MORNING SESSION
Gail Wickham, Esq. met with the Board to discuss a permanent
easement for installing and maintaining surface water faCilities
at SQuthold!Gardens on the north side of Hill Ro~d West, Southold.
Dr. Myron Slater met with the Board to discuss the programs of the
North Fork Rural Arts Association. They would like to hold programs
at the former East Marion school, property owned by the Orient-East
Marion School District, but need lights for the area. The Town
feels they might be able to find a light for Dr. Slaterw and Highway
Superintendent Dean offered to speak to Jim Monsell of the Greenport
Utilities relative to obtaining a light pole, however, Dr. Slater
should secure a letter from the Orient-East Marion School District
giving permission for the erection of a pole and lighting connection
and assure the Board there is sufficient insurance to hold the Town
harmless.---Dr. Slater also spoke to the Board relative to the sound
equipment owned by the Town. Plans had been made to put this equip-
men~ into the June 2nd auction, but after consideration of the project
proposed by Dr. Slater, they decided to withdraw the equipment from
the action. It was agreed to lease the equipment to the Nortk Fork
Rural Arts Association with the provision it may be used by other
organizations if it does not conflict with the NFRAA schedule, and
the ~FkAA will be responsible for its maintenance.
A regular meeting of the Southold Town Board was held on Tuesday,
May 8', 197~9 at the Southold Town Hall, Main Road, Southold, New
York. Supervisor Martocchia opened the meeting at 7:30 P.M. with
the following present:

Supervisor MartOcchia welcomed the people to this night meeting.
He said we have had Town Board meetings in the evenings before and
the same six that came in the afternoon came ~t night. He is very
appreciative that so many people are interested in seeing how the
town government operates. Later in the meeting iw will be opened
to the public questions.
On motion of Justice Suter, seconded by Councilman Drum, it was
RESOLVED that the minutes of the Southold Town Board meeting of
April 24, 1979 be and hereby are approved as submitted.

