MORNING SESSION
Mr. David Spohn and Mr. John Duetl spoke to the Board relative
to possible sites for a town airport. The Board is appreciative
of the research, time and effort they have given to this project
and advised they should actively pursue a location for an airport
with sufficient length to qualify for a federal grant.
Chief Cataldo met with the Board relative to the proposed new
telephone communication system for Police Headquarters. The
Board will study the proposal and make a decision later in the
day.---An aucti6n~of surplus town equipment and unclaimed
property was discussed with Chief Cataldo. This auction will
be held on June 2nd.
Mr. John Pendleton, Fishers Island Civic Association addressed
the Board, asking if there is any manner of tax relief available
to businesses to entice them to come to Fishers Ist&nd. Mr.
Pendleton was advised the County does have such a program. Also,
there is a loan program available at 3%_inte~est. fO.r. business
improvements available throughthe County.---Mr. Pendleton also
discussed other problems of the Island people, including a request
for additional street lights. The Board advised Mr. Pendleton
the street lighting~ committee would discuss the request and come
to a decision later in the day.---Mr. Pendleton stated the Fishers
Island F~rry District is interested in acquiring surplus~property
from ~he~federal government. He presented a letter from the Ferry
District and a map indicating Building 9209 as the property in
question~and asked that the Town Board place a request for this
building on their behalf. The Board agreed to do this.
A regular meeting of the Southold Town Board was held on Tuesday.s,
April 24, 1979 at the Southold Town Hall, Main Road, Southold, New
York. Supervisor Martocchia opened the meeting at 3:00.P.M. with

RESOLVED that the next regular meeting of the Southo.ld Town Board
will be held at 7:30 P.~{., Tuesday, May 8, 1979 at the Southold
Town Hall, Main Road, Southold, New York.

Supervisor Martocchia:
1. Notification from Long Island Cablevision Corporation that
starting May 1st they will convert their present premium movie service
to Showtime and reduce the ra~e from the present $9.95 to $8.95 per
montk. -
2. The parks and Beach Committee met last week with representa-
tives of the Cedar Beach area, the Highway Superintendent and Chief
of Police to determine how they may resolve some of the problems
in that area during the summer months. Some solutions have been
arrived at, and there will be an inspection of the area toward
further solutions. Under the contract entered into with the County
of Suffolk there will be funds available for the Town to provide a
special police officer during the summer season.
3. Letter from Judith Hope, Special Assistant to the G6venor
for Long Island offering her services in dealing with agencies Of
New York State Government or with staff members of the Executive
Chamber.
4. Letter from the New York State Department of Environmental
Conservation, Stony Brook, to Highway Superintendent Dean stating
a recent inspection of the Town of Southold Landfill revealed 55
gallon drums filled with liquid from Mattituck Airbase, as well as
industrial waste in the leaching lagoons and Mr. Dean has been asked
to immediately stop receiving these wastes.---Highway Superintendent
Dean stated the matter will be corrected.
5. Receipt of a letter from the New York State Parks &
Recreation relative to the Town Doctor's House, Ackerly Pond Road
Southold. The owner of the property known as the Town Doctor's
House, Peter Stoutenburgh has inquired relative to eligibility
on the National Register of Historic Places, however, the N.Y.S.
Parks & Recreation has been advised the house may be threatened
or somehow adversely affected by the recent flooding problems. They
urge the buildings owner and the Town to take the appropriate
steps to safeguard this historic resource from the adverse effects
of flooding.---The problem will be investigated by the Highway
Superintendent.
6. Letter from Lorraine A. Hoey, 537 Conklin Road, Greenport,
asking when the Town will be adopting the Regular Flood Program.
Mrs. Hoey feels that since the Regular Program is available and
the cost of the insurance in the program is a great deal less
than the Emergency Program the Town should move in that direction
and benefit from the savings.---Mrs. Hoey will be advised that
the Town has not adopted the Regular Program as our Planning Board
Chairman, John Wickham has been involved in an appeal on behalf of
the Town with relation to elevations established by the Department
of Housing and Urban D~velopment.
7. Notice of highway defect from F~orence K. Rushmore, stating
she ~11 on the sidewalk on Pike STreet, Mattituck. The Highway
Superintendent, Town Attorney and Mc-Mann Price have been notified.
Highway Superintendent Dean advises he has investigated the report.
8. Notification from the Department of Housing and Urban
Development that the Southold Tovm preapplication f~ a federal
grant under the Small Cities Program has been denied. They suggest
a new submission for the next fiscal year.
9. Letter from the Mattituck Chamber :~of Commerce to County
ExecUtive John Klein stating they have been advised that James
Creek, Mattituck may not be dredged this spring. This project
has been POstponed for the past three years and James Creek contains
Mattituck's only Bay marinas and over 100 property owners are
dependent on this creek remaining open.---Supervisor Martocchia has
dteermined that the~small new county dredge is not adequate to do
the job in James Creek and they are going to put it out to bid.
Patting it out to bid would mean it would not b~ don~e before the
end of the summer, therefore, it has been arranged that the small
dredge will open ~he entrance and then bid for the b&l&nce of the
interior of the creek.
10. The Board has received from Jean Tiedke the Town of
Southold's response to staff motion of April 5, 1979 and to
County of Suffolk motion of April 10, 1979 to the New York. State
Board of Electric Generating Siting and the Environment re:Long
Island Lighting Company Jamesport Generating Station, Units 1 and 2.
11. The Board is in receipt of several resumes for tox. m jobS.
12. Notification from the Department of the Army, Corps
of Engineers upon application of Orient Wharf Co., Orient for
permission to construct a pier arrangement and mooring piles.
Objections due by April 26, 1979.
Applfcation to the Corps of Engineers upon application
of the U.S. Department of Agriculture for permission to extend a
timber pier at the Plum Island Animal Disease Center, Gardiners

