July 10, 1979
WORKING SESSION
The Board met with William B. Smith relative to inspections at
the construction site of the Senior Citizen and Youth Center,
Peconic Lane, Peconic, New York.
A regular meeting Of the Southold Town Board w~s held on Tuesday,
July 10, 1979 at the Southold Town Hall, Main Road, Southold, New
York. Deputy Supervisor Homan opened the meeting at 7:30 P.M.
with the following present:

RESOLVED that the minutes of the June 26, 1979 meeting of the
Southold Town Board be and hereby are approved.

On motion of Councilman Drum, seconded by Councilman Pell, it was

Marotcchia. All candidates for the Town Board from both political
organizations are being'invited to attend their next meeting on Monday,
August 20th at the Southold Fire House. At the last meeting Mr.
Martofchia attended he said he would contact Mr. Leavey of the State
Fire C~de and ~ire ~re~ention Control for Southold Town. They would
appreaciate it if Deputy Supervisor Homan would follow this through.
12. ~t&ce from the Town Clerk of defect in a s~de~&lk at
Main'Street, Southold. All necessary individuals have been notified.
13. Notice of local government cost cutting conference,
Grantsmanship Seminar to be held on July 12, 1979 at the Suffolk ~ounty
Community College from 9:00 A.M. to 11:00 P.M. The purpose of the
workshop is to share info,marion about the cDmplicated process of
acquiring and managing grants. Councilman Drum will attend.
14. .Letters from the Long Island Rail Road, John D. Woodward,
Chief Engineer, fu~ Francis S. Gabreski, President. Before Super-
~mAorCMartocchia passed away he met with Mr. ~bodward and Highway
Superintendent Dean relative to certain railroad p~p~rties and
pu0jects in Southo!d.TowD~. At one d~ the meetings he was told the
~0rk~was not being considered'properly in the budget and unless the
North Fork supervisors wrote strong letters to the railroad urging
them not only to maintain the railroad but to upgrade it, it was
quite possible the railroad would be allowed to deteriorate and
possibly eventually phased out. Mr. Martocchia did write, Riverhead
Supervisor Allen Smith and Shelter Island Supervisor Bliss also wrote
to the railroad and representatives on the State and County levels
letting them know that we felt the railroad, especially ~n view of
the energy crisis is an important part of the town, and would probably
be more i~portant it it were properly cared for. Through ~his effort
the Town has received approval from the railroad on fixing up a
certain number of railroad crossings, also the Town has agreed
verbally, and we are waitin~ for a confirming letter from the
railroad that we will take care of certain railroad properties
in the ToWn and we will be reimbursed from the railroad on that.---
Highway Superintendent Dean stated that he met with Mr. Woodward
and Supervisor Martocchia at the Southold railroad station. The
railroad has given Mr. Dean permission to purchase all the materials,
blacktop to rebuild the station, platform and bulkhead. This will
cost between $1,000 and $1,500 and the railroad will pay for it.
They also gave the Town priorities on crossings. They asked for
3 and the Town supplied 8 seperate crossings. Next year they will
probably do Depot Lane, Alvahs Lane, Youngs Avenue and Love Lane.
The Town's biggest gripe was that the south side got all the money
last year. We want our share of the money. The railroad has agreed
to help try to upgrade the railroad system in Southold Town.
15. Receipt of a copy of a letter sent to Huntington Town
Supervisor Butterfield by Allen Smith, Supervisor of Ri'verhead Tow~
relative to a proposed meeting in Westhampton with the Lieutenant
Governor .on July 26th to protest the issue of the potential decrease
in State aid to local municipalties. The Supervisor or Acting
Supervisor of this Town will be at that meeting.
16. Letter from Hudson Hagglund, Mattituck representing ~e
Southold Chess Club asking that consideration be given to scheduling
the chess club in the Senior Citizen and Youth Center when i~ is
completed. This request will be considered.
17. Letter from Walter E. Cain, Superintendent, Southold
School District submitting a list of names of Southold High School
students who have volunteered to serve on the Advisory Boardr for
the Senior Citizen and Youth Center.
18. Receipt of a copy of a letter to Chief Carl Cataldo
from Bruno H. Brauner, Assistant Superintendent of Schools, Mattituck-
Cutchogue School District thanking the Police Department for their
attention to the school district's needs during the school year.
19. Letter from the Nassau Point Property owners Association
to Highway Superintendent Raymond Dean expressing ~heir appreciation
for the repaving of the SkunkLane-Eugene Road intersection.
20 Notification from the Suffolk County Department of Trans-
portation,' Traffic Safety Division, stating they have available,
free of charge, to all high schools, youth groups, and other interested
individuals and organizations in the County a Motorcycle/MoPe~ Safety
Instruction Progr~. This announcemen~ has been sent to the chambers
of Commerce and placed on the Town ~lerk's bulletin board.
21. Request from the Board of Fire Commissioners of the
Mattituck Fire District for permission to install a base station
radio antenna at the Southold Town Polibe headquarters in
conjunction with a new alarm system being installed at their head-
quarters in the near future.---This is not a new service, but an
upgrading of an existing service.---This will be reviewed with the
Police Department, and if the Police Department has no objections
it is expected the Board will go along with the request.
-22. Letter from Virginia Sh~cter thanking Deputy Superuisor
for making the necessary arrangements for a "mini clam transplant"
at Mill Creek on Saturday, June 30. A group of concerned Mill
Creek residents worked three hours on that day relocatinq polluted
clams f~om the west end of Long Creek into the clean pubiic wasers
of Mill Creek. This project was arranged through the efforts of
the residents, James Homan, and the DEC under ~he watchful eye of
Bay Constable William Januick.
23. Letter from the North Fork Volunteer~Fireman,s Association
expressing their dissatisfaction with the way the towns of Riverhead
and Brookhaven handled the demonstration at the Shoreham LILCO site
on June 3, 1979.. Tkey ask that should this Town know of any Demonstra-
tions planned in the future they let the fire departments know so
they can prepare in advance.
24. Request from Maria Heaney, Transportation Chairwoman,.
Boy Scout Troop 15, Greenport for permission to use 'the senior
citizea can for a trip to Upstate New York on August 4 and 5 and
August 11 and 12.--In the past the Boy Scouts have been allowed the
use of the ~an for transportation wzthin the CQ~n~- However, in
view of the fact the ~own only has one van now, and there were two
before, and in view of the gas crisis and the distance these people
wish to use the van this request must be denied. Justice Surer
stated that s~nce %he Highway Department has been cut 20% in their
gas allocations and since this uan is the only one left in'the Town
and if anything happens to it then the Nutrition Program and Seni~
Citizen Transportation group would be out of business, he does not
feel the van should be allowed out of the county a.t'this time.---
~r. Walter Kohnle asked why the Boy Scouts couldn''t be given money
out of the Senior Citizen's budget.---It was explained that alloca-
tions in the budget were made for youth organizations and functions
and this money has bee~ expended. The senior citizens also have
an allocation in the budget and have hot expended all of their funds.
On motion of'Councilman Drum, seconded by Justice Surer, it was
RESOLVED that John Baglivi, CUtchogue, New York, be and he hereby
is appointed a seasonal police officer at $3.50 per hour.