Supervisor Martocchia:
1. Dr. Myron Slater appeared before the Board in the' morning
session requesting help in support of the No~tk For~ Rural Arts Associa-
tion. They are in need of lighting at the Orient-East ~arion School
property on Main Road, East Marion; and they would like the use of
the to~n owned sound system. The Board agreed today to enter i~to
a lease aqreement with the NFRAA for.the use of the sound equipment
for the summer, and should the equipment unused other ~ights, other
organizations may use it after making arrangements with. Dr. Starer.
2. Letter from Jody Adams, Pec0nic relative to probl'ems sh~
has at Indian Neck Lane.
3. Receip~ of approval through April 30, 1980 for the employ-
ment of Robert F. Reeves, Watchman with the Southold Town Police ·
Department from the New York State Department of Civi~
Reeves has reached the age of ~0 and .cannot continue ~n our '~mplo~ent
without approval of the State.
4. Letter from the Riverhead Bay Conservation Association
indicating they are going into a clam transplant program similar
to the one in Southold Town. Since their line is close to the To,Tn
of Southold they sent maps of their transplant rareas for our informa-
tion.
5. Letter from Scheyer, Jellenik & Attonito, attorneys for
Angelo Accardo (Taurus Homes, Inc.} in the matter verses the Town
of Southold and H.B. Walters, Inc., stating that Mr. Accardo has
informed him that the clean-up has been accomplisheld on the Walters
property and thanking the Town for their efforts in. the matter. ~e
does point out that the fenceor screening is still missing and asks
to see that it is done as quickly as possible,
6. Letter from Franklin Bear, President, Nolrt~ 'Fork Environ--
mental Council, Inc. askin~ that the Town Board thbroughly study
all aspects of a town airp6rt before making a com/nitment to anyone..
Mr. Bear was on the A~iport Committee with Councilman Drum and
other individuals. His letter outlines basic facts- the Town ~oard
should consider in connection with a future town airport.---The
Board does not have a~y immediate pl-ans for an airport and all
aspects will be thoroughly studied.
7. Letter from the Department of the Army, Corps of Engineers
relative to maintenance dredging in the entrance of ~attituck 'Inle~
They state that environmental restrictions 'preClude tk~ accomplisk-
ment of dredging during~the months: of February to August, ~nclusive~
to a~oid interference witk'fisrh eggs and larvae. They are. co~t--
ing the environmental agencies w~ich 'desired t~sre~triction to
ascertain if dredging can be accomplished at an earlie~ time in view
of the shoaled condition of the entrance channeI.~--Money has been
allocated in the 1980 federal budget for th~s proje:ct but the To~rn .
cannot wati that long, and approval has been granted for an emergency
program.
8. Letter from the Fishers Island Ferry District confirming.
that the District %till transport Senior Citizens f~om the Town
to Fishers Island on June 13, 1979 and return later tkat da~. At
the same time the Fishers Island Senior Citizen-s will 5e transported
from Fishers Island to Southold for the day. Th~ G~eenport-Sauthold
Senior Citizen Cluh~ has been ~ranted permission to take 'this trip.---~
Supervisor Martocchia apoligized to the new' group the seniors Club
of Southold-Peconic, Inc. who requested that tReY be.~ncluded i_n
trip after arrangements had already been made. H~ had committed
himself to the Greenport-Southold group, but next year the Seniors
Club of ~Duth~ld PecQnic ~ill take the trip.
9. Letter f~rom County. Legislator Denis R. Hurley and letters
from, and to co~missioner R.M. Kammerer relative to flooding
conditions on DePOt Lane near the Sound, Cutchogue, and Route 27 east
of Youngs Avenue, Southold. They are trying to develop a study that
will allow the entire County to be involved, with the possibility of
subsidy money if the work is done.
10. Letter from Joan Hatfield, Cutchogue, strongly urging the
Town Board to take a vigorous and public stand to oppose licensing
of Lilco's nuclear power plant in Shoreham as well as the proposed
nuclear plants in Jamesport.---The Board has taken the position in
1977 of opposing nuclear plants at the present time until further
study has been completed, and the opposition still stands.
11. Letter from Sophia Adler, Southold also o~posing the nuclear
plants, and asking the Southold Town Board to be heard not only support-
ing the farmers but offering reasonable leadership in opposing the
dangers of the' Shoreham Nuclear Plant.
12 Letter from the Catholic War Veterans, S ~. Agnes Post No.
730, Greenport, inviting the Town Board to attend the annual Memorial
Day Parade to be held at Greenport on May 28~ 1979 at 10.30 A.M.
13. Letter from Gary Flanner Olsen, attorney for Louis Hodor,
owner of Greenfields Subdivision requesting the release of the
Roae Performance~Bond.-~-Approval must be secured from the Highway
Superintendent and Highway Committee. The Highway Committee with
Superintehdent Dean will make their inspeciton on Monday, May 14th.
14. Notification from Arthur F. Siemerling that he fell
from the curb on the west side of Love Lane in front of the "Tic
Tac Toy" store, Mattituck, as a result of a flaw in the road at
the curb.---The Highway Superintendent, Town Attorney, and insurance
agency have been notified.
15. Letter from the Greenport Fire Department inviting the
Town Board to the dedication of the Richard-Bruce Memorial Statue
on Sunday, May 20, 1979 at 1:30 P.M.
16. Letter from the Southold Town Trustees relative to a
dredging project off the Port of Egypt. The Board suggests that
the dredged material b~placed on the west side of the island as
the tern colony is eroding along the south shore and the sand being
placed to th~ west wouls help nourish the beach and protect the area.---
Supervisor ~artocchia met with Carl Eisenschmeid of the Suffolk
County Department of Public Works and he concurs with the Trustees
that the dredged material should be placed on the west end of the
island.
17. Letter from Donald B. Rynd, Jr., attorney for Helen M.
Rynd in the matter of the spoil damage done to her property
immediately adjacent to Wickham Creek in Cutchogue.---The dredging
project near Mrs. Rynd's-~p~operty ~alled for one foot of spoil to
be placed slong the beach line, and instead three foot of spoil was
placed there. The contractor for the job has agreed to remove the
excess spoil, returning the property to one foot of spoil as agreed
upon originally.
18. Notification from the New York State Department of Audit
and Control relative to a~counting procedure~ ~n connection with
dog mon~es in accordance with a new Article 7 of the Agriculture
and Markets Law.
19. Letter from Holzmacher, McLendon, and Murrell, PC adivsing
the Highway Superintendent that the New York State Departmentof
Transportation is in the process of inventorying and inspecting
highway bridges for. potential rehabilitation and replacement with
Federal funds. The only bridge in Southold Town that qualifies is
the one at ~rushes Creek, and Highway Superintendent Dean will
be in touch with the NYSDOT with suggestions within the next month.
20. Letter from Holzmacher, ~dLendon and Murrel PC, to the
Highway Superintendent transmitting Chapter 2.2 "Sol~.~ Waste
Quantities: containing their final evualation of the estimated
solid waste generation for the TOwn of Southold. These quantities
are based on the data obtained from their recent vehicle count
and the material survey at the Town landfill.
21. Letter from the NYS Dept. of Environment~ Conservation
advising of their negative declaration, notice of no significant
effect on the environment in connection with the application of
"Long Pond Estates: for a proposed 53 single family re§idential
subdivision on 61 acres at Arshamomaque Pond, Southold.
22. Invitation to the ToWn Board memebr~ f~om suf£~lk lounty