Long Island Sound, Kenney'S Beach, Southold. Objections by

13. Notification from the N.Y.S. Department of Environmental
Conservation upon application of George Thogersen for permission
to contruct a one family dwelling on Lot 18, Fordham Acres,

Application to D.E.C. by James H. RamCo, Inc. for James
Kaminski for permission to convert an existing floating dock to 45 ft.
by 12 ft. fixed timner structure at Mattituck Creek end of Mill Road,

On motion of Councilman Drum, seconded by Justice Suter, it was
RESOLVED that the Supervisor be and he hereby is authorized and
directed to enter into an agreement with the Suffolk County Depart-
ment of Labor for the 1979 Summer Youth Employment Program, Youth
Conservation Corps environmental preservation peojects, at no cost
to the Town of Southold, for young people aged 14-21 who will be
paid $2,90 per hour.

ment relative to the Southold Commons project~ inviting the Town
to ~ubmit all comments or information they may have Which they deem
relevant to HUD's determination on the project.---S~pervlsor

15. ~tter from the Mattituck Chamber of Commerce asking
for funds for their brochure which will be published in 1980.---
Funds have been set aside, for th~s purpose, h~w~ver, in a meeting
witk the Mattituck chamber of Commerce last year, and meeting with
members of the Greenport Chamber of Commerce also held last year,
Supervisor Martocchia advised them it was the feeiing of the Town
Board that all of the Chambers in the Town, as well as the North
Fork Promotion Committee should see if something could be ~eorked
out for 1979 whereby a joint venture 'of all groups could be
initiated for a single publication that weuld benefit the entire
township;---Further information on this subject will be gathered
from the ~.~attituck Cham~er of ~Commerce.

16. Letter from tke New York State Depar'tment of Civil
Service relative to retiree T~omas J. Byrnes.--~kereas the Town
has just appointed two new radio op'er~tors for the PoIice
Depar'tment the. Board does not plan to ask for an extension for
Mr. Byrnes as ke has been working part-time and is called on
infrequently.
On motion of Councilman Homan, seconded by Councflman PeI1, it was
RESOLVED that the Southold Senior Citizens ~ and hereby are' granted
permission to contract for two buses in the amount of $2~8.00 to
take them to Oakdale on May 10, 197'9; and two. buses .in the amount
of $310.00 to take %kem to W~stbury on May 17, 1979.

Seniors Club of Southold-Peconic, Inc., who was present in the
audience, with reference to their rsquest that they be peremitted
to go to Fishers Island on the annual senior citizen boat' trip.
prior to the establishment of the Seniors Club of Southold-.Peconic,
Inc., the Board committed themselves to allowing the Southold Senior
Citizens to go on the annual trip this year, the boat will only
take 100 people. The Cutchoque-Mattituck group went last year
and the Board will schedule the Seniors Club of Southold-Peconic,
Inc. for next year.)
Supervisor Martocchia:
17. Letter from the Board of Southold Town Trustees
suggesting that a sign be made to be placed at the 150 foot
mark facing t~wards the ramp at the public bulkhead at Gull
Pond that this area be left open with no permanent moorings.---
Mr. Paul Stouteburgh, Town Trustees, stated that someone came
to the Trustees and asked that a line of permanent moorings be
allocated at the west and teh Trustees wanted to ~ake sure that
there will always be an emergency area tO the east so a boat
co~d pull in there at all times and tie up.---Supervsior
Martocchia said the Board would ask Bay Constable Januick to
prepare a sign and place it al Gull Pond as per th~ir~request.

RESOLVED that the Southold Town Conservation Council b~?and
hereby is granted permission to hire a secretary to assist them
at their meetings; said secretary to receive $20.00 per meeting.