WHEREAS, George Thogersen has heretofore applied to this Board f6r
a wetland permit on property located on the southwest corner of
North Road and Wiggins Lane, at the northerly end of Fordham Canal,
Greenport, New York, and
~EREAS, the app~ica~ has duly submitted a written statement
(Environmental AsSessment Form) in accordance with Chapter 44 of
the Town Code, and
WHEREAS, notice of receipt of such statement has been dhly posted.
NOW, THEREFORE, IT IS RESOLVED that this~Bo~rd''has h~r~by ~determined
that the proposed action will not h~e a significant affect on the
e~vironment, and
IT IS FURTHER RESOLVED that the Town Clerk shall file and circulate
THIS DETERMINATION in accordance with Chapter 44 of the Southold

has applied to the Town Clerk for a Games of Chance License, and
~REAS, the Town Board has examined the application, and after
investigation, duly made findings and determinations as required
by law,
NOW, THEREFORE, BE IT RESOLVED that the Deputy Supervisor be and
he hereby is authorized and directed to execute on behalf of the
Town Board of the To~of Southold the findings and determinations
as requiuedL by law, and it is further
RESOLVED that the Town Clerk be and she hereby is directed to issue
a Games of Chance License to Our Lady of Ostrabrama R.C. Church,
Cutchogue, New York.

Supervisor, Town of Southold on the following banks: The Bank of
New York, The North Fork Bank and Trust Company,Chemical Bank, and
Hartford National Bank and Trust Company.

Deputy Supervisor 5oman explained that approxi~tel~.tw~years 'ago
the Town entered into an agreement with tke State of Ne~York ~kereby
the Department of Transportation funded a complete restruc~uming of
the ferry terminal landings at Fishers Ialnd. It w~s an extensive
project and the cost was well over $100,000. The project has been
completed, the contractor has been paid all but the 5% retainer
which, is $6,226.65, plus $136.00 in overage. At this time tke
Supervisor's Office would like to pay the contractor %ha ~emaining
balance subject to receiving the necessary records for State audit.
On motion of Justice Surer, seconded by Justice Doyen, it was
RESOLVED that the Deputy Supervisor be and hereby is authorized
to pay James ~. Rambo, Inc., contractor for the Fishers Island
Ferry District R~pa~r and Improvement~of Ferry Landing and Dredging
at Fishers Island his 5% retainage in the amount of $6,226.65, plus
$136.00 overage, subject to receiving the necessary project recordsfor
State audit.