23. The ~oard has been .accepting resumes for se~erat
vacancies, and.appointments will be made at the May' 22 meeting.

24. Notification from the Department of the Army, Corps of
Engineers upon application of Goose Bay Civic Association, for
permission to maintenance dredge 120 feet and remove 3,000 cubic
yards of fill. Objections by May 23rd.
25. Notification from the Department of the Army, Corps of
Engineers upon application of Jaap N. Hilbrand for the~construction
of piers, ramp, dolphins and dredge at Stt~ling Basin, Greenport.
This is within the jurisdiction of the Village of'Greenport. Object-
ions by May 30th.
26. Notification from the Department of the Army, Corps.~of
Engineers ~:upon ap.p~icationof Thomas A. Isele for permission to
bulkhead and fill at Stifling Creek, Greenport. This is also
within the ~urisdiction of the Village of Greenport. Objections '~
by May 30th. {
27. Notice from the N.Y.S. Dept~ of Environmental Conservation ~
for complete application for non-minor project by Edna V. McNulty
for permission to create two lot subdivisio~ and construct a one
family dwelling on each lot, south side of Westview Drive, west of
Brower Road, Mattituck.
28. Notification from the New York State Department of
Environmental Conservation relative to tidal wetlands application
for subdivision and construction of four homes on the east side of
Wells Roa~, Peconic. They Wish to know whether the Town desires
lead agency status. This matter is being sent to the Planning
Board for review.
29. Receipt of job description for manager of the Fishers
Island Ferry District. Supervisor Martocchia will contact Civil
Service to determine whether this is a competitive or exempt
position.
30. Letter from Jerry S. Walker, D.V.M. Vanston Road,
Cutchogue concerning a problem with a silted waterway in Haywaters
Cove at the east end of Fishermen's Beach, Nassau Point.---Supervisor
Martocchia inspected the property on-May 1st with Carl Eisenschemid
of the Suffolk oCounty Department of Public Works, the Bay Constable and
Mr. Baldwin of the same area at Nassau Point, and T. Samuels. This problem
will be resolved to everyones satisfaction.
31. Receipt of follow-up information from Mrs. Ethel E. Wortis ~
on a request for funding for the Inter-Agency Council directory.
The Board would like to study this further. ~ ~.~
32. ~ighway ~pecifications for the replacemen~ parts for the
D-6 Catepillar Bulldozer have~been received and advertisements for
bid have been placed in the local newspapers.
33. Supervisor Martocchia, Councilman Drum, Councilman Pell,
Highway Superintendent Dean and the consultant firm of ~olzmacher,
McLendon and Murrell appeared before the New York State Department
of Environmental Conservation recently in the matter of alleged
violations at the landfill area in C~tchogue. The DEC has agreed
to suspend the fine for the alleged violations if the' Town agrees
to comply with certain requirements setforth by them.

RESOLVED that Supervisor Albert M~ Martocchia be and he hereby is
directed to execute the Order on Consent for the New York State
Department of Environmental Conservation in the matter of the alleged
violation of Part 360 fo Title 6 of the Codes, Rules and Regulations
of the State of New York by the Town of Southold.

