Dean On motion of Justice Suter, seconded by Councilman Drum, it was RESOLVED that the minutes of the Southold Town Board meeting of June 12, 1979 and special Town Board meeting of June 18, 1979 be and hereby are approved as submitted. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Doyen, Justice Suter. this resolution was declared duly adopted. On motion of Councilman Drum, seconded by Councilman Pell, it was RESOLVED that the next regular meeting of the Southold Town Board will be held at 7:30 P.M., Tuesday, July 10, 1979. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Doyen, Justice Suter. This resolution was declared duly adopted. On motion of Councilman Pell, seconded by Justice Suter, it was RESOLVED that the May 1979 report of the Southold Town Police Department be and hereby is accepted and ordered filed. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Doyen, Justice Suter. This resolution was declard duly adopted. Deputy Supervisor Homan: 1. The Town of Southold is presently engaged in its annual transplant program, and creeks where this transplant is taking place will be closed for a period of 30 days, the 30 day period beginning next Sunday. 2. Notification has been received from the New York State Board of Equalization and Assessment that the final equalization rate for the Town of Southold 11.70. This is down from 12.28 last year. We do have the equalization rates for the other adjoin- ing towns and we did take one of the smaller increases in our equalization rate. 3. Receipt of a letter from Birgit Snellenberg, Southold relative to the Southold Senior Citizen-Youth Center. Miss Snellenberg suggests that a swimming pool be built at the center.=--This is an excellent suggestion, however, the funds are limited and the letter will be placed on file for future reference in teh event additional funds become available. 4. Letter from C. Wells Horton, Bedford, Massachusetts who was sruck by a truck while riding his bicycle on Route 27, Greenport. He wishes to thank the Southold Town Police for an excellent job, they went way beyond their required duties with their help.---A copy of Mr. Horton's letter will be forwarded to the police depart- ment. 5. Letter from CongressmanWilliam Carney relative to the Town's request for an adjustment in the flood plain map level. He i's asking for an investigation into our request. 300 6. ~ommun~cation from the Sigsbee Road Civic Association in Laurel relative to a burned-out house which has been boarded up and children in the area are playing in the structure and the Association feels it is a hazard.----This matter will be investigated, if the house is boarded up properly and is broken into there is not too much we can do about it, if it has not been boarded up properly perhaps some action can be taken. 7. Letter from the State of New York, Office of Mental Retarda- tion and Developmental Disabilities, NYC/Long Island County Ssrvices Group~ Some time in the past Southold Town had agreed to help this group find a center in this area. A house on the Main Road in Southold was considered, however their letter indicates the boave sight is no longer under consideration by them. 8. Letter to the Superintendent of HighWays relative to the disr-epair of the "67 Steps" at the end of Sound Road, Greenport.--- This is one ~of several letters received. The problem has been discussed with the Highway Superintendent relative to a step- rebuilding program and we are going to make an effort to police the area to reduce further vandalism. 9. Receipt of Wetland Application no. 39 from Thomas and Jacqueline Occhiogrosso and their Short Environmental Assessment Form. The application has been sent to the Board of Town Trustees and Southold Town Conservation Advisory Council for findings and recommendations. Moved by Justice Suter, seconded by Councilman Drum, WHEREAS, Thomas Occhiogrosso and Jacqueline Occkiogrosso, his wife has heretofore applied to this Board for a wetland permit of prop- er~y located at Corey Creek Lane, Lot 28, Map of Corey Creek Estates, Southold, and WHEREAS, the applicant has duly submitted a written statement (Environmental Assessment Form) in accordance with Chapter 44 of the Town Code, and WHEREAS, notice of receipt of such statement has been duly posted. NOW,THEREFORE, IT IS RESOLVED that this Board has hereby determined that the proposed action will not have a significant affect on the environment, and tT IS FURTHER RESOLVED that the Town Clerk shall file and circulate this determination in accordance with Chapter 44 of the Southold Town Code and Article 8 of the Environmental Conservation Law and the rules and regulations promulgated pumsuant thereto. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Doyen, Justice Suter. This resOlution was declared duly adopted. DSputy Supervisor Homan: 10. Letter from Congressman Thomas J. Downey, 2nd District, New York advising that he has been in contact with the Department of Labor relative to the CETA incentive bonus for Suffolk County of Labor relative to the CETA incentive bonus for Suffolk county and a decision has been made to award Suffolk the bonus. This means $70,000. to the five eastern towns. 11. Letter from the Cutchogue Fire Department requestinq two special summer patrolmen to direct traffic both at the b~ginning and end of their 12th Annual Parade and Drill on Saturday, July 21st. This will be referred to the police department requesting they give whatever assistance they can. 12. Item 12 on the agenda pertaining to the Cutchogue Fir~ Department is a Park District matter and has been referred back to the Fire Department. 13. Notice from Long Island Lighting Company stating the Public Service Commission has approved a 3.3% general increase for traffic signal lighting services effective May 4, 1979. 14. Recommendation has been received from the Southold Town Planning Board for acceptance of the amount of a subdivision bond for "Richmond Shores at Peconic." O~ motion of Justice Su~er, seconded by Councilman Drum, it was RESOLVED that the Town Board of the Town of Southold accepts the amount of $125,000 as a bond for completion of roads and improve- ments for the subdivision known as "Richmond Shores at Peconic~ Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Suter, Justice Doyen. This res61ution was declared duly adopted. Deputy Supervisor Homan: 15. Receipt of a letter from Lawrence M. Tuthill, P.E., Town Engineer requesting an increase in fees for bond estimates. His present fee if $50.00 for the first ten acres and $2.00 for each additional acre. His is asking for $100.00 for the first ten acres and $3.00 for each additional acre. A letter has been received from the Plan~ing Board supporting Mr. Tuthill's request. On motion of Councilman Pell, seconded by Justice Surer, it was RESOLVED that the fees Of Town Engineer Lawrence M. Tuthilt, P.E. for bond estimates be increased from $50.00 for the first ~en acres and $2.00 for each additional acres to: $75.00 for the first ten acres and $3.00 for each additional acre. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Doyen, Justice Suter. This resolution was declared duly adopted. Moved by Councilman Drum, seconded by Justice Suter, WHEREAS, Chapter 659, Laws of 1972, provides financial aid for the construction of municipal solid waste management projects, and WHEREAS, the Town of Southold, of 53095 Main Road, Southold, New York, hereinafter called the Municipality, has made application for State Grand-in-Aid, and WHEREAS, it is necessary that a contract by and between the People of the State of New York, hereinafter referred to as the State, for such State Aid be executed on behalf of the Town of Southold, NOW, THEREFORE, be it RESOLVED by Town of Southold, the governing body of said Municipality~ as follows: 1. That James Homan, Deputy Supervisor, be hereby authorized to sign, on behalf of the Municipality and make application for a StateGrant-in-Aid and provide the State such information, data and documents pertaining to the application for a grant as mD~ be required. and otherwise act as the authorized representative of the Municipality in connection with said application. That the Municipality agrees that if a Federal grant or grants and StaGe assistance for the Solid Waste Management peoject are made, pursuant to Laws of 1972, or any Federal law or program, the Town of Southold will pay the remaining costs of the approved p~oject. 3. That the Municipality or Municipalities set for thei~ respective responsibilities bY attached joint resolution relative to a joint solid waste recovery and management project. 4. That four (4) certified copies of this resolution be prepared and sent to the New York State Department of Environmental Conservation, Albany, New York 12233, together wiht a complete application. 5. That this resolution shall take effect immediately. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Doyen, Justice Suter. On motion of Justice Suter, seconded by Councilman Drum, itwas RESOLVED that Maddie Miles, Mattituck, New York be and she hereby is granted a six month renewal of her permit to locate a single trailer on private road off north side Main Raod, Mattituck, New York. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Doyen, Justice Suter. This resolution was declared duly adopted. On motion of Justice Suter, seconded by Councilman Drum, it was RESOLVED that Geraldine Davis, Mattituck, New York be and she hereby is granted a six month renewal of her permit to locate a single trailer on the south side Sound Avenue, Mattituck, Bew York~ Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Doyen, Justice Suter. This resolution was declared duly adopted. 