Supervisor Martocchia:
18. The Board has studied the informational folder on Docks,
Filling, Dredging, ?~ooring, Bulkheads, Alteration of Wetlands as
prepared for the Town of Southold by the North Fork Environmental
Council. The Board feels that if the Trustees wish to prepare a
similar type informational folder under thsir name the Board would
be agreeable.---Mr. Stoutenburgh said he would so advise the
North Fork Environmental Council of the Board's feelings, however,
if the Trustees should not want to use it could they then come back
and get the Board's approval?---Supervisor Martocchia said it is
the Board's decision that if the Trustees want to do it they should
put their name on it and have it available in their office.
On motion of Justice Suter, seconded by councilman Pell,
QHEREAS, Supervisor Allen M. Smith, Chairman of the Sub-Committee
of the Suffolk County Farmlands Program f6r Riverhead and Southold
has requested that H~nry Moisa should hand in a report and recommenda-
tion pertaining to Edward W. Latham's submission of his farm for the
sale of development rights to Suffolk County, and fearing there might
be a conflict of interest by Daniel La,ham, his son, an appointed
member to the Suffolk Committee of the Suffolk County Farnland Program,
it is therefore
RESOLVED, that the Town Board-of the Town of Southold reccomends
that Henry Moisa act in behalf of Daniel Latham on the recommendation
for the property of Edward W. Latham, and that property only.

19. The decisions on wetlands applications~of Pluschau and
Gardner will be made on ~ay 8th.
20. There will be a working conference on amending the
Suffolk county Tax Act on Friday, ~ay 4, from 2-5 p.m. at the
State O~±C~ ~uilding~:inTH&~ppau~e. -The Tax Receiver will be
attending this meeting as well as one member of the Town Board.

RESOLVED, that Tryac Truck & Equipment Co., I~c., Riverhead, New
York, ~he only responsible bidder, be and hereby is awarded the
bid for a 1980 International 2524 Truck with dump body at a cost
of $21,878.00

Justice Suter commen~ed that there has been a misunderstanding as
to the timing of this matter and he is sure no one feels that Henry
Raynor has not done a good job, and he knows personally he is very
dedicated to his work. Justice Suter: Aye~
Supervisor Martocchia commented that Councilman Pe!l's abstaining
· s not in oppos±~on to Henry Raynor. Supervisor Martocchia made
a statement two weeks ago he would hold some of the appointments
open to a further meeting but he did not realize Mr. Raynor's term
expired April 30th. Supervisor~Martocchia: Aye.
Councilman Pell stated that at the meeting two weeks ago Supervisor
Martocchia said he would hold the appointments open for two meetings.
He had advised people that they would be open until approximately
May 8th, and they had until May 8th to get resumes in for all
appointments; there are four to be made. He felt h~:icould not vo~e
for Henry or against Henry as he is a good man, but he 'feIt he had
to keep his word to those he told they had until May 8th.
On motion of Councilman Homan, seconded by Councilman Drum, it was
RESOLVED that Henry E. Raynor, Jr., be and hereby is appointed
Chairman of the Southold Town Planning Board effective May 1, 1979
through December 31, 1979.

RESOLVED %hat Charles Grigonis, Jr. be and he hereby is appointed
to the Southold Town Board of. Appeals for a five year term, effective
May 1, 1979 through April 30, 1984.

WHEREAS, John Wickham, a most valued mem_ber of the Southold Town
Planning Board will retire from public service effective April 30,
1979, and
WHEREAS, John Wickham has given generously of his time and talents
in his faithful service to the Town of Southold residents as
Chairman of the Southold Town Planning Board since its establish-
ment on April 30, 195%, and
WHEREAS, his record 6f fine service to the Town of Southold and
its people deserves the sincere gratitude o~ those with whom and
for~kom he ~o~k.ed,
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the ~n.of
Southold expresses their most sincere appreciation to John wi~k~am
for his unselfish and wholehearted cooperation adn untiring efforts
on behalf of the Town of Southold, and its best wishes for the
years ahead, and
BE IT FURTHER RESOLVED, that this resolution be made a part of the
permanent records of the TOwn of Southotd, and a copy be sent to
Mr. Wickham.

Justice Suter stated that Mr. Wickham was at a working session of
the Board earlier this afternoon and was formally presented with
the foregoing resolution.

22. Word has been received from the New York State Commission
on Cable Television that they have reviewed the hearings held by
the Town Board on ~hange of rates by the Lon~ Island Cabelvision
Corp. and the expansion program, and they approve the amendments.
On motion of Councilman Pell, seconded by Justice Suter, it was
RESOLVED, that Town Attorney be and he hereby is authorized and
directed to prepare deeds, and the Supervisor be and he hereby is
authorized and directed to execute said deeds for the exchange Of
property between the Town of Southold and William W. Schriever at
Tabor Road, O~ient, New York. Parcel A to be conveyed to the Town
of Southold by William W. Schriever and Parcel B to be conveyed to
William W. Schriever by the Town of Southold; said parcels are shown
on a certain map entitled, "Map of Exchange Town of Southold with

behalf of the Fishers Island Ferry District, for the acquisition
of Building ~209 at the former Fort H.G. Wright on Fishers Islands
this property has been declared surplus by the General Services
Administration.