34. The three chambers of commerce have asked for funds to help
defray their expenses, and last year Supervisor Martocchia met
with them to discuss the feasibility of a joint venture for a
brochure covering all of Southold~Town, ~ather than three separate
brochures. At that time they agreed this would be a good idea.
However, they have not put this plan together for this year, but~
will do it next year. This year they would like to share funds
that have been put aside for the brochure in the amount of $2,000.
On motion of Justice Suter, seconded by Councilman Drum, it was
RESOLVED that Supervisor Albert M. Martocchia be and he hereby
is authorized and directed to allocate $600. to the Mattituck
Chamber of Commerce, $600. to the Cutchogue-New Suffolk Chamber
of Commerce, and $600. to the Greenport-Southold Chmaber of
Commerce, and each chamber may draw against their account upon
the presentation of vouchers with supporting bills.

Supervisor ~4artocchia:
35. Letter from Mary B. Tuthill, Site Manager, Southold
Town Nutrition Program thanking the members of the Southold Town
Board for their cooperation in maintaining Gerald King as cook
in the Southold Town Nutrition Program for the Elderly.~--Super-
visor Martocchia explained that Jerry King is a CETA worker and
they have worked out a means to keep him until September with
Nutrition Funds and from September to the end of December with
a contribution by the Town to the Program. Possibly in 1980 he
will be included in the regular Nutrition budget.
36. The Board has decided that in the event of emergency
problems ~ith the generator at the Town Hall they will call on
Joseph J. Prohnhoeffer, Jr. of Southold who is qualified to repair
this type of generator. The Board members have also been invited
to a one time test and display of the Wheian 2000 watt Electronic
Siren System for stationary emergency applications at Frohnhoefer's
Southold on Wednesday, ~ay 16th at 7:00 P.M.
37. Sometime ago the Fishers Island Ferry District had a
Problem with their Yalo Fork Lift and submitted figures to the
Town Board for the-purchase of a new fork lift or repair the
existing one. They have now received figures for the repair at
$6,542.43 and contracted with the Connecticut Fork Lift for the
~ob.
38 Letter from the New York State Public Employment Relations
Board relative to switching tours by the police officers.
39. Letter from the Department of Housing and Urban Development
stating that in response to a letter from Supervisor Martocchia on
May 26, 1978 and several letters from John Wickh~m appealing the
Federal Insurance Administration's flood elevation determination for
the Town of southold, they have determined that it is not appropriate
at this time to modify the Flood Insurance Study for the Town of
Southold.-~In connunction with the Town Attorney, Mr. Wickham has
prepared a letter fro the Supervisor's signature stating ~he
proposed establishment of an eight foot flood plain elevation for
the Peconic Bay section of Southold Town is not acceptable and
outlined, inconsistencies ~eading to this appeal,
40. Proposals have been received for dry cleaning services
for uniforms for the Southold Town Police ~epartment f~om Hometown
Cleaners, Mattituck, Hoppy's Cleaners, Inc., Greenport, and Village
Dry Cleaner & Laundry, Greenport. Village Dry Cleaner~-submitted
the lowest proposalS.
On motion of Councilman Drum, seconded by Justice Suter, it was
RESOLVED that 'the Supervisor be and hereby is authorized to
enter into an agreement with Village .Dry Cleaner & Laundry, Greenport
to perform the cleaning services required by the Town for the uniforms
of the members Of the Southold Town Police Department for the period
commencing the'first day of May 1979 and ending the 30th day of
April 1980 as follows:

41. Receipt of application for a wetland permit from Thomas
E. Fox. This application has been transmitted to the Board of
Town Trustees and Conser-vation Adivsory Committee for their
recommendations and reports.

WHEREAS, Raymond W. Pluschau applied to the Southold Town Board
for a permit under the provisions of the Wetland Ordinance of the
Town of Southold, application dated February 12, 1979, and
WHEREAS, the said application was referred to the Southold Town-
Board of Trustees and the Southold Town Conservation Advisory
Council for their findings and recommendations, and
WHEREAS, a public hearing was held by the Town Board with respect
to said application on the 10t'h day of April 1~79, at which time
all interested persons were given an opportunity to be heard, and
WHEREAS, this Board has thereafter examined all statements and
documents submitted with respect-to such application and has also
visited the premises in question and is therefore familiar with the
premises and the affects upon the same which would res~lt~by reason

permission to construct 68 ft. of bulkheading and dredge approximately

to the ramp whichever is less.