RESOLVED that the sum of $1,500.00 be and hereby is authorized for
transfer from General Fund Whole Town Contingent A1990.4 to Whole
Town Shellfish A8830.4 and $1,696.06 from General Fund Whole Town
Contingent to A3310.4 Traffic~Control $500.00, and A8160.4 Refuse
& Garbage - $1,196.06

On motion of Councilman Drum, seconded by Councilman Pell, it was
RESOLVED that a recess be called at 8:00 P.M. for the purpose of
holding a public hearing at 8:00 P.M. in the matter of the applica-
tion of Thomas Fox for a wetland permit, and at 8:10 P.M. in the
matter of a proposed Local Law for the purpose of using resident
parking permits for the disposal area. Meeting to reconvene
immediately following the public hearings.

Deputy Supervisor Homan:
25. In the matter of the Smithtown vs. HUD lawsuit in which
Smithtown lost, as of yesterday it was thought the Town of Southold
was going to get some $17,000 additional HUD funds, but as of today
we are not doing so well with it but will keep pursuing it. Since
the Town of Smithtown was not granted any funds the funds should
have been dibided amoung the remaining towns of Suffolk County but
after communication today with the County the Town does no~ seem
to be getting the funds.
26. There is a vacancy on the Planning Board. Member Frank
Coyle retired as of June 30th and the Board will be accepting
resumes to be considered for the vacancy up to and through the
next Town Board meeting.
On motion of Councilman Drum, seconded by Justice Suter, it was
RESOLVED that the Town Board of the Town of Southold fix the
ampunt of $200,000 for a bond for James Homan, Deputy Supervisor,
Town of Southold.

On motion of Justice Suter~ seconded by Justice Doyen, it was
RESOLVED that the bond in ths amount of $100,000 posted for the
completion of roads and improvements in the subdivision known as
"County Club Estates'! be and hereby is released upon the recommenda-
tion of Planning Board, Planning Board Inspector, Superintendent of'
Highways, Cutchogue Fire District Commissioner's Attorney and the
Town Board Highway Committee.

RESOLVED that Bond No. 73 S-15975 BCA issued by the Aetna Casualty
and Surety Company in the amount of $200,000 in the name of James
Homan, Deputy Supervisor, Town of Southold be and hereby is approved
as to its form, sum., manner of execution and sufficiency of surety
therein.

The Town Clerk read a letter f~om Robert W. Brown dated July 10,
1979 in which he submitted his resignation from the Southold Town
Board of Assessment Review effective immeidately.