27. The new police telephone system will be discussed following
the recess of this meeting.
28. During the work session this morning the Board discussed
the disposal area. On one item Highway Superintendent Dean was
directed to discuss with the two major carters in the town relative
to whether the~ would like to enter into a contract for removing
papers and light metal from the disposal area.
Mr. Franklin Bear said he was surprised at the action taken by the
Town Board relative to the Information Bulletin prepared by the
North Fork Environmental Council. As President of the N.F.E.C.
he has been offering the services of members of the Council to
aid the Town. As he understands some months ago someone objected
to passing out the bulletin with the name of the N.F.E.C. on it, so
since them the Council revised it and offered it to the Town again
as a service, either with or without the name of the N.F.E.C. on
it. It raises the question in his mind as to whether or not the
Town would rather not have the services like this offered. For
example, some months ago at a hearing on teh SEQR Act it was
offered at tha~ time to help try to bring about an understanding
of a subject that might serve the purposes of the Town of Southold
better than the one offered. Is it the policy of the Board not to
accept assistance from the N.F.E.C. or other organizations in the
manner in which they are trying to do. They are trying to assist
and be helpful and not trying to do these things in a critical way.--
Supervisor Mar~occhia said he did speak to Mr. Bear after the hearing
on SEQR amendments that they would not act on it because of some of
the input from the N.F.E.C. was very good and he wanted to talk to
him about it. This matter was discussed this morning ~xand it was
brought %o the Board's attention that the State of New York will
change the S~QR Act again. Therefore it was decided to wait to
see ~hat the S~ate does. As far as receivin~ help from the various
orgnnanizations, the To~n would certainly not refuse it, and welcome
input. It is l:he Town Boardl. s feeling on the Information Bulletin
that ~f the Tr'~stees wish to hand out this type of information they
should prepare something with their name on it.---Councilman Homan
explained that-if they do something for one organization they would
be obliged to ~o something similar for another organization~!pe~haps
with not the s~me quality and standards as the N.F.E.C. Every Board
member recognises the good work %~e-~NcF.E.C. has done and appreciates
work they are ,~oing toward the E.P.A. meeting coming up in May.
However, the B(>ard should not allow a Town body to use someone elses
material, the ?rustees should do it themselves, as well as aNY OTHER
office in the ~own.--~Mrs. Marie Johnson took exception to Councilman
Homan's statements. She said she feels if the Town has a good
responsible organization that will take time to put together informa-
tion in a form_approved by the Town Boar~, it would be unwise of them
not to accept it.---Justice Surer said he has been faced with the
same problem in the court where four organizations wish to hand out
materials to defendants, and the information might all be conflicting.
It is the poli~y of the ~oard to provide material from the Town ~epart-
ments through ~he Town Departments. Furthermore, Justioe Suter spent
several hours going over the booklet and before they could even
consider giving it out the Town Attorney would have to look at it as
there are certain statements in it which are wrong. The Board fully
supports the N.F.E.C., most of the Boa~d members belo~o~'.the N.F.E.C.,
but there is a Board policy and they cannot deviate from it.---Mr.
Stoutenburgh asked if the Board wouid request the TrUstees to give
the bulletin o~t.---Just~ce Surer sa~O the Trustees have their own
Board and if they wish to give it out under their own~rules~'and~
regulations th~n they are ersponsible for it.---Councilman Fell
stated that he as one Board member would like to see the Trustees
meet and consider the Trustees putting the bulletin out; it is
within their jurisdiction, they are most familiar with the rules
and regulations than he is; and he hopes the Trustees will reconsider
the stand they took some months a~o on this matter.
Mrs. Barbara Schriever, Orient, abked if the carters who~remove
the paper from the disposal area pay the Town for it?--'-$~pervisor
Martocchia said they do.
Mr. Paul Stoutenburgh co~ended the Board in using recycling at
thedisposal area and hope they might even consider going one step
fffrther such as Brookhaven Town has done by using the leaves and
branches and mulching them up so the town people can use it.
Mr. William Shcriever, Orient, asked whether the Highway Committee
has decided whether the easement is satisfactory :f~r the t~rn~around
in his subdivision approval?---Justice Su%er stated that it meets
with what he discussed with Hr. schrieVer's attorney and as soon as
Town Attorney Tasker approves it there 'will be no problem with them.