30 1 Deputy Supervisor Homan: 16. Item 19 on the agenda: Local Law Re: Appearance Tickets, was something Mr. Homan~requested the Town Attorney to draft a few weeks ago. It has to do with an amendment that was passed in 1978 New York State Legislative Session. It refers to the Criminal Procedure Law and Municipal Home Rule Law in allowing towns to adopy a local law permitting other members of town government to issue appearance tickers who are not allowed to. The Board has some reservations about this, after having read it, and are goin~ to hold it for further study. On motion of Councilman Drum, cseconded by Justice Suter~ it was RESOLVED that the Mattituck Senior Citizens bR and hereby are granted permission to contract for one bus in the amount of $468.00 to transport them to New Preston~ Connecticut on October 16, 1979. On motion of Justice Suter, seconded by Councilman Pell$ it w~s RESOLVED that Cutchogue Fire Department Chief3James Fogarty, 1st Assistant Chief Fred Kaelin, Jr., and 2nd Assistant Chief Stanley ViCtoria be and hereby are appointed Fire Wardens for Robins Island, Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homan, Justice Doyen, Justice Suter. This reolution was declared duly adopted. Deputy Supervisor Homan: 17. Item 25 on the agenda has to do with the gas situation in Southold Town. Supervsior Martocchia had been working very very hard on this and still had work to do on it. Today, Deputy Super- visor Homart spoke to Mr. Murray of the office handling the gas shortage problem and directed the police to circulate another form to all the service stations in the area to be completed today and returned to him relative ta their allotments. H.e has informed all of the service station operators there will be a meeting tomorrow at 11 AM at Hauppauge called by County Executive Klein who will be going to Washington later in the day. Along this line the Board would like to send a telegram to the Governor as well as various other State Officials concerning the severe kardship the gas shortage is causing Southold Town. On motion of Councilman Drum, seconded by Justice Suter, it was RESOLVED that Deputy SuperviBor aames Homan be and he hereby is authorized and directed to send the following telegram to Governor Hugh L. Carey with copies to Assemblyman aohn Behan, Senator Kenneth LaValle, County Executive John V.N. Klein, and Congressman William Carney: The gas crisis continues to deteriorate in the Town of Southold. The economy of this seasonal community is'.~ery adversely affected. We urgently request that your office give all possible consideration in obtaining additional fuel allocations for this area. Vote of the Town Board: Ayes: Councilman Pell, Councilman Drum, Councilman Homah, Justice Doyen. Justice Surer. This resolution was declared duly adopted. Councilman Pell asked Mr. SamUel Markel, Southold if anyone had contacted him about his beach on Long ~sland Sound~---Mr. Markel stated that Supervisor Martocchia sent him a copy of a ~ to the Corps pf Army Engineers whereby a meeting had been set up to survey the situation. Mr~Markel was in hopes of hearing something definite as to when they are due to arrive. Not only Mr. Markel but all of North Sea Drive hhnow has ~oined in and wants to meet with. the Town Board and the Corps of Engineers. Along the same line information has come to Mr. Markel that the Greenport Water Department is having a lot of trouble with their wells on Eorton Lane with chlorides ahd nitrates. There is a rumor that they would like to put a pipe line into Great Pond which is about 500 ft. away from the sound, and if this is done a~ fresh wa~er is drawn out of Great Pond it will invite additional salt water intrusion, which we already have in our area to a great extent, in fact most of the people in M~ Markel's area buy bottle water to drink. If this salt water intrusion happens it will contaminate the entire area on Soundview. Great Pond at one time went from the Camp all the way to Horton Lane. It was one continuous Great Pond and a lot has been lost and some of it filled in, but it zs a great source of fresh water fo~ the water table. Mr. Markel feels this is lust as serious as the problem of beach erosion and possibly a little more severe.---Deputy Supervisor Homan asked that Mr. Markel make himself available after the meeting for a discussion of this matter with him. 303 On motion of Justice Suter, seconded by Councilman Drum, it was RESOLVED that this Town Board~me~tin~be adjourned at 3:35 P.M. in~.memory of Supervisor Albert M.