Mrs. Gladys Csajko complimented the Town Board on their appointment
of William Weinheimer to the Board of Assessment Review.
Mr. Donald Stanton, resident of Leeton Drive, Southold spoke to
the Board relative to the GOldsmith Inlet Jetty. He stated that
in 1964 the Goldsmith Inlet Jetty was designed and constructed.
Since that time there is a record of damage east of the jetty
because the drift of sand on the north shore in that region is
from west to east. The substantial damage can be documented if
required. He asked the~Board to request, now, in 1979, that the
Goldsmith Inlet Jetty be removed. The purpose for which it was
constructed no longer exists, as there was a planned marina in that
area and the plans have since been abandoned. There was also
plans for the construction of additional jetties east of Goldsmiths
in recognition of the fact that additional shoreline stabilization
was required. Those jetties were never constructed. Consequently
Mr. Stanton has suffered substantial damage. He is about 1~ mile
east of the Inelt, and a number of his neighbors both east and west
of the jetty have suffered damages as late as this year. In addition
to that there is also public property being damaged. The Suffolk
County Peconic Dunes Camp is suffering serious erosion, Kenney's
Beach is suffering serious erosion, and the problem can be expected
to continue until some action is taken and it the Town of Southold
who are the owners of the title to the Goldsmith Inlet Jetty and
would h&~e to initiate the action to have it removed. Mr. Stanton
stated it has been establisked to his own siatisfaction through marine
contractors that the jetty could be removed at no cost to the taxpayers
because the cost of the stone itself is of sufficient value that there
would be no additional cost for the removal i~self. Deputy Supervisor
Homan asked Mr. Stanton if he knew of his own knowledge of any
litigation pending in the matter?--Mr. Stanton said he was not aware
of any directly concerning the Go!~smith Inlet Jetty. He knows that
there is a Notice of Claim on file by Judge Lockman.----Town Attorney
Tasker stated that there is a Notice of Claim and the ~nsurance carrier
is investigating it, but he is not aware of any litigation as yet.---
Mr. Stanton stated that they have documented through surveys and a
check of the records that have been kept by the Corps of Engineers
in the last 75 years. They checked the recent rates of erosion
against those historical rates and the current rate of erosion east
of the jetty are five to ten times that rate prior to construction.---
Deputy Supervisor Homan said he would rather not get into a long
discussion on the jetty at this time. He had a call today from the
New York State Attorney Gsneral's Office relative to Goldsmith Inlet
and he presumes it concerns the jetty, He has given dates for a future
meeting. There is no further information on the matter than that. He
has asked the Attorney General's office to follow up confirming the
date and if possible the subject matter so it can be researched and
the town attorney be aware of what the Attorney General wishes to
meet on in relation to Goldsmith Inlet.--Mr. Samuel Markel, Southold,
stated that prior to Supervisor Martocchia's untimely passing he
personally went to see Mr. Markel concerning the jetty stating that
not only was the jetty put in by the County, approved by the Corps of
Engineers at Southold Town's request, but the son of a very prominent
politician got the job to do it and he told Mr. Markel that the
Attorney General's Office was going to investigate it.---Deputy
Supervisor Homan stated that Mr. Markel appears to know a lot more
about it than him. Unfortunately there is not a member on the Board
that was sitting on.~the Town Board when the jetty was constructed.---
Justice Suter stated that ~e wasn't on the Board but.he is aware of
the plan--for the three additional jetties to the east, but after they
put the first one in they never followed through with the other three
so the plan was one-four comPleted. He feels they should get the
whole plan back and see what they can do. In Sunday's paper they
covered the whole north shore from Throgs Neck right out to Orient
Point and every area has the same problem just more or less depending
on the geography of the area.---Mr. Markel spoke about the boat ramp
at Kenney's Beach and it is of no use right now, If the side of
that was filled in with rock it would start to help again, because
when that boat ramp went it really caused erosion all along that
side and ripped out a whole sea wall from'Lockman down to his house.

That.proposal would not cost very much at all.---Mr. Stanton stated
he has used the boat ramp at Town Beach which is dirt and sand. The
ramp at Kenney's Beach is unusable. The nearest ramp west of us is
in Mattituck and is open only to residents of Mattituck. He feels
it is a poor situation that the residents can't launch a boat into
Long Island Sound in the Town Of Southold. He feels the one remedy
we have is to correct the situation at Kenney's Beach.----Justice
Suter stated there were plans for two, one in Mattituck at the Inlet
at the Breakwater, but Captain Kidd's Civic Association opposed that.
Then there was another one proposed by the County at Cl~rk's Beach
and the neighbors in the neighborhood opposed that. If the Town
could get County Money and use it at Kenney's Beach, it would be wOrth
~xploring.---Mr. Emil Pupecki, Peconic stated he has lived in this
are for the last 55 years and he is very familiar with the beach
as far as erosion is concerned and all he wanted to say is that
any o~ these people that built their homes right on the beach have
done nothing but invited trouble for themselves.
On motion of Councilman pell, seconded by Justice Suter, it was
RESOLVED that the Town Board of the Town of Southold retain the
services of William B. Smith, Southold, New York as the Clerk of the
Works for the Senior Citizen and Youth Center at a fee of $10.00
per hour, not to exceed $1,000.~00
Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum,
Councilman Homan, Justice Doyen, Justice Suter.
This resolution was declared duly adopted.
On motion of Councilman Homan, seconded by Councilman Drum, it was
RESOLVED that the Town Board of the Town of Southold authorizes
the payment of $11,385.00 to Strathmore Construction Corporation,
General Contractor for the Senior Citizen and Youth Center; said
money to be drawn from HUD funds marked for this purpose.

Moved by Councilman Homan, seconded by Justice Suter,
WHEREAS, the residents of the communities in Southold Town are
grieved by the tragic loss of our friend and fellow official,
Albert M. Martocchia, and
WHEREAS, by his passing this Town Board has lost an esteemed and
efficient presiding officer as Supervisor of the Town of $outhold,
and the members of this Board have been deprived of his wise
counsel and judgement, and the members of this Board have lost a
faithful friend and associate, now, therefore, be it
RESOLVED that the Town Beard of the Town of Southold hereby gives
formal expression of its loss in the death of Albert M. Martecchia,
and be it further
RESOLVED that when the Town Board adjourns this day it does so out
of respect to the memory of Albert M. Martocchia, and that a copy
of this resolution be transmitted to the family of Albert M. Martocchia
that we may extend to them our sincere sympathy.