The Board discussed the dedication of roads in Oreqon~Vie~Estates,
Mattituck. Since they do not have a letter from the Assessors
giving the assessed valuation, and a set of a in the
file they w~ll hold this dedication ~ntil the Mal; 22nd meeting.

Supervisor Martocchia:
42. Today the Board discussed the joint meeting he had with
Maria Tejo and Gladys Csajko ~elatieve to possibIe chalnges at the
Dog Pound. In turn it was suggeSted that Mrs. Csajko talk to the
Town Attorney, which she has. Supervisor Martocchia appointed a
committee of Counc~iman Petl and himself to talk to Mrs. Csajko and
Mrs. Tejo to work out a solution.
43. Chief CataIdo has requested permission to attend a seminar
at Evanston, Illinois in July. The Board will discuss this request
at the May'~22nd meeting.
44. Letter from the Department of Housing and Urban DeVeloPment
~requesting the Boardts comments or information on the Southotd
Commons project. The Board has ag.~reed that HUD should be 'advised
that an investigation has been donduet~d into the availability of
rental units &n the Town of ~outhold and this investigation~reveals
there is no need for additional units at the present time.
On motion of Councilman Drum, seconded by Councilman Koman, it was

Supervisor Ma~tocchia stated that the Board and Chief Cata~Ido have
spent two and a half years studying alternate communication systems
to the one t~at is pre.sently being used at Potice'Keadquarters. The
New York ~ele~hone Company cannot bid, hut in studying their systems
it has been found they are cheaper than what the present system at
police headquarters costs n~y. There Will be one change, however,
the deletion ~of the call boxes. The telePhone company is putting
public .phone~ in many locations in the Town,' and the police officers
can communicate-by '%he~r car radios. Tki's new System w~li be a
saving to the Town for a much improved system~
Supervisor Martocchia said that last Wednesday he met with 26 gas
station attendants and owners. He had been in touch With Federal
representatives and State repuesentatiVes in the energy fields, as
well as Consumer Affairs in Suffolk CoUnty. The Consumer Affairs
representative was at the meeting. Supervisor Martocchia has talked
to County ExeCutive Klein and he will write to the Federal government.
They are trying ~o enact a condition that any area which is classified
as a touris~ area will be allocated more gas. The New York S~&~e
representative has advised that New York State holds back 3% of
the State allocation and the local dealers are all entitled to draw
from that from a supplement, but that can only be two times out of
a twelve month period. Some of the gas stations have used their
supplement already. This Town is very dependent upon gas to support
our resorts, hotels, motels, shops. The S~a~e representative has
been asked to see if they can get the allocation moved up from 3%
to 9.9% , but there is no commitment. The gas station owners and
attendants left the meeting very unhappy but that is the best that
can be done at the present time.
Margaret Lightfoot, Fourth Avenue, Greenport sa~d that last month.
she sent a letter to the Board urging that nets be placed at the
beaches to protect the public from the jelly fish. Last year many
people could not go to the beaches because of the jelly fish.---
Supervisor Martocchia ~stated that they received a request last year
from a large number of people and a study of Islip Town~ Brookhaven
Town and individuals who make nets. Figures have been received from
each area. It seems to be a prohibitive figure uniess they net an
area 100 by 100, but a larger area would cost a tremendour amount
of money.---Mrs. L±ghtfoot asked if ti would be possible to have
a levy for the beaches where the residents and tourists would pay
something thereby contributin~ to the installation of the nets?---
at the present time residents m~y use the beaches free and non-
residents pay $2.50~per vehicle. That does not bring in enough
when the figures would be about $100,000'. to~ $200~000. for installing
nets. In addition the Town has spent $30,000 each of the past few
years for erecting sanitation facilities. There are also liefguard
costs, beach attendant costs, beach patrol costs. Supervisor
Martocchia said he would like to gamble another year ~o see if we
get hit again by jelly fish and is so we would be required to give
it serious study. For this year there are not enough funds available
for such a program.
Mr. Charles Watts, Jr. asked if'a lot of money could'nt be saved
if the litter law were enforced and people fined stiffly for
