stated the matter~$11 ~_~i~en i~ml~d, iate attention to researching his proposal. He_was under the impression a resolution was adopted a few months back authorizing additional lights. Mr. Gada spoke about the need for day markers in West Harbor.-- Supervisor Homan said he would follow upon the request and get back to him.---A woman in the audience s~ated that the markers that are in at the present time are not very well maintained, they do not have enough reflective tape. Question: Why can't Fishers Island have a state trooper year-round?-- Assemblyman Behan said he and Senator LaValle would contact Commissioner McNeilly about the request and get back to him in the near future. Assemblyman Behan mentioned that he will3be holding hearings August 22, 23,24 in the five eastern end towns'relative to the formation of Peconic County. Senator LaValle and Assemblyman Behan have submitted joint legislation on this proposal.---Assemblyman Behan also spoke on the 100% Assessment program. Question: Must government buildings conform to the zoning regulations or are they exempt from the zoning laws? Town Attorney Tasker stated that all government buildings are exempt by statute if used for government use.--The main question seemed to pertain the the Coast Guard trailer who sewage system is old and drains into Silver Eel Cove.---Rovert Villa of the Suffolk County Department of Health stated that the Coast Guard is exempt from Town and County rules. QUE~TTQN: Is there a sewage tax district on Fishers Island?---Town Attorney Tasker stated there is. In 1977 pub lic hearings were .held on Fishers Island on the petition from FIDCO and the property owners in the Fort area requesting that a sewer district be created. They requested that a conditional district be created. The condition was that if they did not get State and Federal aid for the construction of the plant the request was that the Town dissolve the district. They are right now in the process of applying for State and Federal grants. The purpose of the resolution that was adopted at this meeting was to amend the original engineering contract with Hen~ Souther Company because of the change in the rules and regulations of the Federal Environmental Protection Agency. The basic changes are that in addition to studying the Fort area the engineer is going to be required, under Federal regulations, to amke a study of the entire Isalnd, also the depth of the study is going to be much more severe. The result of all of this is as far as the Town is concerned~ is that the original engineering charge under the contract was $19,5000. As a result of the Federal requirements for the additional engineering the cost is now going to be increased to $32,650.00 QUESTION: Will everyone on Fishers Island pay the sewer district tax? .... Town Attorney Tasker stated that unless the individual is in the district they will not pay taxes into the district. Further discussion relative to the creation of the Fishers Island Sewer District, breakdown of cost, etc. Town Attorney Tasker stated that the study has not been made yet and until it is there is nothing to present to the public. He said he would think that when the study is complete and report made it would be appropriate to have either a meeting or informal hearing at which time the 331 engineer can explain tO'~he'~O~'~h~dtst~'i~t what it is. they propose to do and what it is going to cost.---Supervisor Homan assured everyone that when the study is complete whoever is Supervisor at that time will be on the Island to discuss the results with the Island people and especially those Who will be within the district. Question: It is possible to go to a water district since the expansion on the Island has caused problems and the system is at least 60 years old and in order to update the system the rates will go out of sight? .... Supervisor Homan said they are studying grants for Southold Town. They will explain the problem on Fishers Island to. see if there is a possibility of obtaining some sort of grant to upgrade the district or expand the facilities. ~r. ~ada stated stated the insurance rates have jumped because of the water system. Question: When is the Town going to paint lines on the road? They have been asking fD~.%-hi~ for ~a couple of years.---Highway Superintendent Dean'.guaranteed the lines would be painted in the very near future. Question: Is there any wa~ Fox Avenue can have police protection until the bar closes. People sleep under his bushes and leave debris on his property?---Supervisor Homan said that before he leaves the Island he will see the constables regarding this matter.--- The request was also made to widen the road on Fox Avenue. Question: Can anything be done for mosquito control?--Supervisor Homan stated he had invited the people from the Suffolk county Department of Public Works to come over today, but unfortunately they could not make it. He will get back to them within the next day or so or have the Vector Control contact them. Question: What can be done about a senior Citizen program for Fishers Island? There is a good program for senior citizens in Southold as well as a Nutrition Center.--Supervisor Homan stated that Southold Town has one of the best programs, the Nutrition ~enter in Greenport funded by the County of Suffolk. It provides hot meals for the aged. He see~:no reason why he could~not, on behalf of Fishers Island, ask the County what can be done for them. The Senior. Citizen/Youth Center in Peconic is being built at no expense to the taxpayers but through a HUD grant. Supervisor Homan said that he was on the Island two or three years ago~to see about a youth center. He is sure that if there is an organized group of senior citizens and an organized youth group there should be no reason if the demand and need is there the Town could not look into establishing a facility for those purposes~--At the present time there is no organized group of senior citizens on Fishers Island.-- Supervisor Homan said he will try to arrange to have representatives of the Suffolk County Office for the Aged come to Fishers Island to discuss their problems with them and aid in setting up an organized group.--Senator Kenneth LaValle said there are a lot of programs in the County and State and money available for the programs.---- Mr. Gada said the Ferry District now charges $1.75 for ferry trips for senior citizens instead of the regular $3.00 charge. The problem of the lack of medical fa'cilit~es-on the ~sland was discussed. The following notice from the Fishers Island Ferry District by R.P. Knauff, Manager dated August 9, 1979 was read: "Notice is hereby given that the Board of Commissioners of the Fishers Island Ferry District, Fishers Island, New York will hold a public hearing, Monday, August 20, 1979 at 7:0'0 P.M. at the Fishers Island School, Fishers Island, New York on the estimated revenue and expenditures for the Fishers Island Ferry District for the fiscal period beginning January 1, 1980 and ending December 31, 1980. At such hearing any person may be heard in favor or against such annual estimates as compiled, or for or against any i~em or items therein contained." Question: Can only budget items be discussed at that meeting?--- Ferry District Commissioner Raymond Doyen said that the meeting is a budget meeting but is has been traditional to informally discuss any other problems anyone m~ght have. Question: Can~'anyone explain how much money is spent on roads on Fishers Island?--Highway Superintendent Dean said it is all lumped together in the budget, but he could break down specific expenditures for a given period of time. On motion of Justice Doyen, seconded by Councilman Nickles, it was RESOLVED that there being no further business to come before this Town Board meeting adjournment be called at 2:15 P.M.