littering.---Supervisor Martocchia and Justice Surer said'that
the litter law is very hard to enforce.---~, watts said that
on the south shore and other areas there does not seem to be
such a problem'with littering.---Supervisor Martocchia said thet
two police committee members will bring this information to the
Chief of Police to see what can be done.
Mr. Franklin Bear reminded those present tha~ on Thrusday, May' 10th
at 7:30 there Will'be a discussion of how to handle waste problems
and how to finance them. A gentleman from the New York State
Department of Environmental Conservation will discuss alternative
methods for waste menagement and a gentleman from the Environmental
Protection Agency of the United States will disucss ways in which
they are trying to integrate funding for all of these programs. This
is also sponsored by teh North Fork Environmental CounCil. League
of Women Voters and North Frok Audubon Society in cooperation
with the Town Board.
Mr. Robert Hood stated he is interested in being a member of the
Conservation Advisory Council.---Mr. Hood was advise~ he should
submit his name and get a resume in tomorrow.
~r. Hood said that Bailie Beach has been in bad shape for the past
four or five years. H~ has seen the disposal cans being thrown into
the water. He feels if the area were patrolled twenty-four hours
a day a better job could be done.---Supervisor Martocchia said that
five extra special patrolmen are hired in the summer., and ~here
will be an extra one at Cedar ~each this year with the use of County
funds.
Mr. Samuel Markel said that it seems to him that th~ only way some
of these problems are going to be solved is if the private citizen
becomes a policeman. All they would have %0 dO is get the evidence,
license plate of the car, name of the kids or adults throwing
~arbage and cans, etc., take the evidence and report to the Police
Department in writing with ~h~ir name an~ they will investigate it
and possibly bring it before the'judge and have them fined. The
individual must appear like a policeman. They can also do the same
thing ~ith speeders.---Mr. ~ood asked if they have protection after
they t~rn someone in?
Mrs. Jean Tiedke reminded those present that tomorrow night at
the Greenport High Scho01 there is another hearing to be held
by the Corps of Army Engineers on dredging of~the Thames River.
The dumping~of the spoil is righ~ off Fishers Island.
Mrs. Tiedke thanked the Board for holding evening meetings.---
Supervisor Martocchia said that Board would like evenin meetings,
however, they were tried several times but it didn't work out.
He~is very happy there is such a good turnout.
Mr. Joe Mahoney spoke about the communication system and asked
if there is going to be anything available at the beaches for
emergency such as the call boxes?~-- Supervisor Martocchia stated
that at all of the beaches there are public telephones.
Mrs. Gladys Casj~0 asked about the transfer from the general fund
earlier in the meeting relative to workmen's compensation. What
period of time does that cover?---Supervisor Martocchia said that
it covers one year.
Mrs. Casjko asked about the letter from Audit and Control relative
to the sur~us dog monies, what is that about? .... Supervisor Martocchia
said ±~ is a directive relative to bookkeeping procedures under the
new system.
Mr. Jim Henderson said there is no phone on the causeway at
Nassau Point beach.---Supervisor Martocchia said there will be
a letter to all park districts advising them the call boxes will
be removed and undoubtedly telephones will be installed.
Mr. Frank Csajko asked if the Baord has taken a stand one way or
an other on n~clear pla~ts?---Supervsior ~ar%occhia said they
took the stand in 1977 opposing nuclear plants at the present time
until further study has been made on the sb~ject regarding nuclear
plants and other energy alternatives.
Mr. Bill Pfeffer, Southold, said that last year he complained
about the location of certain fish traps that block the channel.
he was told that the responsibility for granting permits 'was very
vagu~ that tke Army had decided not to issue permits, the Town
was not issuing permits. Who is responsible for allowing a fish
trap to be set up where it blocks the 'channel? Town Attorney
Tasker stated it is not under the Town's jutisdict~6n , it would
be the Corps of Army En~ineers.--~Councilman Homan stated that if
a fish trap is in the channel it is a hazard to navigation and
should be reported to tke Coast Guard.---Mr. Pfeffer said he
repo~ted it ~to the Coast Guard last year and it stayed until the
winter.-~Councilman PeI1 said he would find out whose responsibility
